This bill would require hospitals to include information regarding safe sleep environments when they send parents home. And it's a bill that I've worked on with the -- with the creators to -- and -- and refer to it as Cody's Law. My intention for this legislation is for hospitals and health care professionals to share with new parents important information about safe sleep for babies. This information is widely available. It does not necessarily need to be purchased by hospitals or health care professionals. I ask for an Aye vote.

Thank you, Mr. President, Members of the Senate. Apologize for taking a nap there. Okay, this -- just so to make it clear, after your fourth conviction for a DUI, your license is revoked forever. House Bill 1446 retains this prohibition, but what it does, in limited cases where a person has turned their life around and is able to overcome that demon of alcoholism, it will allow a person that -- under that situation to petition the Secretary of State for a restricted driving permit if they can prove by a clear and convincing evidence that they've had no driving infractions from five -- for five years since their last sentence, that they can prove that they've been sober for the last three years. And this restriction will only apply from a point A to a point B with restrictions as to hours, and hopefully give that person the opportunity to -- for gainful employment. But it will only be for those type of purposes or for education. It will also require that the car be fixed with a -- a BAIID device. The person would also be required to complete alcohol and drug evaluation, provided by the Secretary of State. They'd have to reapply for the permit annually. I just want to make this clear, there is no opposition and Mothers Against Drunk Driving supports the bill. So if there's no alcohol in the system, the vehicle will start; if there is, it will not start. Now, Senator, the -- the BAIID device is not a -- it's not like a fingerprint; it's not an individual device. In other words, it can't distinguish between the person who has the -- BAIID device installed in their car and someone else. I mean -- and my point being - I want to make sure I'm right about that - it's not a foolproof mechanism. It is maybe another step towards trying to assure that the driver is not intoxicated, but it's not a foolproof method in that regard. Is it?

I don't think all of the devices are able to track who's actually blowing into the BAIID device, but I believe there's -- there -- the newer ones actually have a -- a camera that will record the person blowing into it. But nonetheless, every time somebody blows into that, they will be recorded. And just to make it clear, going -- I personally have experienced trying to get someone back some privilege to drive, to put a BAIID device in their car, through the Secretary of State; they do not take this lightly. I would anticipate no one gets this on their initial try. And, remember, the standard is clear and convincing evidence that they are sober for three years, that they have had no driving infractions for five years. Senator, I -- I have always been -- and I'm not an expert on the DUI laws, but I have always been under the impression that when someone has suffered a DUI conviction, or their second, or their third, in order that -- the Secretary of State's Office does not provide for an easy process, absolutely. I was on the phone this morning, in my district office, with someone who was -- who was complaining about the process, and the point I made to them, and I want to ask you about this, is that once someone has been convicted of driving under the influence, then it seems to me, appropriately so, that the first concern is for the driving public, not the individual who's gotten the second or third or fourth DUI. The first concern, very strongly so, has to be for the driving public. And it would seem to me that as someone gets their second, or their third, or their fourth, that that barrier or that presumption in making sure that you are as error proof as positive -- as possible before letting a person get behind the wheel under any circumstance would be very, very high. I mean, can you respond to that and tell me what your thoughts are on that?

Well, you're -- you're absolutely correct. And it -- it should be very high to ensure the public safety, but just so we're 57 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 43rd Legislative Day 5/19/2015 clear - this is the way Illinois law currently works - once you have a conviction for a DUI, your first conviction, you're -- the maximum sentence in prison is one year, your license gets suspended for a minimum of one year, up to twenty-five hundred dollars in fines. The second conviction is -- is also a year, up to twenty- five hundred in fine, and a minimum five-year suspension. Third DUI conviction is a three- to seven-year sentence in prison, up to twenty-five hundred dollars in fines, a minimum of ten-year suspension. Then the fourth one is three to seven years again in prison, up to twenty-five hundred dollar fine, and a lifetime revocation. This is an exceptional case. It's going to be rarely used and -- and used in those limited cases where someone has turned their life around and it's going to be very difficult. We all -- you know, the alcoholism is -- is an addiction, but we're talking about someone who's -- has overcome that demon in their life, to give them an opportunity to use their car to be gainfully employed, and drive safely with insurance. And that'll hopefully protect -- and we have these safeguards in place to protect the public.

