I have noted over the past week that a team of about seven armed folks in uniform have been guarding the chamber, that they have been in the back hall here, up there, usually up there now, outside. There is a team of about seven. I have always relied on those wonderful men in red jackets to watch our doors. Are we in peril? I recognize that under...under four.... Rule 4K, you have the general supervision and duty to protect the security and safety of the House chamber. Are we in peril that I don't know about?"

"I would imagine a fellow like you with your voting record is probably always in peril, Representative Greiman."

"Well, but I can defend myself. Somebody my size can defend themselves."

This happened immediately after the assassination attempt on Pope John. And at that time I suggested to the Speaker that we might be well advised to improve our security around the chamber. He agreed, and I believe that he contacted the Secretary of State's office to do just that."

"If I might just have an opportunity to comment. I...agree with my Minority Leader on many issues like statewide grand jury and things like that, the great issues of the day, but I can disagree with him on this issue and disagree with the Speaker on this issue. I don't think that we should...each time there is some world thing that occurs, assume that we're going...we're in some kind of peril. I haven't found any State Representatives yet that have been the object of assassinations or anything like that, and I think that I find my...well, you can wave me down if you want, but I find that when we are in this free society and we require armed guards in both of the balconies, that this is indeed a sorry day for democracy and for open expression and for freedom. Too many people in Parliaments long gone complained about the notion of armed people around the Legislature. And I would ask that you rethink that, Mr. Majority Leader...I mean Mr. Minority Leader, and Mr. Speaker, and perhaps remove the armed guards from our midst."

"Thank you, very much, Mr. Speaker, Ladies and Gentlemen of the House. Amendment #3 to 447 adds a little over a million dollars to the appropriation. Right now, currently, indigents that appeal in the State of Illinois, the state pays for the indigent appeal for all counties except for Cook County. Cook County, about a third of their indigent appeals are paid for by the state dollars. This was pointed out to me by Herman 'Nell' and I agree with him that that's unfair. And So, all this does is equalize Cook County with the way they treat all their counties in the state. And I would move for the adoption of Amendment #3."

"Is there any discussion? Representative Wolf." Wolf,J.J.: "Yes, Mr. Speaker, Members of the House, all this does is add 1,175,824 dollars to the appropriation. I'm going to urge people to vote against this. You know, we've been working. There's a number of Amendments coming up here today. There's a total out to over 133,000,000 dollars of additions. The Appropriations Committee has been working diligently, working long, hard hours. We were able to find 105,000,000 dollars to take out and some of those cuts were very painful. Most of these Amendments we're adding on today are strictly budget-busters and I hope everyone will 6  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 48th Legislative Day vote 'no' on this Amendment. It's money we just can't afford."

"Mr. Speaker and Members of the House, Amendment #3 comes to me as quite a surprise. The Gentleman who's offering the Amendment is my. I believe, my principle Cosponsor on House Bill 447 and we discussed at this some at length, and I think...I thought that we had some understanding that the agency was not in favor of this additional fund I, perhaps, may have been in error. Mr. Speaker, Members of the House, I find it somewhat bewildering that the downstate leader on the other side of the aisle would be offering this Amendment to bail out some funds for Cook County. Now, the Cook County people who are interested in this Amendment spent little, if any, time talking with me about the offering of this Amendment and the spending of this additional money. Mr. Speaker and Members of the House, everyone knows how this agency is funded and what their individual responsibilities are. To come down to the Assembly in the closing weeks of the Session and try to grab an extra million and a half dollars only for Cook County certainly isn't fair to the agency, nor is it fair to the taxpayers all around the state.. The Amendment adds excessive dollars to this particular agency. And for those reasons, Mr. Speaker and Members of the House, I rise to oppose it."

"Can you... Thank you, Mr. Speaker, Members of the House.. It seems to me that if the concern about the budget that both Representative Wolf and Representative Telcser are 7  STATE OP ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 48th Legislative Day May 21, 1981 addressing is very real, we would, instead of this kind of an Amendment, seek one in which they would be reducing the expenditures that right now go only to downstate counties. It seems to me that if we are concerned about finding places to close up expenditures that are not, in fact, necessary, for you to argue that equity is not relevant in Representative McClain's Amendment is exactly the wrong tact to be taking. And I would feel that your sincerity would be a good deal more clearly put on the line if either of the Gentleman who spoke against this Amendment were instead offering this House an Amendment to reduce this appropriation by the amount that downstate expenses are, in fact, picked up by the State of Illinois, rather than by opposing Representative McClain. I'm going to vote 'yes' on this Amendment and I hope the other Members of this House will too."

