"Let us pray. Lord God, of the universe, we call upon Your Name and ask Your blessing on these people gathered together for the important tasks of government in our State of Illinois. We are thankful for the dignity and creative challenge of their work. A work that can ennoble them and can lift up the spirit of Your people in this State. May these Legislators rely on Your promised help so that the work they undertake will not be just their own. Help them remember that You, our God, have a holy design for each of us. That we are, each of us, special to You. That are names are written in the palm of Your hand and our place in history, our purpose for existing is known to You since endless ages. Remind them of their own giftedness and the strengths they bring to this job, unique gifts that enable them to work for the good of those they represent and to make a difference. Individual strengths that make it possible to give reality to our dreams and in so doing, to help create Your Kingdom here in our midsts. We rejoice in the reminders around us at this season to be hopeful, trees and fields, birds and flowers are strong signs of renewal and growth and strength. Make all of us, Lord, know the capacity for change in our own lives, for without change there can be no real growth and no true life. This...the Senate has now agreed to recede from this Amendment. The supporters of the Amendment understand the error of their ways and have agreed to back away from this Amendment."

"Mr. Hoffman, would...I don't really care about Senate Sponsors. This is the House. Could you explain what the Amendment actually does, please?"

"The Amendment provided...at an appropriation of three million dollars for supplemental appropriations to the Illinois State Scholarship Commission Monetary Award."

"And was this a supplemental appropriation?"

"Yes, it was."

"Has that money already been dedicated to students but just not spent to the colleges, is that correct?"

"I'm not really too familiar with the program. My only interest was to get this Amendment off of my minuscule transfer Bill for the School Problems Commission. So, I'm really uncertain about that."

"Do you have any idea how many students are affected by the Amendment?"

"None at all, except that the Senate Sponsor and the people who supported the Amendment, initially, have now backed away from this. It's my understanding that this would have drawn down on the total appropriation the way it works so that it would have cut out practically all of the resources available for junior college scholarships, as well as the fact that the Scholarship Commission had agreed last year not to file any supplemental...any request for supplemental appropriations."

"Someone has come to my aid, indicates that there are about 35 thousand student awards affected out of a total of 85 thousand awards and that is a partial...would affect their awards partially, whatever that means."

"And it's...the schools, both public and private have already committed the dollars, isn't that correct?"

"That's true."

"So, what we're basically doing here is either the public or private college has to eat the money or they will ask the individual students to pay the difference, maybe $80.00 per student?"

"I'm told that's true."

"Ladies and Gentlemen of the House, I realize that probably a nonconcurrence Motion will pass. If I could, Speaker, I'd like to speak to the nonconcurrence Motion? Speaker?"

"Proceed."

"Thank you. Ladies and Gentlemen of the House, just for your information. What the State did here is, the State agreed to give certain awards to students, let's say for the second semester of their year in school. And what has happened here is the State is not going to fulfill its word in fulfilling...paying for their awards that these students received. So, what will happen back in your districts, is either that the private or the public college will eat the money, which will average about $80.00 per student, or what will happen is that your college, be it private or public, will force that student to pay the difference of $80.00 prior to receiving their degree or going on to their next year of schooling. I think that, indeed, I understand Mr. Hoffman's position and now the Illinois State Scholarship Commission. I think they make a tremendous error but I think the Membership ought to know that in agreeing with 9  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 49th Legislative Day May 26, 1981 Mr. Hoffman to nonconcur in this, all of us will hear from our constituents, be it either from the public or private colleges, that they have to eat that $80.00 per student or that their students are going to be required to pay that $80.00 and I, for one, will be saying 'no' to the nonconcurrence."

"Yes, Mr. Speaker, I concur with the last speaker. Just because we have a Scholarship Commission that's inept, inefficient and don't know what they are doing from the word 'go', I think we ought to be realistic about this. These students were awarded scholarships based upon the judgement of the Commission at that time. And why should we penalize the students and/or those institutions which accepted those students? Now, I'm not for a supplemental appropriations but this would be a dasterdly thing to do for these students in these universities. Representative McClain is absolutely right. What's been done is done and we ought to finance it. And I would ask for a nonconcurrence as well."

"Representative Jones. Any further discussion? The Gentleman from DuPage, Representative Hoffman to close."

"Thank you very much, Mr. Speaker, Ladies and Gentlemen of the House. I mistakenly assumed that all bases had been touched on this issue. I'd only make two points. The group who advocated this Amendment to begin with, the Federation of Independent Colleges and Universities, have backed away from this Amendment. They realize the import of their request. I would also suggest that this will only draw down the '82 appropriation by an equal amount if it were to pass. The Scholarship Commission, of course, does 10  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 49th Legislative Day May 26, 1981 not support it and it has been agreed that the Senate will recede from the Amendment where it was initially introduced, so that this tiny, small, innocuous, little Bill of mine, which transfers a mere $4,000 within the line items of the School Problems Commission, could become a reality. Now, that's not asking too much. I appreciate your nonconcurrence."

"The Gentleman moves that the House do not concur on House Bill 364. All in favor will signify by voting 'aye', all opposed by voting 'no'. Representative Leverenz, did you care to explain your vote?"

