I felt like I was wearing a white hat when I put this in.' And if you notice I have been changing my image ah... at ah...the last... lately. I wear a long tie now, and I've been associa....associated with nice white hat people, and this is along that line. I think meditation...get the credit for this. I'm really...really very serious about this resolution. For you that don't know why Transcendental Meditation has become a big...scientific subject in the whole country and deserves a great job in the fighting of drug about throughout our country, and is already in install. in many of the Universities. In fact, in our own Universities, they give ten semester credit hours for a course in Transcenden: Meditation. In this day of high tensions, am I bothering you GENERAL ASSEMBLY STATE OF ILLINOIS HOUSE OF REPRESENTATIVES you fellows? I would suggest that you meditate a bit, but you might fall asleep and forget to vote. Actually, it's a very serious subject this...this is an art and has been proven scientifically to be a great physical aid, great mental aid, and I believe it's something that is well worthwhile to encourag the continuation of the advancement of this in this day of high tension. I think it's a good resolution, I'm very serious about it and I ask your support in the passing of the resolution.

We' just telling them to encourage all of these young people that are taking something serious instead of violence and...and demonstrations, they are taking something serious and doing something serious that is doing them alot of good. You will not find one meditator a demonstrator any place, you'll not find one meditator a user of drugs, and I think you're putting a great deal of emphasis here that is not there. We're just saying to them or encouraging them to their program. They are GENERAL ASSEMBLY STATE OF ILLINOIS HOUSE OF REPRESENTATIVES 44. not asking for any money. We're not asking them to sponsor themselves or anything about it. But to encourage them. And if there is anything wrong in this somehow I have been misled in my entire lifetime. "Ah...Mr. Speaker, ladies and gentleman of the House, as the clerk said this is the deficiency approp- riation for the Pollution Control Board. The deficiency is caused by the fact that the Statute that we paseed in 1970 requires that all hearings to the board ah...be public hearings and that they ah...there be a complete transcript provided. GENERAL ASSEMBLY STATE OF ILLINOIS HOUSE OF REPRESENTATIVES 47. Ah...nearly all of the deficiency is for the ah...court reporting to coverthese transcripts. The original bill was for $225,000 after substantial negotiations in the ah...the ah... appropriations committee and the sub-committee. An amendment was put on the bill on second reading to reduce the amount to $165,000 ah...which is the amount of the bill, which is under consideration at the moment. Ah...I believe this is an agreed bill with the members of the appropriations committee on both sides of the aisle, and I would appreciate your support. The bill came out of the appropriations committee 18 to nothing."

"George, at the time this bill was on second reading. I made inquiries of you with regards of having employees as court reporters rather than buying the service. I have since discussed with a Mr. Hartnett who is the legislativo chairman of the court reporters association, the official Court Reporters Association, and checked with various people on what it would cost for employees vs. buying. I find out that even in the Federal Court our court reporters officials are paid $13,500 a year. The official court reporters are at that rate, the Federal Court Reporters are at the rate of $16,000 a year, and to that they are paid the rate of a $1.00 a page or 75 cents a page depending on what's going on. NOW it seems to me, looking at what we hire private court reporters for $22.00 an hour, plus $2.00 a page, ah...it just seems to me...I guess its $22.00 whether they work an hour or three hours and after that its $7.50 an hour. But it just seems to GENERAL ASSEMBLY STATE OF ILLINOIS HOUSE OF REPRESENTATIVES 48. me that it would be substantially less than what we are spending now, and I discuss further, are there court reporters available at those mutuals? And they tell me there are sufficient number of court reporters in this State that would be interested in taking employment of that type. So George I can't support this bill in the present form for that reason. I suppose they need the money and maybe I will support it because I know we want to get it out of here. But why are they so hard heading, George, about this attitude that they won't hire people, that they've got to do it on a contractual basis?"

"Ah...Gerry, first of all let me point out as I did on second reading that this is a deficiency appropriation for last year and your question is a perfectly valid question one which I immediately passed on to the chairman of the Pollut: Control Board. But your question is relevant to the appropriati. for the current biennium, not for the past year. So for that reason..."

"And my understanding is that this money is to be used to pay for court reporting services in the months of May and June."

