The reason for this is because infection is a more accurate term because disease and infection are not synonymous. Many infections do not develop into a disease. The update also aligns with CDC language and procedure by updating how we refer to these infections. The second statutory change is to add human papillomavirus, or HPV, and mpox to the list of infections that IDPH considers sexually transmitted infections. Finally, the Bill updates the title of the Act so that it is Illinois Sexually Transmissible Disease Control Act to the Illinois Sexually Transmitted Infection Control Act. The Bill adds shipping prohibitions to the list of petty offensives or… a person of retail could face if they violate the Act. I call this diabolical genius marketing. The high school… this was brought to me by a Joliet Township High School board member who explained to me that you can now buy vapes that look like Sharpie highlighters and… what are those things they call… zip… it's drive… what is this? You're young, what are they called? Yes. USBs. USBs. "Thank you, Mr. Speaker. Thank you, colleagues. The population at the Department of Juvenile Justice, as we all know, has gone down dramatically over the last 25 years. In Fiscal Year 20… Fiscal Year 1999, the average population was over 2 thousand juveniles. This year, the average population was around 150. That's the result of a lot of great work that's been done by this Body and policy changes and transformation that's happened at the department. One byproduct of that is that many DJJ facilities have been left underutilized. And so, there is a question about how those facilities can be utilized more effectively and in 10300112.docx 19  STATE OF ILLINOIS 103rd GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 112th Legislative Day 5/24/2024 transformational ways to help support our young people. So, that's what the Bill before us today will do. This will enable the Department of Juvenile Justice to enter into an intergovernmental agreement with the Department of Corrections to use IYC Harrisburg as an emerging adult center so that DOC inmates who are between ages of 18 and 22 could… who do not have a high school diploma, could be transferred into this DJJ facility, under DJJ custody, to get their high school education. As you probably know, DJJ operates its own school districts. So, these young adults could come down to this facility and get their high school diploma, while also receiving supportive wraparound services and… and job training. We know that the vast majority of people who are incarcerated at DOC will return home to their communities one day. So, this Bill provides that when those folks do return home, this population will be able to return home with a diploma and with some skills that will enable them to reintegrate into community and find successful opportunities in the future and limit recidivism, keep us all safer. It's a win-win. It… it keeps this facility open and vibrant. It provides support for these young adults. And I ask the Body's approval."

This… they worked in collaboration with school management and the Rethinking Safety coalition, and there are no opponents to this Bill. The Bill adds… the Bill states that ISBE shall, in consultation with relevant stakeholders and behavioral health experts, draft and publish the following guides on or before July 1, 2025. The development of reciprocal reporting systems in accordance with current law, school bus safety procedures in accordance with current law, evidence-based intervention procedures including examples, and their reengagement of students who are suspended out of school, expelled, or returning from an alternative school setting. Davis, W.: "So, after listening to the previous speaker, I thought it was important, as the House Sponsor of Senate Bill 100, to 10300112.docx 28  STATE OF ILLINOIS 103rd GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 112th Legislative Day 5/24/2024 say something. Senate Bill 100 was a response to disciplinary actions that were taken unfairly, inappropriately, and disproportionately impacting students of color. That's where we started with Senate Bill 100. But keeping in mind that also the objective was to make sure that instead of kids being arbitrarily suspended and kicked out of school for however long it was, is that we did everything possible to make sure that before you… before you got to an exclusionary situation, and that didn't stop a school district from expelling if it needed to, but before you got to that point that you did everything possible to keep the child in the school building to make sure that they continued to be educated. Because what you've found happening is that if a student was pushed out of the school, then, unfortunately, parents are working. They're latchkey kids, and they weren't just staying at home. They were out in the neighborhoods roaming around, in some cases, causing trouble or at least being victimized by situations where, if they're just walking down the street, police were just stopping them, harassing them, and situations escalated beyond what they really needed to be. So, if anything, what I see what you're doing, Representative, as the furtherance of trying to make sure that school districts are working in the most collaborative way possible to make sure that when children are a little antsy and getting into trouble in school, that we're working collaboratively to keep them in school to make sure that we are providing the opportunity for them to be addressed in a way where they still get consistent education and have consistent learning. So, for anyone to characterize this as this Bill does nothing would be so 10300112.docx 29  STATE OF ILLINOIS 103rd GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 112th Legislative Day 5/24/2024 inappropriate. Because like with most legislation, you know, sometimes you start at one place, and then over time, you evolve. You know, sometimes we even call them trailer Bills because we know there's more work that needs to be done. And this is the situation where we appreciate the fact that, after having had Senate Bill 100 in place for a few years, we've recognized that maybe there's a little more that we need to do. Maybe there's a little bit more acknowledgement that needs to happen. So, again, I wouldn't say this is not doing anything. We're just evolving, which is what we're supposed to do. And as a result, I would strongly encourage Members of this chamber, whether it's because of the current support that it has from advocacy groups or just generally acknowledging that our best way to educate kids is to keep them in buildings to make sure that they're not just out roaming the neighborhoods and in the streets, where they, unfortunately, get into other challenges and other troubles. So, again, I would strongly encourage every Member of the chamber to vote 'yes' on this piece of legislation. Thank you."

