Today I rise to remember the tragedy at the heart of last summer's social justice demonstrations across the world that prompted sweeping legislation in Illinois to promote equity and justice. Every year we will be forced to painfully relive where we were when we saw the video of George Floyd's senseless murder one year ago today with the anniversary of his death that will always hold significance. And we know his story is representative of the injustices, the disparities, and the racism the black people across this country face on a daily basis. George Floyd was a man who deserved to live a full life. And he was so much more than an unarmed black man murdered at the hands of police. George Floyd was a father. He was a brother. He was a son. And that's why, here in Illinois, the Illinois Legislative Black Caucus demanded meaningful, systemic change. We unveiled an ambitious and long-overdue agenda to begin the process of dismantling systemic racism and to create a more equitable education system, to improve access to health care, to demand economic justice, and implement police reforms and criminal justice reforms. These are historic first steps to reforming a system designed to promote inequities, but we are far from done. Before I present House Bill 1443, I want to make sure I give a special recognition and a thanks to Representative Cassidy and Leader Gordon-Booth for bringing in so much revenue to the State of Illinois by enacting the cannabis law here in Illinois. So, thank you very much, Representative Cassidy and Leader Gordon-Booth, and for all of the people that helped make this cannabis law what it is today. But, we realize that there's some things that we should do to improve it. And so, with that, I'd like to also thank my friend, Representative Willis, who over the summer spent her time fighting with the social equity applicants, doing everything that she could to move the needle forward. Thank you so very much, Representative Willis. And I'm sorry your name got moved away from the top. Things happen, but you've been working diligently. So, thank you so very much. And I should also thank Speaker Welch. And, Sam, I know you've given your pure entirety to this legislation to get it right. And I thank you so very much for getting this to the point where it is, and for everyone that had something to do with getting this to the floor today with the hopes of passing it. So, as amended, House Bill 1443 does a number of things. House Floor Amendment #6 was just a line Amendment to House Floor Amendment #4, and it just corrected a drafting error. And so, that became the Bill, and it made a correction for the 1500 foot exception for social equity applicants. So, House Floor Amendment and the Bill as it is presented today creates 2 additional lotteries of 55 license each, in addition to the lottery for 75 licenses currently authorized under the CRTA that has been delayed for almost 400 days. The Bill also deals with relocation of existing earlier approval adult use dispensaries. House Floor Amendment and House Bill 1443 allows for early approval adult use dispensaries to relocate under certain conditions. One, the local government of early approved dispensaries have to approve and prohibit the sale of adult use cannabis. Two, the early approval dispensaries has obtained the approval of the municipality or the county if the location and the unincorporated area to move to another location within the same local government. It also sets up something that social equity applicants like. And I want to thank the Chair of the Exec Committee, Robert Rita, for holding a hearing where the people's voices were heard. And this part, the 1500 feet bumper zone exception for social equity applicants were added due to the fact that Representative Rita required that we have more input from the 10200041.docx 13 STATE OF ILLINOIS 102nd GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 41st Legislative Day 5/25/2021 public. So, thank you, Representative-Chairman Rita. It allows for social equity applicants and social equity justice involved applicants to locate within 1500 feet of existing dispensaries. This allows for the dispensaries to catch up and gain some great locations to support their businesses. It also has a social equity justice involved medical lottery. House Bill 1443 creates a new lottery to issue five additional medical cannabis dispensary license to a new pool of applicants that qualify as social equity justice involved applicants. It expands the R3 Board. Currently, it expands it by eight individuals. And I want to thank the Latino Caucus for making sure that this had a real, true social justice board. There's no way we could really have a R3 Board if it didn't represent the people that we serve in our districts. It also creates the cannabis regulation and oversight officer. House Bill 1443 provides that the cannabis regulation and oversight officer serves as a conditional role among state agencies regarding the CRTA and Medical Act. For Marty Moylan, Representative Marty Moylan, I thank you for fighting to make sure that we had increased transparency. Because of Representative Marty Moylan, we have transparency in this Bill, which means that Marty Moylan demanded that ownership information about business owners will be known in the State of Illinois. With the additional licenses, why are we here today after we had passed the original cannabis Bill? I think a lot of us read in the papers and were briefed on how the initial round for equity applicants went. What is our hopes in this legislation to do to help those minority applicants that did not make that first round?"
"Representative Welter, that's a great question. And I know it was the intent of Representative Cassidy and the intent of Leader Gordon-Booth and all those people that worked so diligently to try to pass the most comprehensive and fair cannabis Act in Illinois, but it fell a little short. And right now, to date, almost 400 days later, there are no majority-owned black or brown, or woman-owned, majority-owned dispensary. This Bill, if it passes out of the House and goes to the Senate and the Governor signs it, we believe that it will increase the chance greatly for diversity in the cannabis emerging market."
"What specifically, in the Bill, are we doing different compared to what we did in the original Bill that's going to ensure that there's equity in this industry?"
"The lottery… number one, we're going to have three lotteries. Lottery one had a provision in it where it required a perfect score. And with a perfect score, it eliminated a lot of the possible social equity applicants and it gave preference to a lot of people that may not be social equity applicants. And so, what did we do? We're going to make sure 10200041.docx 15 STATE OF ILLINOIS 102nd GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 41st Legislative Day 5/25/2021 that the state responds to its responsibility to make sure that the people that paid the money to the State of Illinois finally get a chance to have their scores cured and have a chance to be in lottery number one. Then, working with Toi Hutchinson and the Governor's Office, they issued another 110 licenses. This will allow for the social equity applicants that did not score perfect scores to move into round two to have what you call a cut score. And that means that they have to score at least 85 percent or higher in order to qualify to be in that lottery. Then, moving forward, there would be a third lottery strictly for those in the DIA and those with a criminal record impacted by the 'war on drugs'. That gives a real shot and possibility that this field… that this field will target the intent of the original cannabis law in Illinois."
"And just to clarify for Members, the applicants that are going to be given a second look, do they have to go through the application process again? Do they have to pay the fees again? Or will this allow them to kind of get right back in the process where they were when they had submitted their application?"
"That's an excellent question too. The way this has been negotiated with social equity applicants and members that have concern is that we use the same pool of applications so that people will not have to pay any more money to apply again, which could take maybe two years before any licenses get out. So, we would use the same pool, no extra cost to applicants. There's a lot of other provisions that we've been trying to accomplish over the last year, year and a half. Obviously with the pandemic and Special Session, we attempted an omnibus Bill before that ended up failing. I would commend you, Representative Ford, for doing a great job of bringing stakeholders to the table to try to work out and correct some of the… I would say some of the shortcomings of our initial passage of the cannabis legalization for adult use in Illinois. I think we're all very well-intended as Sponsors of that Bill in negotiating at the table. Unfortunately, the way that the scoring and everything worked out was not to our original intentions. So, I'm glad we're coming back and cleaning this up. I do have one other point that I would like to touch on here that's in this Bill and that's the relocation provision. Could you touch on what it would take for a current dispensary to be able to gain approval to move from their current location?"