"Thats.... Thats right. And the board is making a thorough investigation. I told them precicely what you had said on the floor of the House. And you can believe that they want to save them money just as much as we want them to save GENERAL ASSEMBLY STATE OF ILLINOIS HOUSE OF REPRESENTATIVES 49. the money, because the more they save the better job they can do. I did not give them the name of the gentleman which you just mentioned because I didn't know that ah...you can be sure that Dave Curry will have that man's name and address this afternoon. Ah...I might say the board before the ah...approp- riations committee and in the sub-committee did discuss this matter in some length and Mr. Curry gave all the details as to what he had tried to do in advertising and hiring a court reporter, ah...full time court reporter on the staff. One of the problems is that one court reporter on the staff cannot do the job, my recollection is it takes something like 5 full time court reporters, plus all of the accouterments and equipment that they need plus ah...secretarial assistance in all of the office space and everything else so it isn't simply a matter of the salary that's paid to the court reporter himself, that's of course a major item, but that is only part of it. I would guess that probably not more than half of the total outlay."

"Well George, let's assume we had to buy five court reporters for $16,000 a piece. That's $80,000, and lets assume we need another five employees to back them up maybe at $10,000 apiece, that a $130,000 and with their typing and every- thing. That would be less than the deficiency appropriation that their asking for."

"Gerry, plus all of the office space and all of the other things that go into overhead in an office like this. Now let me say, I'm not recalcitrant on this and neither is the board. The fact is they did try to hire a full GENERAL ASSEMBLY STATE OF ILLINOIS HOUSE OF REPRESENTATIVES 50. My recollection time court reporter and couldn't even hire one. is they offered $19,000 or something of that general magnitude, which is way more than $13,500 and they couldn't even hire one. Ah...there was also an allogation made, and I don't know how true it is, that ah...they thought they had one and that one was blackballed, but one of the gentlemen on your side asked if that question were true and ah...there is a serious problem in hiring a full time court reporter. Let me say again Gerry, they want to go that way, they have tried to go that way, I agree with you it's the best way to go, and if there's any possible way they can do it, they will do it with this approp- riation."

"That's exactly right, the pollution Control Board is conducting no hearings right now because they don't have the money to pay for the court reporting services. They're having to devote their attention to other matters and ah...they are really crying for this appropriation. They've called me every single day for the last couple of weeks to see if I can't get this bill through for them so that they can. go back GENERAL ASSEMBLY STATE OF ILLINOIS HOUSE OF REPRESENTATIVES to work in conducting their hearings."

"Well I wrote a letter some months ago to the Pollution Control Board, and the chairman of that board indicating my displeasure at the $7.00 or $6.95 court copy of the transcripts provided them during the public hearing. And I inquired at the time, why they couldn't with the machinery and equipment available to them, in their own office down town, provide the copy, seven copies that were necessary to ah... make the hearing worthwhile. And I am still waiting the answer from that board. Now in conversations with the EPA in relation to the Pollution Control Board when you go over there, not on Jefferson Street, West Jefferson Street and try to find something out ah...as to the activities relative to the Pollutuion Control Boards activities and to the EPA, they will tell you over there that all they can tell me, or anybody that goes over there is merely hearsay. Now it appears to me and its quite obvious, that the ah...ah...communication between the Pollution Control Board and the EFA is certainly lacking in something, because on 17 different occasions in this past year I have been able to find out exactly nothing from the EPA and Pollution Control Board. Now isn't it true George That...that ah...they do have the authority to transfer funds within that agency up to 5%?"

"Now why, if these public hearing are so important, and they tell us they are, and I have several in my area that I consider to be quite important, why didn't they in order to continue at least one or two of these public hearings affect GENERAL ASSEMBLY STATE OF ILLINOIS HOUSE OF REPRESENTATIVES 53. that transfer of fund within the agency. Ah..instead of waiting till now, and as you say, as you say they keep calling you every day for this efficiency appropriation. Now they had funds available to them merely by exercising the authority transferring funds within the agency, this was never attempted because I pointed that out not only to the EPA but to the Pollution Control Board, and of course, on three seperate occasions when I wrote to them they completely ignored my... my communication to them. So I understand the appropriation was for initially $250,000. Now are you satisfied George, that all of the public hearings throughout the state, that have been terminated because of the lack of funds in this part of the budget for the public hearings will be continued and continued to a conclusion with the addition of this money?"