"Thank you, Mr. Speaker. Senate Bill 3414 is an initiative of the Senate Sponsor, as well as the American Diabetes Association. It is similar to HB5382, of which I was a Sponsor, along with the American Diabetes Association. And I see today that as a person who freely admits and tells people that I have type 1 diabetes, this Bill is imperative for people with diabetes across the State of Illinois. This is a life-altering and frustrating disease that I have suffered since I was a teenager, over 31 years ago when I was diagnosed in college. And the technology that has changed over the last 31 years makes lives longer, it makes lives healthier. And a couple years ago, we passed a Bill that included CGM coverage for type 1 and type 2 diabetes patients. Unfortunately, rules were made that limited that access. This Bill is a trailer to that Bill. And it applies to insurance plans under the State Employee Group Insurance Act, the County Code, the initial… the Illinois Municipal Code, School Code, the Health Maintenance Organization Act, the Limited Health Services Organization Act, the Voluntary Health Services Plans Act, and the Illinois Public Aid Code. It is in response to the Department of Health and Family Services adoption of rules that have greatly limited approval for coverage, in particular for people with type 2 diabetes and for patients who suffer from types other than type 1. Some of these rules include that a person has to have a history of emergency room visits prior to being able to use a CGM, which goes against 10300112.docx 38  STATE OF ILLINOIS 103rd GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 112th Legislative Day 5/24/2024 general medical needs, general medical practice. They are asking people to get very sick and potentially die before they get CGM coverage, which is meant to help save lives. They invite dangerous health events, and they are costly. CGMs prevent this. They also had a rule related to a stigmatizing diagnosis called uncontrolled diabetes which is hated in the community I live among. The requirements that type 2 diabetes take multiple injections of insulin per day is also a rule that is not appropriate for the community. As a type 1 diabetes patient, I take one type of insulin. Many type 2 patients take one. That rule needed to change. These far exceed the requirements that are necessary for a patient to have a CGM, and the current Bill addresses these issues very carefully. It includes all forms of diabetes, because there are more than type 1 and type 2. There's gestational diabetes, there's MODY, there's LADA, there's type 1.5, and type 3. The Bill provides that a group of insurance policy or plan provides coverage for these medically necessary CGMs, related supplies, and training on a CGM. It allows any physician under the Medical Practice Act of 1987 or a certified nurse practitioner or physician assistant with a collaborated agreement with a physician to prescribe a CGM. This looks forward. Not everyone has access to an endocrinologist. And this looks to rural communities. It looks to low-income communities, where individuals may not have access to an endocrinologist and they see their primary doctor for care. It also includes language that the CGM will be based on an individual's circumstances, preferences, and needs in consultation with a provider. CGMs are effective in… and a life-changing tool that help keep people healthy. They save on long-term health costs. The Bill and its counterparts that have run already have the support of the American Diabetes Association, the Illinois Pharmacists Association, the Illinois Academy of Family Physicians, the Illinois State Medical Society, and the Illinois Rural Health Association. It passed the Senate unanimously and with bipartisan support. I have significant sign-on for this Bill. HFS is neutral. We made changes in our Amendment to bring them to neutral. We worked with the insurance companies to make changes so that they were on board. House Bill 4828, the original intention of the Bill, the underlying Bill, was to address the fact that we currently do not have any… anything in statute that regulates the use of restrictive housing. And we know that there's an extensive body of research spanning more than 150 years that's documented the detrimental effects of restrictive housing on the health and well-being of people who are incarcerated. And, again, right now there is nothing is statute that regulates the use of restrictive housing, but the Department of Corrections has made significant improvements in how… significant changes… great changes to how restrictive housing is utilized. But we believe that there's more that can done. And so, with the Amendment, the Bill right now doesn't have any… will not affect… impose any sort of restriction of the use of restrictive housing. But during our conversations when we engaged with stakeholders about the Bill, what we agreed to was that we needed more data. And so, House Amendment 1 replaces the original Bill. And it would require the Department of Corrections to publish quarterly an annual data on the use of restrictive housing in Illinois. This will help us… help us get the data that we need to move forward in the right direction. And so, this Amendment, I will say is… is supported by the advocates and it's also supported by AFSCME. And, you know, part of this data collection that was actually a request of me. I've had several colleagues here in the House that have asked me where I'm at on this Bill, and… and I was not in support. I'm still not… I still am not sure it's necessary. I look at where the Department of Corrections was at on segregation when I left in 2014, where they're at now. I'm constantly on the phone with our correctional facilities. This… this data collection, quite frankly, I'm really surprised that the department would be slipped in opposition to this. You know, everybody… you know, I know two things, losing my reading glasses and corrections. And this… this data collection that we're looking for… and I was very actively working with the Representative on this Bill. It's not that difficult to get. When… when these individuals are put into segregation, 90 percent of this information is documented within books, and that was back from 2000 and 2014. House Bill 4875 is an important step forward to doing just that. It takes a balanced approach in dealing with the issue of the unauthorized use of digital replicas. This Bill protects artists' ability to control their voice, their image, and their likeness, while still providing necessary exemptions to allow for artistic creation. Additionally, the Bill targets bad actors while providing safe harbor for those who unknowingly contribute to the distribution of such content. The Bill accomplishes this by creating a separate private right of action for the conduct of distributing, transmitting, or making available to the general public a sound recording or audiovisual work with actual knowledge that the work contains an unauthorized digital replica. The bifurcation leaves the current exemptions in the Right of Publicity Act as is for the unauthorized use of an individual's identity that does not involve a digital replica and creates a separate set of exemptions for the unauthorized use of an individual's identity in a digital replica. Lawmakers in State Capitols across the country are grappling with how to address this issue, but Illinois is one of the first to take action. We're not waiting on anyone else or looking to see what others are doing first.
