There's a lot of confusion when the names building alone was used to describe the fund. The miscon- ception being that it was being too constructive and the title operations or maintenance or building and maintenance which is suggested word change here, the purpose of that is to better and more accurately describe what the fund will be used for which is not primarily new construction and the original structure is changes in the law other than the change the name of the fund."

"George, can you tell me why that this agency with its large expenditures for court reporting has to go the contractual route, why can't they do like other agencies, particularly the Supreme Court, hire court reporters on a yearly or basis and then pay for the transcripts rather than pay $7.50 an hour to have somebody sitting there and start paying $2.00 for the first copy and so much a copy thereafter? Ah, I. ."

"Ah, Jerry, that's a very good question which I've discussed at some length to its Chairman Curry and the other members of the Pollution Control Board. Ah, GENERAL ASSEMBLY STATE OF ILLINOIS HOUSE OF REPRESENTATIVES 51. court reporting fees as you know are extremely high, those of us who are lawyers have to pay the darn things every once in a while and they're murder. I talked to the Chair- man about the possibility and the sub-committee of Approp- riations, the Full Appropriations Committee, which approved this bill, also, discussed this matter with them. Isn't there some way that you can sit down and hire somebody to take over the full time court reporting as an employee for the agency. Ah, the agency did try that route and it turn- ed out that they made an offer of $17,500.00, I believe it was for a full time court reporter and could not get anybody at all to accept the offer, and they figured that the total cost if they had someone on their staff would be approx- imately the same as they are if they hire outside court reporters. Another problem is that they have many more court reporting requirements that one employee could han- dle, they'd have to have a number of full time court re- porters, and they simply aren't available. It's kind of like the situation with doctors, it's a seller's market and the problem is that we just don't have the people available for the job and those that are available are locked up in the outside court reporting firm and I believe the sub-com- mittee and the full appropriations committee and I know I am convinced that this is the most economical way for them to go, but you can be sure that the Chairman and the members of the board are well aware of the problem and they're doing their best to cut down the problem." "Yes, Mr. Speaker, in response to Representative Shea's inquiry, not only was it to point out the extensive court reporting costs, but it was also to point out the extensive costs per meeting. Director Curry agreed with the excessive court reporting cost, they did try to hire a person, and fortunately the court report- GENERAL ASSEMBLY STATE OF ILLINOIS HOUSE OF REPRESENTATIVES ing association supposedly blackballed this and fortunately took the job. This was pointed out in committee that ah we requested that maybe the Department of Personnel would incorporate a training program so we could hire a person in this capacity. Last week, Thursday, in Environment Com- mittee, the Director Curry stated that they just opened up a bid for a court reporting service for the coming year and in turn, I guess the dollar amount was quite favorable, but as far as the House Bill 4130, the amendment that has been proposed was fairly discussed in committee, the reduc- tion based upon fact and I concur with the movement of the Amendment Number One to this bill."

"Well, basically what we're trying to do is to get the money out of the Treasury of the State of Illinois, out of the General Revenue fund and into the Appropriation for the Department of Revenue so that we can have an adequate amount of money to pay the refunds to the taxpayers and to pay them promptly. I don't believe, if I may continue, Representative Shea, I don't believe that the fault lies with the Department of Revenue or with the State of Illinois. I think it's been evident each year since we've had the State income tax that the employers respon- sible for computing the withholding for their employees con- tinue to make errors in the amount that is to be withheld, then continue to cause those problems on the tail end of the tax year for the Department of Revenue. It is just not fai ling with the state income tax, but exists also with the federal income tax and if you've been following that pro- blem in the newspaper on the federal income tax, then you know that it amounts to about up to a sum of about $10 GENERAL ASSEMBLY STATE OF ILLINOIS HOUSE OF REPRESENTATIVES billion on a federal level this year that has been miscal- culated by employers in their withholding from their employ ees."

"Well, Ed, I do follow it, but unfortunately I am not in a position to do anything about the federal tax. You, hopefully, will be there next year and be able to take up that subject. Right now, I'm more concerned about the people of the State of Illinois and I'd like to know the total $133 million what percentage of the refund will go to the corporations and what percentage of the re- fund will go to people?"

"My understanding and this is an estimate, roughly, Representative Shea, I have to offer to you as an estimate, and I have to ask you to accept it as an estimate. If the situation follows percentages follows the experience last year, then in excess of 80% of this money would go in refund form to individual tax payers."