"As long as we don't have enough green votes, you are approaching, at least in my mind if we leave the Amendment on, we are approaching the threshold of deficit spending. I think that the issue of the Scholarship Commission is a separate issue and this is where we are spending next year's money this year for the private sector schools only. I understand a green vote is to take the Senate Amendment off. Thank you."

"Yes, thank you, Mr. Speaker, Ladies and Gentlemen of the House. I agree with the Sponsor of the Bill. If we concur in this Amendment, we will be penalizing the public institutions, not only this year, but in FY '82 as well. We should vote green on this Amendment to take off this three million dollars because we are going to get bombarded next year in FY '82 for students for loans and the budget for FY '82 will be reduced. So, I concur with the Sponsor of the Bill. We should all be voting green on this piece of legislation."

"Mr. Speaker, this Amendment would restore this appropriation to the original request of the agency. The Amendment would restore $324,210 to the Arts Council and it's broken down in the usual manner. I would move for the adoption of the Amendment."

"Thank you, Mr. Speaker. As the Chairman of the Sub-committee on Economic Development that sponsored the Amendment to delete the 324,210. This was General Revenue monies for the Illinois Arts Council. We spent a considerable amount of time looking at this particular agency and we found that this was a good area where we could make cutbacks that we could justify and I would ask that all Members resist this Amendment and vote 'no'."

"Mr. Speaker, Ladies and Gentlemen of the House, I support the restoration of the $324,000 to the Arts Council. There's been some rhetoric on the floor with regards to the Arts Council but we have as the years pass by there's been less rhetoric on the floor and we've found that the Arts Council has provided the stimulation of culture and the arts not only in the Chicago area but throughout the downstate area and we feel that the Arts Council needs these funds so that it can do a good job 14  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 49th Legislative Day May 26, 1981 throughout the State of Illinois. So, I strongly support the Minority Leader in restoration of these funds."

"The Gentleman from Macon, Representative Dunn."

"Thank you, Mr. Speaker and Ladies and Gentlemen of the House. For those of you who may feel that this may be of benefit only to the northeastern part of the State, I would urge the Members to look favorably upon this Amendment. Those of us downstate over the past few years have been the beneficiaries of the downstate tour of the Chicago Symphony Orchestra. That tour is financed in part by the Illinois Arts Council. The Chicago Symphony program of course and its European trips and so on are funded independently by themselves and are not funded with taxpayer dollars. But the downstate swing is and when the Chicago Symphony comes into a community they are generally added to whatever community concerts series is taking place that's taking place in that particular community that year and it is without dispute that ticket sales for the local arts series go up when the Chicago Symphony comes to town. So, not only do we find that the symphony comes to town but the entire arts series and cultural program for a community is boosted significantly when the symphony makes a downstate tour. This funding is necessary because without it the testimony in Committee was, the symphony probably would not be coming downstate and furthermore with the cuts in education that we see at the present time, this is a chance for us to support the fine arts. We want our children to grow up exposed not only to athletics and vocational ed and reading and writing and arithmetic but we want them to know about some of the finer things in life so they can...when they become adults, enjoy a better quality of life than perhaps we have been the beneficiary of. Without this funding that is jeopardized. "Thank you, Mr. Speaker, Members of the House. The previous Gentleman just talked about a tour by the Chicago Symphony Orchestra of downstate Illinois. During the Committe, the director said there wasn't going to be any tour of downstate Illinois by the Chicago Symphony Orchestra because they were planning on going and touring Europe. Now the Arts Council got an increase in the last General Assembly of nearly 35%. This Bill leaves a good increase for them. The Committee felt this was an area that could be cut without seriously damaging vital programs and I as I stated the other day, there's a whole string of Amendments. I don't really want to get into in arguing each and everyone of these things but it's probably necessary. The sum total, bottom line, is we're trying to add with the series of Democrat Amendments another $133,000,000 to the budget. Now, I have to regard these as budget busting Amendments, and urge everybody to resist these pressures and vote 'no' on this Amendment."

It took its last year's appropriation and reduced that by $12,000 and then the Committee reduced that further by $324,000. For the past three fiscal years we have appropriated that $12,000,000 for that purpose. It has been enough and it is estimated that the expenditures this year will be a little over $10,000,000. The reason we feel $12,000,000 will be enough for the coming fiscal year is because of the Governor's freeze there has been less State employees leaving public service. Both receive State...the State step and merit increases but only the coded employees receive the cost of living increase that we call the 8% solution this year. This would provide an 8% increase for the technical employees so that they are on an equal footing and not bearing the brunt of the problem. I would ask for the adoption of Amendment #31."

"I would like to comment on that for the benefit of the Parliamentarian, that he might take a few matters into consideration while he's pondering the germaness. I would like to point out first that this Amendment deals solely and exclusively with the expenditure of funds. The Amendment does not affect the substantive rights of any person or entity. Nor does the Amendment create any substantive law whatsoever. Number two, the Amendment merely specifies the goegraphical areas in which the appropriated funds may be spent. This is simply a different manner of identifying the purpose or objective of expenditures. Number three, the Amendment does not conflict with the existing substantive law. Existing law neither requires nor prohibits the geographical allocation of road fund monies for these purposes. Existing law defers to the appropriation process to allocate funds for these purposes among different projects and areas of the State and lastly, I would point out that the Amendment does not attempt to impose a permanent formula on road fund expenditures. The Amendment merely provides a legislative allocation of specific dollars to specific areas in the State for a single fiscal year. I believe these four points weigh very heavily in favor of a finding of germaness."