…bill -- to the bill, if I might, Mr. President. Ladies and Gentlemen, I would just urge caution. As we've talked about in the last week or so, there is a -- there is a trend, there is a movement in this building about second chances and third chances and fourth chances - and I'm not -- and I'm not poking fun at that all - but sometimes we need to do these things in steps. And at some point, you need to say, okay, you had your second chance; 58 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 43rd Legislative Day 5/19/2015 okay, you had your third chance; okay, you had your fourth chance. And at what point does the danger to the driving public that this person has chosen to make themselves, say, okay, that's it; you've had your last shot on the road; we're not going to put you out there anymore with law-abiding drivers, innocent people who are out there trying get from point A to point B, and endanger them with yet another opportunity to drink and drive. Ladies and Gentlemen, I -- I've prosecuted DUIs, for quite a bit of time in a previous life, and -- we always run into this trouble of people get a DUI, they lose their license and they can't get to work. But, to be brutally honest, my experience is, once you come back for a third DUI, you're going to keep going until you've either killed yourself or you've killed somebody else or you're in prison. And the reality is, the court system society affords all kinds of opportunities to first offenders, and quite frankly, my experience in doing traffic court for a lot -- for a while, the DUI first offense is where the average member of the public does come in contact with the criminal justice system. And most of those who come in contact with it, they're abundantly ashamed of what's happened, they take responsibility, they do all 59 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 43rd Legislative Day 5/19/2015 the fines, all the rehabilitation, all the AA meetings, all the things that are required of them, and more, and you will never hear from them again, ever. That's the vast majority of first- time DUIers. By the time you come back that second time, by the time you come back that third time, you will not stop, and that is not a matter of rhetoric. It is -- it is amazing -- it's just amazing, and -- and -- and thankfully, for all of us and for our families and for our loved ones and for the public at large, thankfully that number of people in the third-plus category is very small, because, like I said, most of the folks who get their first one never come back. But that third-plus category, I am immensely hesitant to afford any more privileges to drive in the State of Illinois. I -- I just -- I -- I've done it. I've seen it. When you come back that third time on, God help us all, because I have zero confidence that they will stop ever again before they've hurt someone, hurt themselves or they're in prison. So I'm, if you can't tell, opposed to the bill. Thank you.

Could you explain to me how you were able to secure their support on this legislation?

I relied heavily on -- on the -- the House sponsor, Elaine Nekritz, in securing their support. But, you know, the thing -- Mothers Against Drunk Driving and -- and the Alliance Against Intoxicated Drivers {sic} (Motorists), they're worried about the safety of -- of the public and -- and -- and they should be and we all should be, but this is -- this is not -- I mean this is an exceptional case. They also believe in -- that people can turn their lives around and -- and address their addictions. And the previous speaker having zero confidence that anyone in their life can turn around their lives and remove the addiction and can't face it and address it and go to -- go to classes, go to programs, and get evaluated and -- and overcome that -- that power, that -- that -- of that addition, I find that -- you know, I think we all probably know people that have problems with alcoholism that -- that have overcome it, and they go to classes, they go to AA meetings, and it's a constant struggle. And this -- this case is actually trying to afford someone the opportunity - instead of driving illegally when their license is revoked - afford them an opportunity, a process that they can go through and to prove with clear and convincing evidence that they have overcome this demon, and they haven't had any infractions, they've gone to classes, they are sober, and they're willing to abide by this permit. I should also note that Illinois is only one of six states that 61 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 43rd Legislative Day 5/19/2015 actually has this lifetime ban on -- on not driving -- or revoking your license after the -- the fourth conviction. So we're trying to take care of the people that have actually -- have fought that hard fight and they -- they've overcome that addiction.

