"Thank you, Madam Speaker. Today I rise for House Joint Resolution 66, which designates Interstate 64 in Wayne County from mile marker 112 to 116 as the 'Deputy Sean Riley Memorial Highway'. Deputy Riley was a three-year veteran of the Wayne County Sheriff's Department. He was a public servant at heart, dedicating his time to his community and sports, serving as a tee-ball coach and basketball coach. But most of all, he loved spending time with his family. His wife, Leslie; sons, Logan and Deegan; daughter, Mia; sister, Spring; Aunt Margaret; mother-in-law, Glenda; and sister-in-law, Glenna, who are with us here today along with Wayne County Sheriff Chris Otey. Sadly, on December 19 of last year, Deputy Riley gave his life responding to a distress call, a call for help. That's the definition of a hero. Putting yourself above others, responding to a call, not knowing the situation or how it will unfold, but knowing someone is asking for help. That is a hero. It's difficult to put into words Deputy Riley's impact on his community. Following Deputy Riley's passing, the outpouring of support was tremendous from local businesses to just normal folks who wanted to help. So much so that his services were held at a local high school and every seat… every seat, folks, was filled an hour ahead of time. Deputy Riley's sacrifice will not be forgotten and his impact will always be felt. Today we honor a hero. This legislation makes changes to the Governor's Office of New Americans to clarify their duties of the office to help it more effectively assist immigrants and refugees. The… excuse me. The legislation also provides that the Office of New Americans shall monitor the completion of New Americans Plans at each state agency. This Bill comes before you for consideration at a critical time as millions of people are forced to leave their homes and lives in Ukraine to seek safety, protection, assistance, and refugee abroad in the midst of their country's ongoing invasion by Russia. Over the past few weeks, we have heard calls of support for the people of Ukraine from both sides of the aisle. What specifically would the office do? Let's be honest, $200 thousand probably isn't a lot, but what can they do with that?" Hernandez, L.: "Well, let me just name a few things that the office has always been designated to do. Simply the only additional, and I did mention it, is the reporting factor that we have included. But what… what they do is basically promote and support immigrant and refugee integration into social, cultural, and economic and civic life of the United States, ensuring access to quality English language learning programs that support the successful integration of immigrant adults, coordinating the efforts of state and federal, local entities to support the effective social, economic, linguistic, and civic integration of immigrants, refugees, and their children. And there's more."

"Well, okay, that usually means it's removed. Can you point to me anywhere in the new language that you think is comparable language to helping people on a journey towards self-sufficiency?" Hernandez, L.: "I think that there are some programing that is currently in place. One of the initiatives is through the welcoming centers that exist through DHS that is a avenue to try to help immigrants to self-sufficiency."

"Okay. Well, can you point to me to any of the duties that you've put in the Governor's Office of New Americans that is going to encourage people to expedite their journey towards self-sufficiency?" Hernandez, L.: "Oh, well, we can… ensuring the inclusion of the perspective of immigrants and refugees from performing duties, identifying the anticipated effects of new government policies on integration efforts. It provides strategic advice to the Governor on how to address effects, gaps, and needs created by such policies. Evaluating the scale, quality, and effectiveness of state initiatives with respect to immigrant and refugee social and economic integration. That's a few."

"Right. Well, I… I've heard… I heard giving advice and sitting on commissions, but not actually achieving getting anyone on a pathway toward self-sufficiency. "Yes. You said that… that in the lines 5 to 6, item 1, to welcome and support immigrants and refugees in the State of Illinois. But it's implied that this is only supposed to involve legal immigrants and refugees in the State of Illinois. Is there a reason why you didn't specifically say legal?" Hernandez, L.: "I think it's understood to all immigrants and refugees, including legal."

