House Bill 114 amends the Juvenile Court Act of 1987 by requiring that 9  STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 120th Legislative Day 5/26/2016 the Department of Children and Family Services file case plans with the court every six months for minors who are in their custody. Currently, these reports are filed by a guardian or appointed legal custodian. Furthermore, it requires the Department of Juvenile Justice to file reports to the court dealing with any incidents the minor might be involved in which appear to cause a serious threat to the minor's life or well-being. The DJJ must almost submit reports detailing all youth released by the Prisoner Review Board, but remain in the DJJ facilities due to not having an approved aftercare release host, along with reports on those who have been in the DJJ facility for more than one consecutive year. These reports must be made available to the minor's guardian ad litem, attorney, or parent, if known. We do not have any opponents that I know of at this time and the Department of Juvenile Justice is neutral. And this a -- work of the Cook County Public Defender; Cabrini Green Legal Aid; community mental health, substance abuse (and) prevention providers; Safer Foundation; the Juvenile Justice Commission; and the Cook -- Cook County -- Public Guardian. And I would ask for your Aye vote.

Thank you once again, Madam President, Members of the Senate. House Bill 229 allows the McHenry and Lake County Boards to dissolve a unit of local government if a majority of the unit's board members are appointed by the county board. This is pretty much identical to what was done in DuPage County a few years back. The amendments include -- the first -- there are two exclusions. So one thing that will be excluded under amendment, I believe 4, is the conservation district of McHenry, and under Amendment 3, we're excluding the mental health board. I know of no objections to the bill. I'd be happy to answer any questions and I would urge for an Aye vote. This is something that we've negotiated for quite a while and it's a good bipartisan bill.

First, I'd -- I'd like to applaud Senator Bush. This initiative is -- is huge for the State of Illinois. This was a lot of work and I -- and I applaud all of your efforts. This is not an easy thing to do. Truthfully, we started with DuPage three years ago, we are now at Lake and McHenry, and there's no point and no reason why we should not be mimicking all -- both of those bills, the DuPage bill and these two -- and this bill right here, and be able to do this statewide. So I thank you for all of your efforts and I look forward to, as we move this, as a statewide initiative for every county in the State.

I -- I'd like to thank you for your comments, Senator Oberweis. I know we talked a bit in committee about why those exceptions are there. They're in McHenry County. I represent Lake County, where we made no exceptions. However, I should -- should indicate to you that the mental health board is created by voter referendum. So it was created by the voters. We really felt that - you know, I agreed - that that should be excluded because of how it was created. But I appreciate your comments and, again, you know, many times in order to get something to a place where we can vote on it, there's bipartisan work that goes on here, and there was -- you know, certainly, that occurred in this Chamber, work across the aisle, and -- and I'm happy with the final results. But I understand your question. But I would still urge an Aye vote from you.

And certainly government consolidation, as we all know, is an important thing that we need to do here in this State. And I also urge an Aye vote. Thank you.

This bill amends both the Labor (and) Storage Lien Act and the Labor Storage Lien Act {sic} Labor and Storage Lien (Small Amount) Act by inserting notice provisions for lienholders. In both Acts, the new language would provide that it is -- that an entity seeking to impose fees in connection with storing a vehicle in -- in its procession must provide a written notice to the lienholder of record prior to the accrual of such fees. Further, the notice would provide the rate at which the fees will be accrued {sic} (incurred) and give the lienholder an opportunity to inspect the vehicle. If the lienholder chooses to inspect a vehicle in the 27  STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 120th Legislative Day 5/26/2016 procession of a repair shop and ultimately pay applicable fees, the bill provides that payment may be made by cashier's checks, certified check, wire transfer, which is at the option of the lienholder. I also want to read in for legislative intent -- a question was asked about will this bill apply to repossession companies regulated by the Consumer Financial Protection Bureau, and the answer is no, that this will not apply to that part -- that particular organization. So, happy to answer any questions.

But right now, and -- and I know that people have tried this, all you have to do is get the VIN number off the vehicle and get on to the Secretary of State's website and that automatically pops up. What you're talking about is if it hasn't been processed right. We'll -- we'll look into that.