It is a one year appropriation. What Section is there a problem with?"

"Representative Oblinger on Amendment #33."

"Mr. Speaker and Members of the General Assembly, for 13 years now you have been funding the Capital City Relocation Authority here in Springfield to the tune of around $80,000 a year plus the amount of the money that's given for consultation. They haven't come up with a plan that people can agree to. Finally, this year they were going to ram through the relocation rather than the limited Bill which is the underpass and overpass. The way it is allocated for the funding of the relocation is three-fourths of one percent is given by the county 1.4% by the city, 2.5% by the State and the rest is by the Federal Government. If they go with the relocation, the county has already adopted a resolution refusing to pay their three-fourths of one percent. The city, which is 1.4% is already broke and is trying to find ways to reduce the money. I don't see how they can come up with their percent. The state's two point five percent..you were just talking about saving money...would be five million, eight hundred and fifty thousand dollars which I think we can well use for roads and bridges whereas, the limited Bill, which is seventy million, the amount for the state would be one million, seven hundred and fifty thousand dollars. What I've attempted to do with this Amendment is not to put the relocation authority out of business, allowing them the forty-nine thousand dollars and the thirty-one thousand dollars for their planning and administrative costs, but to delete for this year the amount of money they would have to come up with in order to make the relocation. The reason for this is there won't even be a hearing on this until June 23rd and I see no reason that there should be this five million plus dollars in this budget for something we're not even sure will occur. "Mrs. Oblinger, I was on the phone while you were discussing Amendment #33. So I may ask something that may be repetitive. My understanding is that you are taking funds out that are going to be used for the Capital City Railroad Relocation Project and your reasoning is that there's no way that the funds can be used for that purpose. Is that what I'm hearing?"

"In Section 15, there is money for their planning, $49,000.00. In Section 38 is the additional planning for them of $31,000.00. We're not doing away with the relocation or taking away their authority for planning and administration. What I'm saying is that the county has already refused to pay their share. The city is so broke I don't know where it will get theirs without a new tax and for the state, it means over five million dollars at today's going cost. Plus the fact, there won't even be a hearing on this until June 23rd. So I'm asking that that part of those two Sections which are allocated to Springfield be removed."

"Well, Mr. Speaker, it seems as though every year that I've been in Springfield that one of the big issues amongst the area Legislators is the matter of the Railroad Relocation Project. And I know, Representative Jones, that was always one of his pet areas here on the House floor. I think...I will admit as Representative Oblinger is admitting evidently on the floor that this project has never been ..come to reality. But it seems as though if we remove this from the budget we are stating legislative intent that they not proceed and I think all of us, as Members of the House, are aware that if there's any one 37  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 49th Legislative Day May 26, 1981 city in the State of Illinois that has too many ..too many railroad crossings it's the city of Springfield and something ought to be done about it. I'm sure that the Federal Government is ...has been stalling on this. They haven't done what they should do. But I feel strongly that we ought to keep these funds in there otherwise we are admitting that we never want to see this done in the city of Springfield and I recall one time, Representative Giorgi, and he's left here...where we..this was quite a few years ago. Representative Giorgi and I had a commitment at one of the ..on the other end of town at one of the functions, legislative functions, and we actually got a laughing jog because of the times that we were caught at a different crossing and we were late for the function. I think it took us about 45 minutes to get from here to there and we never got there. So, I think we do need these funds so that we do declare our legislative intent."

"Mr. Speaker, may I answer Representative Matijevich?"

"Proceed, Representative."

"Number one, there is another method besides the Railroad Relocation which is a limited Bill, the underpass and over pass. It costs seventy million and against two hundred and thirty-four million. Now that's number one. Number two, if you think this plan of relocation, Representative Matijevich, is going to remove railroad lines, you're badly mistaken. The only thing it's going to remove is the 19th Street corridor. All the switching lines will be left and the 3rd Street corridor will be left. And number three, we'll building greatly to the east in Sangamon County so we'll have the same problem again with the people coming from the east. I'm not as handsome as he is, but I'm short, fat and pretty good looking and I'm a County Chairman too and I want to know what he's been doing to be entitled to flowers like that from sweethearts or from ..he's either an awful woman's man, Mr. Speaker, or he's selling jobs up there one. I don't know which it is. And I think we're entitled to know a little bit about all those flowers, Representative Barr. I know you had a hard time convincing some of those Committemen to get you down here, but I didn't know that they had to send flowers to keep you. So I think you'd better get up and tell us where you're getting them flowers and what obligations you've got. It might be, Mr. Speaker, that it's important to the rest of this House. I've heard back home about how woefully underpaid Members of the General Assembly are and I thought this might possibly be a permissible way to supplement my income and that's really the goal here. One of the most intriguing cards though here is from...none of these are signed and I'm not sure why that is. That is, not signed with names of anybody I recognize, but here's one that says, '..I'd do anything to be your secretary..'. It's a beautiful plant. I've been thinking about that. Let me tell you. And I would welcome suggestions from Members on either side of the aisle as to what might be an appropriate response. There's one, obviously, obviously misdirected though, Mr. Speaker. And this may have been the one that was meant for Representative McCormick because it says, '...To my sugar daddy..'. I'd like also to say, I've lost count. These are probably...catch me up to 17 or 18 different plants or floral arrangements. But in every case, every day, Mr. Speaker, there's been at least one gift and there's another here today from good old faithful supporter. And I want to thank 'Faithful' for all of his and/or her faithful support. Thank you very much."

