Yes. Thank you, Mr. President, Members of the Senate. This bill, as amended, is in response to the Secretary of State's decision, due to the budget impasse, to stop mailing registration reminders. The bill prohibits the Secretary of State from imposing a delinquent registration renewal fee while the office is not sending registration renewal notices to vehicle owners and allows the expiration of vehicle registration during the period where the Secretary is not sending these notices to be an affirmative defense to a citation one month after the expiration of the registration. And at the suggestion of Leader Radogno during Executive Committee, we adopted an amendment that sunsets the provision of the bill on June 30th, 2017. However, if the charter's renewed by a State Charter School Commission, the charter may only be renewed up to five years. The bill also increases the amount that charter schools may receive from the Charter School Revolving Loan Fund from {sic} (for) startup costs from two fifty to seven hundred and fifty dollars per pupil. This is something that has been worked out. I -- I -- everyone became neutral after it was -- they sat down and talked and negotiated with the Illinois Network of Charter Schools. This is an 34 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 122nd Legislative Day 5/29/2016 initiative of the Illinois Retail Merchants Act {sic}. It does a few things. One of the things it does, it extends the sell-/use- by date for grade A eggs from thirty days to forty-five days. Currently, forty-three states allow the forty-five-day date for grade A eggs. It also extends the sell-/use-by date for grade AA eggs from fifteen to thirty. Currently, forty-two states allow the forty-five days for grade -- grade AA eggs. It also implements egg lot consolidation in Illinois. Egg lot consolidation consists of sorting undamaged eggs from cartons that also contain damaged eggs to build complete and sellable cartons. The cartons must be from the same brand and the eggs must be from the same lot where they were graded, inspected, sized, and stamped at the same time, therefore maintaining the same identity so that the -- the -- the egg can still be tracked back to that lot and brand. Forty-one states currently allow retailers to implement egg lot consolidation program. And I would just note, while the Farm Bureau is listed as an opponent, there are members of the Farm Bureau that are in favor of this bill. And I would just close by saying this is an "eggcellent" bill and I'd ask for your Aye votes.

Well, Senator, you and I, and I think most people in this Chamber, have a good relationship with the Illinois Retail Merchants. Are they, in your mind -- I mean, have you ever known them to be egg experts?

I don't know if I'd classify 'em as egg experts, but they are in the business of monitoring retailers who sell, buy, and produce eggs.

Thank you very much, Mr. President. Senator Mulroe, you talked about egg lot consolidation. I need you to help me with that. How many eggs in a lot?

Can you give me a ballpark of what you're talking about?

I don't -- I'm not sure of the lot size, but the cartons, that they can contain up to as many as thirty eggs. So where they -- how they actually -- that lot size, I'm not a hundred percent sure, but it's greater than thirty. It just -- I guess when you're producing eggs, just picture a lot of eggs coming from the same - - same place and they're graded and they're examined the same way and then they're sent out to our -- our retailers.

How, Senator, would the person at the grocery store know whether or not a particular egg came from the same lot? I mean, are the eggs stamped? Is there a decal on them? How would they know?
PRESIDING OFFICER: (SENATOR HARMON) Senator Mulroe.
The -- actually, this bill goes farther than any of the other states in terms of training employees how to deal with this situation. So they require employee training. The bill requires a one-year record retention requirement on all cartons that have been consolidated. And it provides -- well, it provides an in- state exemption or opt-out for -- Illinois farmers who don't want to be part of the -- of the consolidation efforts. So there's nothing on the cartons that would identify it as a carton that was consolidated. That was contemplated. We talked about that. But imagine a red dot or something on a carton of eggs - it would obviously deter the -- the person who's buying the eggs from, you 38 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 122nd Legislative Day 5/29/2016 know, buying it, in my opinion.

Last question, Mr. President. Thank you for your indulgence. Senator Mulroe, is there anything in the legislation that would require that the grocery store employee wear gloves while they are picking eggs up and moving them around from lot to lot? I mean, just kind of a…

I'm not aware if the actual bill requires the employees to - - to wear gloves, but I would point out, our largest producers in Illinois - and I can name them for you - Midwest Poultry, Dutch Farms, Rose Acre Farms, are actually for this bill. So there are members of the Farm Bureau that are against it, but there are -- our largest producers in Illinois are okay with this bill. They're satisfied with the safety requirements and the training and the handling of the eggs.

Thank you for bringing up this bill. This is one of those bills that when people back home heard about this, they said, are you serious that in Illinois you have a law that says if you have a cracked egg in that carton, you've got to throw the entire carton away? That's just one of those people just can't believe that that's even -- even the place. And currently the law says that - - so if it's -- if -- if an egg is cracked, you have to throw out the entire carton because it's not safe enough for the consumers to use, but it's okay for the store to use those same eggs in their own bakery. Is that correct?
PRESIDING OFFICER: (SENATOR HARMON) Senator Mulroe.
That is correct. We heard testimony from the Farm Bureau that said it -- one egg could be bad, they'd want to throw away the whole carton, because they consider that a safety concern, but then they came right back in the next sentence, but -- saying that they could use that in their own bakery. So they consider it unsafe for consumers, but not unsafe for their bakery, which is a little confusing. And they also said they could use those -- those eggs to give to food pantries. So, that's caused me some concern as well.

