"Thank you, Mr. Speaker. This Bill will seem familiar to many of you. This Bill provides for… it deals with MS patients and the ability to procure physical therapy services when prescribed by a doctor. In 2007, the Illinois General Assembly passed a Bill requiring insurance companies to cover physical therapy for MS patients because, if you know anything about MS, you know in many cases there is no treatment and of course, there is no cure. So, physical therapy is the only option for many patients. This Bill will eliminate many of the barriers that have been imposed by insurance companies that will limit patients' access to this treatment. And I will note, you can only get physical therapy services if, in fact, they're prescribed by a physician. So, that’s always a safeguard there to ensure patients don’t get more than they need. "But again, this is very… I would make it an analogy to a prescription medicine. For patients that have absolutely no treatment, physical therapy is, in fact, the only option for them, not only to improve quality of life but to address potential injury, injury prevention. It actually saves costs in the long run in addition to addressing quality of life issues. So, what we've done as a Body is, provided that MS is different than other conditions because it does have this direct correlation with benefit to the physical therapy option. So, it's just… I would say it's more like prescription. And if your doctor prescribes it, the insurance company should cover it."

"Sure. As a practical matter, what some of the insurance companies have done is, reported by patients, is put a cap on the amount of physical therapy sessions that a particular patient could avail themselves of. For example, a patient may get 30 physical therapy sessions covered. Well, the doctor may say you need to go to physical therapy weekly in order to find benefit and success. So, patients, what we're finding, patients that are unable to provide for a physical therapy expense themselves are kind of rationing their physical therapy. So, even though their doctor has recommended they go every week, they're going maybe every other week. And it's just not been a good thing. Again, because of the lack of any other treatment options for these patients. And in fact, it's a big deal for injury prevention these patients… if you know… I'm sure you know about MS and… and the devastating impact it can have on mobility, et cetera."

"You know, we had this same discussion. This is the Bill's second or third year in the mix. And there's some debate as to how it's covered under ACA. "You know, I did some research on this yesterday because that was a question that came up in committee. And all states structure their insurance programs so differently it was hard to make a apples to apples comparison. It's really more about what… how they handle physical therapy. In some states, it's what's called direct access where you can procure physical therapy services directly. Actually, for this Bill, I think that you can argue that that makes it… there should be a higher comfort level because, again, in order to get physical therapy you must have a physician's prescription. So, I would argue that if you're an MS patient and you get a prescription for physical therapy, you need it."

"Yeah. I really don’t understand why… I did meet with some of the proponents of this Bill who very articulately talked to us about how this was ve… our laws in Illinois were quite arbitrary in that this therapy is actually very, very helpful, is it not? It's often corrective. Can you explain that a little bit?"

"Well, there's two types of MS. The first is relapsing remitting and that provides… the course of that disease is what… you know, what the name would suggest. You have episodes and then you have, sometimes, a period where you go back to normal, sometimes not quite. But the physical therapy is the only option for the type of MS called progressive… primary progressive. And that's a disease that… that's a condition of the disease that progresses, again, as the name would suggest. So, there are numerous MS drugs available and the advances that science has made are quite stunning, but again, that only applies to the relapsing remitting form of MS. So, for progressive MS patients, this is the only option. Again, quality of life, injury prevention, and many other things that I believe save money in the long run."

The patient groups are not on board with the version that's passing out of the Senate unfortunately. The Bill was negotiated but it was kind of… the patients were negotiated right out of it. And that's… that’s, I think, the problem with that piece of legislation. So, we're happy to keep discussing the Bill. It's certainly not in perfect form. It may not be in final form, but it's definitely a way to keep the patients in the conversation."

And I think that you've done… this is certainly not the first year you've sponsored this and I know how committed you are to it. So, I want to take a moment to talk about civility, respect, professionalism, and decorum. Civility is defined as formal politeness and courtesy in behavior or speech. I hope, starting here today, 'cause it hasn’t happened so far this week. I hope, starting today, we can treat each other with civility and respect. "I would like to personally discuss the events of this week. It began when the women decided, and some of our male colleagues decided, that we would join our constituents, we would join members from across the State of Illinois outside at the Illinois… Illinois Women's March on Springfield. We left to go and to champion things that were related to equal rights for women, labor standards, economic policy, family concerns, criminal justice reform, issues that address the homelessness that occurs in our state. And when we did that, 10000041.docx 15  STATE OF ILLINOIS 100th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 41st Legislative Day 4/28/2017 of course, you know, there was some contentious debates going on, on the floor, verification was called and we were attempting to come back into the chamber. But we decided to first stand in solidarity with Leader Feigenholtz as she gave her speech at the rally to the hundreds of people gathered here as citizens. Then, later in the week, we saw such discord and disrespect and condescension when Representative Moeller attempted to pass her Bill related to equal rights and equal pay for women in the State of Illinois. And then we go to yesterday when my own roommate, my colleague, my seatmate was attempting to bring back dollars to the schools that struggle in her district, demanding for TIF reform, and she was asked a question and as she attempted to answer her question, she was cut off, spoken over, and her voice was completely silenced and disregarded among… about the issue that she cared most about in her district. And I don't want to say that I'm speaking for any of those women, I can only say that being a witness to all of that this week and being a woman, and also being a woman of color, I am deeply, deeply hurt by some of the interactions that I've seen throughout this week. It's not that those interactions have not occurred before, they've been actually quite subtle, but this week was at an all-time high. I want to ask that we all decide that we will treat every person in this chamber with courtesy, respect, civility as Representative Welch just eloquently stated. But I can't stomach being here when such disregard occurs. And… and in this example, I only spoke of what I deemed to be institutionalized sexism. I am not making any specific, you know, statement for anyone to say, well no that's not me. I'm not that. But please look at what those things mean. Institutionalized racism. Institutionalized sexism. Subconscious racial bias. Subconscious sexist bias or gender bias. And please try to figure out ways that you cannot feed into that. I thank you for your time today. I stand here in solidarity with the women in this caucus, with the men in this caucus, and also with my colleagues across the aisle. We simply must be civil with each other. Thank you."