Thank you. I rise in support of the bill and -- and, I confess, I do so with some surprise, because when I first heard about the bill, I shared the concerns that many of you do. I don't have much tolerance for repeat offenders, especially with drunk driving, because some of the points that have been raised are legitimate concerns. The point here is that this is exactly for the person who, as another speaker noted, has stopped and has proved convincingly that they have stopped. It is not a restoration of a driver's license. It's a limited permit so that one can go to and from work. It requires a BAIID device to be installed so that the engine won't start if there is a drunk driver behind the wheel. And it recognizes the reality that a lot of these people are going to drive anyways because they have to drive to go to work. They will be permitted, they will be insured, and the streets will be safer as a result. The fact that Mothers Against Drunk Driving and the Alliance are in favor of the bill should give you some comfort that this is in fact good public 62 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 43rd Legislative Day 5/19/2015 policy. The reason for the angst is the subject matter, and I understand that, but I compliment the Senate sponsor and the House sponsor for taking on a difficult issue and for working towards a commonsense solution. They don't get a second chance. They don't get a third chance or fourth chance. Their life, for all intents and purposes, is over. They will lie in that nursing home for the rest of their lives. That's a true story. House Bill 1531, to start, this bill was developed over six years by the Illinois State Bar Association's Family Law Study Committee with the intent to modernize and update the law and eliminate confusion between two existing Parentage Acts. The -- the bill was heavily negotiated by both proponents and -- and opponents. The bill extends equal rights to every child and to his or her parent or to each of his or her two parents, regardless of the legal relationship between the parents. It adds a new provision regarding various permutations of parentage, codifies current case law, and uses gender-neutral language whenever possible. This bill brings Illinoisans into the twenty-first century to recognize new changes, such as genetic testing, complex family relationships, and other changes in the last half of the twentieth century. The overriding goal of the House bill -- or -- is the preservation and protection of the family relationships and ultimately an individual child's best interests will always be the lodestar for the Illinois courts. And I notice that both the Illinois Family Institute and Family-PAC are opposed to the bill. Can you summarize for me what their opposition or the concern might be?

Okay, they are -- and I think, I don't know, right before the committee hearing, I had a meeting with them, along with the State Bar Association and others. The only problem the Illinois Family Institute has -- and they said they are this close. They said it's a good bill with the exception of one thing, and it's regarding the full faith and credit. They want to tinker with that provision, not recognizing some orders from other states. To do that would not only jeopardize federal funding to the State of Illinois to enforce those orders and deadbeat dads that -- that come into Illinois, but would also jeopardize us by doing that, allowing deadbeat dads or deadbeat parents to come into this State and state that we don't have to follow an order in another state. 72 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 43rd Legislative Day 5/19/2015 That's their only argument. That's the only thing that they wanted changed, the full faith and credit, nothing other than that, -- no substance. We recognize two parents - they wanted to do that. We -- it's in the bill. Although -- today, obviously, there's different relationships, whether you like it or not. You know, we have civil unions, we have gay marriage. But the -- the most -- the purpose of this bill is to check -- to protect the children, regardless of the parental situation or relationship out there, and make sure that if your obligated to support your child, you do.

Now, Senator, it's my understanding that that issue with regards to the full faith and credit clause boils down to a really pretty simple point - and I wouldn't say it's without substance; I think it's potentially very substantive - and that is, the desire by some or the concern by some that Illinois will be put in a position of recognizing three legal parents. So, one, I would like your response to if there was a situation where a -- a family comes from another state and there are three legal parents, what your view is of Illinois recognizing that.

