Thank you, Senator Link. Ladies and Gentlemen, I'm really pleased to have an outstanding group of young individuals here with us this morning. These are your State Champions in Class 1A, the Illini Central Cougars. They -- they beat Madison, which I understand is in Senator Clayborne's district, for the championship game. They won fifty-five to forty-four. It is the school's first State championship in any sport, so it's quite an accomplishment. They had a conference record of sixteen and oh, an overall record for the year of twenty-eight and five. Just a little bit of history about the championship game: At the end of the third quarter, or the start of the fourth quarter, they were down thirty-two to twenty-seven; they came out in the start of that fourth quarter and had an eight to -- an eight and oh scoring run to start the fourth quarter and that gave 'em the momentum, I think, to go on and win the -- the 15 STATE OF ILLINOIS 98th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 28th Legislative Day 3/21/2013 championship game. So, I'd like to introduce the head coach, John Giesler, and he's going to say a few -- mention a few things about the team. Coach.

There's nine seniors on this team, so I told the underclassmen they have a -- a big task ahead of 'em next year to -- to get back to the championship -- to get back to the championship game. But I'm sure that they'll -- they'll do their best to get there. These folks -- just for your record, Illini Central is located in Mason City, over in Mason County, which is just north of Springfield about twenty miles. So, let's give 'em another round of applause. We really appreciate 'em being here.

Ladies and Gentlemen, if I could have your attention, again today. We also have another - excuse me - another group here that I'd like to introduce. Behind the President, up in the President's Gallery, you see a lot of green shirts up there, and this is 4-H green shirt day here at the Capitol. And the -- they are -- they're from all over the State of Illinois, basically. They're eighth graders all the way up to -- 16 STATE OF ILLINOIS 98th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 28th Legislative Day 3/21/2013 actually, a senior in high school. And there's a –- a couple of college students up there as well. The -- it's Legislative Connection Day. There's thirty-six 4-H members from the Illinois 4-H Youth Leadership Team. These youths are from twenty-four different counties throughout the State, representing almost two hundred thousand 4-H participants from all one hundred and two counties. They are -- there's a couple of folks up here with 'em, Denise Legvold. I think Bill Million's here somewhere. Debbie Stocker is here as well. Of course, Pam Weber has helped coordinate the group here at the Capitol. But, folks, 4-H is a -- a great program, something all four of my children participated in. I asked the kids earlier in the day, I said, "Well, what have you gotten out of 4-H?" And they talked about leadership and -- and understanding government, and it's really opened up their eyes and given 'em a lot of opportunities. Mr. President, if we could recognize this group and show our appreciation for them coming to Springfield here today.

The Floor amendment simply codifies CMS and executive order with respect to military leave for -- for -- for police officers employed by the State of Illinois who get activated via the National Guard to go overseas and serve our country. There's a discrepancy at the U of I about the existing statute which puts them out of line with the rest of the State of Illinois in how they're interrupting that and this would codify the CMS version and comply with executive order.

Thank -- thank you, Mr. President, Ladies and Gentlemen of the Senate. House Bill 1188 is a -- a curative legislative measure. It's designed to help implement the referendum approved by the voters in the Palos Fire Protection District. 47 STATE OF ILLINOIS 98th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 28th Legislative Day 3/21/2013 We've seen measures like this before, most recently with Northfield. In the recent election, there were several referendums approved. Because of the -- the mechanics of the way the question is asked and the rate is determined and applied to EAV, these taxing districts realized much less than they had asked the voters to approve. This would cure it for this year only. I don't believe there are any other taxing districts that would need this sort of curative measure. I do intend to advance legislation later in the Session that would hopefully prevent this from happening in the future. But for now we're left with the task of trying to cure it for this one particular taxing body, where the voters approved a referendum, but the results, for unintended reasons, are not what the voters approved.