I know as Floor Leader that's part of your job, but I needed you to hear it from me and from this caucus that you are not the person that we are talking about, Sir. The way on the other hand, and he's a friend of mine and a fellow graduate of a Catholic school, that the Leader treated Representative Moeller the way that Representative Ammons was treated on her Bill, that is the behavior we're talking about because that is not the way that individual would question another Member or has in the past. That is not the tone that would be used by that Member to question other Members. That is what we are calling out. So, respectfully, Sir, you have done a fantastic job. I am proud to call you a colleague and a friend. You, Sir, are not the person we're talking about. I hope that everyone, on both sides of the aisle, will use your example as the way to be a Leader on this floor. Thank you, Mr. Speaker."

"I think as we are finishing up today, which will probably be a very long day, many of us are here because we are passionate about what we do. We would not be here if we were not leaders in our own right. We would not be here if we were not passionate about things in our own community, but it is important to keep that civility out there. I think Representative Mitchell was very eloquent and I was going to… I'm going to second his thoughts on that. Floor Leader Andersson, you do a wonderful job on your side. You are a fair individual. You are very good at what you do. But we also know that there are times when we all are contentious and we are passionate about our own Bills. Sometimes we're passionate against somebody else's Bill. We can go and bring that passion out but continue to remember that we are all individuals. We are all doing the best we can here. We all have a purpose here and we need to be respectful. We often are respectful when we go and have dinner together afterwards, but we need to be respectful and watch that center aisle and work across it continuing that way. We haven’t always seen that here and it's not necessarily from you, Sir, but there are certain Members that take it beyond passion. And that's what we need to be careful about. You can be passionate but you can be respectful. We can agree to disagree on things, but remember, at the end of the day, we are all doing what we feel is the right thing. So, I urge you all to choose your words wisely as I oftentimes told my students and tell my children. Make sure that we, at the end of the day, can look each other in the face and still go on and do what we want to do. And the prob… the issue isn't that this is… that they are amusement parks and they should simply be regulated under amusement park regulations. You know, the other piece with amusement parks is that that they also do background checks on employees. And that's a requirement in the… in the amusement park regulations. When I went to the Depar… the Department of Labor came to me and said we have been looking at this issue for a while and thank you for putting this Bill in. It just gives us a little more impetus to move legislation." Wheeler, B.: "So, you had a conversation with a doctor because he had patients coming from the trampoline parks that had injuries. How will this… by regulating, what sort of regulations are going to keep the… the children safer?"

We simply moved it into the amusement park regulation part of the… of the law, but you know, I'm hoping that they do things like make sure that they have enough adult spotters per children… per child in these parks. So, six years ago at a small indoor amusement park in my district, a three-year-old boy got on an indoor kiddy rollercoaster, stood up in the rollercoaster, fell out and was beheaded. If you're worried about too much regulation, a three-year-old boy at an indoor amusement park fell out of a rollercoaster and was beheaded. Okay? So, the Department of Labor was called into question and said where are all of your inspectors that should be inspecting these amusement rides? And we found out, there were five in the whole state. Yes, our budget problems in Illinois had reduced the number of safety inspectors to five to inspect every amusement ride in the State of Illinois. So, in an initiative of the Department of Labor that was, get this, this was in conjunction with the amusement industry, we passed a Bill that was agreed to and went out on broad bipartisan support that created a fee structure specifically to increase the number of safety inspectors so that children that ride on amusement rides could… we could be… we could do a better job of assuring their safety. This Bill is taking one new craze, trampoline parks, where there is a history of injury and all it's doing is it's adding them to that Bill. This is a good idea. We should all be in support of this. If you don’t like regulation, that’s fine. But then turn to all the parents in your districts who have kids that get on rides and tell them that we're going to do away with all safety inspections 'cause that's deregulation, but leaving one person out of an Act or one type of amusement ride out of an Act makes no sense whatsoever. So, please remember that young three-year-old boy who died in my district when you think about voting this. As a state, we knew… we need to do what we can to protect our residents. According to the polls, the two most appreciated parts of the Affordable Care Act include keeping your children on your policy until you're 26 and having coverage for preexisting conditions. Illinois is ahead of the curve… Illinois is ahead of the curve because in Illinois it is in our statute that we can keep our children on our policies until they are 26 years old. Now, we need to take the next step and ensure residents who have a preexisting condition can afford their health care. Prior to the Affordable Care Act, these preexisting conditions ranged from everything from arthritis to sleep apnea to cancer. Being on medication for autism, angina, or anemia could also eliminate you from coverage. This is ess… an essential Bill that will allow people in Illinois with a preexisting condition to get the health care coverage they need. I ask for your 'aye' vote."

