Carter graduated from the eighth grade from Pleasant Plains here in Springfield {sic}, Illinois. Carter loves football, baseball, and basketball. He wants to go to Ole Miss when he went -- goes to college. And then when he retires -- or gets ready to go back in the workforce, he wants to be an Illinois State Trooper. Carter has two sisters. His father is Jerry Crabtree, is from West Frankfort, a town where I'm from, and has relocated in Springfield. Jeff and Mike Crabtree is Carter's uncle {sic}. They're both…(inaudible)… And Jeff Crabtree is a guy that used to work here in the -- in the Senate staff. Now he's working for the Teamsters out of Chicago. Carter's grand -- grandparents are living in West Frankfort still yet. I just wish that Springfield would give him a welcome today.

Thank you very much, Mr. President, Members of the Senate. If I could just make a -- a brief statement going forward. In the spirit of fairness and in acknowledgement of the process here in the Illinois General Assembly, but, in this instance, in the absence of a spending proposal given by our Governor, who addressed us back in February, which was his constitutional right, to give us a template for a spending plan, I propose today four amendments to this bill, the first being Senate Amendment 1, which will reflect his proposed level for child care, The Autism Project, Teen REACH, early intervention, and the breast and cervical cancer 9 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/27/2015 screening program. According to our Governor, reductions to these programs would save over two hundred and four million dollars.

You know, we have had -- it's been kind of a stark contrast between the two Chambers so far this year, where we saw, one, the one we kind of like to refer to as the upper Chamber, trying to work together substantively, a little more constructively, and then we had the House. And the House has been the land of stunts and games and really kind of been beneath the dignity of this entire process and the people who sent us down here to represent them in it. So it's -- it's -- it's kind of unfortunate and sad to see the Majority on our side join in the games of Speaker Madigan, the very guy you tell us all the time doesn't dictate to you, and now you're -- now you're dancing to his tune. This is not how the Senate operates. This isn't how you have operated. I think this is really disappointing that you've chosen to go down this road. It's an act of desperation and -- and, unfortunately, it's a little more revealing, I think, than maybe you guys realize. To the -- to the merits of it: For our side of the aisle, this isn't real. This isn't an honest attempt at putting a budget together. This is political gamesmanship, but we're in the last week and we can't get real leadership from our friends on the other 10 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/27/2015 side of the aisle. You walked away from compromise. You walked away from working with the Governor. And this is just poking a stick in the eye of the Governor and those who want to work with you down here. You still have time to pull this out of the record and make a statement - then you're different from Speaker Madigan - and I hope you'll do that. But if you won't, I encourage everybody on our side of the aisle to vote Present, to step away from this and make a clear statement that we are not participating in political games. We weren't sent down here to do that. We were sent down here to solve the people's problems and this is not an honest attempt to do that. So until you're ready to engage seriously and substantively, I encourage a Present vote on all of these sham amendments.

My vote is my vote. I do what I believe is right and I certainly hope that there's no gamesmanship in those comments. So I would urge all of you to do what you believe is right today. I know that we're the Senate. We are the upper Chamber. We're all here trying to do the best job that we can. Thank you very much, Mr. President. Just -- just a comment. Since February 18th, we have repeatedly had requests, for one, to present the Governor's proposal. He made some -- some serious remarks, certainly remarks that -- that were necessary, that we are here in the State of Illinois at a crossroads. We certainly have seen the downside of the economy and we're positioned now, at this point, to move upward, but with that, we had to have a proposal. We have asked the other side of the Chamber, the other side of the Rotunda, and everyone to work with us, as we come up with a proposal that will basically propel Illinois in the position that it rightfully deserves and needs to be in. So, and as a consequence of that, we said that we would present those individuals -- for those individuals that wanted to see what six billion dollars in reductions would mean, to vote for it, and put it on the table for serious discussion. So to accommodate those that wanted that discussion to happen, is what precipitated us pulling {sic} this bill forward today. Before we vote on it, I do ask for a roll call vote on this bill. And for my own personal feelings, I would like to see everyone vote No on it.

Thank you -- thank you, Mr. President. Floor Amendment No. 2 appropriates for all State public universities for operational expenses. In total, Senate Bill 2038, as amended with this Amendment No. 2, would total a 780.3-million-dollar GRF for FY'16, which represents a decrease of 350.2 million dollars to GRF, which basically is thirty-one percent cuts for the universities here in the State of Illinois. And I ask for a roll call vote.

Who do you guys think you're fooling? I mean, what you're really doing here is trying to divert everyone's attention from what's coming next, which is a budget proposal that's three to four billion dollars in the hole. Your numbers are three billion; 13 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/27/2015 I think others would say it's four billion. Whatever it is, it's not good. So you got a bill here and you're going to try to save the day because later you're going to present a bill that, oh, it's only six and a half percent. What do you think happens when you send a budget bill that, oh, you're only cutting a little bit, but you're not funding it to the tune of three or four billion dollars? Never mind shirking your constitutional responsibility under the State Constitution to the citizens who elected all of us to -- by -- by passing an unbalanced amendment. In this instance right here, you're going to try to pull the wool over everybody's eyes, and say, "Oh, it's okay. Look, we'll save you later. It won't be that bad." But yet, when you pass that bill later today and you only have thirty-two billion dollars' worth of revenue to fund thirty-six billion dollars on your spending list, what's that cut like? What does that do? The fact is, this is a sham. This is ridiculous. This is a diversionary tactic to try to avoid the reality of what the Majority is going to do later today, which is pass a unbalanced budget to the tune of billions of dollars and completely walk away from Springfield for the summer without doing anything to bring jobs back to the State, without doing anything to help create jobs in the State, without doing anything - anything - to keep jobs in this State. You can't have a budget, you can't have revenue, if people aren't working. So I don't want anybody to be fooled and, quite frankly, folks, nobody is being fooled. No one is being fooled by this. No one I talked to at the coffee shop this morning is fooled by it. Nobody I talked to last weekend at my kid's ballgame is being fooled with it. The citizens of Illinois are on to this and they were on to it long before last November's election, but that's when they showed up. They've had 14 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/27/2015 it with this kind of shenanigans. They've had it with everybody who keeps passing unbalanced budgets and letting the jobs leave Illinois. Well, guess what, we're not going to be fooled again. Thank you. I would urge Present votes only.

Thank you very much, Mr. President. There is no intent to fool anyone at this point in time. We want to be -- bring some clarity to -- to the comments and to the message that the Governor gave us, again, on February 18th, 2015. What we don't want to be fooled by, going forward, is that we were going to get 2.2 billion dollars' worth of -- of reductions and cuts and savings from pension reform. We don't want to be fooled by the 1.5 billion that the Governor has proposed that we're going to get from cutting Medicaid, nor do we want to be fooled by the five hundred and seventy million dollars that was projected to be saved by cutting group health insurance, when we know that's a collective bargaining 15 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/27/2015 agreement. So what I want to present today, as I will do with the remaining two amendments, is saying if there is someone that believed that message, if they -- you want to be an active participant in crafting a budget for us going forward in 2016, that, in fact, you may vote for these kinds of cuts and that'll make are discussion much easier. I do not participate in circuses. My wife's birthday today and for forty- one years I've been at her side and today I'm with us. Yes, shake your heads, because, hey, sometimes from Humboldt Park -- and I'm not afraid to say it, I'm a very educated man, but today the ghetto's coming out of me. But in keeping with what we've been talking about, our Governor, in his budget address of February 18th, 2015, also talked about shared sacrifice; that to get out of the hole that we're in, we certainly have to - all of us - chip in and -- and make that quantitative difference. This amendment was one of his proposals and it includes his proposal to cut the Local Government Distributive Fund by fifty percent because he believes that - at least it's our interpretation - that all municipalities should share in getting the -- the State back on an even footing.