Alright, let's get to the situation. We got -- Texas recognizes - and I don't know if it's Texas or some other state - recognizes three legal parents. They have a baby. The father of -- or the husband believes that's his baby. It's later learned that the -- the guy that the wife had the affair with is the third parent, and they recognize in the other states that that person is obligated to make child support payments to that child. That person comes to the State of Illinois. I want that order enforced, and that's what the full faith and credit clause is all about.

Okay, the -- the concern about three parents, is there a cap on that? I mean, potentially, could it be four? I -- I suppose we could come up with all kinds of hypotheticals. So, one, I wonder if you think this is limited to three, or it could be four? And second, are we just talking about issues of child support or are we talking about a broader set of parenting issues, including visitation, input with regards to medical care? Because, as I'm sure you would recognize, the -- the broader those issues are and the more people you have involved, the more complicated and confusing that becomes for the person who we are supposed to be looking out for, and that's the child.

So, to be clear, in the purpose or general purpose {sic} (provisions) of this bill, Illinois is recognized as a two-parent state. We want to make sure any orders in other states get enforced in the State of Illinois, regardless -- and this is all about the kids, to make sure that any orders regarding anything supports that kid and protects that kid.

Ladies and Gentlemen of the Senate, as trends continue and come across not just the country but elsewhere with regards to what families are and -- and how many parents will be recognized in Illinois or other states, sometimes we get caught up into focusing on what, in this case, would be the third legal parent or the fourth legal parent and -- and to -- to his credit, the sponsor has mentioned a couple times that -- that he wants to stay focused on the children. But at some point, you can't have it both ways. At some point, there needs to be certainty and confidence for the child. And the question is, is that as we open the door to a third or fourth legal parent and then we walk into what can be the incredibly complex arena of legal rights and who can visit when and who can have what kind of say with regards to what kind of medical care that the child might be getting, where the child might be going to school, what the children is being -- what the child is being taught, then that -- the -- the person for whom that is 75 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 43rd Legislative Day 5/19/2015 worse is not the potentially disenfranchised parent, if they're really being disenfranchised, as it is the seven-year-old boy or girl, who is lost with regards to who they turn to, who they look up to, who is the father figure, who is the mother figure. And I think that this is one of those opportunities for Illinois to say this is that which we believe in, and the potential, far away, oftentimes threatened, but hardly ever realized, threat of losing federal funding needs to be put aside. I'm a little unclear. I mean, this bill is about supporting children regardless of what state they were born in or orders entered in those states, regardless of the parental relationship they have and what's recognized in other states. If you come to Illinois -- the purpose of the full faith and credit clause is to make sure we enforce orders of other states, especially when they're regarding children. And we don't want deadbeat parents coming here to stand behind Illinois' admitted policy - and this was as a result of the bargaining - as -- to be a two-parent state. Well, we don't want 'em to stand up and say, "Hey, you're a two- parent state; my state is a three-parent state, so therefore that order must be invalid in Illinois." This -- if you're in for -- if you're for supporting children and supporting the rights that are entered in other states on behalf of the children, then you're for the bill. Specifically, as I understand the process now, a long- term care facility has to send a voucher into Springfield, Springfield reviews that, sends that back to the nursing home before any checks can go out. This will make it a one-step process by which the nursing simply bills the State and the State then sends the reimbursement. The delay has been requested by the Department because, quite frankly, they are new. They are just getting started on this. There was commentary during the committee, I believe from Senator Steans, asking the Department what steps that they could take in the interim to try to speed up the reimbursement process. The Department came forward with, I think, some helpful suggestions that they're going to implement in the next year. Be happy to answer any questions.

Last year, the Second District Appellate Court in Illinois held, 101 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 43rd Legislative Day 5/19/2015 in the case captioned Dina, that a -- a mortgage issued by an unlicensed mortgage broker or originator is -- is void, notwithstanding the fact that the statutes that we passed already prescribed a more proportionate response. This bill would overturn the Dina decision. It would leave in place the statutory remedy for an unlicensed broker and would eliminate the disproportionate remedy of voiding a mortgage. The bill passed unanimously in the House. There has been late opposition here in the Senate from a handful of lawyers who practice in this area and have been using this decision as a tactical advantage. But I believe on the substance, the bill is correct, and I would happily entertain your questions and ask for your Aye votes.