"Thank you very much, Mr. Speaker. Ladies and Gentlemen of the House, I'd like to bring out three things if I can. First of all, neither the Appropriation Chairman nor the Majority Leader should talk about holding the line on the budget. In the Mental Health budget alone, they passed out a five million dollar Amendment onto the Mental Health appropriation that was not in the Governor's budget. So they can't really talk about always that the Governor's budget is sacrosanct and that it should never be amended. Secondly, Mr. Telcser, if you recall our discussion, there was some confusion on what you meant by 'agency'. And I let you off the hook on your word because of that confusion and we did not have any trouble there. I did not take any personal affront at that. It was just confusion on our word. And so... But for you to say that a downstate leader 8  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 48th Legislative Day May 21, 1981 is supporting this Amendment, I think all downstater's should support it because all we're talking about is equity. All downstate counties now... The indigent appeals are paid for by the State Appellate Defender's Office. Only in Cook does a third of the appeals ... be paid for by the State Appellate Defender's appropriation. Two-thirds are paid for by the county taxpayers. I think that's inequitable. I think this is a fair, equitable Amendment. I think everybody in the House ought to be in favor of it, but don't start talking to me about holding a sacred budget in line because you're own majority-held appropriation budget passed on an Amendment of five million dollars for the Mental Health that was not in the Governor's budget, just a bludgeon to the Director of Mental Health. So I'd ask for a favorable vote."

"Yes, Mr. Speaker. I rise on a point of personal privilege. I know, Mr. Speaker and Ladies and Gentlemen of the House, that a lot of you think that I am going to say that I am appauled. Well, let me tell you something. I have been appauled so many times in the last 10 days that I have become immuned to it. But on my point of personal privilege. Nr. Speaker, last Saturday and last Sunday, being a consciencious Legislator, I sat in this House waiting diligently for my Bills to be called while a lot of other Members of this Assembly, including leadership, went home over the weekend because they knew damn well that the deadline was going to be extended. And then Monday when the deadline was extended, the Speaker stated, and I believe, because I am a naive big city slicker, that every individual will have the opportunity to have their Bill heard once. Well, Mr. Speaker, I pose this question to you now, what is the posture of the Chair as far as the deadline on appropriation Bills, and what is the posture of the Chair as far as our working schedule for this rest of this week? Because I am not going to sit here if you're going to go home."

Amendment #5 takes its direction from the Republican Subcommittee and appropriations which originally recommended a reduction in operations to a level of 16-2-55. Working with other Members of the House, we agreed that that was an appropriate figure, and part of the rationale relates to the notion that there will be some decreases for some public personnel teaching in otherwise, at university levels, for example, to take their pay increases later in October. So the operations budget, as you see it in this Amendment, offers to the House for its adoption a lesser figure than came out of the full Appropriations Committee, but one that was originally a recommendation of the Subcommittee. And I would move for its adoption."

As you said, Amendment #5 is basically the same...reverts back to Amendment #3 which was placed on by the the Subcommittee, but after Subcommittee's recommendations were taken to the full Committee, this was changed as such, and I would have to oppose Amendment #5 because I believe the Bill as it came out of the full Committee after some negotiations with the Subcommittee and the full Committee, is in the proper form, and I would have to oppose your Amendment #5."

"Well, thank you, Mr. Speaker. The Subcommittee Chairman, Mr. Wikoff, is absolutely right. There was a point of departure Amendment in the Subcommittee, and through further negotiation I must inform those of you who have talked to all of the people that came to see you, that Representative Schneider's Amendment also includes a decrease for the summer internship programs for those young students who have particupated in that. You must remember that in the intensive negotiations that took place after the Subcommittee had acted on that particular morning, the full Committee then adopted the additional increases to the budget. It still is some 40% below the new money that was in the operations budget. This is a small cut, but if we're to get to the situation where we can address things like the actual needs in the local districts and drivers' ed in other areas, I think we ought to be supporting these Amendments that do not do harm to the operations by way of the cuts but allow us to put money back where necessary into the real programs in the school districts. And that is why this Amendment and others on this Bill... on other Bills ought to be supported."

Representative Speaker Ryan: "When I get ready to let you know. Stuffle on House Bill 492."

"Amendments #2 and 3 failed in Committee. Floor Amendment #4, Stuffle Schneider, amends House Bill 492 as amended."