All right, thank you, Mr. President, Members of the Senate. So this -- we are now going to be doing a series of bills. We have nine of them today in the Senate and we're going to have nine additional House bills and there is another bill that still is getting worked out. As a package, these bills present an investment plan that totals -- the total dollar amounts in them will be about 36.3 billion dollars. The revenue that this is based on is about thirty-three billion dollars. What we're doing here, the Senate Democrats are very eager to work out a budget for fiscal year '16 and think that this should be the top priority that we are working on right now in this Legislative Session. We believe that this investment plan really reflects the overwhelming majority of the people in Illinois - what we value, what we need to be spending our core -- spending our dollars on for -- to meet our core priorities. It fully funds our pension payments, which the Supreme Court has clearly indicated we must do. It makes fully -- it fully funds SIP and TRIP, our insurance, health care 27 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/27/2015 insurance for teachers. It funds group health insurance. It funds our debt service. It -- assumes full funding of our transfers out, our statutory transfers, so that's fully funding Local Government Distributive funds. It also assumes that we're not making -- that we're funding Medicaid program, current level to the current year. And what we're doing then, above the line, is actually -- with those things that we must do, we're actually funding our statutory requirements. What we're also doing is discretionary spending, the -- what we have come to finally call it in Springfield, the below the line items, where we have discretion, funding education, funding general services, funding public safety. It's holding this funding exactly level to last year -- the current year funding - at about 17.2 billion dollars. This is the budget process. You know, in February, the Governor brought us a -- a budget that I think we also believe was unbalanced. It only made -- it cut 2.2 billion out of the pension payments that we think we clearly need to be making. There was other things that it did not fund that are statutorily and federally required. Our response now is a budget that fully invests where we need to be investing, yet at the same time, it's making cuts. We're cutting -- we're making -- we're making cuts in human services, we're making cuts to higher education. We've been trying to work within the constructs of what we believe are shared set of values that we have here in this caucus. The Governor has also said he values economic development, education, and public safety. We are -- mirroring and also sharing those values for investment as well. We're ready to work with him and everyone here in this Chamber to bring this -- budget into balance as well, this investment plan. We're here to get it done and were looking 28 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/27/2015 very much forward to working with everyone on this Floor to do it. Now to the specific bill, the first bill that we have here to talk about the budget is Senate Bill 2037. This bill is providing the funding for Departments of Public Health, the Department of Children and Family Services, Department on Aging. It -- in total, it appropriates 2.8 billion dollars for these agencies in all funds, about an eighty-one million decrease from fiscal year -- excuse me, it is - I'm reading the wrong one 'cause I had caught that mistake earlier - it represents about a 7.1 million increase, or about flat, from 20 -- fiscal year '15. Totally in GRF, it appropriates 1.8 billion dollars, a slight decrease from current year level spending. I want to just highlight a couple of things that we're doing in here that -- distinguish these budget from what the Governor's proposal had been. For the Department of Public Health, the Governor's proposed budget had eliminated numerous programs that we are restoring to some extent in this bill - things for sudden infant death syndrome, sickle cell clinic, mobile care, and prostate cancer awareness. For the Department of Children and Family Services, the Governor's proposed budget had entirely eliminated services for eighteen- to twenty-one-year-old wards of the State. This -- this budget proposal restores those funds and assumes that we're going to get additional federal matching dollars for this. Those of us in the budget working group know that the new Director there is working hard to bring in the extra federal dollars and I think he's going to have great success with that. This Department of {sic} (on) Aging budget retains level funding for the Community Care Program, compared to -- Governor's budget would have drastically reduced the funding for the Community Care Program. We're also appropriating about twenty- 29 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/27/2015 two million to the Adult Protective Services. That has a little bit less because they hadn't been spending their full appropriation in the past. With that, I will close. I urge an Aye vote on these -- this appropriation bill and will be happy to answer any questions folks may have.

You know, we had a little bit of a conversation about this yesterday in committee and I took the opportunity then and I'm going to take the opportunity now to read 31 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/27/2015 some language directly from the Illinois Constitution. The Illinois Constitution provides that "appropriations for a fiscal year shall not exceed funds estimated by the General Assembly to be available during that year". You had indicated that we're going to have thirty-three billion dollars in revenue, is that correct?

How does it possibly square with the plain language of the Constitution, the budget that you're carrying?

Thank -- thank you for that question, Leader Murphy. So, yes, I do believe this is constitutional, in that this is one piece of a package, ultimately, that we'll be passing. We clearly - and I think that's the elephant in the -- in the room here - we clearly need to talk tax reform as well. And I think this -- this investment plan speaks to that need in this State. And, you know, I think, the Governor, we have heard he's acknowledged that we need someplace between three to 3.5, even himself, billion in revenue. We have heard -- the Civic Federation came and spoke to our Appropriations Committees. They talked about a plan which would actually raise, once fully implemented, at least five billion dollars. Clearly, this needs to be part of an overall plan and we're really looking forward to sitting down and getting to the point where we can be focusing and having these kinds of budget conversations on the revenue side, as well as on the appropriation 33 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/27/2015 side. This is a step in the process.

But to be clear, Governor Rauner has never said that he supports raising taxes. In fact, he has said that without reforms, he absolutely would not accept raising taxes. And since you guys have steadfastly refused to cooperate with him on reforms, how can you expect that there is going to be revenue here? And, secondly, where is your bill? Where is your bill to produce this revenue? As Senator Jacobs famously and often said, "Why didn't you go to the bill room? Where's your bill?"

I must say, I -- I enjoy that Senator Murphy, because we've been -- I've been here a number of years now as an Appropriation Chair and have relished all of the appropriation bills we've gotten from the other side of the aisle in this Chamber. We have passed numerous revenue bills already in the Senate. We know we have done that. This is a conversation we need to have. And we look forward to actually being able to do that, and what we believe though, should and needs to be a bipartisan fashion. And I think ultimately we'll get to that point for the overall -- in the overall budget process. What I want to -- I think you suggested that there needs to be work done on non-appropriation-related items, non-budget items, before we can do this, and -- and that's where I think we just differ. We have a job as a General Assembly to pass a budget, make sure the State government continues to 34 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/27/2015 operate. That's our job. We're coming to the end of Session. We haven't seen a whole lot of momentum and a whole lot of support throughout the State on the -- the Turnaround or turnback agenda, some people might call it, in Illinois. You know, we haven't met -- had many municipalities indicate or local governments indicate that they support this agenda. I know the House has put a number of the bills up on the board; they have not gotten support. We've been starting to hear bills in the Senate; we haven't been able to pass those. Here we are at the end of Session, we haven't gotten to an agreement on those. It's a shame. I look forward and hope we do get to some agreement on some of those items. We haven't yet, and it is our job in this Chamber and in the other side of the aisle as well - other side of the dome - to pass appropriation bills and keep State government operating. That's what we're doing here.

We didn't go down that path of trying to lay blame that he was putting forth an unconstitutional budget. It's all part of the process. We're not done.