This is an initiative of NAMI Chicago, Thresholds, and the Illinois Department of Human Services to create a strategic plan for the department to maximize the use of existing state-operated inpatient psychiatric beds. It will include, number one, inpatient strategic plan. DHS Division of Mental Health would prepare a strategic plan for making the best use of state-operated inpatient psychiatric beds, reducing length of stay for forensic patients and improving quality of care in state- operated facilities. For IDOT, the cost may not exceed $400 million for contracts awarded during IDOT's multi-year highway improvement program for any 5-year period. For Tollway Authority, it may not exceed 20 percent of the Authority's annual improvement program. The design-build approach consolidates design, engineering, and construction services into one fixed package selected by a qualification-based selection process. The goal of this process is to bring greater efficiency and innovation to the system in order to deliver projects faster and more efficiently. IDOT and Tollway typically use a different approach. This is what's happening today. Design-bid-build, which through these services procure such as separate contracts. While this process works well for most projects, design-build offers a more streamlined and effective approach, an efficient approach for more complex projects, bridges, interchanges, and such, which are coming. Illinois has hundreds of small and diverse engineer companies that work with IDOT and Tollway. I, along with many advocates and other Legislators, we had serious concerns about the impact design-build would have on this sector and we wouldn't sit back. So, as a result, the language in this Bill works to ensure that DBE inclusion and protections are present and visible in this new procurement model, including separate goals for design and engineering and bid shop protections. Again, real protections for DBE inclusion. Also, making sure that there's still a separation with the bids with regards to engineering because some of the companies were concerned about the big boys coming in and taking all the design-build work. And I get the Sponsor doesn't think it's necessarily relevant. Well, in that construction space, all of this is relevant. And to his point, you're right. I guess if I'm concerned about the goals or all the things that he mentioned, maybe I do need to do… file Bills. But in his opening, he talked about how this process protects. And I'm just not convinced that it does protect small businesses. Yes, it may be a better way of the state doing business, being able to do projects, get projects done, but there's a lot of detail that I think may be not being discussed in this process. So, obviously, Members will vote how they feel. Parenting coordinators are authorized to make recommendations on things like dropping off and picking up children for parenting time, minor disputes on extracurricular activities. Just to be very clear, and this was something that was discussed in committee, parenting coordinators are not empowered to make decisions related to health care. There are no known opponents. "While I appreciate that you're saying that, again, the intent of this was not to necessarily make health care decisions, I think one of the reasons why there was a concern in committee about the scope of this… and it wasn't just raised by me, other Members came to me, including on your side of the aisle, expressing some concerns that the language here was pretty loose in terms of these parenting coordinators and what they could and couldn't do. Because there's a concern that they're going to effectively become the latest arm of DCFS that's going to start to interfere with parental rights and then the parents are going to have to pay for it besides. So, if we… so, one of the things that it does say is that one of the things that the court is allowed to do is to have this 10200094.docx 42 STATE OF ILLINOIS 102nd GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 94th Legislative Day 3/30/2022 parenting coordinator make decisions… and this is on page 1 of the legislation, lines 21 to 22. 'The parties' failure to adequately cooperate and communicate with regard to issues involving the children.' So, there was a concern that that's pretty broad and loose language that probably should be tightened up. Because, again, this is allowing for a parenting coordinator to be appointed when it's deemed in the best interest of the child due to any type of supposed failure to communicate. And then when it comes to item (C) that starts on page 2, line 7… again, it isn't just kind of making an assessment on who's right, who's wrong. I mean, this has the parenting coordinator talking about facilitating the resolution of comment regarding an existing parenting plan, monitoring parental behaviors, including compliance or lack thereof with orders. You know, that was viewed as a parenting coordinator as effectively stepping into the position of the judge and that may be denying parties some of their rights. Making recommendations, not only to the parties but also to the court, and that somebody doesn't necessarily have many rights to communicate on this. And then when it comes to some of the specific recommendations, yes, they're relating to time, place, and manner for pick up, but it also has this parenting coordinator making decisions in connection with the extent and nature of the educational and extracurricular activities. It says minor alterations of parenting time, but there was a question as to what does it mean to actually have minor alterations of parenting time. What might seem minor to one could be minor to someone else. And but then… this is one that I'd like you take a look at a little bit more closely. 10200094.docx 43 STATE OF ILLINOIS 102nd GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 94th Legislative Day 3/30/2022 On page 3, item (4), lines 6 to 9. This is talking about any other specific issues assigned to the parenting coordinator by the court or agreed by the parties which do not exceed the authority under this Section. So, again, while I appreciate that you think that it shouldn't involve health care decisions, that language doesn't preclude it. In fact, it seems that if the court does make a referral in connection with a health care related dispute, then the court's going to have the… then basically your parenting coordinator is authorized. So, that's why I think that there was a belief that conceptionally there's probably cases where this could be a good idea. The way in which it's drafted, I think… some of us thought that there could be some improvement in the language drafting and we're kind of disappointed, I guess, that some of that hasn't come out. And then… and likewise, when it comes to where we're saying that the parenting coordinator shall not make recommendations, again, that does not preclude… or it doesn't prohibit health care related decisions from being referred to a parenting coordinator. So, this is an area where I think an Amendment would be appropriate. It would probably and hopefully make the Bill better. And then the other major objection that needs to be addressed or dealt with is, this is another area where if the court so orders it, the parties have to pay for it. So, how are… how are you going to handle the funding situations for that? So, I know that those are a whole lot of things. Because if I'm already in the court and I have to have an attorney, even if you assign a parenting coordinator, in our case there was a mediator assigned, which they can charge whatever it is that they say their time is worth. There is no restriction on that. That increases the cost for the family of which they're already struggling to pay. And the mediators of the courts that are already paid for in this… to try to help this, the parents don't have to pay for that mediator out of their pockets currently. This would incur another cost to the families in order to have mediation. And I do think there needs to be mediation, that's for sure. But to add a… another professional in between that process outside of a CASA or outside of a mediator of the courts that are already designed to try to solve these issues with a parenting plan, I think this adds an additional burden to families to have to pay for that. If this was going to be covered by additional resources that we provide to local governments or to counties in order to cover their court cost, that would make sense. And anybody in this room who has been involved with or knows high-conflict divorce cases, this is an actual solution to the problem and not whether or not somebody's going to get a health care decision. The language in this statute is clear as to what this parenting coordinator can actually do. These are helpful for our families. I'm going to urge an 'aye' vote. This is a good Bill that solves problems."