Senator, can -- can you please walk through, not necessarily word for word, what the ballot question was and what the result has been and what your bill would do to change that, but something close to word for word, so we have an understanding of exactly what we're doing here?
PRESIDING OFFICER: (SENATOR LINK) Leader Harmon.
Thank you, Mr. President. Thank you for your question, Senator. And it's -- it's right on point. The -- the taxing body, the fire protection district, went to the voters with the question, "Shall the taxing rate be increased by .25 percent above the PTELL limiting rate?" In addition to that, it sets forth in very clear terms that the approximate amount of taxes extendable at the most recent levy were 4.2 million, and if the referendum is approved, it will be roughly 6.2 million. It also says that for the next tax year, the approximate impact on a house with a fair market value of a hundred thousand dollars is eighty-two dollars and fifty cents. The reason this is a problem is because of the way we formulate the question. Taxing bodies figure out how much money they're going to need, then they use the current extended -- the EAV to determine a rate. Then they ask for that rate, and after the rate is approved, they come back and apply it against the EAV. If the EAV has changed dramatically, as we have seen, the result is not the dollar amount set forth on the -- the referendum question, but something far less in this case. In the past, in other circumstances, it's been much more. And that's a problem as 49 STATE OF ILLINOIS 98th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 28th Legislative Day 3/21/2013 well. Again, I have another bill I hope will fix that. But I think the voters understood the dollar amounts and the impact on their homes much more than they understood the -- the –- the rate as a -- as a key piece of the question.

So, then, after the ballot measure was approved and then those -- that tax rate was applied to the new EAV, what's been the outcome?
PRESIDING OFFICER: (SENATOR LINK) Senator -- Leader Harmon.
As I understand it from -- from the district, instead of generating approximately two million dollars, applying the -- the tax rate to the current EAV, the reduced EAV, would generate about six hundred thousand dollars.
PRESIDING OFFICER: (SENATOR LINK) Senator McCarter. SENATOR McCARTER: To the bill.
PRESIDING OFFICER: (SENATOR LINK) To the bill. SENATOR McCARTER: We had a discussion on this in the committee yesterday and I think my -- my objection to the bill then and now is that we have a system that we work within today, which is a -- the -- taking -- establishing a rate against an EAV. We're attempting here to kind of bypass the system, and I understand it's -- it's 50 STATE OF ILLINOIS 98th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 28th Legislative Day 3/21/2013 to fulfill the intent of what the voters put forth, and I -- and I -- so I -- I don't think there's any -- I think there's good intentions here. But the problem is, if we -- if we continue to do this here, we'll do it with somebody else. And my -- my next question was, when –- when EAVs do -- go back up, do we change the rate? Now, that said, I -– I am in complete agreement with -- with Senator Harmon's Senate Bill 2256 and (22)57, which present -- prevents this from happening in the future. I think that's -- those are great bills which will keep us from coming back and having to do this. So, although I'm -- object and -- and not in favor of this bill, I would suggest that we all support those other -- 2256 and 2257. Thank you.

Thank you, Mr. President. The prior speaker made a couple of good points. I do want to just put a very fine point on it. Number one, to the best of my knowledge, there are no other taxing districts left in this circumstance to come back and ask us for help. And -- and, two, the way the -- the Property Tax Extension Limitation Law functions, the rate will come back down next year. Because if the EAV goes up, the -- the aggregate extension does not; the rate will -- will be changed to reflect that. So, there -- there's a -- there is a -- a collar on this.

SB 66 amends the Riverboat Gaming {sic} (Gambling) Act to allow a supplier to affix its logo or other distinctive identifying mark in lieu of the supplier's full name. The bill also allows the Illinois Gaming Board to waive the requirement of any specific products if it's determined that the requirement is not necessary to protect the integrity of the game. It also provides that items purchased from a licensed supplier may continue to be used in the event the supplier subsequently changes his name, logo, mark, or ceases to be licensed as a supplier for any reason. Senate Bill 1310 is a bill that enhances public safety on our waterways and protects us by strengthening provisions in the Boat Registration and Safety Act regarding a boat's carrying capacity, the definition of an "authorized emergency watercraft", and increases penalties for certain violations. It clarifies that a person being towed by a watercraft is considered part of the total numbers of passengers. It also adds flashing blue lights to the list of colored lights necessary for a watercraft to be designated as an authorized watercraft. The IDNR Office of Law Enforcement currently uses flashing blue lights. It also increases the penalties for certain violations relating to boat 63 STATE OF ILLINOIS 98th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 28th Legislative Day 3/21/2013 rentals. And it changes the penalty for falsifying or altering a watercraft -- registration from a petty offense to a Class A misdemeanor. The intention of the bill is to make sure that when people are boating, we're increasing the safety, making sure that we're counting people -- is the correct number. It's certainly not the intention of the bill to stop people from enjoying our beautiful waterways.