To give you some background, since 1988 all Illinois dwellings have been required to have smoke alarms or smoke detectors in them. Technology since then has changed and unfortunately, what we find is, in some of the older buildings smoke alarms are being disabled because of that annoying battery that beeps and gets in there. And people are taking the batteries out for other things. We have found that, unfortunately, Illinois ranks second in the most numbers of residential fires. Certainly in 2017. We had 42 deaths since January on smoke… fires in residential residence. This Bill will hopefully cut down those deaths by putting in a much more efficient smoke alarm into homes. We're asking for a smoke alarm that is a self- contained battery smoke alarm. So, what this Bill essentially does, it prohibits hospitals from enacting what appeared to be do not admit lists that they are… that are kept to sometimes suggest that if a… if a individual has presented themselves numerous times at a hospital or they may be difficult patients, hospitals unfortunately maintain lists that they will not admit an individual. So, this is essentially designed to prohibit those lists from being enacted. But again, allows flexibility that if someone presents at a hospital that there is an opportunity for that doctor to find the appropriate place for them to be cared for, if neces… if one becomes available."

The State of Illinois support for higher education has been cut by 1.39 billion or 41 percent from fiscal year 2000 levels when adjusted for inflation. "Thank you, Mr. Speaker. To the Bill. This legislation is extremely important. Given the current state of affairs in a lot of our districts in relationship to people with severe heroin addiction and many who may have unfortunately been sent to prison for that heroin addiction as opposed to sending them to a rehabilitation center. So, there are thousands of Illinois residents who have had unfortunate addictions that have led them to do things that many of us would not think thinkable in a clear state of mind. But this Bill does change eligibility for those who come out of institutions with little to no resources or support. And because of the implication of policies, purposefully or not, that made this class of people subhuman in our society, we've denied them access to jobs, we've denied them access to housing, and now we deny them access to a very bare minimal level of support from the state. And so, this Bill is actually a critical Bill to provide a bridge for those who are coming out of our institutions attempting to reclaim their lives and to serve as good citizens of the State of Illinois. This actually is a very good Bill in line with what was talked about all week about providing people an opportunity to reclaim their lives. And if we believe that to be true and we don’t want to create a permanent underclass as we have since 1985, then we do want to begin to roll back the policies that make it difficult for people to just get by. "Thank you, Mr. Speaker. This Bill has gone through a lot of hard work by a lot of Members and a lot of organizations. This Bill is what we are calling the First Responder Criminal… let me grab it. I took my glasses off. Pardon me. It has been called the First Responder Endangerment Act. And we have gone and put this in as a Memorial Act to fire fighter Daniel Capuano, who was tragically killed in a respond to a building fire where the owner of the building was going through and doing renovations and had covered up that they were doing renovations, never got a permit and tragically fire fighter Capuano fell through a elevator shaft and was killed. And we found that there was no way to hold the building owner responsible to it on a criminal level. There's certainly an opportunity to do civil charges but no criminal charges. And so, we've gone and worked with many different agencies and we have gotten to where everybody is neutral on it. I did do a small change that I will be having unchanged over in the Senate for CMS to be then again neutral because we did put in there… they wanted in there that it was subject to appropriations to have them to secure the building. And we went round and round on it and we both agreed that it would probably be best to keep that in there even though we both know that they will probably still be doing anything to make the building as safe as possible if they could. This is an initiative that comes kind of a ground… roots… grassroots effort from the dentists. So, both… the proponents of this Bill that have been on… you know, slowly but surely coming on in the last few days have been both in network and out of network dentists. There's also patients on that growing list of proponents. So, this is something that comes from the dentists. Something that I think Representative Long had said it. And also, there's an additional problem with having Delta pay the patient. If they do have secondary insurance, whether a spouse has additional insurance, without that explanation of benefits, that EOB, the dentist can't bill for that secondary insurance. So, there's not only the delay of payment and trying to get the payment from the patient now who's been paid and have already cashed the check, but then they aren’t able to process the secondary payment."