"Thank you, Mr. Speaker and Members of the House. The House Appropriations Committee perhaps through inadvertence deleted 1.5 million dollars in appropriations to the Institute of Natural Resources to fund operating costs in 27 state museums. I say perhaps they acted through inadvertence because the 1.5 million dollars was money suggested by the Governor, both in his budget one and his budget two addresses. For the last two years, the state has been funding 27 museums in the state at this small level, 1.5 million dollars, and the utility of that kind of funding is absolutely clear. The museums range about the state, in the City of Chicago, in Decatur, Bloomington, DeKalb, Pekin, even in the Speaker's home city, Kankakee. All of these museums serve many more than the residence in their own home communities. The Brookfield Zoo outside the City of Chicago, for example serves about 800... about 510,000 people who live in the State of Illinois, but now in the County of Cook. All of these museums and institutions serve many people who come from outside of the State of Illinois and I would urge the House to table the Appropriations Committee action in this measure and restore the 1.5 million dollars Governor Thompson would have us spend to help the operating budgets of these various institutions."

As she said, the Amendment that we adopted would eliminate 1,500,000 dollars in General Revenue Funds. This ... the Natural Resources has only been making funds available for the last three years, maybe four years. It went from 500,000 dollars to 1,500,000 dollars. We are in... We have economic... The times... Our economic times are bad. We can't afford to spend 1,500,000 dollars. The Committee spent a lot of time looking for areas that we could cut dollars to meet with the Governor's budget problems and this is one agency where we can do it. If we find out we've got additional dollars next year or the year after, then perhaps we might be able to come back and give the public museums some additional dollars. But right now 1,500,000 General Revenue Fund, we just can't afford it and I would ask that the Lady's Motion be defeated."

"Mr. Speaker, Ladies and Gentlemen of the House, I rise in support of the Lady's Motion to table the Committee Amendment. The Committee Amendment would have the effect of eliminating all financial support from the State of Illinois to the major museums throughout the State of Illinois. Representative Currie has already stated that the attendance of these museums is statewide in nature, and I would like to recite for the record and for the edification of the Members certain mandates which have been placed upon these museums by action of this Legislature. As an example, the Chicago Historical Society is under a statutory requirement to admit all school children free of charge, including their teachers and chaperones. The Field Museum of Natural History is under a statutory requirement 70  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 49th Legislative Day May 26, 1981 to admit everybody free of admission on Fridays and to admit school groups when they are accompanied by a teacher. The Art Institute of Chicago is under a statutory obligation to admit free of charge elementary and secondary school children and also on Thursdays that all day and evening hours be free. This pattern persists through all of these major, cultural institutions so that this General Assembly, by its action, has placed requirements upon all of these institutions that there be free admissions. From one institution to the other, the requirement varies, but the concept is always there. The General Assembly has required free admissions. The effect of the Committee Amendment would be to eliminate all state support for these museums. I think that the Committee Amendment is ill founded and short sided and I would recommend support of the Lady's Motion to table that Amendment."

"Mr. Speaker and Ladies and Gentlemen of the House, I too believe the Committee errored in reducing this amount. In addition to the statutory obligation that we have to mandating that students be admitted free into those public museums, I feel that we are short sided because when we have people coming as visitors as we do at our public museums, that means so much to the economy of the area. You may realize, for example, if you read a couple months back where the Mayor of the City of Chicago had contemplated for awhile about having some races at the lakefront. That was immediately rejected because of the worthiness and value of Sunday as a visitors day at the public museums. So that idea was dropped, and many, many people come from all over, not only Illinois, but all over the country to visit these museums. I think it would be short sided of us not to have the state contribute to the 71  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 49th Legislative Day May 26, 1981 value of our public museums. This would be another case if we dropped this funding where the state, rather than looking at its own bureaucracy is finding ways not to produce revenues to local governments, to local museums and that sort that add so much to the vitality and the economy of areas all over the State of Illinois. If you travel in other states like Wisconsin, I think it's just a shame. I live in Lake County and the people trip over themselves to leave the State of Illinois to go to Wisconsin where the State of Wisconsin contributes so much to the vitality and economy of its areas. That's the least that the State of Illinois ought to do, and this is a way of doing it by contributing this amount to the public museums."