I think this Bill needs some more work. There is the issue with the waivers and how that is going to actually be played out. I'm not sure if anybody in here has ever had to apply for a waiver. I doubt it because you would not receive it, you make too much money. But if you make $15 an hour, you are often refused a waiver. So, that means that the average person out here flipping burgers that's going through a divorce cannot afford this service. They're not going to get a waiver. And they're going to be stuck with this. If they object… and it says that this coordinator shall provide a plan. And if you object to that plan, you're going to be stuck paying for the court fees to go back to court to say that you disagree with this coordinator that you didn't even have an opportunity to object to. I believe this Bill is not soup yet. It needs to be pulled from the record at the very least. I'm asking everybody, please do not vote on this. This is not a good Bill in its current form. And I just… I just refuse to battle with this coordinator 'cause all I want to do is get divorced from this husband and raise my kids, or to have him to pay the child support so he can help me raise my kids. I don't need a coordinator. But now, this coordinator, instead of my husband, he or she is going to bring me back to court. Now, really? I mean, I know your intentions are well, but families… this is a hot-button issue. And no one… you can… I can… I don't know your life experience and your background. And you cannot come into my house and I shall obey you. I know it's a job for somebody, but it's a bad job and you can cause a lot of friction and family… further family divisiveness. And I can see… between the divorce and this coordinator, I can see that it's going to be the children that's ultimately going to be hurt the worst. So now, if you really… if you really want to do something… because I'm sure you've had friends, girlfriends, boyfriends, all kinds of friends that you have had it out with. But give you some space and then we can come back and talk about it later. But this coordinator, because I got to do what he or she says, they can come to my house any time they want to. "One of the first pieces of legislation that I had here was the filing of creating birth and death electronic records. So, we've had electronic filings of death certificates in Illinois for a number of years and it's helped in a variety of reasons. This would ensure that the protection, via electronic, is there, but it would also allow the firms to be able to buy the technology, if they wish to, to have the electronic means in which to do this, protect the security and the identity, but yet get the signature as soon as possible which is timely and important when it comes to death. So, I certainly intend to support the legislation. And also, the safeguard in here is that there is nobody in Illinois that is cremated before the coroner, the medical examiner would sign off on that cremation authorization. Which by the means, was done through the IVRS, which is the Illinois Vital Records System, which is part of the electronic filing death system. So, all and all, I believe there's safeguards there while we're going to create the means and the ease and convenience for families to be able to do something in a timely manner that is either their wish or their loved one's wish, correct? DHS would like to apply for a waiver to continue this program as we know the workforce shortage and the risk of infection by COVID variants will persist for some time. This is the One Day Rest Seven Act, which protects workers' rights to the opportunity of one day off work per week and a 20-minute meal break for every 7.5 hours worked. The current parity of this language is outdated and inconsistent with the Department of Labor enforcement practice. What this Bill would do, it will add an additional 20 meal break for workers working a 12-hour shift or longer and clarifies the reasonable bathroom breaks that don't account toward the meal break. It adds a breakdown poster… a breakroom poster requirement, including virtual options for employees with remote workers, clarifies that a work week is defined any consecutive seven days. And it also creates a two-tier penalty structure for small businesses while protecting workers under the Act. And I urge an 'aye' vote."