"Ah...Bus, let me say several things. First the amount authorized transfer is 2% not 5% and I don't personal. know whether that 2% has been transferred. I would be a little suprised if it had not been under the circumstances. But even if has not been, 2% transfer is not going to be enough to conduct all of the public hearings that they have going. Now as for your second point, The whole purpose of the deficiency appropriation is so that they can continue the hearings that have already been initiated, and subject to other considerations such as the manpower the board members, you know the board member split up for the hearings because there's only five of them; they also have hearing officers who conduct the hearings for them, so they're doing the best job they can with the limited GENERAL ASSEMBLY STATE OF ILLINOIS HOUSE OF REPRESENTATIVES funds they have available to them , to conduct as many hearings as they can all over the State, and...and I assure you the main purpose of this deficiency appropriation is to get them back in action so they can complete the hearings that your falking about. Now finally, Ah...let me say to you that ah...my...my experience has not been the same as your in communications with the board ah...I'm...I'm embarraged that any administrative agency in State government does not reply immediately to any State Lesiglator who writes to them, and certainly that's a matter which I will take up with both the chairman of the Pollution Control Board and the director of the Environmental Protection Agency and I'll ask them to go back through their files and contact you directly to make sure you get an answer, because certainly like any citizen of the State, and really more so because your'e a State legislator your entitled to a answers when you write to an agency like that. I might say...."

I would. like to point out to you George that on many different occasions ah...I'm not so concerned with the fact that my communications with the board have been ah..ignored so to speak, but many of the people from my district, particularly one area of my district have written the different people involved in this activity and have found them lacking in responding to. their inquiries. Now George, I...there's only one thing that concerns me and that is I can tell you quite frankly that that two percent transfer, and I agree with you it used to be five and by legislative action we reduced it to two, and I recall that and you 're quite correct, GENERAL ASSEMBLY STATE OF ILLINOIS HOUSE OF REPRESENTATIVES 55. but that transfer has never been made within the budget of the Pollution Control Board, because I specifically asked that question and they said no because the amount that would be forthcoming from such an action would not be worth while. Well I can say to that, and its obvious, that if we could have continued one public hearing because of the two or three thousår. dollars involved for that activity, we would have been successfu and something would have been done while we were waiting for this efficiency appropriation to be ah.. finalized. Now again I want to convince you George, and everybody else in this Chambe.. that I am going to continue to insist that the Pollution Control Board do something about the cost of recor...of these transcript. because I, like Representative Shea, know for a fact through inquiry and through facts received through that inquiry that obviously, and they have proven it to me time and time again, that six dollars and ninety-five cents is just outrageous for copies of these transcripts per page, and I hope that you'11 pursue that and see that somethings done in this area."

"Ah...Bus, you can be sure that I will, let me say just a couple of things. First of all, I know one thing that ah...chairman Curry is doing is making the copies in the office. They've made arrangements to do their own zerox or duplicating copies in the office so that they don't have to buy all seven copies on the outside. Believe me Dave Curry is a lawyer, he's well aware of the...as all lawyers who have to handle these goofy court reporting fees all the time are aware, he's aware of the inordinate cost of them. Ah.. One thing that he's discussed, is the possibility of GENERAL ASSEMBLY STATE OF ILLINOIS HOUSE OF REPRESENTATIVES 56. shortening the public hearing by entering in a proceedure by which the ah...complaint and a proposed stipulation of facts are sent to the respondant at the outset. If the respondent agrees to that stipulation of facts and order can be entered and the hearing can be immensly shortened, instead of taking all that testimony in a hearing where you have to have the court reporting sitting there, because we've required that he have a court reporter sitting there, it can all be done before hand, so that there's no court reporting costs on the...on the collection of the facts that can all be stipulated to. This is a proceedure that the Federal Trade Commission has used for many years to great success and a great saving of the public funds. While I'm up let me... let me say one other thing ah...in Mr. Curry's statement before the committee he indicated that his budget allocation for court reporting in fiscal 1972 in answer to Gerry Shea's question was $194,500."

