I would like to make a few remarks about our honored guest, Reverend Jackson. If he would join me, please. Madam President and Ladies and Gentlemen of the Senate, I would like to share a few remarks to acknowledge the accomplishments and the achievements of Reverend Jackson, Louis Jackson, our honored guest today. He is the founder and President of the Rainbow PUSH Coalition. Reverend Jackson is perhaps one of the last remaining protégés and disciples of Dr. Martin Luther King, Jr. And on Saturday, the Chicago Urban League will honor him with the 2013 1  STATE OF ILLINOIS 98th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 74th Legislative Day 11/7/2013 Edwin C. Berry Civil Rights Award in recognition of his stature as one of America's foremost civil rights, religious and political figures. One of the reasons we have such a diverse Body in the Illinois General Assembly, diverse by gender and race, is because Reverend Jackson marched from Selma to Montgomery with Dr. King in 1965. And as an ambassador for peace, he has traveled the world to negotiate the release of many prisoners of war and human shields. In 1984, he negotiated the release of Navy Lieutenant Robert Goodman from Syria. Also, in 1984, he negotiated the release of forty-eight Cuban and Cuban-American prisoners in Cuba. In 1991, he negotiated the release of foreign nationals and British and American -- more than twenty Americans from Iraq. And in 1999, he negotiated the release of U.S. POWs captured during the Kosovo War. In recognition of his international and national activism for social justice, civil rights, peace, empowerment, and gender equality, President Clinton awarded Reverend Jackson the Presidential Medal of Freedom in 2000. This is the nation's highest civilian honor. And last, but not least, who can forget his historic presidential campaigns of 1984 and 1988 that laid the groundwork for the successful 2008 presidential run of our former colleague and now President Barack Obama. He has many more accolades to be recognized for, achievements, but just in the interest of time, please extend a warm and generous welcome to this outstanding and great humanitarian and human rights leader.

Today, we have a guy that works for the Senate -- Senate here. Has been for a long time. And he's helped me out a bunch. He's in the Labor -- Labor Committee. His name is Jake Butcher. Most people don't know Jake. Jake and me, we've had quite a time. So, he took care of all the Labor Committee. We got going together that -- we'd have bills come up in my committee, I'd say, "Jake, I don't like this bill. We're going to put it in subcommittee." He said, "Oh, Gary, Gary, you can't do that. You can't do that. Let me look at it. Let me work on it. Let me work on it." Well, Jake would always come back and go see everybody and he'd work on it. He'd come back and we worked things out. But Jake's leaving us here. And we're all going to miss him. He's going to go on up the ladder. He's going to be one of the best lawyers in the State of Illinois one -- one of these days. And let's give Jake a nice happy hand from the Senate.

And I've got to say, I -- I've really looked good doing it. I looked -- I -- I've really looked like I knew what I was talking about at all times. Unfortunately, I may have to resign my chairmanship of the Judiciary Committee, ‘cause today is Amy's last day on Senate staff. And she's going to be going to the Supreme Court to help the Supreme Court opine on what we'll be sending them soon. And so I've got some final thoughts to share with you, Amy. We'll talk about that before you leave us, because we expect us -- we expect you to continue to working -- continue working for us as you go to the Supreme Court. The bill includes 33.9 million other State funds and appropriation authority related to the implementation of the Firearm Conceal Carry Act. Current law also requires a clerk who collects an automated recordkeeping fee to also charge and collect an equal amount from any guilty defendant in a felony, traffic, misdemeanor, municipal ordinance, or conservation violence -- or, violation case. House Bill 2327 amends the Act to cap these additional fees at fifteen dollars. And I'd ask for your support.

Yes, especially in Cook County with the sheer number of records that need to be digitalized. So the proponents argue that the fee -- that the fee increase is necessary to keep up with the ever-increasing digitalization of the legal process; new electronic innovations coming to courthouses, including allowing officers to issue electronic citations, which are sent automatically to the courthouse database; the expansion of e- filing; and interactive systems that allow judges and lawyers to look at electronic documents on screens placed throughout the courtroom rather than passing around paper copies. The issue also is that they -- the -- very few circuits charge the current maximum automation fee, so this is very unlikely to affect the great majority of circuits.