Then the -- the other question was, during the -- the issue about the fifteen extra days that forty-three other states currently do, that really wasn't an issue of concern from public 40 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 122nd Legislative Day 5/29/2016 health individuals or even the Farm Bureau. I don't think they raised that even as an issue. I don't think anyone disputes that this extra fifteen days is fine. That's not a -- a health hazard at all. As far as I know, that was never brought up, was it?

Senator Syverson, you're absolutely right. The Farm Bureau did not raise that as a concern. I can only assume it was not a concern. It -- this bill is also -- there's no opposition by, as you said, the Department of Public Health or the Department of Agriculture.

And last point. The retailers, I would submit that they do have an awful lot of training, probably more training than most when it comes to handling food services, because that's their livelihood. That's the -- that's -- anything that happens at that store is going to have a reflection on that company's future. So the idea that they would have -- do anything that would jeopardize the safety and the health of the -- of the people that go to those stores is just -- won't be the case. And as you mentioned, the training standards here are -- far exceed what other states do and it almost gets to the ridiculous point, because all of us have bought {sic} home eggs that were cracked. We never threw out those eggs because one was -- was cracked. The idea that we're overly -- I think this bill goes too far when it comes to actually common sense in dealing with eggs, but I know that you tried to go as far 41 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 122nd Legislative Day 5/29/2016 as you could to help the Farm Bureau. So I appreciate you passing this extremely commonsense bill and I hope -- I certainly would encourage all green votes on this. So thank you, Senator.

It might surprise no one in this Body that at a much younger age, I worked in Oberweis Ice Cream stores and, guess what, we sell eggs. And I can tell you that every once in a while somebody handles a dozen eggs in a way that is not the safest and an egg breaks. I will tell you that on many occasions when that happened, we saved the other eleven eggs. We did not want to waste them. I would combine them into a dozen. This seems absolutely crazy that we're debating whether somebody can save eleven out of twelve eggs when one breaks. For heaven sakes, we have serious things to worry about, serious things to solve our budget mess. Please don't tell people they can't save eleven out of twelve eggs in a dozen because one broke. I strongly urge an Aye vote on this now.

It amends the human care -- Humane Care for Animals Act. It prohibits an owner of a dog or a cat that's a companion animal from exposing their dog or cat to extreme heat or cold conditions and, we're adding with this bill, that result in hypothermia, hyperthermia, frostbite, or a similar condition as diagnosed by a vet. This is supported by the Humane Society and the Animal Welfare Institute, the Animal Protective League, and we worked out an -- an agreement with the Farm Bureau, the Department of Agriculture, and the Cook County State's Attorney. This is an initiative of the Illinois Student Assistance Commission. The goal of this legislation is to provide consistency by reflecting the language used by the -- the IRS language for prepaid tuition across the country and allow students here in Illinois to be able to use their prepaid tuition dollars in trade schools and other institutions across the country. That is actually the institution that does the investigation in this regard. So the IRS definition is -- is simply how it applies to what -- Section 529 at the federal level and the evaluations that they do.

So you're telling the Senate that the IRS will not be able to rummage through Illinois citizens' records to determine if they meet the tax deduction requirements under the law?

But it certainly is substantially better than any of the other funds that we've been talking about.

So this bill gives us more tax deductions, increases the scrutiny of the IRS, unfunds or keeps current an unfunded actuarial liability, and you're asking us to vote for this when we have thirty-two billion dollars in income and thirty-eight billion dollars in obligations? I looked at the sponsor and he just looks like he thinks he has an "eggcellent" bill here. But it's taking money out of the State. There's no evidence-based formula and, as Senator Syverson pointed out, this is just a Chicago bailout. And I urge that everybody vote No on this bill.

I'd like to ask her to stand. The young woman, formerly known as Christine Szukalla and now she's known as Christine Clark -- first off, let me tell you how honored I am. There's so many wonderful speakers here on the Floor and Mr. Tyler Clark over here has asked me of all people to introduce Christine to us this afternoon. As many of you know, Governor -- or, Tyler is our Governor's Senate liaison, otherwise known as our boss here over on the Republican side of the Floor, but we're here to talk about Christine and so -- I might have just gotten myself in trouble. Christine is a second grade teacher in Skokie, and we -- we love teachers and so we appreciate that. She's also a former volunteer of mine, which I've recently learned; she helped out on my campaign. Yeah. She's nodding. She remembers walking some precincts. She was very kind enough to lend Tyler to my campaign and, of course, we very much appreciate that. And so I just wanted to extend -- oh, and I almost forgot, Christine is, in about a month and a half, going to hit the -- the one-year anniversary of her wedding when her and Tyler got married. Thank you, Madam President, Ladies and Gentlemen of the Senate. Several years ago, the General Assembly by statute told Medicare providers that they needed to retain their records for six years. Recently, the Department of Health -- Healthcare and Family Services began trying to recover amounts of money relating 60 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 122nd Legislative Day 5/29/2016 to overpayments or missed payments, in some cases dating back ten, twenty, or even almost thirty years. This amendment is an attempt to strike a balance and has been agreed to by both nursing homes that provide under Medicare and the Department and the State Police. A -- a six-year look-back on efforts to reclaim overpaid moneys and whatnot with the understanding that in certain circumstances, where either there's an active investigation or in an -- an effort by the federal government to recoup moneys, that would toll the six-year period. So with the amendments, I'm not aware of any opposition and I ask for your Aye votes.