When we saw them gain the adult use license, we saw the traffic at the location increase and public safety become an issue. How does your Bill address that for relocation when it comes to public safety?"
"Well, I think that the original drafters of the cannabis law really took all of that into consideration. So, everything about the inaugural Bill and law isn't bad. There's a lot good and that was one that Representative Cassidy and Leader Booth had a lot of guards there. So…"

"Yes, Representative Moylan. House Bill 1443 expands the discloser requirements for dispensaries to all of the various cannabis business license, such as cultivator centers. So, right now, if you're a cultivator and you have a center, a craft grower, or an infusion, or a transporter, you have to disclose. This Bill, because of your input, adds the cannabis dispensary ownership information of the businesses that are also licensed under the Medical Cannabis Act. Under this Bill, the other cannabis business, in addition to dispensaries, must file and maintain a table of organization, ownership, and control with the Department of Agriculture. That's what this Bill would do if it becomes law."

"Thank you, Mr. Speaker. I rise today for House Resolution 73, which honors a gentleman who had a strong relationship with this chamber. Anthony 'Tony' Leone, a longtime public servant, local historian, friend to the arts and tourism, died early in the morning of February 3, 2021. Tony was born in Springfield on September 1, 1950. He graduated from Griffin High School and earned his associate's degree from Springfield College and his bachelor's degree from University of Illinois Springfield. Early in his career, he worked for local State Representatives Josephine Oblinger and Irv Smith. Tony was selected to be Assistant Clerk of the House in 1979. From 1981 to 1983, Tony served as Chief Clerk of the House. 1983 to 1992, he finished out his duties with the House as Assistant Clerk. My sister was part of the staff for many of those years and talks very highly of Tony. During this time, he also served on the Board of the Legislative Information System, which was created to computerize the General Assembly. Tony served in many other capacities in state and local government as well, including Director of the Secretary of State Index Department, Chairman of the State Property Tax Appeal Board, Sangamon County Board of Review, Chairman of the City of Springfield Rules and Regulations Review Commission. Tony also had a distinguished career dealing with election law, Supervisor of Public Discloser for the Illinois State Board of Elections, Chief Clerk of the Sangamon County Election Office, and Assistant Chief Clerk of the Springfield Board of Elections. Having served as an election officer in the city, county, and state level, a feat that few, or any, has ever achieved. Opened in 2002 as a bed and breakfast and has hosted many special events. That Pasfield House filled with art, antiques, rare books, and historical memorabilia reflects Tony's many interests and talents and underscored his well-deserved reputation as an expert on Springfield early history and the love of his state and country. Tony also served on the Illinois State Capitol Historic Preservation Advisory Board. He was named Historic Preservationist of the Year by the Illinois Historic Sites Commission in 2011. Tony also served on the commission in 2003, which helped design the Illinois Commemorative Quarter. In 2019, Tony co-authored Springfield's Celebrated Horseshoe Sandwich book, which I hold in my hand. And after this was published, I always introduced Tony as my favorite author. That's why… if you ever get a chance to read this book, I ask you to go to pages 28, 37, and 80 where he was so gracious and mentioned me in my efforts in promoting the horseshoe. Tony was buried on February 12, Lincoln's birthday, which was so fitting. I, like many others around the state, have been blessed to have known Tony and to be able to call him a friend. I, like many others, will miss him dearly. Especially his long-time special friend, Cathy Cragoe.