I mean, I have never seen people try to make themselves seem less well read and less intelligent, too - extremely bright, extremely articulate, very well-educated individuals, who should be proud of their intellect, pretending that they don't understand what -- the phrase, "appropriations for a fiscal year shall not exceed funds estimated by the General Assembly to be available during that year". You really needed to go to law school to figure that one out? Come on, come on! At least admit what you're doing is in blatant disregard of the Constitution. I understand the political pickle you're in. Right? You feel compelled to pass a budget, although I'd note, you still haven't put a full budget 36 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/27/2015 out. We have not seen a full budget from you yet. I am eager to see a full budget. But I think, more broadly, let's take a step back and look at what's been going on. There's been an opportunity, an olive branch, extended by the Governor from day one, with the working groups trying to reach common ground. He's taken things off the table. You yourself had acknowledged that he was willing to compromise on tax revenue. These are things he has shown he's willing to compromise on. The people of this State sent a Republican Governor, a guy who said we are not going to continue to do things the way they have been done, because the way they have been done has been systematically crushing opportunity for those in the middle class and every other class who lives in this State under your twelve years of rule. He reached out to try to work with you. There's tangible evidence of his willingness to compromise. There is zero proof of your willingness to extend an olive branch back to him and we Republicans. There was a reference made in committee yesterday that -- that -- I've been around here a little bit and I -- I -- I still occasionally get surprised and yesterday was one of 'em. We were told in committee yesterday that this unbalanced, more of the same budget represents the values and morals of the people of this State. The values and the morals of the people of this State. The people of this State, let me tell you, do not support spending more money than you have. The people of this State do not consider it moral to promise people you're going to be able to give them something when you know you can't, 'cause you don't have the money. That's not what's moral. You know what else isn't moral? Economic policies that make it harder for people to get the best job they can do. We have been one of the worst-performing job record states in the nation for a 37 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/27/2015 decade. And you know why? Because your tax and spend policies failed. We have more going for us than any state in the Midwest by a longshot; we should dominate economically. The fact that we lag is because policies coming from this building, policies like this budget, where you spend more than you take in, send job creators scurrying for more responsible climbs. Morals and values. This budget is neither moral nor reflective of the values of the people of this State. It is nothing more than more of the same failed ideology of tax and spend that you guys have tried for years. You say you don't want to tie reforms to the budget, well, here's the problem with that, we tried it your way in 2011 - sixty- seven percent income tax hike, no reforms - you know what we had? The worst job growth -- the worst job record in the country in the calendar year that followed. If you don't fundamentally change the environment that we operate in, you're not going to create more opportunity for the middle class or any other class that we all care about. It is all tied together; it does need to be done together, because doing it piecemeal, doing it your way, hasn't worked. The people of this State recognize it. That's why they sent a new Governor here. It's time that you guys recognized it and reach back to the Governor who is trying to work with you to actually turn this State around and create opportunity. This is not a responsible budget and it's not the right thing to do. And I encourage a No vote.

You know, there's a lot of other issues that are important, and I know they're important to the Governor and many folks, and they deserve hearing. I absolutely agree with that. They're not a part of the budget process and the appropriation process. We need to be focusing right now on the real fiscal issues that the State faces. When I talk -- and we -- I, you know, have talked to many of the organizations around the State - including the Civic Federation was here talking to all of us. Many groups said - I think many of us would suspect more are on the -- your side of the aisle in alignment in their thinking - say the biggest concern they've got with the State of Illinois is the fiscal uncertainty; that we just don't provide stability here. We need to stop playing these games and actually getting down to providing fiscal stability and a certainty so that we can all stop reeling from fiscal crisis to 41 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/27/2015 fiscal crisis in this State. And that's a conversation I wish to be -- that I think -- believe absolutely to my core that we need to be having and need to be focusing on until we get that solved.

It provides funding to all of our local governments that clearly need to have their dollars to keep them running. It provides general State aid to all of our school districts across the country {sic}. It provides funding, in these budgets specifically, to continue to provide services to all the wards of the State, who, by -- by definition, we are the loco parentis for them here in the State. It provides funding for folks who are getting services in -- through the Community Care Program, so that they continue to get -- not -- stay in their home by getting those hour or two of services so they don't end up nursing homes. I can go on and on, but I think you get the gist. We're providing the ongoing needs and operations of State government.

Even those like the Civic Federation, who are more aligned with business community interests, are suggesting the different revenue sources we should be using. And, yes, I do think we're going to ultimately end up having those conversations as well.

Someone will be left out, period, bottom line. Maybe it's DCFS, I don't know. We don't know the answer. The Majority won't tell us. Maybe it's higher ed in one of the other bills. Maybe it's whatever it is, but to sit here and pretend that you're going to have a moral position, and last night in committee, it was, as Senator Murphy mentioned, described as the moral position of the 43 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/27/2015 people of Illinois. Someone gets left out. You're not telling us who, and the bottom line is you have no way to resolve this that's in front of us. You've talked about it; you said, hey, it's going to be here by the end of the day, I think was your phrase - we'll have this resolved by the end of the day. I look forward to that.

The grants provide funding to local health departments across the State to protect citizens and visitors from infectious diseases, unsafe foods, impure drinking water, and unsanitary sewage disposal. It provides protection from things in our everyday lives that we take for granted. I would note that this budget provides about seventeen million dollars for the Local Health Protection Grants.

