I think this is -- this addresses those in the geothermal business, where there are wells drilled to lay pipe in the ground to -- for recirculating water in -- in HVAC systems. Senator McCarter, I think you addressed the bill probably better than I can, because you know the industry better than I do. But, yes, this is exactly what it is. It’s the geothermal bill. It’s a bill that we passed out of here two times previously, unanimously. It is a agreed-upon bill. Everybody in the industry has agreed on all the parts of this bill. We finally have passed it out of the House, which has been our problem. It has come back here as an agreed-upon bill and we would like to move it forward so that it’d be on the Governor’s Desk so that we can get this Association to have their work statewide be regulated.

It regularizes the manner and form of which insurance companies file their annual financial statements. Has a number of other requirements. It clarifies the fee structure associated with the annual financial statements. There was some worry that this was a fee increase, but they say that it’s not. The Insurance Director - I suppose this is legislative intent - assures the industry this -- this will not be -- this bill will not be used to -- to do anything other than to continue to levy the late filing penalties consistent with past practice for dental plans, PPOs, and similar things.

…you, Madam -- thank you, Madam President. This bill would ensure that doctors who are convicted of a sex crime will permanently lose their license. Unbelievably, when a health care worker may go to jail for sexually assaulting a patient, that does not mean that he or she ever loses their license to practice medicine, and that’s going to change under this bill. I want to thank the Chicago Tribune for revealing that sixteen doctors had been convicted of sexual offenses, but none, none, of the men’s licenses were permanently revoked and two of these people continued to practice medicine. So, finally, Madam President and Members, for too long there’s been a disconnect between law enforcement and State regulators of doctors that would allow sex offenders to practice medicine. I mean, a sex offender can’t drive a school bus, but he could be your child’s pediatrician. It’s wrong and we’re going to stop and curtail forever a sex offender from practicing medicine. The law needs to be clear - a sex offender will not ever practice medicine in Illinois. And I’d appreciate a favorable vote, Madam President. Thank you.

Yes, thank you for your question. Yes, it does. First of all, the -- the bonding limits are not changed at all by this. What this bill does is it -- the Metropolitan Water District -- Reclamation District plans to construct a new satellite facility and a laboratory in upcoming years. The District believes that the -- the -- best to fund these projects with bonds, rather than corporate accounts supported by property tax revenues, because these facilities will have a thirty- to fifty-year expectancy and therefore is really more in keeping with being financed by bonds. So that’s what the purpose is.

With a higher tax rate, an unstable budget process, a high cost of doing business, job creators are fleeing the State in droves and we got to put a wall up, which this bill does, to try and keep ‘em here. Again, I understand the intention of the sponsor. I know he’s trying to do the right thing, but this is a -- a major red flag, when you have to, by law, try and keep people -- job creators in Illinois ‘cause you have otherwise made the -- made the place so unattractive to stay. And what this bill is about today is there’s no trauma district between Springfield south, where I live at. All the trauma is from Springfield north. And what we want to do today is, the money that’s collected in my district stay in my district, like it does the rest of the State of Illinois. Since we don’t have no trauma district, we want to put this money in our local hospitals. So, right now, that money is going to Springfield, I believe - the Springfield trauma area, correct?

It goes in a pot of money and they spread this money out in all the trauma districts. And like in my district, I don’t have no trauma district, so I don’t get none of it spread to my district. So all I’m trying to do, that money that spreads out in the trauma district from Springfield north, I would like to keep that money in my district where it can go to our local hospitals and help health care.

No, I don’t have that figure. All -- all the figure I have is that we collected last year 3.5 million dollars in the State of Illinois. And it’s just -- the fines and stuff, you know. Whoever has the most fines -- pays the most fines will probably collect more. So I don’t have that figure. That figure could go back and forth. It’s just on the fines and the tickets.

I believe you testified there were eleven trauma centers in the State. So if you have 3.5 million and let’s say -- let’s say they’re -- they’re even, don’t know that for sure, you’d be looking about at three hundred thousand, something like that, that would no longer be going to the Springfield area, but that would be staying in your area instead.

Well, it’s just not the Springfield area; it’s from Springfield to Chicago area. It’s the whole north State. I mean, it’s -- it spreads out, because there’s eleven trauma districts. So all we’re wanting to do is, what money we collect in our district, same as the money you collect in your district goes to your place, and I just want to keep the money that’s collected in my district, go back in the hospitals so we can take care of health care, same as everybody else in the State of Illinois.

And so with this extra money in your trauma areas, what is the -- what are the hospitals going to do with it? Because as you mentioned, you have no trauma centers.