In Decatur Illinois there is a man by the name of Rose, who owns the landfill around route 48, now he does not take any garbage. He's recovering, or was recovering his own land for the best interest of this...of our community and I say this as an expert on our community, and the needs of our community. A hearing that was held on the Rose case as such was such that I...I attendended it, was such that I felt was not only a waste of taxpayers money, but it was conducted in such a way that it was obvious that the hearing officer and GENERAL ASSEMBLY STATE OF ILLINOIS HOUSE OF REPRESENTATIVCS 58. those connected with it didn't know a thing about our community. Well...because obviously they were not from it. Now there is a Mrs. Day in Fairfield Illinois, I believe that's in Representative Blades district, and I checked up on her and her ah...her case ah... hearing for the Environmental Protection Agency. Mr. Rose was fined $1,500 for recovering his own land. Making it valuable for our community and stopped, well practical stopped. Our community...Ah... Montgomery Wards, a city square block is built on Civil War Dump. The Mrs. Day case they fined her $150.00. The charges were identical. Mrs. Day $150.00, Mr. Rose $1,500 fine. There only was one slight exception in relation to justice, Mrs. Day, in Fairfield Illinois was taking garbage. Mr. ah... Rose was not. Now here's to my mind an absolute case of injustice. There's many more things I could tell... that I could...havn't got the time allowed me here but I think it's time we teach these gentlemen a lesson, that they are going beyond what is sensible and logical for the best interest for this State or this people. In my community in relation to State accompany I can quote it. The Northwestern Railroad I can help quote it. The Illinois Power and Light I can quote it, and the stories, but I cannot take the time for these various incidences. But we have a chance to if not.. since its a expenditure that they have already spent and that has to be made up a deficiency, we can hold this off till the end and teach them that it's time that they begin to look at what their doing and what they're creating. Most of them from Chicago, they have no understanding of downstate problems and the effect down state and could care less. They're dictatoria GENERAL ASSEMBLY STATE OF ILLINOIS HOUSE OF REPRESENTATIVES 59. they are ah..ah..manditory ah..they...they could care nothing for what we think or what we want or what our best interests are, and this I can state without any question in my mind for my community, that they do not understand what is best for our community and could care less. It's time we bring a halt to some of the things that they're doing and delay them in the creation of one of the greatest political machines that this State has ever seen with autocratic powers. And I say we should hold this off for a while till the very end, last day and then let them have the money to teach them that they should keep within their budget."

In turn director Curry mentioned that they received a new personnel officer from the ah...charge of their office and the hearings are running approximately $1,000 per hearing. Since January this cost has been reduced to approximately $700. We still aré concerned in this area for the excessive costs per hearing. Part of the cost were court reporters. In turn we had asked that the good director contact the department of personnel and see if people in this state could be trained in this area. The third item that we mentioned were the possibility of the people that were found guilty...guilty when they were imposed a fine, GENERAL ASSEMBLY STATE OF ILLINOIS HOUSE OF REPRESENTATIVES 60. part of the fine would be off the court costs. And this can be based upon the dollar amount that was needed to bring in a case, justify its position and through the courts. I hope that the sponsor of this bill makes cognizance of the facts, and in turn when the revenue appropriation comes up, we'll have an answer. I support this measure, and I ask that members of this House do as well."

If you people would ever try to find out what is happening to one of the cases that these people have, from Aurora Illinois to Chicago GENERAL ASSEMBLY STATE OF ILLINOIS HOUSE OF REPRESENTATIVES is only 38 miles and the phone bill certainly shouldn't run too high. But you can spend a ten dollar bill trying to find out where these cases are. And I'd like to point out to Mr Burditt, only because he has made the statement that he's going to talk to these people, to try to straighten things out. I've had this same problem, and as of today Mr. Curry hasn't answered any of my phone calls. I've had calls from his secretary when you start questioning them about a certain case and they don't know anything about it. So you end up spending money...a ten dollar bill is nothing when you start making phone calls to either the board, the EPA or the Attorney General's office relative to these cases that the citizens of my district would like to know something about. And I certainly would suggest, ah.. George, that you go to these people and explain to them, that the people in various district are vitally interested in this particular field, and they want the informa- tion, and if the Legislators can't get the information, how do you expect a citizen that is interested in one of these cases to get it. I've had alot of complaints about these three areas. And I wish, certainly that you would do something about it."