This is -- this is a difficult time for all of us in the State and I really was struggling with whether I was going to speak, what I would say if I got up to speak to this, and I already hear the rhetoric flowing, I hear the name calling. I understand that when we leave this building, there'll be threats flying all over the place. It doesn't matter where the threats come from; there's nobody that's sitting on this Floor that doesn't get threatened by somebody about if we don't do what they want us to do, then, you know, we're going to take you out kind of conversation. And I remember explaining to some constituents that -- that means the only thing I have for you is the best I can do. It means when I 45 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/27/2015 take every issue at its -- on its face and it comes in front of me, I have to look at that one issue and say, where do I think this is going to best serve my constituents, where do I think this is going to best serve the State of Illinois? Now there are a lot of negotiations that are happening in this building, but I don't pretend to believe that I'm going to negotiate you into becoming a Democrat, any more than I think you can negotiate me into becoming a Republican. You're never going to negotiate me into saying that I think that people who live in this State don't have a right to organize themselves and -- and democratically elect someone to represent their interests. You're never going to get me to say that. I don't believe -- I fundamentally don't believe that. You can't negotiate me into believing that when you constrict public dollars that somehow magic happens - math doesn't work, economies go out the door, economics go out the window - and -- and lie about the fact that when you constrict public sector spending, when you do that, there is a correlated lost private sector economic reality. There is. You're not going to get me to be able to say that when there are agencies in our districts that perform services, critical essential services, that I don't know what happens when you shut down those services. There's no way that I'm going to be negotiated into -- into arguing away those interests. I believe, honestly, that there are some things that government does well and there are some things that we are called to do. And as to the plain language of the Constitution, here's some plain language - it's in the beginning. "We, the People of the State of Illinois - grateful to Almighty God for the civil, political and religious liberty which He has permitted us to enjoy and seeking His blessing upon our endeavors - in order to provide 46 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/27/2015 for the health, safety and welfare of the people; maintain a representative and orderly government; eliminate poverty and inequality; assure legal, social and economic justice; provide opportunity for the fullest development of the individual; insure domestic tranquility; provide for the common defense; and secure the blessings of the freedom and liberty to ourselves and our posterity…." It is astounding to me that we're not having any conversations about what those words really mean in the plain language of the Constitution we all rose our hands and swore to uphold. At the end of the day, this isn't a conversation about whether or not this is the particular spending bill that's going to be done, because we understand that there are three separate coequal branches of government and, when this budget leaves the Chambers, it's going to go to one of those other branches, the Executive Branch, and in that he has the authority to line-item veto out whatever he thinks we cannot -- we don't have the revenue to support. So I would ask, since you find this so immoral - you know the moral position - that the only truly moral document we have in this building is the budget, because it's where our priorities are. Don't tell me what your priorities are, show me what your priorities are. Where you put your money is where your priorities are. So it's not difficult for me to say, yes, this investment plan, this spending plan, whatever you want to call it, reflects the priorities of things that I honestly believe in. I want you to tell me where you don't think that. So what should we cut? Or is this the first step in a program for us to decide what the end package and result is going to be? And there's nobody in here who doesn't believe that we're not going to be back here discussing that. We have work to do. Our work is undone, but 47 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/27/2015 there's some very plain-meaning language in the Constitution that specifically charges us with how we take care of the people who live in this State. And I fundamentally don't believe that anything we do to balance this needs to be on the backs of people who can least afford it. I understand, I understand that when you concentrate those cuts - remember when we had that conversation about the twenty-six million dollar cuts - when we concentrate those cuts in areas that never participated in the economic recovery in the first place, that that twenty-six million wasn't just twenty-six million; there was an economic multiplier. If those cuts had gone through, you would have concentrated the lost private sector economic activity in areas that never got to participate in the economic recovery in the first place. So, yes, I find this whole situation immoral. But I also understand that we are not done yet, and I will come anywhere as long as I can, to whoever wants to sit down in a group and work, so that we truly can be honest about what it takes to provide the services that we know our constituents need. It is a patented myth that you can decrease spending -- you can decrease adequate investment on the front end and expect to get positive growth outcomes on the back end. I'm saddened because I came here to represent my district and the State of Illinois, and I'm saddened because since I've been here, I've made friends with -- became friends with just about all of you and I found something very interesting; I found that in talking to a lot of you, and -- and you on the other side of the aisle, I -- I found in conversation that politically we agree a lot more than we disagree, but yet here we are, and we're -- we're -- we're bickering back and forth. You know, none of us here have all the answers. I don't have all the answers. Our leadership doesn't have all the answers. Your leadership doesn't have all the answers and the Governor doesn't have all the answers. But, together, we can find a way to make it work. And what saddens me even further - and I know it's been talked about and already been beat over the head - but what really saddens me, and maybe it's because I'm new, but five months ago I was honored to raise my right hand and swear to uphold the Constitution of the State of Illinois - this is not upholding our Constitution. Article VIII, Section 2, subsection (b) - I'm just a fireman; I don't need to be a constitutional lawyer to interpret that. It's very clear. And I'm saying what -- what your side of the aisle is proposing, they're not all bad things. There's a lot of good stuff in there. The stuff that the Governor said, it's not all good. Some of it's bad, but there's a lot of good stuff in it. Let's come together and talk about it. But what saddens me is that all of us in here, me being the newest one, five months ago raised my right hand and took an oath to uphold our Constitution. But before I ask those questions, Senator Steans, I did want to make one comment to the distinguished speaker from Palatine, who I thought it was very interesting when he brought up the Constitution and the constitutionality of things, because I happen to remember sitting on the Pension Conference Committee. As a matter of fact, it was out of the Pension Conference Committee that came Senate Bill 1. I was known as being the one dissenting vote from the Pension Conference Committee. I thought it was a 50 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/27/2015 little rich, because I was one of the few on that committee who was not an attorney, but I did argue the constitutionality of that bill. I also argued the moral objective of that bill and the concerns I had with breaking a promise to people who were all of a sudden going to lose their ability to retire, and certainly to retire in dignity. So I want to say this before I ask my questions, with a corporate budget - and this seems to be what that side of the aisle's talking about - a corporate budget, a corporate budget is a balance sheet, it has numbers, it has dollar signs, and you know what you can do with those? You can slash out and zero out some of those dollar signs and take some cuts in that company - that's ok to do that. But I want to talk to you a little bit about a budget when you're dealing with the government - the government, whose responsibility isn't just to have a corporate balance sheet. It is a document that has programs in it, programs that benefit people. We're talking about people, we're talking about human lives, we're talking about your mother, your sister, your grandmother, your wife. And that's why I want to ask a couple questions that are in this budget, because this budget isn't just dollar signs. This budget also provides for the people of Illinois, who it is our responsibility to take care of. So that was a very long preamble, Senator Steans, for me asking, what exactly does the breast and cervical cancer screenings program do?

They provide free mammograms, breast exams, and pelvic -- pelvic exams and Pap -- Pap smear tests to eligible women. So, we didn't -- we didn't restore to the current levels. We restored part of it. The Department says it has transitioned about thirty percent of its clients to the ACA/Medicaid, and that's good progress. It's not enough yet. The Department's estimated that under the Governor's proposed spending for the program, there's about thirteen thousand women who can be screened. That leaves a huge gap from the previous twenty-five thousand women, especially considering that early detection of breast and cervical cancer can save their lives, and if we wait too long, we miss that opportunity. So, yeah, we're trying to restore some of that 52 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/27/2015 funding until we fully transition everybody into the ACA programs.

Yes, to that point, I think I've on a number of times indicated that this is a step in the process. I think what the Governor had put forth back in February was not balanced for -- for numerous reasons. I think we're now taking this to the next step, saying here's where we realistically, prudently, but still taking care of both of our core priorities, the things we have to do, our core priorities and -- and making sure that the most vulnerable are not getting left high and dry. And we still need to have that part of the conversation on where we're going to provide full funding for all of these investment priorities that we have as a State.

But how -- how in the world is it an investment when you openly and readily admit that the dollars aren't there? We cannot continue to careen from fiscal crisis to fiscal crisis. And we here as a Body are compelled to make those hard choices on what we need to invest in and how we're going to fund that, and that's a conversation I think every single one of us in this room stand ready to have. I think we need to have those conversations and we're today beginning to engage in that conversation on how we're going to do this.

You've got more than enough votes in this Chamber, and, heck, in the Chamber across the street here, to do whatever you want. It doesn't matter what the guy on the second floor 55 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/27/2015 thinks. And, in fact, you've reminded us over and over that you don't really care what the guy on the second floor thinks. Governor Rauner has put forward his ideas and we Republicans have stood here and said "We'll work with you", "We'll work with you", "You want our cooperation, we'll work with you. Here's our ideas." And what do we see? Unilaterally, one after another - we just did one of 'em on workers' comp this -- this afternoon, this morning and afternoon - Republicans put forward their ideas, your response is, no. Yet you're asking the Republicans here to raise taxes, cooperate with you to raise taxes. Why don't you just do -- is - - is that your plan to just do that alone? You got all the votes to do it on your own anyway. And if you don't want to do it on your own, are you willing to really work with us and with Governor Rauner on some of these reform measures that we've put forward?

Yes, I think, you know, what I hear from my colleagues on these working groups is they've been heavily engaged in those and they were having conversations, put things on the table that sometimes our side took off, sometimes administration took off. I think it's an ongoing conversation. I think these issues are important and deserve, absolutely deserve, a hearing. We are here now, though, at the end of May and our priority needs to be on the budget. It is our obligation, as an entity, to pass a budget and to get that done. I know there's been times in the history here of Illinois, before my time, where we've had divided government - Republican Governor, Democratic Chambers - where they have passed budgets that have not gotten approved and they come 56 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/27/2015 back by Veto Session and get it done. I mean, these can be a process. And this is, as I say and will continue to say, I believe good faith movement forward in getting us to a place that we can fund our core requirements, things like the pensions, things like our statutory transfers out, things like our debt service, things like general State aid, and really show that we need to protect services, also the most vulnerable. And that is what we are working on today.

But where -- where's the ongoing conversation, though? That's where I'm -- that's where I'm lost here. Are -- should we plan to have hearings on, say, the Republican proposal for redistricting and the Republican proposal for term limits here before the end of the week?