"Yes, Mr. Speaker and Members, this Amendment is an attempt to put back in this appropriation Bill only the amount of money that would have been there had we continued the appropriation for the school aid formula distributive fund at the amount of the Governor's original requested $90,000,000 allocation for elementary and secondary education. I think it is important to note on this particular Amendment that if we were to restore the amount of money in this Amendment, we would indeed be at the original allocation level, not at the SBE'S first level. This represents only a 2% increase in the formula distribution from last year. I believe if you go back and look, that is the lowest increase in this state in at least a decade for the formula distribution. I would also indicate to you that this Amendment provides full funding for those summer school students who are funded within the distributive formula's appropriation Bill every year. We're talking about here some $300,000 additionally above what came out of Committee. It is very important that you look at that summer school handicap program, I think. On the Republican side of the aisle particularly. Representative Hallstrom has worked very hard in this area. And I hope she would take a look at that. Because all we fund any more on our fiscal line item for summer school handicapped students are those students who are certified to necessarily have to have summer school programs in order to continue their education SO that they don't slip backwards. We used to put millions more into this line 27  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 48th Legislative Day May 21, 1981 item to fund all of the handicapped kids in the state in any summer school program, but we compromised down some three years ago to the point that we now only fund those severely and multiply handicapped kids. $3,000,000 is definitely necessary to provide the full reimbursement there, and I don't think anyone would want to cut that. Also, I would indicate to you that this formula appropriation fits directly into the Bill we passed last night sponsored by Representative Hoffman, House Bill 1353. If we were to add the money here, that Bill will automatically adjust to the appropriation level in this Bill by way of the per pupil guarantee. Now, I know that there are some people on the Republican side of the aisle, and perhaps on our side of the aisle, who might oppose this simply because we're adding money. But I would indicate to you that the Democrats on this floor, and I would hope some of the Republicans will join us, will be proposing Amendments to each and all of the appropriation Bills as we go through them today and tomorrow and this week to reduce money so that you will be able to necessarily put money in the priority programs like elementary and secondary education. Lastly, I would indicate to you that the formula part of this Bill is virtually identical to the amount of money that is proposed in the next Amendment by the Republican Chairman of the Elementary and Secondary Education Committee. For what reason he is now proposing this, I don't know. I hope he will persist in that effort on Amendment #5 and will support this Bill because it has the same level of appropriation in it as does his Amendment for the formula. I hope that that was more than a momentary pang of conscience, and he will support us on that. And for the reasons cited here today and for the fact that we're offering Amendments that will cut other 28  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 48th Legislative Day May 21, 1981 areas so you can fund this necessary priority that we all campaign on as the number one priority in the state, that you would support Amendment #4 to this Bill."

"Thank you, Mr. Speaker. I would rise in opposition to the Amendment, and if people will listen for a second, I think I can explain coherently why. My own personal opinion is that this number is about right for general state aid. But we can't come in at $13,000,000 over the Governor's level because the money doesn't exist. Let me show you what's happened here so far. We hear a lot of talk about how we're going to make cuts in operations in order that we can justify increases in grants. Great. We made $9,800 in cuts. Now we're offering an Amendment to put $13,000,000 in new money. I had next intended to offer an Amendment that would put essentially the same amount in, and I would certainly would be willing to increase that to fully fund summer school. But the only way you get that money, unless you want to print it or play with play money, the only way you get that money is by cutting money somewhere else out of education which I was prepared to do with a subsequent Amendment to another Bill. It is my understanding that the Minority Party would not support that, so I will be withdrawing Amendment #5. My problem is, we don't want to send false signals to school districts. They start making plans based on what we do at this stage even though we all know it is going to end up in a Conference Committee. All this proposes to do, it is a raw pure add of dollars. There is no...there is no offsetting cuts. That just isn't going to happen. The Amendments all total that the Democrats intend to offer don't make that happen, and so I would oppose the Amendment. I think Representative Reilly pretty well hit it on the head, but let me point out something. We're going to hear throughout the day and days...the next few days to come a lot of very impatient speeches about what we're doing to various segments of the population, and this small amount is really not going to make that much difference. But as of the Amendments which were filed on the appropri....or as of last night, the Amendments which were filed on the appropriation Bills that we have before us, we have a total of 133.2 million dollars worth of appropriations which are added back on. Now you know and I know that those are not going to stay on there. The Governor has said very plainly that the money is not there and he is going to veto it back. Now, are we going to make the decisions or is he going to make the decisions? This is $13,327,000 in one lump sum. We cannot afford it, and I think that we should be the ones that make the decisions rather than the Governor on this, and I would urge a 'no' vote on this Amendment."