PRESIDING OFFICER: (SENATOR LIGHTFORD) Senator McCarter. SENATOR McCARTER: To the bill: I think -- I think the sponsor has just made a great argument for voting No on this bill. You -- automation reduces cost. You just talked about everything was e-filed and instead you're going the opposite direction. This is one of the highest filing fees in the State. This doesn't make a bit of sense. If you -- if you -- if you increase the number of -- transactions by ten times, it only -- it costs you ten times as much, and by automation, you've reduced the cost per transaction. 40  STATE OF ILLINOIS 98th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 74th Legislative Day 11/7/2013 You're going in the opposition direction. Thank you, Madam President. I rise in support of the bill. And I -- I need to respond to the prior speaker. I think he mischaracterized what's at issue here. It's not that there are more transactions being processed by the same system; it's that the ever-expanding electronic world requires more systems. Those need to be developed. There are more records being processed in more different ways and all of that comes out of the same fee. This is simply recognizing that as we expand the electronic digital world in the courts, there's much more work to be done. And in a county like Cook County, the fee needs to be increased in order to pay for all those new electronic recordkeeping systems. I urge your -- your support of the bill.

It'll cause tremendous problems if January 1 comes and they're not able to do it. That's number one. Number two, it grandfathers in people who are qualified but do not have supervisory experience because they've been providers. And it grandfathers them into the approved provider list for at least two years if they've been on that list prior to the application of the law. There's -- there's no opposition. These programs were changed in statute a few years ago, and because the rules for the new programs weren't in place until June, the schools that offer these programs weren't able to complete applications until now. And so this bill simply pushes back the implementation by a year to give time for those applications to go through the system, so the programs don't have to be stopped for a year. I know of no opposition. And I, frankly, can't think of a reason to oppose it. But I will say that it's a little disappointing that we're here. It would have been nice to have this program up and running at this point. And I certainly stand before you today with the expectation that by granting this additional time, we'll be able to see especially high quality applications once the program is up and running a year from now. The first is some corrections to a bill that we passed just this past spring, which in turn was clarifying the bill creating the Tier 2 pension system for the State University Retirement System. These are entirely technical clarifications to make the intent of that bill entirely unambiguous. The second is some changes to the return to work laws for the State University Retirement System. There's some -- some technical changes that were worked out between the employers and the Retirement System to make sure that implementation would be smooth. And there's also a -- a -- a fairly modest change to tighten, simplify, and strengthen the reform by eliminating what's known as the "eighteen paid week" condition. But what would keep someone on the east side of town - the other side of town is this facility - from closing their facility and coming across town to take advantage of this program?

This is for -- in areas that are having this problem or it's an eyesore. The State owns the facility. The State is spending money. I'll give you a simple example. In Joliet, the mayor that spoke in committee, it's 3.7 million dollars just to keep it secured for the prison in Joliet. That's an example. I don't know if that helps you any.

You want to make sure that a abandoned State property, like one of our developmentally disabled institutions or prisons, doesn't cost the State more to upkeep. I understand that. You don't want it being an eyesore. I understand that. You're going to give someone an advantage, a saleable tax credit, which I think are great, to actually come in there and do something with 58  STATE OF ILLINOIS 98th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 74th Legislative Day 11/7/2013 it. But if we're just shifting it from one side of a town to the other side of a town, we've created a -- the same problem on the -- where these people left from. Now, if you're saying if somebody comes from out-of-state or, you know, to -- to -- to locate there and invest there in the community, that makes sense to me. I'm just afraid, as much as we need the -- we need to -- the State needs to get out from under the -- the burden of these properties and to allow that to be invested in the communities, specifically my community, that we're just going to have a -- a shifting, just like we did with STAR bonds, potentially, to give people the -- the -- the motivation to relocate from one side of town to the other. Is it possible that we can come back, kind of qualify that, so that this can be a better and safer bill for those communities, including mine?

SENATOR MUÑOZ: I would say what's in the bill now -- there is safeguards in it, and I'll tell you this much, Senator, if a certain municipality wants to do what this bill talks about, they're going to have to go to the local mayor. I'm sure they're going to vote on it. There's going to be -- they have their own safeguards. Each municipality's going to do it. I -- I don't think a company can just come in and say, from one side of town, and -- we're going to go in there and take control over a certain property. That's not what this bill does.