I -- I think both those items deserve -- deserve to be heard. I think they're important. We're talking, though, right now -- we are in May of 2015. I mean, this is just absurd to create an environment in which we're not providing and discussing the actual, upon us now, fiscal circumstances that we are in in Illinois, to distract away from. They may be important ideas and things that people feel very strongly about, but they're 57 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/27/2015 nothing that are going to have anything to do with dealing with our fiscal situation in the State of Illinois. I mean, this is -- this is where the fundamental disagreement exists, though. You know, Republicans put forward our reform ideas, we're told no, and we're told, but let's continue the conversation. It's not a continued conversation when the absolute no comes from the other side of the aisle. And -- and here's the problem. Republican's put forward reform ideas, Democrats say, "Well, those aren't reform ideas to the budget", even though they absolutely are. Think of this, if we adopt workers' compensation reform, if we adopt the lawsuit reform measures that we've put forward, what do we do? We reform the Illinois economy so that we can -- put people back to work. Those people who work, pay taxes. More -- more than that, more than that, on the bills we can't even get a hearing on, everyone who's anyone knows that the reason Illinois is in the financial problem that it's in is because of the ridiculous financial decisions made by one career politician after another in this Chamber and in the one next door. If Illinois adopts a term limits bill, an amendment, what do we do? We get rid of the people who've put us in this mess. What has term limits have to do with the budget? I am almost certain that every Senator in this Chamber has a senior or two in their district. The Governor's proposed budget would have eliminated sixteen thousand seniors from a program. So, you know, when we talk about government, government is not a corporation. Government is about helping the most vulnerable. This budget that we are proposing takes care of the most vulnerable. It takes care of my ninety-five-year-old uncle, who's still in independent living, who depends on these programs while I'm down here working to make sure that he is taken care of so I don't have to put him in an institution. And I'm almost sure that many of you here have either parents or seniors in your lives, constituents, who right now need those services. 61 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/27/2015 Again, this budget is about taking care of those most vulnerable. Thank you, Mr. President, Ladies and Gentlemen of the Senate. I'm not sure if I've ever spoken on a budget bill. There -- there are so many Members of our -- our Chamber who are willing and able to do that, I've not had to. But the hysterics surrounding this notion that what we're doing today is somehow unconstitutional has compelled me to rise. As an aside, I would say much of that wailing and gnashing of teeth has been coming from people with pretty sketchy records on predicting the constitutionality of what we do here. But let's turn to Article VIII, Section 2, subsection (b): "Appropriations for a fiscal year shall not exceed funds estimated by the General Assembly to be available during that year." But let's read the sentence immediately before that: "The General Assembly by law shall make appropriations for all expenditures of public funds by the State." The balance of the budget, the constitutionality of what we're doing is not measured until all of the budget bills are passed and either signed into law by the Governor or enacted into law by an override of the Legislature. What we are doing now, as Senator Steans said and 62 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/27/2015 Senator Hutchinson noted, is exactly what it is, it's a step along the process. As the budget bills come together, as line item vetoes and reduction vetoes are offered, as revenues are added, we will evaluate this package when all is said and done and it is law. So no one need be worried about breaching their solemn oath to uphold the Constitution. We will be measured in the end and we will have a balanced budget.

One -- one of my questions, because it is a concern of -- to -- of my community and many individuals throughout the State, Senator Steans, is this funding, that restoration that you're bringing that's for eighteen- and -- to twenty-one-year-olds, can you tell me what -- what that does exactly?

Right, the Governor's proposed budget had eliminated all funding for DCF -- Department of Children and Family Services' wards of the State. They're by definition our responsibility. I found that, I think, probably one of the most problematic aspects of the budget. What we're restoring now will impact pregnant and parenting teens; it will provide funding for housing support, counseling and therapeutic services, placement alternative contracts for them to go and start living independently, educational support, vocational training, scholarships for them to attend educational institutions, and -- and numerous other services for that age group.

As we try to juggle the dollars, the limited dollars, that we have, we certainly look for matching dollars from the federal government. Absolutely not. To get the federal matching dollars, teens need to be in programs, educational programs, job or job training programs, or have a disability. I think probably many of us feel, in this room, the same way, that we would not at eighteen kick our kids out the door and provide no other services. So these are twenty-four hundred young adults in Illinois who will no longer be kicked out on the streets.

It's another when you deal with the collaborative effort of wondering and finding out what the concerns are -- are those -- of those individuals that we represent. What I didn't hear is what I've been told when I first started this job, in that this was a government of the people, by the people, and for the people. So -- so I commend you for carrying that torch forward in this great democratic country that we live in and this great State of Illinois.

Just to the -- thank everybody for the debate on the budget, first budget bill. We have a number of others, hopefully that -- we can do 'em a little quicker. But just -- I just wanted to comment on the fact that I have had some experience in the General Assembly, institutional memory going back to 1979, when we had a Republican Governor and we had a -- differences with the Republican Governor. From 1979 to 1991, I was in the House. We would appropriate bills, the Governor didn't agree with them, but by the time we were finished with the amendatory veto process, we had a balanced budget. There were a couple of years, however, where we were just short of revenue, so Governor Thompson, twice, asked for temporary tax increases. He asked us if we would help him pass those bills, which we did, and we -- and we voted for 'em and they 66 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/27/2015 passed. In fact, when Governor Edgar was the Governor, he asked that one of those temporary income tax increases remain permanent. So we cooperated as a General Assembly, a majority of Democrats with Republican Governors, and we look forward to doing that now. This budget that we're talking about, it's been pointed out how much will be in it total. Just as Governor Rauner proposed a budget that was pointed out to him that it was perhaps a little out of balance by four and a half billion dollars, it's said that this one is out of balance, but it's the beginning of a process. But one thing we definitely have to do is give the Governor authority to spend money. It would be irresponsible for us to leave without doing that. So that's what the process is about. And so I appreciate everyone's comments and debate, but I think if you look at the actual product, this budget is going to be really, really close to the final end product. And for that reason, I would ask us to vote Aye.

Thank you, Mr. President, Members of the Senate. I -- I -- I really do value this debate. There's nothing more important we do in -- in this Chamber than get to and pass a budget. Folks have mentioned they're saddened. I too am saddened. I -- I had hoped at this point in time that we would have come together as - - with across the Dome, second floor, that we would have gotten to an agreement on how to approach this. There is nothing more important in the State of Illinois right now than some fiscal stability, fiscal responsibility. Our credit ratings continue to drop. We've seen what's happened in Chicago. I think it's really 67 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/27/2015 sad that we're playing games on a whole bunch of other items that have nothing to do with the budget and distracting from what we really need to be doing here in this Chamber, and that is providing fiscal stability and fiscal certainty. That's going to be the most important aspect of driving the economy and job growth in this State, is that certainty. We're doing anything but that when we -- when we hold hostage this to things that have nothing to do with the budget. And budgets are, in fact, a reflection of priorities. They are moral documents, I do believe that. And when we have a budget that now -- before us that is, in fact, ensuring that we don't kick eighteen- to twenty-year-olds {sic} out onto the street, when the average kid out of the DCF {sic} (DCFS) gets -- has less than a hundred dollars in his or her pocket when they are out, and we're saying that we no longer should have any responsibility to provide any care for that eighteen- to twenty-one-year-old. When we have seniors across this State who are staying at home rather than going to nursing homes because of the Community Care Program, and the things that would have been happening if we didn't restore that funding in this budget is leading to that. It's very short-sighted. Would lead to much higher costs. I think it's incredibly important that we take these actions to ensure the ongoing operations of State government. I'm, in fact, very pleased to be able to present a budget that I think is, at the one time, making sure we protect our most vulnerable and, at the other time, is very restrained in the spending. Again, the overall budget packages that we're -- being put forward would retain spending at about fiscal year '15 level. This is not some crazy plan on how to spend our dollars. It's, in fact, only investing more in pensions, five hundred and thirty-five million 68 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/27/2015 more there. And everything else in discretionary spending is being held to this year's level. I urge an Aye vote and very much look forward to getting Aye votes on the rest of the budget and continuing our conversations and getting to some agreements in -- in this Chamber. Thank you.