"Thank you, Mr. Speaker, Members of the House. Again let me make it very clear that this is part of a long series of budget busting Amendments that are a sum total of over $133,000,000. Now, the Gentleman who offered this Amendment, and I'm not questioning his sincerity, but has constantly put Bills before this Assembly increasing pension benefits by millions of dollars, and I submit to anybody with an ounce of common sense, where are we going to get the money from? "Yes, Mr. Speaker and Members. I hope that the Republicans look at what the Democrats, at least this Democrat and some others, are willing to do with regard to budget cuts on other Bills. And keep in mind two things Representative Reilly said which were inaccurate. First of all he suggested that there was only one cut coming down. We've only considered one Amendment that has passed here because we've only considered one Bill that proposed a Democratic cut n any area. That is why the only cut that has been made or considered is that one before us that came on the previous Bill. Secondly I would indicate to you that you can indeed vote for those cuts and you can indeed reallocate money just as our counterparts in Washington are now about putting together reallocations. Also I would point out that that Gentleman who introduced Amendment #5 which did put this at the same level as us and now is willing to reject his own position, himself added $5,000,000 by Amendment in Committee to another Bill on another appropriation. So he himself subscribes to the theory that you can reallocate money without question. I am glad to go back and say that I am working to cut the budget where necessary, but also trying to put the money back where it is most important. I ask an 'aye' vote on Amendment #4."

"Well, Mr. Speaker and Members of the House, this proposal, I thought, was doing the Governor's work. We were talking about the... the direction the Governor wants to go is to force the local taxpayer to pick up the catagorical programs, increase the taxes locally, and drive some credit from advancing more funds through the per pupil guarantee into the districts. So I think that is pretty much the motivation of the Governor, and I sense that those of us on this side of the aisle, at least, who appreciate the difficulties of other kinds of catagorical grants can also vote for this as well as those grants. We cannot continue, as the Governor has done in the last four years, to back away from our Constitutional obligation. That is to provide 50% or more of the educational funding and responsibility for education. So what we're seeing here is that an effort to, as you'll see in subsequent Bills, an effort to place the costs of education back in the locals. Look at the last four years. We have moved from about 47% at the arrival of the Governor down to about 42 or 43% of the state responsibility. Inversely, the local responsibility has increased. May 21, 1981 That is to give more money to distribute statewide for those districts. I was discussing this with the IOE, and they said in Peoria for three consecutive years, they have reduced the school book fee. And what this program does, it offsets any increase in school fees for any school student."

"Well, I am trying to get a handle on last year's appropriation versus this, and what you're saying is you need $9,000,000 in order to affect the program. Is that what you're saying?"

"No, Representative Tuerk. To fully fund the program from kindergarten through 12, one book per student in the entire State of Illinois, it would take $25,000,000. "Well, Ladies and Gentlemen of the House and Mr. Speaker, I would like to point out that three of the speakers that did get up and object have never supported the program at all since day one., So their opposition is very natural. Mr. Cook told me that four public school administrators have contacted him unsolicited, to testify before the Senate Committee. This is one of the best programs that we have ever passed out of this House. There is less red tape. All they do in the school system is order the book, and within three months, they are sitting there at the schools waiting for the students to return in the fall. It would seem ashame that we would cut this program back to $5,000,000 when every single parent in every district saves money through this particular program. If you really want to do something for the people in your district, please vote on this Amendment. Please vote 'yes'."

"Thank you, Mr. Speaker, Members of the House, continuing as one of your Members suggested of looking at 50  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 48th Legislative Day May 21, 1981 the education package in a total picture. Amendment #9 adds to the formula driven mandates a percentage dollar amount that represents 95% of full funding in areas of private tuition, extraordinary services, personnel and orphans tuition which is 100%. It changes the Chicago and downstate bilingual in the following fashion, recommends $13,500,000 for Chicago bilingual; $3,875,000 dollars for downstate bilingual. The Chicago figure is a slight increase over last year's expenditures and the downstate bilingual is also...is a slight drop because of various lapses in the program. We also then, we'll change text books downward to $8,000,000 from last years 12 and from the Amendment that was just adopted at 14. Further on in the package, or the Amendent rather, under regular transportation this Amendment will bring the school districts into almost 98% of full funding, special ed. transportation, 99%. Those two figures, I believe, come out of the Republican Sub-committee, once again, on Appropriations. That Committee as in a full and final number reduced it. School foods is at 95%. The Death-Blind Center is also at 95% full funding. Now what this Amendment attempts to address, Mr. Speaker, Members of the House, is the very serious reality that if we don't make our commitments as they are prescribed in law to fully fund those programs in special education, we will be failing in our obligation as a Legislature so we attempt through compromise to come as close as we possibly can to the idea of distributing what funds we think are available for the education program."

