Just wanted to make sure that we give him a warm Springfield welcome, as he's here from Lake Forest and wanted to make sure that he's welcomed here at the Capitol." Speaker Hernandez, B.: "Welcome. Mr. Clerk, please read the Bill on Third." 10300103.docx 3 STATE OF ILLINOIS 103rd GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 103rd Legislative Day 5/13/2024
"House Bill 4476, a Bill for an Act concerning health. Third Reading of this House Bill." Speaker Hernandez, B.: "Representative Syed is recognized."
"Thank you, Chair. House Bill 4476 aims to ensure that people in Illinois are aware of the dangers of mold and the need for proper assessment and remediation. This Bill does that by developing a mold awareness campaign for the public and also requiring that those that hold themselves as mold remediators have the proper certifications and register with the Illinois Department of Public Health. There's no known opposition on this Bill. This passed out of committee seamlessly, and I urge an 'aye' vote." Speaker Hernandez, B.: "Representative Frese is recognized."
"Thank you, Madam Speaker. Will the Sponsor rise… or will the Sponsor yield?" Speaker Hernandez, B.: "She indicates she will."
"Hi. Representative, regarding your Bill, even though it would appear that it's written as a mandate, there's really no cost to this associated, is there?"
"There is no cost associated whatsoever."
"And the department is behind it?"
"Yes. The department is neutral on this Bill."
"And I… so, to the Bill. I rise in support of the Bill. I have constituents in my own district who are concerned of this and brought it to my attention. I support the Representative's Bill and encourage an 'aye' vote. Thank you." Speaker Hernandez, B.: "Leader Keicher is recognized."
"Thank you, Madam Speaker. Will the Sponsor yield?" 10300103.docx 4 STATE OF ILLINOIS 103rd GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 103rd Legislative Day 5/13/2024 Speaker Hernandez, B.: "She indicated she will."
"Excellent. Thank you, Representative, for bringing this. I do have an exposure from time to time on… on mold related issues. So, I've got some more intent and technical things that I'd like to ask you about, if I could. So, would your intention be that any paid organization that remediates mold must be certified?"
"This Bill would not require registration with the state, but you can register with the state. And that will help the public be aware of which entities, which organizations have the proper certifications through the… through this registration."
"So, I'm… I'm reading in here, and if you could help me clarify, it says, provides that the Department of Public Health shall, instead of may, adopt rules to implement a program establishing procedures for parties that provide mold remediation services to register with the state and provide evidence. So, that is an optional registration?"
"So, the department is required to set up this registration and adopt rules necessary. It is up to individual businesses, entities to decide whether or not they want to register."
"Okay, because sometimes remediating mold can be as simple as putting paint on a wall that has a little bit of mold on it. And I would worry that we would put too much of a hurdle in the face of homeowners or landlords that are seeking to make their condition a little bit better. So, this is entirely optional? You don't have any plans to make this required? Anybody can still paint over mold and seal it in with a… a sealer or a Zins, and you're good, right?" 10300103.docx 5 STATE OF ILLINOIS 103rd GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 103rd Legislative Day 5/13/2024
"Yeah. So, I'm hoping the public awareness campaign that is going to be put forth through IDPH would encourage individuals not to paint over mold and properly remediate it, and then they can access a list of entities that have registered with the state that are reliable to properly remediate that mold. But you're correct, it is not required, and I don't intend to make it so."
"Thank you." Speaker Hernandez, B.: "The question is… I apologize. Representative Syed to close."
"I urge an 'aye' vote. Thank you so much." Speaker Hernandez, B.: "The question is, 'Shall House Bill 4… 4476 pass?' All in favor vote 'aye'; all opposed vote 'nay'. The voting is open. Have all voted who wish? Have all voted who wish? Have all voted who wish? Mr. Clerk, take the record. On this question, there are 88 voting in 'favor', 15 voting 'against', and 0 voting 'present'. And this Bill, having received a Constitutional Majority, is here declared passed. Proceeding to the Order of House (sic-Senate) Bills on Second Reading.