In order -- I can tell you this, from what I'm reading from the bill, to qualify, the facility closure has to have occurred within past two years and would have employed at least a hundred employees. DCEO must approve a qualified rehabilitation plan outlining eligible expenditures for qualified structures for qualified taxpayers.

So not only has the community lost jobs and services to help those with mental illness, but now there's a potential of an eyesore in our community. This is a good bill for the community and the State of Illinois to alleviate us from its maintenance costs. So I support a -- or urge an Aye vote.

It imposed substantive regulations on citizen-initiated ballot measures. After the bill was passed, there were some citizen groups that raised concerns about it. The Governor amendatorily vetoed the bill. Instead of attempting to override the Governor's veto, I worked with Senator Althoff on a -- an alternative procedural mechanism that should accomplish the same desired outcome for the townships without infringing on the rights of citizens to petition their government and present ballot questions for consideration by the voters. Thank you, Madam President, Members of the Senate. This bill amends the Chicago Park District Pension Article. And the bill phases in an increase in employee contributions from the current nine percent to twelve percent in 2019. Employer contribution will also be increased and the supplemental employer contributions will be made in 2015, '16 and '19. The bill reduces benefits for Tier 1 members, and the retirement age for those younger than forty-five will increase from fifty to fifty-eight. The COLA for Tier 1 members will be reduced to the Tier 2 COLA, and there will be no COLAs in 2015, '17 and '19. There's also a duty disability, which will be reduced from seventy-five percent of salary down to seventy-two percent of salary. And any benefit increases that we in the General Assembly may pass in the future, we would have to identify a funding source, otherwise the benefit increase will be null and void. The bill also does lower the retirement age for Tier 2 members from sixty-seven to sixty-five for regular retirement and sixty-two to sixty for early retirement. Now, it is true that there are some unions that are not even representing anyone at the Park District who've indicated that they're opposed 67  STATE OF ILLINOIS 98th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 74th Legislative Day 11/7/2013 to the bill. And I assume that that is because they're taking the position that the bill is unconstitutional. But as I've said before on a number of occasions, we here in the Senate are not the Supreme Court, and unless we pass a bill that someone can challenge, it's all -- we're never going to know. This is a bill that's very similar to the bill we passed for the Water Reclamation District, which I sponsored and which has not been challenged. If -- if these unions object to this bill, they can go to court. They can -- we know what their arguments would be. They would say that we're unilaterally increasing employment -- contribution rates without any benefit increase, and there's no consideration. All those arguments would be made. There's no funding guarantee. But let 'em make it in court. In the meantime, we should pass this bill and recognize the fact that this pension system has come together to try to improve their finances. They need our support. And for that reason, I would ask for an Aye vote.

As I said, the Water Reclamation District was a bill we passed. That's been on the books for, I don't know, a year and a half or so. No one's filed a lawsuit there. And that was a similar type of bill, where we increased contributions from employer/employee. And the same arguments, legal arguments, could be made, but they haven't been made yet.

And, historically, Veterans Day was known for the celebration of military service. The emphasis is not as Memorial Day is, upon the deceased, those who died, although the heroic dead are remembered on Veterans Day. The emphasis of Veterans Day is on service, heroic service, the battles that this republic has fought, the soldiers, sailors, Marines, airmen, all who have fought 'em over the years and served with distinction - some battles won, some lost. But the sum total has been victory for liberty. The emblematic speech that emphasizes what Veterans Day is about was written by Shakespeare, the famous speech of King Henry celebrating the battle which occurred at Agincourt on St. Crispian's Day. And Veterans Day emphasizes all of our St. Crispian's Days: June 6th, 82  STATE OF ILLINOIS 98th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 74th Legislative Day 11/7/2013 December the 7th, Concord, Lexington, Belleau Wood, Fallujah, and Dak To, Hué, all of them, and the Battle of Gettysburg, which is a hundred and fifty years ago this year. St. Crispian's Day is the day soldiers celebrate service and camaraderie. This day, as Shakespeare said, is called the Feast of Crispian: he that outlives this day, and comes safe home, will stand a tip-toe when this day is named. He will yearly say tomorrow is Crispian Day, and he will strip his sleeve and show his scars, and say, these wounds I had on Crispian's day. But we will be remembered forever; we few, we happy few, we band of brothers.