"Further discussion? Gentleman from Cook, Representative Wolf." Wolf(J. J.): "Thank you, Mr. Speaker and Members of the House. I would hope that the Members would oppose the Lady's Motion to table Amendment #1. It received considerable discussion, not only in the subcommittee, but in the full Committee. I know we're all faced with a very difficult problem this year in trying to find money to balance the budget. The House Appropriations Committee did manage to cut 105 million dollars. There was some eight or nine million dollars, of course, added by a Floor Amendment last week before we went back home. I would hope that the Members would resist this Motion at this time. Perhaps somewhere down the line before this Session is finished we can find some other sources and find some areas where things could be cut and we would look to the distinguished Minority Leader for leadership in that area and maybe he could tell us where to find some additional dollars and help us out. The Brookfield Zoo, for example, serves for free 200,000 school children from all over the State of Illinois. The Art Institute in Chicago sees passing through its doors every year over 400,000 people who are not from the State of Illinois at all. The people who come to these museums are spending dollars in our local stores and our institutions, are increasing our revenues and it seems to me appropriate for us to recognize the increased costs of operating these museums, particularly those that are willing to serve our school children whether they come from DeKalb, Galena, Galesburg or wherever for free. We have a state responsibility to 73  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 49th Legislative Day May 26, 1981 spend these dollars and may I remind you that these dollars are not great. 1.5 million dollars, the same amount is asked in this Amendment to table in this Motion to table the Amendment from the Appropriations Committee as we spent last year for these same museums, as we spent the year before for these same museums. Meanwhile, their costs of providing services have, of course, grown by leaps and bounds. If we accept this Motion we are, in fact, offering them fewer dollars as a proportion of their total expenses to serve us, to serve our school children, to serve all the people. This is not an increase in expenditures over prior years. In fact, it is a minimal amount of money to satisfy our conscience, our consciences as Legislators and our conscience as Representatives of the people of Illinois that we have a commitment to the major institutions and museums that serve all of our people. Governor Thompson asked for these 1.5 million dollars and I do too. I urge a 'yes' vote on the Motion to table House Appropriations Committee Amendment #1 to House Bill 586."

For those of you now familiar with this area of the state, this is directly across the Missouri side from where the Missouri and the Mississippi meet. It is directly below the new lock and damn that is to be constructed in Alton and this in the only place in the river, the only land available really for construction of a boat ramp. It's needed not only for recreation, but it's needed for safety so that if there are any accidents, boating accidents, etcetera, in the river someone has a place to launch. "Thank you, Mr. Speaker and Members of the House. In keeping with the intent of the Governor to reduce unnecessary General Revenue Funds, this Amendment will attempt to prevent the spending of ultimately some six million dollars as has been directed by the Department of Conservation for the development of an abandoned railroad right of way that covers some 27 miles. Might I call your attention to the fact that there happens to be some 35 different crossroads in this area which, in my opinion, is somewhat of a safety problem. In addition to that it goes right in prime farmland effecting some 100 farmers in that area in which they own property on both sides of this particular abandoned railroad. Last Session there was a Resolution passed in which abandoned railroads were studied and those reports that came forth indicated that local communities or municipalities should be the ones to get involved in developing this kind of real estate. It's my intent and with the agreement by the Director of Conservation to look for an alternate source to replace 85  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 49th Legislative Day May 26, 1981 this particular piece of property that runs through prime farmland with one that does not go through farmland, with one that does not interfere with any economic situation or municipality, and still provide that recreational source that some people want. Might I call your attention that if there are already some 1200 miles in the State of Illinois that have been indicated as a bike trail. We have seen this program now involved here in the General Assembly for something like 17 years and, in my opinion, this is start up money to only work on some five miles, which I think is unnecessary at this time when we're very much concerned about and looking to where we can save General Revenue money. And with the agreement that we have with the Director of Conservation we certainly have been working to resolve this problem to the mutual benefit of all people. In my opinion, that there are priorities in the State of Illinois that deal with day care centers, special education, public aid, transportation, highway, higher education, elementary education and housing, just to name a few that, in my opinion and I hope that opinion of this House that have higher priority than to develop, in part, a portion of an abandoned railroad right of way rathole. I urge your favorable vote."

"Mr. Speaker, Members of the House, the Gentleman that offers this Amendment really isn't that interested in saving the funds as much as he is stopping the development of this project. Now he mentioned that this has been around for a number of years and that's true. I, personally, have wrestled with this issue long before he ever came to the House of Representative. The fact remains 86  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 49th Legislative Day May 26, 1981 that back in the days when Tony Dean was Director of Conservation he did begin this project and he used a bulldozer type of action on it. At that time, I got up on the floor of this House and saw to it that I and others from our district excised the amount of money appropriated for the development of that trail at that time, because I didn't think the Director of Conservation then handled the project at all well. I realize the farmers in thar area had a problem. I represented those people and this Gentleman that offers this Amendment is some 40 to 50 miles away from the district so he doesn't have all the answers to this problem either. The fact remains he did mention the fact that they're trying to work out a compromise trade. That's all well and good except that trade is no where near fruition at this point. Now what I started to say is I excised or helped excise the funds for the development some eight or ten years ago with the real hope of finding a solution to the problem to satisfy the farmers as well as satisfy those who wanted this trail developed. After many meetings with Conservation people, after many meetings with the property owners along that area, with many meetings with the people who thought that the trail should be developed, it became apparent that there was no solution in the making because you couldn't satisfy everybody with everything. I think that Director Kenney has made tremendous effort to resolve this problem. What he's attempting to do here is develop five miles of the 28 miles. He has put this appropriation, this amount of money in the appropriation for the Department. I think the only way that this whole issue is going to be resolved is for the funds to be restored, the funds to be kept in this budget that five miles of the trail be developed so that we can see whether or not it's going to work in finality. 87  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 49th Legislative Day May 26, 1981 This abandoned right of way admittedly is 28 miles long. It's fraught with peril in terms of problems with the property owners, problems with those who want the trail, problems with our own colleagues here who don't even represent the district but seem to be interested in getting this trail stopped. Now at one time I was in favor of that, but, as far as I'm concerned, I don't think there has been adequate debate, adequate compromise. I think, at this point, the Department of Conservation is in the right. I think they should pursue it and proceed with the development."