When you look at their ability to go into a person's home and look for animals or fish or wild… any wildlife that they've caught. I… and I'm a hunter, so I know they have the ability to do this, to go on your property without… without your permission and things of that sort. I want to make sure that we have good quality conservation police, but I do have big concerns that we're lowering standards on this. Certainly want to provide more opportunity to find the best candidates possible for DNR. I don't know if there's another opportunity or another direction that we can go. I haven't had an opportunity to actually talk to DNR directly about this. But at this point, I will be voting 'no'. I think there are certainly other avenues that we can pursue. So, thank you."

Currently approximately 3300 youth in DCFS care receive Federal Social Security or veterans' benefits because they are disabled or because their parents is deceased. DCFS, like many other welfare agencies, use this money to pay for the cost of the child's foster care, almost always leaving them no money when they transition. This Bill will require DCFS to save a portion of those benefits for the youth beginning when the youth reaches the age of 14. This additional money, technically the child's own money, can have significant positive impact on helping youth successfully transition to independence. There's already a model in Maryland about this Bill that went into effect 2018. I truly believe that children that we care for deserve a head start, especially those who transition out of youth in care… youth in care who transition out of DCFS. I urge an 'aye' vote."

I know it's late, but I… on behalf of Representative Scherer, who due to an emergency could not be here today, I was requested to relay her Women's History Month comments. So, in honor of Women's History Month… throughout Women's History Month, we've highlighted several strong, intelligent, and inspirational women who have made their mark on our state and our country. Today we do the very same for women who share these qualities and use them to raise their children despite many obstacles. It is time to celebrate the thousands of single mothers in Illinois and the U.S. who do everything they can to nurture and support their children. According to the U.S. Census Bureau, of the 11 million single- parent families in the United States, almost 80 percent of them are headed by single mothers. These mothers are more likely to live in poverty, more likely to lack health insurance and earn less than their male counterparts. Single mothers face food insecurity and have to balance the extreme responsibilities of work, life, and motherhood. Even when the odds are stacked against them, single mothers do their very best every day to create an environment where their children can grow and thrive. They sacrifice time, energy, sleep, and personal pursuits to make sure their children have food, clothing, and shelter. Single mothers do so much with so little and deserve our respect and celebration this Women's History Month. As a governing body, we must do everything we can to support this vulnerable, yet extremely fierce, population of women.