"He's asking for Representative Keane....Alright, now that's taken place. So what I would suggest to you then is these dollars are our commitment. We understand that there may be fewer dollars available but we are coming in below in the total package, approximately $80,000,000 below the State Board of Education's recommendation. This package in total speaking to the Bills that have already been addressed by Representative Stuffle and myself and a further Bill will bring us somewhere in between what we think can be made available through various kinds of...various reductions in the overall budget in order for us to make the accommodations then in these areas. I think we should all feel strongly about our obligation in the formula driven section of the mandates to fully fund them.. We also understand that there is a sense of awareness that we can't have everything we want. We don't want to destroy the school districts. Keep aware and be...keep in mind, rather, and be aware that what you're looking at in addition to these dollar amounts is the question of whether or not the State ought to really meet its obligation or whether or not we ought to shift the burden for these kinds of programs back to the locals and this Amendment then will continue to meet as best we can our State obligation and we'll give you an opportunity as Members of this General Assembly to speak to those people back in your district. We have an honest and legitimate concern about how we're going to deal in particular with special education problems. I move that this Amendment be adopted."

"Thank you, Mr. Speaker. I'm still waiting for when we 52  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 48th Legislative Day May 21, 1981 get to the cuts. We're told that somehow we're making some cuts so that other things can be done. But let me tell you what the bottom line is and this has been said before but it apparently falls to some extent on deaf ears. The net, I'm not talking about gross, the net effect of all the Democrat Amendments in Elementary and Secondary Education is up 46.9 million, the net not the gross. You add some, you subtract some. The net effect of all the Democrat Amendments, all together, is up 133.2. When do the cuts come, I'm still waiting. The problem is again, that you just don't have the money and the worst part is, we can stand here and it's kind of fun, we pass these on, we send a press release, we write back home, we say we did wonderful things. The fact is, this money doesn't exist and you can't spend money that doesn't exist. We're sending false signals if we would adopt this to all kinds of people who begin making budget plans and then come August, the money doesn't exist, just like it doesn't exist now. And they say what did you do to us, the reality is, we ought to face up to the facts and defeat this Amendment."

"Yes, Mr. Speaker, I do. I would just point out to the distinguished education expert from DuPage County on the Democratic side of the aisle that he speaks a trifle with fork tongue. On this particular issue he would tell you that he's trying, and on a prior Amendment, trying to tell 53  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 48th Legislative Day May 21, 1981 you he's trying to increase the fund for Distributive Aid and that he's going to have further cuts and yet here we are at Amendment #11 when he goes back into the categoricals of one of the most highly controversial items in this entire Legislature each year in categorical grant programs, the bilingual education, and attempts to put another $9,000,000 back into the program. Now, I don't know what his priorities are, although as I look further down the line, his priorities are to remove this from the mandated section and put it into the nonmandated section so it can be cut again. So, I'm a little confused as to what Representative Schneider wants. But this particular issue had three hours of hearing on the Amendment that reduced the level of bilingual to where it is now under Roman Kosinski's Motion and Amendment in that Committee. Three hours of hearing, it was fully debated and the Committee had decided bipartisanly that this should be the level of that particular fund and I think this Amendment should be soundly defeated. I've concluded, Mr. Speaker."

"Thank you, Mr. Speaker. You're more than generous. I apologize for my former conduct. Mr. Speaker, Representative Barnes and Keane adopted Amendment previously which raised the textbook level to $11,000,000. If this Amendment is adopted it's going to reduce the amount to $8,000,000 which is a reduction over last years appropriation. Quite frankly, this is just a direct attack on the concept, the idea and I'd just like to point out to this Legislature that there are 225,000 kids in nonpublic schools in the State of Illinois, which in the last three years is up 35,000. Enrollment is not declining in the nonpublic schools. They have more students and more needs and this Amendment should be defeated."

"Categorical dollars will be changed in the following fashion; private tuition goes from the appropriation level that is now on the floor, from 13,122,000 to 13,699,000; for extraordinary services, $26,917,000 to $28,000,000 the personnel, 122,395,000 goes to the, my Amendment level, 127,275,000; orphans tuition, a 100% figure because of the fact that no one else picks up that cost except the State. 55  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 48th Legislative Day May 21, 1981 It stays $20,950,000. Transportation, special education, sixty million dollars, one hundred and thirty-eight, increased to 62,000,326, a 99% level. Regular transportation, which is not of course special ed, is ninety million and a half to about ninety-seven million, 98%."

"Then, Mr. Schneider, actually quite a bit of this money that you're speaking of does go to the categorical programs for special education."

"These are the formula driven mandates of which text books and bilingual are neither. That's correct."

"The reason I'm interested is because there has been SO much talk about demandating that I did get information from the State Board of Education and from the Governor's Office that there is not going to be any immediate thought of demandating special ed. I think what I'm saying is, that the money is really needed in these special education programs, and I would hope that people on my side of the aisle would vote to increase the funding for special ed."

"Well, the demandating won't take place by substantive language, I don't think this term or this Session but the demandating part will take place as you reduce the funds from the State and place that back on the locals."