And what it does is amends the Illinois Banking Act and the Savings Bank Act to provide that banks without FDIC insurance pledge securities to pay for the cost of their receivership. It also provides that industry members and public members of the State Banking Board and the Board of Savings Institutions {sic} (Banks) cease to be eligible to serve on the Board once they no longer meet eligibility requirements of their original appointment. And it provides for the assessment of banks based on their most recently quarter -- most recent quarterly report of condition rather than the current method of using December 31st reports. House Bill 3718 is brought in response to an urging from the Illinois Supreme Court, urging the General Assembly to review the automatic transfer provision based on the current scientific and sociological evidence, including a need for the exercise of judicial discretion in determining the appropriate setting for proceedings in these juvenile cases. This is a product of negotiations, primarily between the Cook County Board President's Office and -- and the State's Attorneys Association and the Cook County's States Attorney's Office. The bill raises the age for automatic transfers and limits automatic transfers to minors sixteen years of age or older charged with first degree murder, criminal sexual assault, or aggravated battery with a firearm, and it eliminates the "once an adult always an adult" provision. It eliminates all mandatory transfers and it eliminates all but one presumptive transfer, -- and that case is transfers of minors alleged of committing a forcible felony in furtherance of criminal 132 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 43rd Legislative Day 5/19/2015 activities by a gang; that minor would have to have a prior forcible felony. Like to take a moment just to talk about -- some people see up there a word called PANDAS and think it may be about a -- a black and white bear - it is not. Imagine if -- a little boy who loved participating in talent shows and putting on skits is now scared of performing in front of crowds, talking to his friends. He woke up on his eighth birthday with unusual symptoms. There's an immediate change in personality. Next two months of Charlie's life were the hardest time for his family. He displayed symptoms of obsessive -- of OCD. Charlie couldn't be touched or hugged. He feared his food and was deathly afraid of water to the point where he couldn't shower or brush his teeth. When triggered, Charlie would go into fits of rage. He suffered from hallucinations to the extent he was unable to recognize his mother or father. Charlie's mother was faced with a difficult situation, either being forced to institutionalize her son or place her other two children in care of a loved one. After two months of looking for answers, a doctor diagnosed Charlie with Pediatric Autoimmune Neuropsychiatric Disorder Associated with -- with Streptococcal Infections. That is where PANDAS come from. It is characterized by a sudden onset of symptoms associated with OCD, Tourette's, and other tics after a child has a strep infection. They were the nine African 137 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 43rd Legislative Day 5/19/2015 -- African-American students who registered to attend Little Rock Central High School in Little Rock, Arkansas, in 1957, after the U.S. Supreme Court declared segregation in schools unconstitutional through the ruling of Brown versus Board of Education of Topeka, Kansas, on May 17th, 1954. The Little Rock Nine consists of Dr. Melba Pattillo Beals, Elizabeth Eckford, Gloria Ray Karlmark, Ernest Green, Carlotta Walls LaNier, Dr. Terrence J. Roberts, Jefferson Thomas, Minnijean Brown Trickey, and Thelma Mothershed Wair. The Little Rock Nine were denied entry to the school at first by the Governor of Arkansas, Orval Faubus -- Faubus. The group was escorted into the building by the U.S. Army 101st Airborne Division as ordered by President Eisenhower. The group supported The Little Rock Nine Foundation, which advances the ideals of equal opportunity. The Abraham Lincoln Presidential Library Foundation named The Little Rock Nine as its 2015 Lincoln Leadership Prize Recipients. They are in town right now, in Springfield, receiving that honor. And I'm just honored to present this resolution to the Floor, and I ask for your Aye votes.