I regret that the debate on it was cut off so early that some of us could not voice some of the things that constituents in our -various-districts-had-requested that we bring before this House. GENERAL ASSEMBLY STATE OF ILLINOIS HOUSE OF REPRESENTATIVES 62. Ah...matters that I think would be vitally important to this House. I had the pleasure just recently of meeting with the environmental ah...committee of the Chamber of Commerce of the city of Decatur, Illinois, and their experience is not unique. And this is one of the matters that this bill covers that they discussed with me on that day. This bill that you have voted in now, and which I wish to have the opportunity to have voted against, is a bill which demonstrates the imprac- tibility ah...the impracticality and I might say a view that is previlant among the people throughout the State of Illinois to arrogance of the Board of the Environmental Pollution Control. Not only in the manner in which they've handled the people's funds, in which they seem to think there is not bottom to the barrell, of the revenues that the people can pay to the state of Illinois or to the local municipality upon which they...ah.. they apply some of their impractical requirements. The people who talked to me from the Decatur Chamber of Commerce indicated to me that the industries were experiencing the same problems of impracticality. They are required to put up bonds and to build matter for which there are at present no technical scien- tific data and required to guarantee that these matters will work, without giving any time to prove whether they will or will not and if they can be changed, and be subject to fines and subject to the various actions of the board. The municipal- ities have suffered the same difficulty in trying to build sewers and trying to find out the regulation that would apply. I suggest and would like to have had the opportunity to suggest GENERAL ASSEMBLY STATE OF ILLINOIS HOUSE OF REPRESENTATIVES 63. that we hold this off and indicate to the board how impractical they are and that the experience that the people are having with them throughout the State of Illinois. The law is good and the law must be enforced, but it must be enforced with practicality and with decency and with a lack of arrogance. And I think this board should know that. Thank you Mr. Speaker.

"Mr. Speaker, ladies and gentleman of the House, Amendment no. 2 is an appropriation of $30,000,000 which will be the cost to local government in lost revenue if this bill becomes law. I requested of the sponsor a fiscal note and from the best I could assertain the lost to down state communit- ies would be some $27,000,000 or $28,000,000 in revenue and they were not able to assertain the amount of revenue lost in cook county. Now when the sponsor of this bill. Mr. Speaker I wonder if we could have a little quite, this is a rather importan amendment. At the time the sponsor of this bill presented the bill itself to the revenue committee, he talked in terms of at least $25,000,000 in lost local revenue to the communities in property taxes. He proposes some type of financing or financial arrangement where $5,000,000 of that is in fiscal '73. And another $20,000,000 be paid in fiscal '74. Which means: in fiscal '74 we would not only have to pay the $20,000,000 that is due from fiscal '73, but another $25,000,000 due in fiscal '74. What the gentleman is attempting to do is to throw a burden GENERAL ASSEMBLY STATE OF ILLINOIS HOUSE OF REPRESENTATIVES 67, of some $45,000,000 dollars into the fiscal year some months down the line and heavens knows where we're going to get the money to pay for it. And if we're going to lose this much local revenue in property tax money or in personal property tax money, and there is no sound way to replace it, there is only one place it's going to be replaced and that's in an increase in real estate taxes. So I would hope that the members of this house would support the addition money that this bill is going to cost so that we don't have an increase in local real estate taxes."

I agree, ladies and gentleman that personal property tax relief is an important question, and that each of us should have an opportunity to vote upon the merits of the various proposals on third reading as those proposals are presented ah... by the respective sponsors without the albatross of spurious amendments to such proposals, which is exactly what Representativ Shea's proposed amendment is. Number 1 there is a companion to this House Bill 3776, which would provide a replacement on a dollar to dollar basis of the revenues lost if this classificatic of farm personel property is an act and it provides for a replacement on the basis of time frame in which the fiscal impact is felt by local government. That is the end of fiscal '73 and fiscal '74. Representative Shea is proposing that the appropriation be made in fiscal '73 for an impact that will be felt in fiscal '74. A type of proposal of which I have heard Representative Hanahan and others on the Democrat side of the aisle on appropriations contend and I agree is very imprudent allocations of funds and poor planning. But beyond that GENERAL ASSEMBLY STATE OF ILLINOIS HOUSE OF REPRESENTATIVES 69. Representative Shea's proposal calls for distribution of these moneys to local government and gives to local government the right to determine how much it is they would have lost without any definition of ah...terms and with what would result in gross lack of uniformity. One local unit of government might estimate that it lost so much in revenues from the enactment of this proposal. Another might use assesments in extensions from varying years whereas, the replacement proposal that is companion to this spells out very clearly the formular for dollar to dollar replacement and gives authority to the Depart- ment of Local Government to ah...authorize and make the alloca- tion. So this amendment would make unworkable a proposal which I contend we, as members of this House of Representatives, have a right to deliberate upon as it has been presented to this point on third reading, and determine at that juncture, whether or not we want to provide this type of farm personal property relief to a class, which I feel has been onerously burdened by a cruel double tax. And so I ask that every member ah... defeat ah...vote to defeat this amendment so that the merits of the bill can be deliberated upon on third reading."