"Gentleman from Peoria, Representative Schraeder."

"Thank you, Mr...Thank you, Mr. Speaker and Members of the House. Well, here we have the perennial problem that we thought we had solved amongst the Members of our own district. There was an election last November and one of the incumbents who fought the trail didn't have the feelings of the people in our district so he was defeated. And so we thought we were going to finally work out the problem. We thought our Legislators were going to be in tune with what the constituency wanted and low and behold, we have another interloper, Royko type situation, but that's not the worst of it. In order to solve our problem, he comes in and he goes into another district, not his, and attempts to get a railroad from that district and trade for ours. Instead of solving our problem, he wants to create a problem in the adjoining district so then we have two problems. but I think what I want to say is the fact that we did have a policy established a couple of years ago what's called now, to my constituent anyway, what's fair is fair. And those of you who were there then will remember that the Representative who offered this Amendment tried to 88  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 9th Legislative Day May 26, 1981 sell this abandoned railroad to the private ownership of the farmers along the trail. And Amendments were adopted on that to say well if that's fair, we ought to sell the state parks in that Gentleman's district, and so we attached it to a Bill. We didn't do that this year because we wanted to show you that this is not the way to go. We want to be able to resolve our problem for the best interest of our constituency as possible, and we attempted to do that and the Governor, in his wisdom, has attempted to do that. The Director of Conservation has tried extremely hard to solve this problem and has come up with a solution to the problem. All I would say is without laboring the point any farther is that it is a local problem. And let me remind you that when you have a local problem, the courtesy is due those Legislators to try to work it out as best they can, and we would have had this worked out four years if we wouldn't have had an interloper coming in and trying to tell our constituency what was good for them. Let me say this, let us solve the problem in our own district this year so that you don't have to be concerned with it in the next two, three, four, six and ten years because it won't be resolved, and we would ask for a 'no' vote on this Amendment."

Anybody knows the problem of maintaining parks, but certainly this is about as near impossible as anything I can think of. We've got parks now that need attention that need money to take care of them and certainly we don't need this one."

"Thank you, Mr. Speaker, Ladies and Gentlemen of the House. I have a great deal of respect and affection for Representative Schraeder, and, on a number of instances, end up voting just as he does. But I think he is realy astray on this particular issue when he suggests that Representative Ropp does not have a legitimate issue in the problem or is interloping in the problem. Anytime this General Assembly is asked to appropriate money to pay for something in any district of the state, whether it's something in Chicago, whether it's something in Vienna, or whether it's something in Star County, this General Assembly and every Member of it, in exercising their Constitutional duty, has a right to vote their conscience, has a right to introduce Amendments and has a right to pass legislation. I think it's most important that we exercise that kind of restraint and that kind of judgement because, if Members are unwilling to do that, then what we're going to get is one constant boondoggle after another. I think it's important that people vote against projects whether they're in somebody else's district or not, if they think those are mistakes. Now, Representative Ropp feels very strongly on this issue and I think that there's some justification for his feeling, and I would urge people to go along with his Motion on this and particularly because 90  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 49th Legislative Day May 26, 1981 of the overriding concerns involved. I don't believe he's interloping at all. I just think he's exercising his constitutional duty and people should vote in favor of his position on this issue."

"Thank you, Mr. Speaker. I couldn't agree with the last speaker more and I can tell you that it's almost providential that this Amendment is always presented to us on a Monday when I've been home over a weekend or for three days. In Committee I carried the Amendment which, incidentally, failed on a 9 to 9 vote showing that this Legislature is still divided in Committee and should probably will show that it's divided on this floor. But the Amendment came up on a Monday in Committee, as I recall, and I'd spent that weekend as I spent this last three days. I was fortunate enough not to have any speeches to make so I spent it at home and my farm happens to run a quarter of a mile to a half a mile along an active right of way of a railroad that's private property now that nobody pays any attention to, and I spent the entire weekend picking up things that were thrown into my yard ranging from pieces of broken refrigerators to thoroughly used sexual devices and any number of other kinds of garbage that the people climb my fences and tear them down in the middle and pick asparagus and like the nice green countryside in my particular farm. I sympathize with the people who want a trail in this state and I certainly sympathize with the adjacent property owners. I know what's going on in an active railway where it's private property where the railroad cannot keep security out on an active railroad. I shutter to think what would happen if we turned loose hordes of people going up and down a trail with no absolutely no regard for the adjacent property 91  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 19th Legislative Day May 26, 1981 owner rights. I can suggest to you that the only way that this could be supported is that if we appropriate not 200,000 dollars, but, as Representative Ropp said, six million dollars it would take to build 12 foot cyclone fences on each side of the trail and to have security forces and double the conservation police to patrol this particular linear park. I'm not opposed to conservation. In fact, I'm an outdoorsman and a sportsman. What I am opposed is to peoples' rights being trampled in the adjacent property owners. It's a good way to save 200,000 dollars. The Legislature is divided on the ultimate resolution of this linear park and I suggest that an 'aye' vote on Representative Ropp's Amendment is a very good fiscal vote and one that represents the divided feeling in this particular Legislature."