Yes, thank you, Senator, for that question. What -- what this really relates to is where somebody has dropped a car off to a repair shop, as an example, and then decides that they -- they really don't want the car and they walk away from it and there's a lien on that vehicle. What -- what this legislation specifically 30  STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 120th Legislative Day 5/26/2016 says is that the -- the tow truck company or the repair shop can send a certified letter, you know, once they find out who the -- by the VIN number, who the lienholder is - it's not the owner of the vehicle, it's the lienholder - and once they send that certified letter, the towing charges start on the day that that letter is sent. I mean, that's why it's a certified letter because there's a date on there. It's not when it's received, it's when that tow truck operator or that repair shop sends it, which guarantees them then that if that vehicle's recovered that they get paid for that -- that time. So it really is a -- a benefit, I think, to the repair shops and the -- and the tow vehicles. But they do have to find the hold -- the lienholder is by going to the Secretary of State's website.

Yeah, thank you again. I -- the -- the -- the time it takes to get on the Internet and -- and get into the Secretary of State's system. They may -- when they tow a car, you've got two parties involved here. One is the actual owner of the vehicle, the person that it's -- it's -- it's registered to. So, if they want to protect themselves, they -- they might want to do that as soon as they bring the vehicle in, to know who the lienholder is. And again, if they -- if they're ever suspect that they're not going to have that -- that car redeemed by the owner, then they can charge the lienholder by sending that certified letter. So I think it -- it -- it -- it means that they do have to send a letter, but it also means that they're guaranteed that -- that those charges start on that day.

These people are doing amazing work to help those who have been exploited by this terrible crime. Tragically, frequently, these victims of human trafficking, particularly those who've been forced into prostitution, are treated as criminals instead of victims and often they are convicted of prostitution, a conviction that hampers their ability to find work and create a better life for themselves. House Bill 2822 creates the Human Trafficking Task Force to address the issue in a comprehensive way. The bipartisan task force will be composed of Members from the House and Senate, a representative of the Chicago Regional Human Trafficking Task Force, who is appointed by the Governor, and the Director of the Department of State Police, or his designee. Administrative and other support will be provided by the Department of Human Services {sic} and the Department of Children and Family Services. The group has several objectives, including creating a data sharing network, a resource that will be vital to helping human trafficking organizations and law enforcement officers who work on the front lines. The task force will evaluate current procedures to create standards for more effective intervention, which will allow more lives to be saved and rehabilitated. The task force will be -- will create a much- needed strategic and comprehensive action plan to combat human trafficking in Illinois. Human trafficking isn't a partisan issue, it's a human one. This has been an honor to work with Senator -- McConnaughay on. I'm happy that this will be a bipartisan approach. It is one of those good issues that brings people together. Thank you. First of all, I would like to join with Leader Radogno first to congratulate her on her leadership in recognizing the contributions of our Muslim Americans. Primarily, I inherited a large portion of Leader Radogno's old district and now I have the highest population of Muslim Americans in my district, so I would like to join with her in recognizing some of the progress that we've made as a State in reference to recognizing our Muslim American citizens. In 2005, we passed Senate Resolution 178. It was adopted and it urged development of a list by federal agencies of safe charitable organizations, including Muslim organizations, that are safe for all Americans to contribute to without fear of prosecution and with assurance that their contributions would be used for their intended purposes. We also adopted House Resolution 438, which was identical to Senate Resolution 178, as well as -- also in 2005, we had the first Muslim in history of Illinois to do the Senate invocation in the Illinois General Assembly. We've been working on various initiatives over the years and I happen to have Marquette Park in my community, which a number - many actually - Muslim Americans reside in that particular community. And over the years, I've worked with Nia Hassan and Senator Collins to craft legislation and other activities just in recognition of the Illinois Muslim Action Day. There was an Executive Order of Governor Quinn that created the Illinois Muslim American Advisory Council. We've had the first Muslim Action Day, sponsored by the Illinois Council of Islamic Organizations of Greater Chicago, and we've had annual breaking of the Ramadan fast at the Governor's mansion. And so we could just go on and on and on about all the various activities that this Chamber has -- has worked on to recognize and -- and to acknowledge the vast wealth and the contributions that the Muslim American community has made to the residents of the State of Illinois. Step therapy is the process by which the patient tries other medications first 43  STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 120th Legislative Day 5/26/2016 before stepping up to drugs that cost more. It contains provisions relating to expedient overrides of step therapy, review criteria, and cost-sharing guidelines. This bill institutes step therapy override determination protocol and has been negotiated by step - - by stakeholders for the past two years and has become an agreed- upon bill. The exception process does not apply to the Medicaid program. And I'm happy to answer any questions.