"Mr. Speaker, the bill would exclude certain personal property from local taxation. If that property was not taxed locally, local governments will loose some $25 to $30,000,000 in revenue. I think you will find there has been a fiscal note requested with the bill, and was filed by the sponsor and those are the figures that he and the Department of Local and Governmental Affairs supplied to me. This amendment is an attempt to replace that local revenue so that GENERAL ASSEMBLY STATE OF ILLINOIS HOUSE OF REPRESENTATIVES 71. local governments will not have to raise real estate taxes. Now we're just paying too damn much for real estate taxes now and I for one want to be no part or partial of any bills that are going to raise them. And that is what this bill will do unless there is sufficient money appropriated to pay for that loss. Now I would think that an amendment that would replace the revenue that is going to be lost by units of local government under that bill would be a germane amendment."

Now ah...this was heard in Judiciary too and received as a favorable vote nine to three. Let me be brief, but get directly to the point, in communities like my own, and communities which are smaller, an action instituted against ah...the medical profession is newsworthy. It gets reported. Now if you have an action instituted against a Doctor, or an institution or several doctors when the matter gets to court the judges will be able GENERAL ASSEMBLY STATE OF ILLINOIS HOUSE OF REPRESENTATIVES 79. to distinguish ah...among the persons, as to whether or not some should be in there and some should not. And as a consequence the persons who should not be in the law suite generally get a directed verdict out. That's all well and good except in a smaller community the damage has already been done. The only point I have in this resolutuion is again a matter of fairness. And my...my suggestion to the Bar Association is to make an effort to work this out with the medical profession. It seems to me, its an element of fair play, it seems to me some area wherein we lawyers could protect someone from damage that could be done ah...before any wrong was done. I would appreciate a favorable vote."

The senate asked the medical society to come up with some recommendations about the problem of the maldistribution of doctors and the difficulty of keeping adequate number of doctors in the State. And the medical society in return among their recommendations made the following reference to the question you 're bringing up in your resolution, that the state legislature could make GENERAL ASSEMBLY STATE OF ILLINOIS HOUSE OF REPRESENTATIVES 80. Illinois more attractive to physicians by improving the malpractice climate through the enactment to proposed legisla- tion. Now my question is: In this resolution is there a way that we can incorporate the results of that resolution back into this so that there will be communication between the lawyers and the doctors, and I know this is a question and I am making a statement, but I hope that there will be a way. And I'm asking you in your resolution in the whereas's allow for the breadth of communication which is neccessary to really deal with this very important question?"

While again like the DRamshop Act, if you will, the good are not distinguished from the bad, and the damages done by the filing of the suite, ah...I don't have any quarrel with your point that the patient must be protected at all costs, but at the same time if there's anything we do have a need for it's, I think, a physicians and surgeons and medical type of people. And they are being influenced by the non meritorious case. Ah...and this is all I'm getting at, and actually ah.. Bernie, it's a matter to urge them to try and develop something. I'm not asking for anything in a black and white line, I'm just encouraging them to get together."

There have been a variety of attempts made in GENERAL ASSEMBLY STATE OF ILLINOIS HOUSE OF REPRESENTATIVES 83. different states, not by law, but by the getting together of the two professions. Ah... New Mexico, for example, if I feel I have a legitimate claim say against a doctor in a hospital I can refer my claim to a commission made up of doctors, lawyers and the public. And if they deem it to be a good claim, or if they deem it to be one that may be a good claim, they will say let her rip and we'll find doctors who can testify on your side of the case. On the other hand, if they do not deem it to be a good claim in the sense that there's a question in fact involved, they don't forbid the filing of the suite, they merely urge you not to file it. So what I'm trying to do is keep it on a really ah....an urgent and cajolery way ah. rather than try and set any firm and fast rule."