"Gentleman from Macon, Representative John Dunn." Dunn, John: "Thank you, Mr. Speaker and Ladies and Gentlemen of the House. I reluctantly rise in opposition to the Rock Island Trail. I know that many of us feel that things of this kind are very desirable and it is important to preserve and protect our environment, but I'd just like to add one perspective a... We hear from time to time that this would be a nice place for a people who enjoy bicycle riding to get on at one end of the trail and ride to the other or take their families on a bicycle ride. I've done a fair amount of bicycle riding and I know from experience that most people who like to become involved with distance bicycle riding like to get on the bicycle right at the end of their own driveway and then take off someplace and head for a road or a highway that is not very heavily traveled and go out into the countryside and they don't like to put a bicycle on top of their car or inside their van and 92  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 49th Legislative Day May 26, 1981 transport it 40, 50, or 100 miles, get out and then ride 15 or 20 miles. Experienced bicycle riders like to ride 50 miles or more. So, while this concept has perhaps some merit as the previous speaker has indicated, there are many, many disadvantages and I think when we're perhaps struggling with our decision here we should vote in favor of using our money elsewhere and defeating the funding for the Rock Island Trail."

I dare say there is not one district in this State of Illinois that either currently has an abandoned railroad or soon will have as I certainly do have abandoned railroads and more to come, according to some projections. There's been some interest on behalf of people to resolve this problem and those people who have mentioned that they attempted to resolve this might I call your attention to House Resolution 332 that was introduced by Representative VonBoeckman and Schraeder last year, and that study very clearly said that the state should not, should not get involved in developing a bike trial, that local municipalities, that local people should take the leadership in developing those kinds of programs. I'm saying that even in the Resolution that they sponsored, they are not even complying with the intent and conclusion that came forth out of those several hearings that were held. Might I call your attention to the fact that when Director Tony Dean actually was offered this abandoned 93  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 49th Legislative Day May 26, 1981 railroad several times and refused them until finally when he found out that the new incoming Director, William Rutherford, would be the new Director in which this piece of property was coming through the Peoria Park Foundation, he then did accept it and say, 'Here, Mr. Rutherford, it's your problem. Take care of it.' I'm almost confident that if you talk with each Member in the Conservation Department they would say to you privately they wish this piece of real estate had never found its name into the State of Illinois. Might I say to you now that this is only seed money. It has a snowballing effect that will grow at least to the minimum of six million dollars, according to the Department of Conservation. I want to keep my word with the Director of Conservation and I hope that he keeps his in attempting to locate an alternative source that would replace this particular right of way with one that does not go through prime farmland with one that, in fact, does not involve local communities or does not get involved with any financial disruption. I urge your favorable vote in supporting of this Amendment so that we can more adequately provide funds to more needy programs and we can continue to work in sincere earnest this summer in coming up with an alternative program that will be beneficial to, not only the farmers and local people, but also to the people who are interested in biking and hiking. I urge your favorable vote."

"Mr. Speaker and Ladies and Gentlemen of the House, Amendment #20 to House Bill 586 eliminates funding for vacancies and new positions within the Department of Conservation. In addition, funding is reduced in the contractual services and the equipment line items in order to enforce the Governor's freeze on these items. What I did was have the staff go over the appropriation for the Department of Conservation and, in line with the Governor's intentions of freezing positions, we feel that those long term vacancies ought to be remained frozen. We feel that if we are going to take the quote, 'fat' out of the budget we ought to look at the agencies of government instead of just looking at where we can reduce grants from local governments and try to hamper local governments from operating. We feel that when a position has been vacant for a goodly number of months that it can stay vacant without hampering the agencies of government and; therefore, I have offered Amendment #20 which is a total reduction of 1, 042,500 dollars. I ask for your favorable support for Amendment 20 to House Bill 586."

As I mentioned, we are below the Governor's recommendation even after cutting some ...a million three, and I would urge its defeat."