"Yeah, but if we followed last year, we would not be asking for the additional money this year. My ques- tion is isn't the 7% tax credit recently enacted by the Executive Order of the President? Isn't that accounting for a large measure to great increase in returns to corpor- ations?"

Edward R. Madigan

"No. I think that more than anything else what poses this problem is the fact that the Department of Revenue or any other state department or agencies, is ob- liged to present to the Department of Finance or the Bureau GENERAL ASSEMBLY STATE OF ILLINOIS HOUSE OF REPRESENTATIVES 60. of the Budget their request for an appropriation, broken down as to what they want it for and an accurate amount and then the Bureau of the Budget goes over these things and cuts down those amounts that they choose to cut down. The budget that you see presented to the legislature by this department or any other department reflects a prior judg- ment having been made by the Bureau of the Budget as to what these amounts should be. When the Bureau of the Bud- get is in error, then the Department of Revenue or whatever agency is involved, must come back and ask for additional money and basically that is what has occurred here."

The Department probably comes up with some reliable estimates on need and then somebody in the Budget of the Bureau hasn't got the foggiest idee what's going on besides to cut $25 million out of an appropriation Could you tell me what the Department's request this year in this item is?"

"Thank you, Mr. Speaker. House Bill 4282 is my personal opinion is legislation which could mean millions of dollars to Illinois Small Businesses each year. What this bill does is extend the concept of the federal small business administration to purchases made by the State of Illinois, by authorizing the Department of General Services to designate as small business specifize certain specified commodities, equipments or services. In the cases of purchases designated as small business set aside, invitations to bid would be confined to small bus- inesses and bids from other businesses would be refused. However, in order to protect the State of Illinois, if the total number of small businesses responding to the invita- tion to bid was less than three or if the Department deter- mined that acceptance of the best bid would result in the pending of an unreasonable price, the Department could re- ject all bids and withdraw the set aside designation. Under the bill, the small business is defined as a business which is independently owned and operated and it is not dominant in its field of operation. Doller volumes are also estab- lished, so that no wholesale business would be a small bus- iness if its annual sales for the most recently completed fiscal year were to exceed $5 million and no retail business or business selling services as a small business if its GENERAL ASSEMBLY STATE OF ILLINOIS HOUSE OF REPRESENTATIVES 68. 69. annual sales and receipts exceed $1 million. This bill would further direct the Department to employ and experience contract negotiations to serve in this area as a small business specialist. As an attorney who does a great deal of work with small business administration loans, I think this bill would go a long long way in providing job oppor- tunities for our small businesses, particularly those among our minority in this state and I therefore would appreciate a favorable roll call."

"To the Honorable The Members of the House of Representatives, 77th General Assembly. I herewith re- turn House Bill 206 entitled 'An Act to amend Section 10 of Article VI of 'An Act relating to alcoholic liquors', ap- proved January 31, 1934, as amended.' Pursuant to the auth- ority vested in me under Article IV, Section 9 (e) of the Constitution of Illinois, 1970, I am returning House Bill 206 with the following specific recommendations for change: Amend enrolled House Bill 206 on page 1 by striking lines 19 through 23 and inserting in lieu thereof the following: 'be; provided, however that the city council, president and board of trustees of county board, as the case may be, may further restrict the permissible hours for the sale of al- coholic liquors under such licenses in its political sub- division as the public good and convenience may require.' House Bill 206 is a companion bill to House Bill 205 which I approved on November 8, 1971 and which now appears of record as Public Act 77-1664. These two legislative enact- ments were designed to remove the state's prohibition of the sale of alcoholic liquors on national, state, county and GENERAL ASSEMBLY STATE OF ILLINOIS HOUSE OF REPRESENTATIVES 78. municipal election days. Although the legislative intent is clear and has now been twice manifested, the form of House Bill 206 as enacted inadvertantly repeals the languag of our Dram Shop Law permitting local authorities to re- strict the hours for the sale of alcoholic liquors on any occasion. (See Maywood Proviso State Bank v. City of Oak- brook Terrace, 67 Ill. App. 2d 280, 214 N.E. 2d. 582, (1966)). The striking of this authority, particularly as it would apply to our non-home rule units of local government, is neither necessary nor consistent with the legislative in- tent of permitting the sale of liquor on election days. Both the principal sponsor of the bill and the Illinois Municipal League have noted this inadvertent drafting error and have requested that the bill be returned with the pro- posed specific recommendation for change. For these reasons, I return House Bill 206 with my specific recommendation for change. Respectfully submitted, Richard B. Ogilvie, Gov- ernor."