In total, it's appropriating 34.9 million, representing an increase of eight hundred and five thousand dollars over the fiscal year '15. But, you -- you know, we pass hundreds of bills each year in this Chamber and in the other Chamber. The Governor has proposed five proposals. One was thoroughly voted down today. I suspect the other two that are set 75 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/27/2015 to be heard in committee will -- will face the same fate, and two haven't even been discharged from Assignments. So I think the question is, who's holding who hostage? I'm going to urge a No vote on this, but I'm going to make a prediction here - it's going to be a bold prediction - I think it's going to pass anyways. I think you guys are going to be able to pass whatever you want to pass and all we're asking for and all the Governor is asking for is fair consideration of five proposals that have already been compromised down, taking into account very serious concerns that have been raised. But there was mention made to the Governor's proposals and holding hostage and fair hearing, and I assume the reference was to a bill that was heard today on workers' compensation. It was the intention of the Chairman to have an hour dedicated to that debate. Instead, we dedicated two hours and I had to redirect conversation to the merits of the bill, because I think in giving fair consideration, we ought to be talking about the merits. And, as I did that, we talked about the merits, and the No votes and the Positive votes were delivered after a fair debate of the actual merits of the bill, and the bill failed. I don't know about other issues that may be considered in other committees, but with -- 77 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/27/2015 with regards to that, that one issue, which I took time four years ago to work every day of the Session on, it received a fair hearing and it failed, fairly. So I urge an Aye vote on this matter, based upon a fair hearing on this matter, in isolation.

Thank you, Mr. President and Members of the Senate. Senate Bill 2031 appropriates a total of a 143.4 million in GRF, 48.4 million in other State funds, and 6.5 million in federal funds for the Office of the State Fire Marshal, the Judicial Inquiry Board, the Department of Juvenile Justice, and the Department of Labor. You know, in -- generally speaking, we've held these things to the Governor's requests. Department of Juvenile Justice is the area where we have a significant increase and that's to support their request for the increase. We're not doing quite as much as what the Governor's budget had requested, but close to it. They're under two new consent decrees - the R.J. versus Jones and the M.H. versus Monreal and Jones {sic}, so they need to provide additional support to the kids in -- in the juvenile detention facilities for education and mental health and substance abuse treatment. I would -- I would urge an Aye vote. Thank you.

Senator Steans, I have listened carefully to the debate on the first couple of budget bills and one of the -- one of the themes that I hear recurring in your responses, in all fairness, is that you have rejected the 80 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/27/2015 premise that this is a deficit budget. Every time that issue has come up thus far on this Floor, you've treated it like it's not a reality. So let's go with that premise for a moment. Now you are an articulate, respected Member of the side of the aisle that has a substantial majority. So I have no doubt that your crystal ball is far more clear than mine. I want you to walk through with me how you see this plays out, how you see this budget going to the Governor and somehow, between that moment and when a budget becomes law, that -- that gap in revenue is filled. Explain to me how that happens.

Well, as we heard from the Senate President, when this is -- in other situations, there's been a variety of ways that that's come to be. There could be that the Governor decides to make amendatory vetoes. There's also times that Governor has come and suggested that we do additional revenue and that's been done. There's a number of different ways that we could get to that point.

Well, I appreciate that and -- and it was interesting to hear what the Senate President had to say about history some years ago and that was, of course, before either you or I arrived in this Chamber. And I don't think that he was suggesting that there's any guarantee that that's going to happen. You talk a little bit about line item vetoes, so you've laid out a couple three possible scenarios. But really what I'm asking you to do, Senator, is to 81 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/27/2015 kind of zone in on really what you think is going to happen. Because -- and it's a pretty strong thing to reject out of hand the premise of a question that is based on the math that is plain as could be in front of everyone, which is that, if this became law as it's being put up on the board, we will run short by between three and four billion dollars. So tell me how you really think this plays out -- I mean, specifically, if you can.

Well, of the skills you referred to of mine, one is not clairvoyance. I cannot -- I don't have a crystal ball. I cannot predict the future. I don't know how this is going to all play out. I can certainly tell you that my -- my hope will be that the Governor and the Leaders come together and get to an agreement on how they would like to ensure we provide fiscal stability and continuation of State operations into the future.

Well, I was fearful that you would tell me that, Senator, that you would not be able to give me a good feel for the path down which we will walk in the next few days or few weeks or few months to where, when this spending package becomes law, it's no longer a multi-billion-dollar deficit budget. But since you can't do that, then I -- I don't know that you can have it both ways, Senator. I don't know that you can totally reject out of hand the premise that this budget is a deficit budget, but on the other hand, really not articulate any specific plan you might have for 82 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/27/2015 how it's going to become something other than a deficit budget. So, if it does become law the way it's up on the board, how will the shortfall -- how will the deficit be financed? I mean, you've been handling budgets for some -- a number of years now. When you pass a budget -- you enact a budget that has a deficit in it, how was that deficit financed?

As I thought I suggested, that there are options for amendatory vetoes that could happen or there's options that we may come together and decide that we need to do the revenue to help support this.

So one of the suggestions - and I understand that the Senate President laid this out as an example earlier - one of your suggestions is, is that your party and the General Assembly do the easy thing: Don't vote for the tax increase that you want -- that -- that funds the spending that you want to go home and tell your constituents you voted for and just let the Governor do the dirty work. I mean, is that the -- I mean, is that -- is that the plausible strategy that you're putting in front of the Chamber?

You know, to be clear, I think everyone in this Chamber knows that we have, in fact, voted for the -- we passed the temporary 83 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/27/2015 tax increase on this side of the aisle in the past and it was with Democrats over in the -- in the House. I think we've all -- are a party {sic} of that. The fact of the matter is, when it -- after it had gone away, the -- the Governor asked us not to take it up in Veto Session last year. He -- he specifically suggested he did not want that to happen until he was put into office. So we did not act on that at that point in time, and now we are where we are and I look forward to having that conversation.

I'm impressed, Senator, with your and your party's willingness to abide so quickly to a -- to a request from the incoming Governor. If you showed half that degree of cooperation during this Session, we would be in a far, far different place. To the bill, if I might, Mr. President. Thank you. Thank you, Mr. President. Ladies and Gentlemen, there isn't anyone - there isn't anyone who has the ability to get elected to the General Assembly, there isn't anyone who has the equivalent of a high school degree, there isn't anyone who can count - who cannot figure out the tragedy that is this budget. And I'm not talking about - - I'm not talking about the -- the -- the political -- the political unwillingness to say we're going to pay for that which we spend, which is a pretty important ideal and staple and one that we require local governments to abide by. I'm talking about the way this will be financed. There's a lot of rhetoric every day of every week that we are in Session about the kids - about caring for the kids, about looking in the outyears on behalf of the kids. The problem is, is that when you do things like this, the price is 84 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/27/2015 paid by the very same kids for whom you are voicing such concern, because they get to pay - they get to pay. The kids who are in the schools today will get to pay for what it is you say you want to spend on programs today and that is the height of irresponsibility. That is the height of irresponsibility. I -- there are degrees of irresponsibility and we've seen lots of degrees of irresponsibility in this Chamber for years, but perhaps the worst is the unwillingness to pay for that which you say you are going to spend. Let's reject that degree of irresponsibility and vote No. Thank you, Mr. President.

But because this deals with the Department of Juvenile Justice, I just have a few questions in reference to the intent and the impact it will have dealing with that Department. So the first question is, how much does this bill appropriate to the Department of Juvenile Justice?

And what level did the Governor's budget propose to fund the Department for this fiscal year?

He -- he proposed it at a 151.1 million all funds, so a little bit higher than the amount that we have done here. Ours is about 1.4 million dollars less than what the Governor's proposal is. It's only one percent less, though. It's not a huge distinction.

Why does the Department of Juvenile Justice need such a significant increase over the past fiscal year?

As I mentioned in my introduction on this, there's two consent 86 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/27/2015 decrees that the Department's under now, M.H. versus Monreal and R.J. versus Jones. So they require increasing staffing levels so -- you know, to provide educational services and to ensure that each juvenile who's in the system, when they have to go to get heard, that they have an attorney present as well.