And by the way, the hospitals -- the district is for this in the State of Illinois. I just, you know -- I know if you’d - - like everybody else, every hospital, every school, everybody’s having issues and problems. So everybody can use some money. And what we’re wanting to do in our local hospitals -- and most of my hospitals down home is critical care hospitals anyway. So we’re -- we’re -- we’re on a -- we’re just barely getting by. So any bit -- anything we can help our hospitals and help our health care. This is what this is about.

I can understand that he’s looking to keep the money in his area. I think we all like to do that in -- whether it’s education or with hospitals. But just remember, there is no new money here. The money is just being redistributed, again, a different way. So when you’re voting, keep that in mind. Thank you.

Those areas are not benefiting from those revenues or those fines and therefore they should receive the benefit, particularly in a day and time in which people are struggling. Hospitals are very important in rural communities and in our urban communities. And even though we don’t have trauma centers, they still have emergency rooms. They do treat - in some instances maybe even have to stabilize them - before shipping them -- them off to -- to other trauma centers. Again, we’d just like to keep the money in our -- in our area and to support those institutions. No, I can’t tell you that. I’m not a doctor. Only thing I’m trying to do -- I think that trauma centers are very important. I think they do an -- excellent jobs -- what they do. But I think the hospitals in my district does the same thing and what we’re trying to do is help everybody that -- in this situation. So, what I’m trying to do today, I think, is helping the people in my district that has these issues.

You must have a MRI machine. That’s the biggest difference that you can actually address those traumatic and -- and life-threatening illnesses. Hospitals, by their definition, basically, some of ‘em only have nurses who run ‘em at night. They do not have the emergency room staff. So there is a large outlay of dollars to ensure that we have these specialty hospitals. Question: Do you know how many people from your community are actually transferred to trauma centers?

Do you realize, in fact, that even if you divert these dollars - and this is a diversion of dollars - from these institutions that have to maintain these world-class and state- of-the-art machines and pay for the doctors and staffing on service, what -- what will happen is your patients still, if they get injured - be it a car accident, gun shooting, tractor accident - they’re still going to have to be treated and sent to these hospitals. To divert these dollars from these world- class, in some cases, hospitals, again, will exasperate already a underfunded trauma center that we have here in the State of 41 STATE OF ILLINOIS 97th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 46th Legislative Day 5/18/2011 Illinois. We have, as you pointed out, eleven hospitals, and the reason again, because of the high costs of -- of -- that’s there. And give you an example -- and now to the bill, if I could. There’s not a question here. Just for the Members in general, years ago, we -- we have three trauma hospitals. You know, basically it’s Northwestern, Christ and Cook County Hospital - not enough for our population. Years ago, when we did have dollars, I tried to give five million dollars to Provident Hospital so we can have a trauma center on the south side. ‘Cause if you get shot, hit by a car on the south side, you have to travel all the way to the north side or to the west side to get care. Hospitals told me five million dollars won’t even buy, really, the machinery, the MRI, and the maintenance for that and to -- for the radiology -- things that would be needed to run that center. So, I -- I think this is a bad idea to divert this fund that is designated, that serves the entire State. And in your case, part of these funds is to ensure that you can get a helicopter to get them to these specialized hospitals. There are other funds. I mean, there’s a reason why this fund was designated for trauma hospitals, because -- out of the usual funds that go to hospitals, be in your case the safety net hospitals who get funds that we do not get in the City of Chicago to help you maintain the standard of care that you’re capable of delivering. To take these dollars away, out of the trauma’s fund, jeopardizes the health and the well-being of all of us in this State. And I ask for a -- a No vote.

And he knows, as well as anybody in this room, the City of Cairo, where Donne’s from, we’re trying to get some critical care hospital down there to people. And he brung up gun shooting and accidents, you know; if you don’t get them people took care of, you don’t need a trauma center. You got to be able to get ‘em fixed so you can ship them to a trauma center. And this is all I’m trying to do today. I just want to make sure if these people has a car wreck or they get gun shot or something, we can put ‘em in these places and -- and get ‘em some care so we can get ‘em to a trauma center. That’s all I’m trying to do. I’m just trying to protect the people in my district.

To the bill, Madam President. I support the bill strongly. Obviously, we have a broken system of funding trauma centers. Senator Trotter correctly pointed that -- that fact out. However, the Illinois Hospital Association supports this bill. They represent all the hospitals in -- in the State. The -- the problem we have is that the system to generate money draws money inartfully from all of our districts and away from the hospitals with the ERs. We have to transport these people to St. Louis in my -- my area and that costs money. So, it’s -- it’s -- it’s well and good to talk about funding - and I think that we -- we should address this at some point in the future - but to take money that’s generated by the administration of justice in these -- these areas and divert it north to where no one is going to 43 STATE OF ILLINOIS 97th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 46th Legislative Day 5/18/2011 be served from my area, while our own hospitals with our ERs, which is, as Senator Forby correctly pointed out, is the first line of health care, and -- and deny them the funding while they’re starving just doesn’t make sense. This -- if this bill passes, this will encourage the General Assembly and the Department to look at a different, more just and equitable way to fund trauma centers. And I will support that.

