A point of personal privilege. Thank you, Mr. President, Members of the Senate. Two things. First of all, I have an announcement. The Jackson State University National Alumni Association has decided to select for their Hall of Fame for 2013 one of our Members, and that would be State Senator Mattie Hunter. State Senator Mattie Hunter has been awarded that. Now -- now there's one other -- but there's a caveat, Mr. President. She will be receiving this award on Saturday, June 8th, in Tunica, Mississippi, at the Harrah's Casino. So, it might be a costly weekend for the Senator. Secondly, Mr. President, for the purposes of the schedule. We are going to be coming in, as was previously scheduled, on Monday night. We'll be here at -- in Session at 4 o'clock. And we will then have a caucus -- the Democrats will have a caucus immediately thereafter and then come back on the Floor for Floor action. There are limited options for dining in Springfield on Monday night, so the Senate Democrats are going to have a dinner out at a restaurant here in Springfield. If the Republicans can't find a place to eat, they're more than welcome to join us, if they just want to let us know so we have a count. And also, I would just say that we're -- inform the Republicans, we've been - I've talked to Senator Radogno about this - we've been working with the House on a budget. We had fruitful talks yesterday. We have an agreement in principle on a budget. We will then have more work 4  STATE OF ILLINOIS 98th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 57th Legislative Day 5/24/2013 done on that over the weekend so that, on Monday, we can share with our caucus, as well as the Republicans, a proposed budget, and then we'll have three days to consider amendments and consider modifications and have a full debate on that budget so we can vote on it next week. So, hopefully, we can, for the first time in four years, have a -- bipartisan support for a -- a budget that will be balanced and be the right thing to do. So I hope everybody -- we're not finished today, but I hope everybody enjoys their weekend and back to work on Monday. Thank you.

As I said, I -- to somebody, I've been here for a long time and these never get easier. Trooper Sauter was only on duty with the Illinois State Police -- was in -- or, on duty in his Illinois State Police squad car when a vehicle -- his vehicle was struck by a truck-tractor semitrailer on I-94 southbound on Willow Road. He was pronounced at the scene early Friday morning and had been a member of the Illinois State Police since 5  STATE OF ILLINOIS 98th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 57th Legislative Day 5/24/2013 June 29th, 2008. Trooper Sauter had just completed his temporary assignment on air operations and was recently reassigned to District 17 -- District 15 as a patrolman. Trooper Sauter was 28 years old and is survived by his wife, Elizabeth, and family. Today in the President's Gallery is his -- is his widow, Elizabeth; Don and Eileen Sauter, his parents; Rob and Christine Cowan, his in-laws; Jim's brother, Matt, and his girlfriend, Jessie; his aunt and uncle; four of his Academy classmates are attending; and District 15 Commander, Joe Perez, and several fellow troopers. SENATOR MUÑOZ: I just want to give my condolence to the Mrs. of the trooper, to the mom and dad, the rest of the family, and to his fellow troopers of the State Police. In my eyes, he truly is a hero, even though he was taken, his life was cut short, such at a young age. But, as a police officer, we know that we can always get shot in the line of duty, something could happen and we'll never come home. House Bill 490, as amended, states that the applicants completing a teacher basic -- a -- teacher education or school service personnel preparation programs are required to complete a basic skills test prior to starting their student teaching or starting the final semester of the internship. Current law requires applicants to complete a basic skills test prior to admittance to a teacher preparation program. Just gives a little bit more flexibility. I know of no opposition. Thank you, Mr. President. Current law requires a contractor or a subcontractor who participates in public works to maintain certified payroll records for three years after the date of the last payment under contract. This bill extends that to five years. The recordkeeping will now match with the current enforcement period of violations. The change in recordkeeping is prospective. In addition, the bill codifies certain practice to allow the records required under the Prevailing Wage Act to be either paper or electronic format. This bill is an initiative of Laborers' District Council of Chicago. And I want to thank the Chicago Laborers, Senator Iris Martinez, Senator Pam Althoff, and Chairman Forby, in addition to the Illinois Chamber and the Illinois Municipal League, for their willingness to work together to make this an agreed bill. Labor and business working together is definitely in the best interest of the people of Illinois. And I would urge an Aye vote.

Yes. In the original version -- to be quite honest, this bill was a ten-year period that we were asking for and then two violations within ten years. It adds additional -- an additional section requiring that the method of payment delivered to a title insurance company, agent, or escrowee must be delivered in sufficient time, determined by the parties, for the check to be deposited prior to disbursement. It also establishes a sunset provision to the Act on -- to be January 1, 2015. I'd be happy to explain further on 3rd.

House Bill 1335, as amended, amends the Title Insurance Act by expanding the definition of "good funds", which are approved methods by which funds may be disbursed in connection with any escrows, settlements, or closing out of a fiduciary trust account where the funds are in excess of fifty thousand dollars. The bill requires that in order to use a cashier's check, teller's check, or certified check drawn by a -- on by a State or federally organized financial institution, then the parties involved must know each other and agree to the use of the fund transfer mechanism, making this a permissive bill. Either party can say no and they would have to rely on wired funds. It also requires that the method of payment delivered to a title insurance company, agent, or escrowee must be delivered in sufficient time for the check to be deposited prior to disbursement. Thank you, Mr. President, Members of the Senate. I apologize for that confusion. Amendment 3 did -- does become the bill. And several years ago, we created a fund that would allow an individual that purchased a car, if they were not treated fairly in that transaction, money could be used from that fund to address their financial needs. What this change and what the bill -- this bill does is it -- it sets up a graduated fee that an automobile dealer pays into that fund based on the number of cars that they sell. So the fewer cars they sell, the less the fee. It's graduated up to a maximum of five hundred dollars. I know of no opposition to the -- to the legislation. I'll be more than happy to answer any questions.

Yes, that is correct. So, currently, all dealers have to pay a five hundred dollar fee. Some of the smaller dealers thought that was too steep, so what we've done is we - as I mentioned earlier - we've graduated it. So a dealer that sells less than twenty-five vehicles, they actually would pay zero - no fee. If they sold between twenty-five and two hundred vehicles, they would pay a hundred and fifty dollars. From -- let's see, from twenty-five to two hundred was a hundred and fifty. From two hundred vehicles to three hundred vehicles, it's three hundred dollars. And over three hundred dollars {sic}, then they would pay the five hundred. So, the fee has stayed the same for the larger dealers; it's been decreased for the smaller dealers.

Thank you, Mr. President. As amended, this allows for any charter school that is in a school district that contains all or part of a federal military base to set up thirty-three percent of its current charter enrollment for students with parents assigned to the base.