So, if I hear you correctly, it does enhance training with regard to LGBTQ youth and conform with federal PREA mandates, and implement policies and procedures for coordinating psychiatric, mental health, and substance abuse services, is increase the education staffing to ensure full-time, full-day school in all facilities, and so on. So I think the last question I have for you then, what happens if we don't fund the Department of Juvenile Justice at this level? Or what happens if the Department does not meet the requirements of the consent decrees?

The consent decrees have a court-ordered timetable that dictates the deadlines that are required. If DJJ doesn't make real progress, they'll just fall out of compliance with the consent decree. The court's refused thus far to allow deadline extensions except for some minor issues at this point. So if we fall out of compliance, the State would probably be under a court monitor. That's the most likely outcome, which tends to be more costly and offers less flexibility to the State.

If, in fact, we pass this collective budget out of both Chambers and the Governor vetoes it, and there is no subsequent tax increase to raise more revenue, would you -- would you commit that you would not seek to override that veto in light of the fact that to do so would create an unconstitutional budget?

Well, let me ask it this way. Would you agree if we got to 88 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/27/2015 that point and there were no additional revenue and it really were going to be the thirty-three and we were at a point where this budget had been passed and vetoed by the Governor and an override motion were brought, would you believe that it was constitutional under that circumstance to pursue a veto override and implement a budget that spends 36.3 billion when we only have thirty-three in revenue?

I think we have to see where we end up. And I did use the figure of speech, "at the end of the day". I didn't mean today literally. That was a figure of speech. So I do believe we're going to get to a -- a -- a constitutional plan here and I certainly look forward to continuing to have productive dialogues with all -- all Members at -- at play here. And I will just say as an aside first here, that I appreciate my colleague and Co-Chair on the Approps, Senator Kotowski, continuing to be a gentleman and letting me get through all of my bills first. Thank you. This, Senate Bill 2032, does the appropriations for the Law Enforcement and {sic} Training and Standards Board, the Prisoner Review Board, SWIDA, the State Police, the State Police Merit Board, the Metro Pier, Military Affairs, Sports -- Sports Facilities, and the IPA for fiscal year '16. It appropriates a total of 836.7 million all funds. It represents an increase of a hundred and {sic} (point) nine million above the appropriations. For the General Revenue Fund, on the other hand, it's 509.8 million dollars -- excuse me, of that total, it's only 269.5 million that's from the General Revenue Fund. And the General Revenue Fund increase is about 7.3 million, a total of about 3.7 percent. And most of that increase is in the area of State Police. There's some increased funding for that agency and there's some also in General Revenue Fund to the State Police Merit Board. And the other agencies, there's not -- and the Prisoner Review Board, excuse me. And the Prisoner Review Board, as was the case with the Department of Juvenile Justice, is being driven 92 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/27/2015 by consent decree, which is why we had to increase General Revenue Fund there. It's -- again, they're under -- under the consent decree Monreal, which requires them to have attorney presence when they hear the cases of the juveniles in front of the Prisoner Review Board. I would urge an Aye vote.

Choose Chicago is the marketing organization for the City of Chicago. It markets Chicago as a tourism destination and a place to hold business conferences and helps recruit conventions and trade shows. It's accomplished through the sales and marketing of McCormick Place and Navy Pier as venues for major events. It also promotes Chicago as an exceptional destination to tourists. I know we've had increased rise in tourism over the last several years. It also markets it to corporate meetings -- for corporate meetings as well. It works in partnership with the Metropolitan Pier and Expo Authority, the City of Chicago, and the Illinois 93 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/27/2015 Department of Commerce and Economic Opportunity's Bureau of Tourism. Mayor Emmanuel had launched it in 2012 as Chicago's new tourism organization. The goal was to restructure all the tourism sales and marketing activities under a single, streamlined agency. And we are now funding that here in the Metro budget.

Yes, we have been very successful in driving numerous conventions and tourism to the City of Chicago. Chicago's visitor industry by -- we have shown that the direct tourism spending of 13.7 billion dollars occurred in 2014. We had a hundred and thirty-three thousand jobs related to the tourism industry in 2014. This is the latest year we have the data for. Ninety-four hundred -- ninety-four -- yeah, nine thousand four hundred jobs were added to the Chicago's hospitality and tourism industry since 2010. It's been continuing to grow. Generated tax revenues of eight hundred and seventy-one million in 2014 alone, and the hotel tax revenue generated a 113.5 million of that total in 2014.

It receives 8.9 million in a line in MPEA's budget annually. In addition, it is receiving 2.6-million-dollar line, which is typically appropriated through DCEO - so it's just a movement. Yes, this appropriation bill makes the appropriations for the Department of Revenue, the Executive Ethics Commission, the Executive Inspector General, the Procurement 97 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/27/2015 Policy Board, the Property Tax Appeals Board, and the Racing Board for fiscal year '16. Total appropriation authority is nine hundred and eleven million in all funds, including a hundred and eight million in General Revenue funds. That total in General Revenue Fund is a decrease of about one percent. The overall budget for all funds is an increase of about eight percent. And -- and that is driven primarily for the Executive Ethics Commission, where there's a new appropriation out of the Road Fund, Capital Development Board, and the Illinois Power Agency. They had done an audit and they're doing work for those agencies, and thus believe that that was the appropriate way for them to be accounting for their services. The other agencies in here are generally at the Governor's requested levels with the exception of the Department of Revenue - we're about 1.6 million dollars less than what the Governor had suggested. In the Department of Revenue, I'll also note that there's an increase in other State funds, reflecting an increase in the sales tax distribution that's going to local governments 'cause the sales tax revenue has been coming in higher than had been expected. I would urge an Aye vote.

So Floor Amendment No. 1 to Senate Bill 2035 makes fiscal year '16 appropriations to the Governor's Office of Management and Budget, Court of Claims, Board of Elections, Supreme Court, Supreme Court Historic Preservation 100 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/27/2015 Commission, State Employees' Retirement Systems {sic} (System) and the General Assembly Retirement Systems {sic}, and the Judicial Retirement Systems {sic}. In total, Floor Amendment No. 1 to 2035 appropriates 1.05 billion all funds to these agencies for fiscal year '16, which represents an increase of 15.9 million all funds compared to a total fiscal year '15 appropriation of 1.04 billion all funds. Of this total, 528.99 million is appropriated from the General Revenue Fund, 517.28 million is appropriated from other State funds, and 10.13 million is appropriated from federal funds. This represents a decrease of 3.78 million GRF compared to the fiscal year '15 enacted appropriation of 532.78 million General Revenue Fund. It was the -- the request is consistent with what they asked for and we abided by those requests. The one area, the Treasurer's Office, this is the Secure Choice Program. That's going to provide, you know, retirement services for 1.2 million people in the State of Illinois. Any of the money that's spent on this, it's from another State fund. Yes, I just want to clarify, this budget is not the one that focuses on constitutional officers, but I did indulge the previous speaker because it does seem like he wants a fair amount of attention today. So, not at all, we're trying to do the exact opposite of cutting probation services. The Court is appropriated a lump sum in this budget of 344.8 million, which gives them ability to appropriate as much as possible to keep probation services level with fiscal year '15. It works like this: The Court system first has to fund all of its judges' salaries - that's a constitutional mandate that can't be changed - then what remains post-mandated salary funding is for operations and probation services. In order to keep probation services level with fiscal year '15 at 117.15 million, the Court plans to reduce its operations. It is going to do everything it possibly can to keep probation services level. That's the priority after funding judges' salaries.

It's one of the things that was referenced earlier by Senator Steans, is that this budget is held level, except we've had some cost pressures in it. So, yeah, it reflects pension costs.