I think the answer is, yes. And that’s why I’m running this bill today. Because we’re collecting money in the 59th District and we’re sending it to hospitals -- trauma centers in the Chicago area or south and the people in my district that collects the money, spending the money, right now is -- they -- they think they’re not -- been treated fair. And what we’re wanting to do is keep this money in our district. And we have hospital problems like everybody else; that’s why the hospital’s on board. We want to make sure, these people, we can treat them and get ‘em sent to Chicago or St. Louis or some place to another trauma hospital. We’re just trying to help the people.

Senator, you’ve got me confused and maybe this is one we need to take out of the record, because you just made a comment that this was taking -- this could be taking money from Cook County. You said emphatically in the committee that it would never take money away from Cook County. It was only going to take money from Springfield’s center to here. The second question you talked about was money going out of State. And, again, in committee it was testified that no dollars ever left 46 STATE OF ILLINOIS 97th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 46th Legislative Day 5/18/2011 Illinois, that the money was all going to Springfield. But here the question was that some of these moneys could be going to EMSs outside of Illinois. We need to have an understanding of what that -- how that formula works. And, again, we were told that this is only money from the Springfield EMS pot of money, that it would not take money away from any of the other regions. So, is that true, yes or no?

The first thing, I want to tell you about this bill here. No money in this bill goes out of the State of Illinois. So that -- that answer’s true. So all we’re trying to do now, the money -- this bill is pretty simple. The money collected in my district stays in my district. That’s all we’re trying to do. And today this money is collected and it is going to the trauma center -- where they spread the money out with the eleven trauma centers going. All we want to do is keep the money in my district, none of the money in your district, stays wherever it goes. We’re not going to bother none of that. We’re just going to take the money, what is fair, to stay in our district, that’s -- stay in our hospitals to help our patients.

Well, that was my understanding, but just a second ago, you said yes -- to Senator Murphy, you said, yes, it was taking money away from Cook County into -- into this district.

So what the bill is trying to do today: The money that’s collected in my district stays in my district. So that money will not be going to the trauma center. I’m just -- that’s exactly right, what I’ve been saying all the time.

Okay, let me try one more time. We have eleven trauma centers. I think it’s eleven. The money is collected throughout the State. It goes into that pot. You’ve said then that the money then goes to each of those eleven trauma centers that serve that area. The money that’s collected from that area goes back to that area. So if it’s collected in Winnebago County, that money will go back to the trauma center in Winnebago County. And so every area collects that money. The money that is south of Springfield, that money then goes to the nearest trauma center, which is Springfield’s trauma center. Is that correct?

Let me try to explain how the money goes. Every unit district, it goes into a pot of money, so whatever district -- if your district has more trauma districts than anybody else in 48 STATE OF ILLINOIS 97th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 46th Legislative Day 5/18/2011 the district, you’ll get a bigger share. So whoever does - the trauma district - does the most patients, will get the biggest percentage. You know, if you do ninety percent, you get ninety percent of the money. If somebody else does ten percent, they get ten percent of the money. Whatever the percentage is, that’s where the percentage of money’s going. The money in my district is going and it goes in this pot of money and whatever the eleven trauma districts in there, whoever does the -- the biggest percentage -- if somebody got -- like I said, eighty percent, they’re going to get eighty percent of this trauma district. If somebody else is in the district, they only get ten percent -- they only do ten percent, they only get ten percent. In my district, I get nothing and that’s what I’m trying to do today, the money in my district stay and help my hospitals, which is on board, so we can get them people transferred to one of these trauma centers.

Okay, thank you. I -- so I think I’m understanding it, ‘cause you kept making the comment that the money is collected in my area, stays in my area, and that’s not the case then. What you’re saying is the money that’s collected all goes into this pot and it’s proportionately spread out. So in that case, you do take it from -- this will take money from other -- other regions because we’re enlarging that pot that we currently have in place now. So everyone will get less. Will those communities be allowed then to also - - because they don’t have a trauma center in their district, will they be able to share those same dollars, just like it would be in southern Illinois?