The intent of this provision is to allow an individual that is currently being covered by a health insurance or health benefit plan and that is stable on a medication to stay on that medication for twelve months or until the plan renews. The intent is not for a patient to receive samples from his or her 44  STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 120th Legislative Day 5/26/2016 doctor's office in order to be declared stable under this provision. This provision was negotiated in good faith between members of the -- of the insurance industry and the State Access to Innovative Medicines Coalition and is only intended for patients who had coverage for the drug they're stable on under a previous or current health plan.

Thank you for the question and the compliment and the question that followed the compliment. My concerns primarily are these: vagueness; lack of clarity around what exactly this Community Reinvestment Program would look like; how precisely services would be delivered; what kind of transition plans would be in place; the question of do we or do we not want -- intend to retain a commitment that all individuals would be receiving the level of services 54  STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 120th Legislative Day 5/26/2016 they're currently receiving. On the one hand, that was said in committee and has been said publicly by the administration, but on the other hand, there's a claim that half the cost can be saved without reducing services, which seems - to be honest - almost magical to me. And additionally, the rules that were -- provisionally released specifically provided for the Department to create a waiting list, which seems to be exactly in contradiction to this concept of retaining services to populations already receiving them. So that's a set of concerns that I -- I feel very, very strongly. The second set of concerns that I feel is the -- a lack of readiness and a lack of a clear stakeholder input in the creation of this very significantly new and different from the status quo program in a way that would be, I think, possibly disruptive of services to literally several tens of thousands of older adults who rely on these services. Now I believe that the administration has good intent. I take their word seriously that their intent is to save money and create a more person-centered mechanism for service delivery. I would say, great, I'm for that. You're for that. I'd be happy to work with the administration to do that, but their intent so far, it seems, has been to go full steam ahead, intending to implement fully a program that's at best poorly explained to date, and I think that should be something that causes tremendous alarm on the part of every single Member of this Chamber.

For instance, as I said, the provisional rule explicitly calls for the creation of a waiting list.

Like I said to the previous speaker, I trust the Department and the administration's motives here. I think those motives are good. I think this program, as it's been described to date, is, to put it mildly, not ready for prime time. And so to say, yeah, we intend to retain services; oh, and by the way, it's going to cost hundreds of millions of dollars less; oh, and we'll have a person-centered approach that allows us to find resources already existing, but not currently utilized in creative ways - that sounds awesome, but these are tens of thousands of people who, as far as I can see, do not have before them any kind of clear transition plan. And so I would say the vote before you now is, do you think there's a clear transition plan that you're comfortable with? Thank you. So first to your previous point, the fiscal year starts in a month and a few days, and so, to me, that's really, really soon and, frankly, alarmingly abrupt. I think what you're talking about is, what if there is the switch made from the DON 58  STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 120th Legislative Day 5/26/2016 score to the universal assessment tool. I think there's broad agreement that we can do better in assessing need. I also think there's some pretty broad concern that the switch from the one assessment to the other would be kind of an excuse to throw a bunch of people off. And the purpose of this bill is to make sure that that's not what the switch is utilized for.