"Representative Stuffle."

"Yes, Ladies and Gentlemen of the House, simply to get on the record. The fact that some of the people on the other side of the aisle are not talking about what Representative Schneider vas talking about. I rise in support of Representative Schneider. We suggested that there would be cuts offered to facilitate putting the money back in education by wa y of a prior Amendment to the Distributive Aid Formula and by way of this Amendment. We suggested those cuts would come in a number of agencies and 56  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 48th Legislative Day May 21, 1981 in a number of areas. We did not suggest, as one has done on that side, it would come from education. He believe that priority is education. The money ought to go back there and it ought to be cut and it can be cut elsewhere. And I suggest, again, at least one of the people who stood on that side of the aisle has already introduced an Amendment to put $5,000,000 additionally in the budget of this State that is not there in the Governor's proposal and they are the ones who are talking out of both sides of their mouths. I urge an 'aye' vote."

"The Gentleman from Champaign, Representative Wikoff."

"Thank you, Mr. Speaker. I think there's some confusion around this Amendment and I think the bottom line boils down again to this. This Amendment adds 27.6 million dollars to the budget. Now, I mentioned earlier that there's approximately 133 million which is on Amendments, which are going to be added to the budget. There's approximately 21% of it in this one Amendment. There's been a lot of stories. There's been a lot of comments about this is a good program, that's a good program, everything else is a good program. I'm sure there are. But there's 27.6 million which is almost 28, adds it to what's already 367.4 million and that's what the House Appropriations Committee recommended. This Bill was debated in Sub-committee for quite some time and it was again thoroughly debated in Appropriations Committee and now we're trying to add another, practically, 28 million to it. This deserves a sound defeat. It's not in the bottom line. Again, it will not survive."

I just would like to say, I get kind of tired of hearing the Gentleman from Coles with 57  8th Legislative Day STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE May 21, 1981 his broken record about the Gentleman from Morgan, voted for 5,000,000. That Gentleman also voted to cut 110,000,000 and I've yet to see your first proposal to cut anything out of this budget. This is 26...27.6 million. It ought to go down. I ask for your red votes."

"Thank you, Mr. Speaker, Members of the House. When House Bill 493 was reported from the House Appropriations Committee, the line item for text books was only $5,000,000. We, as Sponsors of this Bill or as Members of the House, had no idea, of course, that Amendment #6 was going to be approved by the House which raised that line item to $14,000,000. Amendment #9, in that one line item, had Amendment #6 been defeated, raised that by some $5,000,000. It's interesting to know, too, that another Amendment, Amendment #15 has been filed to raise this line item for text books to the rate that the House just accepted a few minutes ago, to the $14,000,000 level. As Sponsor of House Bill 493 and as the supporter of Amendment #6, I would support Amendment #15, also. What Amendment #9 also addresses though are some problems that we face year after year in our districts and problems that are faced by our school boards and that's the whole question of categorical aid. I'd like to point, in particular, to two items on regular transportation and special education transportation, that are basically driving our local skilled... school districts into bankruptcy. They're clamoring year after year for support. They're asking us, please help us try to fund our transportation programs and the school superintendents indicate to us that that's the number one problem that they have. Transportation. This Amendment, #9, seeks to do what we tried to do last year, to almost fully fund those line items and let's give them a 58  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 18th Legislative Day May 21, 1981 break on the situation that they have very, very little control over. School districts in my district who contract for bus service are given now blank contracts to be filled in later, to indicate that the increased costs, the energy costs that are rising year after year and almost month after month. Amendment #9 is an attempt to deal with that and to give our local school districts a break and I urge your support for Amendment #9."

"Well, I just wanted to say, at times like these, I don't think we need another $8,000,000 for bilingual education."

"Thank you, Mr. Speaker, Members of the House. We'll address that problem as we progress through the Amendments. All that I would like to suggest to you is what Representative Steczo has indicated is true. For those of you who feel that text books is a high priority, although this particular Amendment will reduce that number by the one...by the Amendment we just adopted by $6,000,000, you will have an opportunity at a later Amendment in this Bill to restore that money. What I think also is true and I think you've heard a lot of comments on over the last couple of months, is what are we going to do with money that is already been expended and we await the reimbursement from the State of Illinois which has committed us to mandated programs? Well, the answer is, to come as close as you can to 100% full funding, and that's what this Amendment does, special ed, transportation, other formula driven mandates. This Amendment is very crucial, I think, to your district in all of those programs that we 59  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 48th Legislative Day May 21, 1981 have imposed upon them. I would argue that an 'aye' vote is a good vote for your district. It's one that sets you straight with the proper programs I would encourage you to vote for it."