North of Springfield, each region up there has a trauma district in it. Each district has a -- has it north of… In my district, I have none, period. If I had a trauma district in my district, we could be -- send ‘em straight to the trauma district, but we’ve got to carry ‘em so -- get ‘em so far to a trauma district. That’s what -- that’s where -- our issue. All I want to do is try to be fair here. Everybody in the north has a trauma district in their district. My district does not have none. All we’re wanting to do is keep the money in our district so we can be equal like everybody else in the State of Illinois.

Ladies and Gentlemen, as I read the -- the full text of the language and as I read the language from what is current law, it says the moneys in the fund shall be allocated proportionately 50 STATE OF ILLINOIS 97th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 46th Legislative Day 5/18/2011 to each EMS region so that that region receives the moneys collected from within its region for the violations of the laws or ordinances regulating the movement of the traffic. So the current law says the money will stay in the region that it is collected. Apparently that hasn’t been happening. It’s been diverted to areas that have trauma centers, which we’ve already had that discussion. There are none south of Springfield. The language -- the new language also says if the -- this is new language now - says, if money collected from a EMS region cannot be distributed to any trauma center in that region - in other words, there -- there are no trauma centers - because the trauma center is located outside of the State - for example, in Senator Forby’s district, there may be a trauma center across the river, in Kentucky for example - the money cannot go -- it says specifically the money cannot go to a trauma center out of the State. So if that’s the case, then it says, then the Department shall distribute the money to hospitals in the EMS region for the provision of emergency services. So the money’s going to go to the hospitals in that region. It’s very clear. The money’s not being diverted out of State. I think the original intent of the language - I’m assuming this - was very clear and it said, the moneys in the fund shall be allocated proportionately to each EMS region. So the money was intended to go to that region. It since then has been diverted to other areas in the State. I would ask for an Aye vote.

This bill is one of the recommendations based on the findings of the Disproportionate Justice Impact Study and what we will do is research some of the disparities such -- facing African- Americans such as education, healthcare, healthcare services, employment, criminal justice, and other economic and social issues. Initially, the Department of Human Services was against this bill; however, I contacted the Dean of Jane Addams School {sic} (College) of Social Work, who also was a commissioner on the Disproportionate Justice Impact Commission, and she has a doctorate student who is a -- into a fellowship position who is going to actually lead some of the research on this issue. So there is no fiscal impact at all on this bill and I ask for an - - an Aye vote.

The form was recently created upon passage of Pubic Act 96-1461, which went into effect January 1st of this year. This bill will ensure that only legal parents can designate the adoptive parents in a surrender to an adoption agency. I ask for your support.

You may recall, a couple of years ago, I believe it was Senator Murphy that presented a bill with regards to collecting DNA from arrestees. This bill, House Bill 3238, is a negotiated bill, along with the Attorney General’s Office, former Representative, now City Clerk, Susana Mendoza. It requires the collection of DNA specimens from persons arrested for first degree murder, home invasion, predatory criminal sexual assault of a child, aggravated criminal sexual assault, and criminal sexual assault after either a judicial determination of probable cause, an indictment by a grand jury, or the defendant waiving preliminary hearing. It also expands the requirement for convicted persons to provide DNA specimens to include any person required to register as a sex offender. Finally, it provides for an automatic expungement of DNA specimens where the arresting charges are dismissed or where -- or where the arrestee is acquitted of the charges.

With the price of metals increasing significantly throughout the United States, people are defacing the graves of our United States veterans, taking the metal from them and taking ‘em to recycle centers. And one of the ways to stop this 83 STATE OF ILLINOIS 97th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 46th Legislative Day 5/18/2011 is to have recyclable individuals not accept this material any longer, and hopefully those who engage in larger grave robbing of our veterans’ graves for the bronze or the copper, which are on those, will stop doing it. The -- I happen to carry an EpiPen and what 84 STATE OF ILLINOIS 97th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 46th Legislative Day 5/18/2011 this -- because I have severe allergies where immediate medical attention might be necessary. This EpiPen would be available through prescription that was offered within the schools. Would be available for use in handling the growing percentages of children who suffer from food allergies. According to the American Academy of Pediatrics, nearly one out of every twenty- five school children suffer from some kind of food allergies, and without -- without the use of an EpiPen that’s available immediately on the premises, there’s a severe risk that -- of -- of incurring anaphylactic shock and invariably it leading to some fatality. This is an initiative of the Attorney General’s Office and is in direct response to the tragic death of Katelyn Carlson who was -- in 2010, who was a thirteen-year-old student in Chicago. She had an allergy to peanut oil in food that was ordered for a class party and she died of anaphylaxis. By having an EpiPen available in the schools, we can avert these tragedies and many others. I know of no opposition and I’d urge your favorable support.

And so, this is a great piece of legislation and will make a difference in children’s lives.