SENATOR McCARTER: Specifically to the bill, this is -- there is a transition plan within this and it doesn't make any changes to anyone that's Medicaid eligible. In fact, you say, well, there -- there's -- there's cost-saving. There's a lot of cost-savings in this bill, about two hundred million dollars. You say, well, you're going to take that away from people? Well, look -- look -- let's put it into perspective as to what we do as a State first of all. We provide three times the national average in services to non- eligible Medicaid seniors - three times. And the proposal is to go to 2.2 times. We still lead in what we provide non-Medicaid eligible seniors. And so here's the thing. You -- you want to fix a budget? This is how you fix a budget. You make tough 60  STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 120th Legislative Day 5/26/2016 decisions like this. You have a good plan, you make good -- you make tough decisions. Two hundred million dollars is within the Governor's budget. This is a reasonable plan. But if we're not willing to take on this small paradigm shift in the way we do things in this State, we're surely not going to save five billion. Is it uncomfortable? Yes, it's uncomfortable. Is some -- are there seniors…

Are they going to get less from us? Yes, they would, but I don't think that's too much to ask. We're not kicking anybody on the street here with nowhere to go. We're just saying we can't do as much for you as we've done in the past, going from three times the national average to 2.2, not down to the national average. We're still 2. -- we would be 2.2 times what everyone else is doing. We're still compassionate. We're still -- kind and we would be honest that this is what we have to spend. This is the kind of thinking that we're going to have to change if we're going to fix this budget. This is a start.

The speaker before that said, hey, this isn't about giving people less, this is about doing things in a more innovative, flexible way and maybe we'll save money, but more importantly, we'll be doing things right and flexibly in an innovative, modern way - isn't that better? I understand that point, too, but they're in conflict with each other and they illustrate how little clarity we have from the administration about what this program would be and how it would work. What we do have clarity about is that it's in the Governor's fiscal year '17 budget plan and that starts in five weeks. There are tens of thousands of seniors who currently rely on this program. If you don't feel clarity, if you don't feel certainty that what's planned is ready to be rolled out and provide appropriate services that those tens of thousands of older adults have been relying on, starting in five weeks, then I would ask you to please vote Aye.

This bill is doing the equivalent rate on this hospital assessment to apply it for the new ACA population. It will generate seven hundred and fifty to eight hundred million annually and we will also, in addition, get a hundred and fifty-three million of funding for the State for healthcare services, which, when matched for Medicaid, will bring in over three hundred million of additional funding for our Medicaid program. The payments will also fund the State's share, the five percent of the ACA in 2017 and the six percent share in 2018, and restores three million in State funding for the Illinois Poison Center. Very much urge an Aye vote. I think this is incredibly helpful to our Medicaid program.

This was generated by Representative Gordon-Booth in the House. 103  STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 120th Legislative Day 5/26/2016 The genesis of it was that two years ago, on May 24th, her son was murdered in the early morning hours. And I remember -- I remember the day that it happened because it was also the exact same day that I graduated from law school. She was going to surprise me at my graduation and texted me very early in the morning to say she would not be able to come because DJ had died. It was every parent's worst nightmare. This was her stepson, who she was very close to and the family was close to. This happened also a few weeks before she had that beautiful little girl that you guys see running around on the Floor all over because I'm her godmother. So, Representative Gordon-Booth is not my sister by birth, but we have become very close, and so this is a -- an issue that means something to a lot of people. Many times in a situation like that, you have to have an eyewitness that directly ties -- direct -- gives you a direct nexus to the crime at hand. You know, we have a Crime Victims Compensation Act which allows for compensation for victims and their families, but this would expand to include a witness that was a personal witness to the thing when they testify on behalf of the State. Representative Gordon-Booth negotiated this with both the State's Attorneys and the Attorney General to make sure that we wouldn't be depleting the fund, but we would make it possible for -- in that particular circumstance, there was an eyewitness. There were a lot of people at the party. But this young woman was so afraid she picked up her four kids and moved them three or four states away, and it was difficult to get her to come back and testify. We were able to get a guilty verdict and life goes on, but for many families in this situation that's the impetus behind this bill. So I would ask for your support. I know many of you have met her and know her. This is a Member 104  STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 120th Legislative Day 5/26/2016 initiative. The White Sox Caucus will be gathering at 7 o'clock at DH Brown's to watch the "still in first place", "barely in first place", White Sox take on the Kansas City Royals. All are welcome, particularly Cardinal fans. And if I can, I want to channel my friend, Senator Haine, and quote from an ancient proverb that might inspire Cardinal fans to join us tonight. That proverb is "The enemy of my enemy is my friend." So I'd like to see everyone tonight at DH Brown's.