"Floor Amendment #10, Currie, amends House Bill 493 as amended on page two by deleting line 24 and inserting in lieu thereof, 'Code $62,840,000'."

"Thank you very much, Mr. Speaker and Members of the House. House Amendment 10 to... the Amendment 10 to House Bill 493 would do a very small piece of what Amendment #9 would have done to the entire categorical grants program. Amendment #10 deals with those people that are most in need of a safety net, the safety net that we've all been hearing so much about from the Federal Government and that we should talking about, ourselves, here in the State of Illinois. It is a safety net for the children who are the least of the children among us and who are most in need of help, and it is a safety net for the school districts that willy-nilly if they are to respond to our mandate to provide special education to children who are in need thereof to make it possible for them to pay for the transportation that those children need. Last year this Legislature opted to provide full funding for special education transportation. Full funding in this case, means following our formula which means we're only in fact paying 60  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 48th Legislative Day May 21, 1981 80% of the cost of providing special ed transportation at the local school district level. Still, to have promised full support, to promise 100% of 80% is not a bad record. The point of Amendment #10 would be to bring that commitment back here to the House Floor today to retain and remake that commitment to our local school districts, restoring 2.7 million dollars to the State Board of Education for post-budget and to that work which vas done in the Appropriations Committee would put us at precisely at that, at 100% of the 80% that our formula promises those local school districts. If we don't adopt Amendment #10, we can't kid ourselves that no one else is going to pick up the cost. We know perfectly well that the local property taxpayer is going to have to provide these dollars instead. Last night on this floor the Governor's people were winding their way around the floor encouraging us to limit local government expenditures severely next year over this year. Many people on this floor voted for that proposal. I would say to each and every one of them, each and every one of you, if you think, in fact, that we can responsibly ask local governments to limit their expenditures then we must responsibly support the programs that we require those local districts to pay for themselves. Failure to provide this 2.7 million dollars is going to mean the property taxpayers will pick up the burden. We may even find local school districts unwilling to respond responsibly to the mandate we've inflicted upon them. I urge your support for Amendment #10."

"Yes, thank you, Mr. Speaker. We've got another situation where we're attempting to add some more money into the budget. All in all of them are laudable endeavors if the money was there. It's not there. This adds 2.7 61  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 48th Legislative Day May 21, 1981 million dollars for 100% funding. State Board asks for 93%, we gave more than that now they're trying to increase it even beyond the State Board request. This is another Amendment that needs a very sound defeat."

"Thank you, Mr. Speaker, Ladies and Gentlemen of the House. This Amendment restores the funding for bilingual education to the level requested by the State Board of Education. I would point out to the Members of this House that bilingual education is basic education for approximately 10,000 children in the Chicago public schools alone. It affects most directly children who are in elementary school. Children who without the funding for this program will not be given the tools with which they can learn and participate in our society. The importance of bilingual education cannot be over emphasized in this discussion. I encourage your support for this Amendment. It does raise the allocation that was put in this line item in the Appropriations Committee but I submit to you, that without these funds a number of young children, children in the schools, will be deprived of what it is that we are here to give them, which is basic educational services. I encourage your support for those children."

"Thank you, thank you, Representative Preston. 94% of the students in Chicago bilingual education programs participated in the programs for less than three years. So we are talking about a transitional program only and again, a program that provides these students with basic educational services."

"Where are those figures you have from? Because I've seen other figures and talked to people who are in the school system, in bilingual education and they indicate to me that where the program initially was designed to be for no longer than two years, in fact, many students are in the bilingual education program for four, five, six, seven and all the way through their elementary school education."

"No. No, Representative, the figure that I have is the figure as provided me by the Chicago public schools but I would point out that in the Appropriations Committee in hearing, the State Board of Education affirmed that figure, that in fact the Chicago program as were the other programs in the State were functioning as transitional programs to provide basic services. I'd like, since you're concerned, to go through some of the statistics. 94% of the students participated in the program for three years or less. For example, 8,093 students who received bilingual services in 1979, June of 1979 were no longer in the program in June of 1980. Most of them left because they had become sufficiently proficient in English to enable them to participate in English instruction in other subject areas. I would point out that the...90% of the program participants were in the elementary schools. 60% of them were between the ages of five and eight. We're talking about little children for whom, in many instances, there is no alternative. 57% of those little children spoke little or no English. 22% were only marginally proficient in English. Again, I...and 80% of the program participants received three or more periods daily of instruction in English. Again, Representative Preston, Ladies and Gentlemen of the House, we are talking about basic education to a significant portion of young children in the public schools to deny them this funding, to deny them this program is to deny them an education and that's really what we are here to do, it seems to me. The need for this program is apparent. Without the bilingual education funding these youngsters will be...will be forced, literally, to not receive education in all the basic subjects, including English to get it as best they can and I think that we are only buying into future problems by cutting off educational services to young children through our failure to fund this program adequately."

