Under House Bill 4273 as amended, every Insurance Company will have to promptly pay to the injured victims of motor vehicle accidents up to $2,000.00 in GENERAL ASSEMBLY STATE OF ILLINOIS HOUSE OF REPRESENTATIVES in Medical, $150.00 a week in wages and $12.00 a day for the replacement of essential services if unemployed. They will... They will also have to offer $50,000. to $100,000. excess coverage which will provide additional 5 years of Medical, Loss of Wages, Replacement or essential services and Dependent survivor benefits, which the insured can buy instead of.. instead of current mandatory uninsured motorist coverage. These benefits must be paid every 30 days re- gardless of the other benefits the insured may have. If the insured still wants to make a claim or file a suit against the other party, he can. If the injury is serious, and there are permanent disabilities, his rights to general damages are exactly the same as they are now. There is no change. In order to correct the Supreme Court objection, House Bi.ll. 4723 as amended applies to commercial vehicles as well as private passenger automobiles. The provisions relating to the mandatory arbitration in the original Illinois Plan have been striken in compliance with the Supreme Court. Finally, the limitations on pain and suffer- ing have been clarified to cover the Court objections to the possibility of differential... of different financial set- tlements in different parts of the State. In effect, what this Bill does... or what Amendment No. 2 does is takes the identical no-fault Bill that was passed by the General Assembly last year and pulls out of it the objections that the Illinois Supreme Court and the Circuit Court had when they declared it unconstitutional. With these provisions... GENERAL ASSEMBLY STATE OF ILLINOIS HOUSE OF REPRESENTATIVES 77. With these objections removed, we have the same Bill as we passed the last time. There were no other subsequent changes other than to place the Bill in compliance with the objections of the Supreme Court."

Ah.. to present to us an alternative which in my humble opinion, does not meet the objections that the Court has previously raised. Ah.. I really think that the Amendment ah.. doesn't do anything to change the major constitutional objections inasmuch as Amendment No. 1 was tabled. I would rather see the Bill held and ah.. re- worked because you've got a problem here with what is reason- able and necessary medical expenses under one part of the proposed Amendment which has a different definition from reasonable and necessary medical expenses in another part of the Amendment. And it doesn't really cure the faults that the Court found in the previous Bill as far as denying due process in equal protection of the laws, the people who are involved in automobile occurrences. You still got the problem that people who do not have automobiles, who do not own them.. automobiles and who do not have the mandatory coverage would have.. not have benefits available to them and yet, by this Amendment would still be prevented from GENERAL ASSEMBLY STATE OF ILLINOIS HOUSE OF REPRESENTATIVES 80. filing suit for the fair reimbursement of their injuries. I think this is ah.. not the proper way to address ourselves to the accident problems in the State of Illinois. And I don't think that the Amendment ah.. deserves our affirmative vote today."

"Mr. Speaker, Ladies and Gentlemen of the House, I to rise in opposition to this totally new Bill put to us once again. House Bill 4273 is amended. It's still unconstitutional for all the reasons given in the Grace Case. This Bill was unfair in concept and it is still un- fair in that it takes away the tort Claims of the people.. The real reason the Insurance Companies want this Bill is for greater profit. They do not need a Bill, a no-fault plan to sell Insurance and we all know the Continental Insurance Company sells its' policy now. No no-fault is needed for that reason. Why they want no-fault is to take away the Court claims of the people. That's where they're going to save the money. Now, in Massachussettes, in the last nine months of 1970, they paid out over $11,000,000. in claims to the people. They put in no-fault and in the same nine months period, they paid out just over $2,000,000. Thus, saving $9,000,000. for the Insurance Companies. That's why they want this no-fault Bill. They don't need it for any other reason and it's time we all woke up to this fact. Now, also, in Massachussettes, they have not cut down the premiums. And in this Allstate Case, in this Grace Case, GENERAL ASSEMBLY STATE OF ILLINOIS HOUSE OF REPRESENTATIVES 81. the Allstate people testified that their not going to cut down the premiums on this no-fault plan. And it's time you stop kidding the people by telling them that their going to cut those premiums. They are not. You're going to cut the money that comes into their pocket. Now this no-fault Bill... What's the hurry? The hurry is to again try to slide it by before the people wake up to what's happening. Let's put in a commision where it belongs. We're all for all no-fault plan, but we're not for a plan to give the Insurance Companies more profit. Let's get out a proper no-fault considered by all of us and get one that the people will appreciate and a no-fault concept that the people will approve of."

"Representative, there are very few plans but there are some that the employee and employer both con- tribute to. This Bill pertains to the employer contributing not to a union but to an employer-employee Trust Fund which is completely separate from a union. This is not dues money. This isn't money for an initiation fee. We're talking about fringe benefit money that was negotiated in a collective bargaining agreement in lieu of wages. It's a $.30 a hour, 87. GENERAL ASSEMBLY STATE OF ILLINOIS HOUSE OF REPRESENTATIVES to $.25 an hour that an employee agreed to have ah.. paid in his behalf into a Pension Trust Fund that sometimes these employers fail to contribute. And what we're trying to do is to whip it in line that we can't use mechanics lien law in some types of Industry. We can't use any other kind of law to get the wages or these fringe benefits collected. So, we felt that if we made it a criminal offense and tacked on a misdemeanor, that we would have this money that is really wages ah.. in all reality was in lieu of wages, this fringe benefit collection. So, it ah.. really is the employer's money. that he has agreed to pay into a Trust Fund that we're trying to assure the collection of."

Now, I don't know whether this would effect us but we all might wind up in jail for a year if we didn't live up to our agreement and put the money in as we should have. But that isn't the main reason why I ah.. offered this Amendment. Ah.. in ah.. Committee and in the sub-Committee that both Tom and I were members of the sub-Committee along with the Chairman, it was brought out that ah.. the large employers are not the ones that are guilty most often. It's the small employer ah.. that ah.. in the construction business that gets a little job and then ah.. bids it low and doesn't care of what he agrees to do. Now, by putting a small employer in jail for a year, you wouldn't only be punishing him, you would be putting him completely out of business. And I believe that if he's found guilty once, and fined a $1,000 dollars that ah.. after that it would be very hard for him to be considered a responsible bidder and ah.. accepted as low bidder if he has ah.. already been found guilty and paid a $1,000 dollar fine. And, therefore, I think Amendment No. 2 is a good Amendment and I urge its adoption."
