It does really some small things, but large steps for women that are incarcerated. What it does, it amends… it makes two legal changes. It creates a mechanism for postpartum depression and postpartum psychosis to be considered as mitigating factors at sentencing and allows for an individual to seek new sentencing hearing if postpartum depression and psychosis were not considered at sentencing. And there is material and noncommutative evidence not presented at the trial or sentencing. I will take any questions."

"I certainly have. DNR would say and they have said that they regulate the taking of animals through the permit process. In my opinion, and I think if you look at it, using a crossbow is more ethical. A lot of times… many times people who use a longbow don't practice enough and they end up wounding a lot more animals. A crossbow is typically more accurate. It has the action of a gun, has a scope and trigger. So, in my opinion, it’s a more ethical harvesting of game."

"Representative Costello, the whole idea about giving crossbow hunters a season and the opportunity to hunt has been around a long time. A matter of fact, one of the first Bills to allow crossbow… crossbows to be used was my Bill because it had to do with someone that couldn't use longbows anymore because he had an injury. And at that particular time, all of the sturm und drang came out about crossbows. People were saying they had the same and the mussel velocity as rifles and all of this kind of stuff. "Sure. So, again what I would say and what DNR would tell you is that they regulate the harvesting of animals through the permit process. And that’s how that they make sure that not too many animals are hopefully taken. What I would tell you is the crossbow, what it does and especially for whether its younger people or sometimes a lot of women who like to hunt have a problem pulling the 40 pounds of a longbow, and so therefore, that’s an issue for them to hunt. Crossbow allows them to get out into the field and to hunt as well."

"And there's no evidence that you’ve seen that said that because crossbows were allowed having their own little season or whatever the case may be that the cull of deer increased by some great margin?"

"So, I… this is something that to be honest with you, I've worked with them probably for the last three years on. And we've put off running this Bill for a couple of years as Representative Phelps just told me, actually longer than that. And we got to the point where we viewed it as it was time to run the Bill. So, we've probably worked with them for at least five years."

"Thank you, Mr. Speaker. To the Bill, I want to compliment Representative Riley and Representative Costello for bringing this. I had this Bill many years ago and tried to talk to all the groups and they just more or less said that the crossbow was going to create more permits, which we're not, we're just giving the hunter the option of what weapon, if you want to call it, to go out there during bow season to use. The groups that Representative Hammond just asked about that said they were against this, they're saying the crossbow is not traditional. Well guess what, neither is the compound bow. So, if we all want to do that and get traditional, we can go back to the recurve Bill… bow and I don't think people want to do that. This just gives the hunter an option. It doesn’t create more permits. A great Bill, great for the sports men and women. Thank you, Representative Costello. "Well, why do we want to enhance, use a penalty in the law that was made specifically for school grounds and this crime would be enhanced if you're caught with drugs on the school grounds, but now it's no longer an open school, the school has been closed. In Chicago, we've had 50 some-odd schools to close and so I don’t want young people who are guilty of making an innocent mistake or silly mistake that will cost. I don’t want them to be impacted by this for the rest of their life and the school was closed. "So, this Bill only removes the enhancements… the penalty enhancements because that risk… that public safety risk of children being present at this time, either because the school is closed or it's after school hours, that risk is not present, correct?"

"All right. Thank you. To the Bill. I would support this measure. The purpose of the penalty enhancements while children are present or the school… on the school grounds, this Bill specifically considers that this would not be the case; and therefore, the penalty enhancements would not be required and would also insist in making sure that young people would not be burdened with an additional enhanced background that could keep them from having other opportunities in the future. Therefore, I vote… I also urge an 'aye' vote on this Bill."

"Thank you, Mr. Speaker. To the Bill. And I can't say it any better than the previous speaker did. You know, we have added a lot of these penalty enhancements and aggravated factors and truth-in-sentencing and mandatory minimums at a time when, you know, we did not have the research to show us that they… they, in fact, do not act as a deterrent and they do not stop the behavior. All they do is pile penalty on top of penalty, and in fact, result in a decrease of public safety rather than the increase in public safety that we anticipated 10000034.docx 27  STATE OF ILLINOIS 100th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 34th Legislative Day 4/5/2017 when… when this Body passed those items. So, I think that… I think the previous speaker, again, spoke very eloquently to the fact that all this does is take away a penalty enhancement. It doesn't remove a penalty. It just takes away a penalty enhancement when the risk to the public is no more on a school ground than it would be in a parking lot or… or at any other location where, you know, folks might be gathering. So, again, there's nothing to… there's nothing to indicate that all these penalty enhancements deter any behavior whatsoever. So I think this makes perfect sense to remove this. It's a small step, but it… but it makes perfect sense to do this when there is absolutely no difference in the public safety between a school where there's no children present and a parking lot, you know, where someone might be selling cannabis. I'd urge an 'aye' vote."