"Mr. Speaker, may I speak to the Bill or to the Amendment? I, as I indicated, I've heard a great deal of conflicting information about the nature of the bilingual education program in the Chicago public schools. Representative Braun, presents one side of it and I'm sure that from her knowledge that is accurate. "Thank you, Mr. Speaker, Members of the House, I rise to support Amendment #11. Let me remind the Members of the House of two things. First of all, we are not here today to take a referendum on whether there ought or ought not to be bilingual education in Illinois public schools. Not only do our own statutes require it and the Federal Government statutes require it but in Chicago that Board of Education is, right now, under a decree, a consent order, from the Office of Civil Rights. We're not here to say whether there should or should not be bilingual. The answer is, that there is going to be bilingual in the foreseeable future. If you don't like it, you have every opportunity to introduce legislation to demandate bilingual at the State level, at the Federal level and through the Office of Civil Rights. I. personally, support the bilingual program and I think that the evidence that has come in, particularly recently, on its effectiveness overwhelmingly suggests that the program does work to help children become proficient in English at the same time that they're able to make strides in other...other academic subjects. That's the point of the program. It is transitional. It is not a permanent consigning of a child to staying with a foreign tongue but in fact it is the way in this country at this point that we try to help children learn the English language and also learn the other kinds 66  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 48th Legislative Day May 21, 1981 of subjects that are before them. This Amendment does not increase beyond the level that the State Board of Education requested dollar allocations in the bilingual program. That request compared to last years appropriation is only increased by 5%. I would ask you to compare it to the State Board request for regular transportation, up 30% over last year. The House Appropriations Committee left bilingual education stranded. It left it hanging out on a limb. It left it hanging out to dry. The point is, that in Chicago and in the downstate areas, transitional bilingual programs have to be offered and they wi will be offered. They will be offered not just for children who are Spanish speaking but also for children who are French speaking, German speaking, Greek speaking, Polish speaking and Romanian speaking. The question before us right now is whether we're going to help the local school districts fund those programs at a level that is commensurate with the .actual costs to those districts. The Chicago Board of Education asks for $16,000,000 for this appropriation. The State Board reduced that request 13,750,000 13,750,000 is the dollar figure for Chicago in Amendment #11. I strongly urge your support."

The request that's made in this Amendment, it is consistent with the request from the State Board of Education, which in and of itself, was below the needs to fully fund bilingual education. It was below even the formula that had been applied to other mandated programs in this budget. Representative Currie is absolutely right. This is not a debate over whether or not we should have bilingual education. Currently, bilingual and text books, although identified properly as mandates, are really not what we call formula driven mandates and are in the wrong proposal. So, you cannot make distinctions over mandates without recognizing the questions of reimbursement as a factor in the formula driven. It is sufficient for me 69  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 48th Legislative Day May 21, 1981 to point out to all of you that the State Board of Education has chosen to make an identification for these two programs that places them with special education, a sensitive area that they know will allow text books and bilinguals to increase because many people support special ed out of a genuine interest in the hardships that those children face. At this time, Mr. Speaker, and only because the time is short. The Bill has had many Amendments. I'm going to withdraw this but next year and perhaps subsequently weeks to follow I think we ought to instruct the State Board properly about what constitutes a formula driven mandate and what constitutes a statutory mandate. There is a significant difference. What it does to us, as Members of the Legislature, is make it very difficult to evaluate programs. They know that. They try to beef up their programs because it keeps them afloat and hopefully, indirectly, it might serve the children. I withdraw Amendment #12."

"Mr. Speaker, I know the great concern that Representative Kulas has about trying to figure out what's going on, and as a long time country bumpkin around here I thought I might give him and some of the others a little fatherly advice. For the last four years we were concerned about adjournment and we developed a system to find out. We usually, since we couldn't find out from the Speaker and the Majority Leader, we either asked the elevator operator or checked the airport and see when Madigan's plane reservation was made."

"Mr. Speaker, I received many calls from the senior citizens this morning and they have been asking me what happened to the tax relief Bill on the utility rebate, House Bill 918. "There's been an occasion when I've missed you too, Representative." I

"But, you know, was the Sponsor of a Bill also effecting senior citizens that was near Representative Kornowicz's on the Calendar and if we hadn't wandered the Calendar with all these goofy orders of call, we might have actually been able to take up 918 and it wouldn't be on the Spring Calendar. I would hope that when we consider Senate Bills we might consider them in a more rational sequence like the Priority of Call or a numerical sequence. That's the way we're suppose to do it."