Well, the Governor's request didn't address what's required by law, what's certified, so the -- the -- the budget that we have allows for -- ensures for the 2.2 billion dollars that we're required to pay by law, which the Supreme Court determined that we have to make that payment. So, it's good, smart, wise fiscal policy to do that. It's above the line cost pressure, which you've indicated before. To be quite frank, I -- I kind of resent your tone, because you didn't ask a specific question. We're appropriating a lump sum to the courts in this budget, 344.8 million, which gives them the ability to appropriate as much as possible to keep appropriation services -- probation services level with fiscal year '15. It works like this: The Court system has to fund all the judges' salaries - that's a constitutional mandate, as I indicated, that can't be changed - then what remains post-mandated salary funding is for operations and probation services. So that's -- you know, the point was, they have to fund the constitutional priority before, like we have to fund consent decrees first, like we have to fund -- mandates first. In order to keep the probation services level with fiscal year '15, at a 117.15 million, the Court plans to reduce its operations. It is going to do everything it possibly can to keep probation services level. That's the priority after funding the judges' salaries. That's the dialogue we had with the Supreme Court. In total, the bill appropriates 486.7 million all funds, which represents a decrease of 6.4 million below the fiscal year '15 appropriation. Of this amount, four hundred thirty million is 119 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/27/2015 appropriated from the General Revenue Fund and 56.6 million is appropriated from other State funds. The universities reflect a 6.5 percent reduction. Funding for the community colleges remain level to fiscal year '15. Just wanted to state for the record, I think it's important to note, that in the State of Illinois right now, we educate, through our investment in community college students, about two hundred and forty-four thousand students in community colleges, two hundred and forty-four thousand, and a hundred eighty-eight thousand six hundred sixty-nine students who attend public universities. This represents part of that commitment to investing in public education. It's a very important component of that. One of the issues that had been raised yesterday is why one of these universities weren't cut more, cut to the level of 6.5 percent, and they were. It's just that there's a financial services component within Chicago State University, which serves a lot of kids, gives 'em an opportunity to be able to access school in an affordable way. Simply, I'd love support, but I'd be happy to answer any questions you have.

So, we thought it was important to fund financial services within that budget, make sure these get students get an opportunity to access an affordable education, achieve the American dream. So that's an important component of this budget.

The length it takes to graduate is significantly longer because many of 'em are single moms working hard, work a couple jobs, taking one or two classes at a time. You know that's just fundamentally untrue. I mean, what we're trying to do is be as fair, equitable as you possibly can. The fact is some universities have greater challenges than other ones. So that's -- that's why that area of funding was included in this budget.

It makes no sense to do what you're doing here unless you're just going to go ahead and admit that you're going to prioritize one or two campuses to the exclusion of everybody else.

But I -- I talked to you about this before, but the graduation rate is significantly higher when you looked at six to beyond -- six to eight years to ten years. You know, look, we have two different schools - one, SIU, which is a major economic engine downstate, employs thousands of people who work there, graduates thousands of students, is significantly larger university. We're not treating different universities in a unfair way. SIU had an opportunity to get funding for a cancer center. This had an opportunity to fund 123 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/27/2015 financial need and services. Fact is SIU has a great research component within that. It was looked at as an important area. And then we looked at Chicago State as providing support and funding for people who were -- had financial challenges. The fact is, we're treating -- you can't, just like in a family, you can't treat every kid the same. You can't treat necessarily every component within the State budget the same and there's some areas that need a greater amount of focus and a greater amount of service, and that's what we're attempting to do here.

To the bill and I'll be -- I'll bring it home here. I -- I think the reality of the situation is that those single moms are just as important at any campus. Those folks trying to go back and better themselves are deserving at every campus. Every campus has specific programs, whether it's cancer research or post- genomic institutes, or whatever it is. Certainly all twelve have financial aid offices - that seems to -- ring very hollow. But here's the reality, and I go back to my opening comments earlier today when the first batter in the lineup was up, here we are trying to pretend that this is going to be a relatively small cut to higher ed, when everybody knows you're three to four billion in the hole. Where do you expect that money to come out of? It's going to come out of this and it is absolutely - I think at the end of the day - irresponsible to sit here and pretend you're at six and a half percent with no way to pay for it, because what's going to happen, it's going to be just like years past under Quinn or under Blagojevich, where you made a promise and then some of 124 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/27/2015 these reserves go in and they never get what they were promised. Schools wait. Universities wait. They don't get any of their funds. They're at six months behind, three months behind, nine months behind. Thirty-one percent - I can tell you, the Governor -- this Governor right now has done more to cripple the south suburbs of Chicago than any Governor. This is another example of this stupidity on behalf of the Governor - thirty-one percent cuts, shut down a university, where it puts all these people to work, allows moms to go to school. That's not the answer. The answer is to be responsible, to invest in our kids' future, and that's what we're doing. Thank you, Mr. President.

Yes, thank you. Thank you very much, Senator Hastings, one, for talking about the disparities in how we fund our institutions of higher learning. But what really caused me to rise on this occasion was just the misinterpretation and misrepresentation of -- of our universities, as if they're all the same - they are not. Chicago State University for the past hundred years has mostly been underfunded or unfunded. Just till a couple years ago, which every university had in our system, they had a convocation center, where kids can graduate out of the gym. They did not have a auditorium; they did not have a financial aid center; they just 126 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/27/2015 had a financial aid room. The graduation rates, which also were brought up by the good Senator on the other side, if he knows the formula of how you look at graduations, you cannot count individuals that transferred into your school as part of your graduation force, 'cause you have to calculate their four-year term there. Most of the individuals who attend Chicago State University are transfer students who have come back to go to school, and as -- as a neighborhood school, as a community school, it provides that service. Just as you can't compare to Governors State, which just became a four-year institution, so you can't look at their graduation rates and compare them to the U of I, to SIU, to ISU, or any of those other universities. So anytime that we use numbers and -- and put them and categorize them as the norm, we're doing ourselves a disservice and certainly those individuals that are matriculating through those institutions. And I ask for an Aye vote.

The proposed cut by the Governor in his budget sadly disinvests about three hundred and sixty-eight million dollars, a three-hundred- and-sixty-eight-million-dollar reduction in higher education at a time in the State of Illinois when we know, mathematically, when we invest in higher education, people are going to get the jobs 127 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/27/2015 that are out there. If you don't have higher education of a degree or an advanced degree or certification, the unemployment rate is twenty percent. But if you got a college degree, advanced degree, a certificate, an associates, it's close to six percent - six percent. It's a fourteen percentage point differential. So we need to invest in education. We did the best we could here to live within the means provided by taxes, but to make a decision to invest. We're not going to run a budget that doesn't invest in higher education. We're not going to run a budget that abandons people who need the help to get access to education. We're not going to pretend like these challenges don't exist. So support this budget because it gives us an opportunity to get people educated so that they can secure the jobs that are out there, so they can be productive and be taxpayers and grow - as you often mention - grow the economy. I ask for an Aye vote.

Senate Bill 2030 makes appropriations for the State Universities Retirement System, the 129 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/27/2015 College Insurance Program, and the State Universities Civil Service System. The total appropriation authority in Senate Bill 2030 is 1.607 billion all funds. This includes 1.417 billion GRF for the operation of the SUCSS and the pension payment for SURS. Bill also includes a hundred and ninety million OSF, which is the transfer from the State Pension Fund to offset the GRF contribution. This bill includes no federal funds. When compared to the fiscal year '15 appropriation level, GRF appropriations are increasing by 57.3 million. This is wholly attributable to the rising SURS pension costs. That's what it's attributable to. So, those of you who are paying attention, there's a reason why the costs are increasing. OSF appropriations are down seven million from a decrease in the appropriations from the State Pension Fund. More than happy to answer any questions you have.