House Bill 514 as amended creates a streamlined process for immediate sealing of records of criminal charges with the exception of minor traffic offenses. So, when a defendant is acquitted, found not guilty of the charges, the charges are dismissed with prejudice. When the record is sealed that means it is not in the public record and is not available for the public without court order. However, the records are still physically and electronically maintained and are still available to the courts, law enforcement agents, and certain entities permitted by law. A petition may then be brought by… by a defendant, their attorney, or the State's Attorney, or the Department of the State Police immediately at the time of the trial or case. There is no opposition. There are proponents. The proponents are the Clerk of the Circuit Court, Cook County Clerks, the ACLU of Illinois, the Cook County Public Defenders. There is no opposition. I worked with the opposition. This Bill was before us last year and didn't pass. What I did do was I added the feedback for the petition and I also allowed for the State's Attorney or anyone to petition the… the filing. I ask for a favorable vote for House Bill 514."

And I think any one of us in this room, if we had been acquitted of some act, some criminal offense, we would want to be able to seal that record so that we could go on with our lives without having to give an explanation, without having to tell someone this is what happened and this is how I have been wronged. So, this is one very simple way to say that when someone has been acquitted let's get that process started immediately so that they can move forward. This is not an effort to try to cover up something; this is not an effort to try to say that a person should be… should not be penalized. Now, before you say, well, there are lots of crosswalks all over the state. These are not normal crosswalks. This Bill only applies to crosswalks which are marked by a new type of device the Department of Transportation is using called a rectangular rapid flashing beacon. They're big yellow lights. They're marked with yellow signs. If you miss this one, you're ignoring the pedestrian in that crosswalk. So, the Bill tightens the penalties for… for violation of… of that crosswalk only marked by these special rectangular rapid flashing beacons. I'll be happy to answer questions. The device is approved in the… what's known as the Manual of Uniform Traffic Control Devices, the MUTCD. When you think yellow, what do you think? You think, oh, I've got to slow down."

"Right." Harris, D.: "If you… if you see red, you say, I have to stop. So, the… the… our… my community in Mount Prospect, where this accident occurred, people say that device ought to flash red. I happen to think they're right; however, the Department of Transportation cannot change the color of the light because it's approved by the Federal Highway Administration. So, are they being used all over? No. They are being used infrequently in the State of Illinois by IDOT. And I think there's a question as to whether or not they're going to use them anymore because of the confusion regarding the lights."

"So, then, what is the rationale as to why that particular signal should be in that particular crosswalk?" Harris, D.: "Because it's so… it's not part… it applies only to where IDOT uses this signal. It could be self-described. And veterans want to be able to get the help that they need and this Bill does exactly what the task force laid out. So, if… if individuals in this chamber want to vote against preventing veteran suicide then by all means you can make up any excuse you want. But the bottom line is, I am committed to addressing the fact that we should have zero veterans in Illinois commit suicide. This is the path to do it. This is the way that we culminated from a year working with the State of Illinois and I know that my colleagues on this side of an aisle share that view and they are committed and they are against and they are going to fight to make sure that no veteran in the State of Illinois feels that they need to take their life. "Thank you, Mr. Speaker, Members of the House. HB2990 is modifying the Code of Corrections to help our state reach the Governor's goal of reducing our prison population by 25 percent by 2025. Many of us are aware of our awful 45 percent recidivism rate and our high number of technical parole violations. This Bill's not only addressing who parolees associate with but how they associate with others. This Bill is seeking to add sensible, commonsense judicial protections for parolees no matter who they associate with under two conditions. One of those conditions is when they are engaging in prosocial, positive activities. These are activities that benefit them that help them to continue to rehabilitate. The other's a provision regarding criminal drug activity. The provision is providing a protection to parolees when they're around drug activity, but they're unaware or don't know about such activity and they haven't demonstrated any criminal intent or involvement. A third of our… a third of our parole violations are technical parole violations. This is a serious, serious issue. The Chiefs of Police are neutral as well as the State's Attorneys. IDOC is also neutral. The Governor's Office is also neutral on the Bill. I know of no opposition. House Bill 1804 is a Bill, a contest I've worked on for several years, but with the cooperation from the good folks at the Illinois State's Attorneys Association, we've been able to come up with language that will work. As we've worked through a great deal of our criminal justice reform, we've often commented on the issue of what happens to the guy that got sentenced on the day before we changed the penalty for a particular crime. So, what we've… what we're doing in 1804 is creating a possibility to seek a resentencing hearing for someone who is currently serving a sentence on a crime that we have changed the penalty for… lessened the penalty for so that they might get the same… they have an opportunity to argue for the same treatment that the person who was convicted on the next day was… was afforded. And I… I have… there's no opposition. As I said, we worked in concert with the State's Attorneys Association to come up with language that… that took care of their concerns. There are no objections to the Bill at all. I ask for an 'aye' vote."

"That was something that we discussed in our dealings with both in committee and in our dealings with the prosecutors. The reality is we're not changing penalties for crimes that carry lengthy sentences. So, it was hard to put a pin in the right amount of time. And it… through our discussions it became clear it really wasn't terrifically relevant given that the likelihood of changing sentences for things with extraordinarily lengthy sentences wouldn't happen and given that prosecutors have an opportunity to object, this only happens with the approval of the prosecutor, it became not relevant to put that time frame in there."