I think, in this era when we say that we've got to tigthen our belts, it makes some sense that if a vacancy is going to exist until January 1, '82 that there's no magic that's going to occur in January that all of a sudden we're going to hire a lot of people. While it's true that 200,000 dollars if General Revenue Funds in this tight time, I view this as an Amendment that will be repaid in time and will eleviate some of the energy problems in communities such are Marissa for the Kaskaskia lock and dam, Metropolis for the Ohio River lock and dam, Shanahan for 'Dresdin', 'Marseilles', Wilmington, Peru for the 'Star' of Rock block and dam and Elgin for the Elgin dam. "Thank you, Mr. Speaker, Ladies and Gentlemen of the House. The subcommittee handling the budget for the Institute gave that budget very thorough consideration. We have already reduced the funding for these positions from one year to six months. This was to allow for consideration for the Governor's job freeze. I'd like to point out that these are not new positions. They are merely positions that are vacant. One of the positions that would be eliminated under this Amendment is the head of the entire archaeological program for the State Museum. It has been vacant for a period of time because the person that would fill this is normally a PHD. It requires a national advertising to try to fill the position. I would urge for the defeat of this Amendment."

"Thank you, Mr. Speaker. Representative Bower made many of the comments that I intended to. I would also urge opposition to this Amendment. As Glen mentioned, one of the problems that we have facing us that's going to severely limit the two water public service programs of the survey. In fact, one of them is going to seriously effect the Water Surveys Northeastern Illinois Ground Water Advisory Service which is right up in Representative Matijevich's district. I think Glen pretty well made the comments that were necessary on it. The House Appropriation Committee has already reduced the funding of these positions for six months and didn't totally eliminate them which would completely emasculate the whole program. I would urge a 'no' vote."

"Mr. Speaker, earlier in this Session we heard the Gentleman from Cook, Representative Bluthardt say that in his opinion this has been the most anti-local government Session that he has seen in Springfield. Never is that better illustrated than by Committee Amendment #10 which is placed on House Bill 587. For the first time since we've passed the State Income Tax Act in 1969 this Amendment would limit the share of income tax sharing that is due to local government units, cities, villages and counties throughout the state by placing a cap on that amount back on to last year's distributive level. The Amendment, in effect, takes twenty-four million dollars which belongs to local governments, cities, villages, and counties and says no, we're going to break the word that was given to local government back in 1969 when the state income tax was passed and I was here and I voted for it and I supported Governor Ogilvie on the assumption that one-twelfth of the state income tax would go to local government. We're breaking that word. We're breaking that bond that's been in existence since '69 with Amendment #10 therefore, I rise today to move to table Committee Amendment #10 and restore the state's word for revenue sharing for local government units without the cap on keeping the one-twelfth. And I renew my Motion to table Amendment #10."

"Thank you, Mr. Speaker, Ladies and Gentlemen of the House. This Amendment has obviously been subject to criticism. It's a proposal that isn't very popular and I recognize that. But it's a proposal that was adopted by the Appropriations Committee in full light and in the full context of the state budget. What this Amendment does is to freeze for this particular fiscal year, fiscal '82, the payments under the revenue sharing program, the state revenue sharing program, at the '81 level. It adopts no permanent change in the formula so that for next year payments would revert to the formula based percentage and amount. Now, there are a number of reasons why this Amendment should be adopted. Perhaps the most important reason is that we have finally reached the position in this country where revenue sharing is a misnomer. What we're doing is deficit sharing and it is appropriate in this kind of fiscal hardship year that we share the deficit with lower levels of government. We cannot buy everything we've wanted to buy in the past. The money is not there. The Federal Government has found that with the Reagan program. The state is finding that because of its resources and its demands on spending. Local government has to find that too. Everyone should bear part of the burden. That's all this Amendment does. It's a deficit sharing Amendment. Now, let me explain to you what would happen if this Amendment is taken off, if the Gentleman's Motion should succeed. One thing that would occur is that revenue sharing payments to East St. Louis would decline by twenty thousand dollars and revenue sharing payments to Winnetka would increase by some twenty thousand dollars. Does it make sense to endorse a formula, to endorse a position which reduces the amount of money going to East St. Louis and increases the amount of money going to Winnetka? That 103  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 49th Legislative Day May 26, 1981 is the problem we have with some of these formulas now in the law. There's no justification for that. There's no need basis for that. We have screwed up our need base formulas to some extent and that is a bad mistake. Now, beyond that, beyond the fact that by permitting the Gentleman's Motion to succeed that we would be benefiting the people who'd need benefiting the less and depriving money from people who need to be deprived the least. The Amendment applies in the full face of fiscal reality. There simply is not enough money to share, not enough to buy everything we'd like to buy. And so I would request your negative vote on this Motion so that we can, in fact, adopt a policy, a deficit sharing so that we can recognize fiscal realities and so that this state will not enact the budget totally out of line. So that we come back here in July and relitigate the issues time after time after time. We don't have the money to do it. The Governor can't sign it. It's your Constitutional duty to balance the budget and this is the place to start."

"Thank you very much, Mr. Speaker. Ladies and Gentlemen of the House, I stand in support of Mr. Pierce's Amendment. I think it's interesting that Mr. Vinson would be the arguer in this case on this particular issue. The same Gentleman that now sponsors the Senate Bill 477 which has the investment task credit which will attack local governments, maybe up to the tune of forty million dollars. The whole process of what Governor Thompson wants to do in terms of balancing the state budget is to take money away from local governments. Instead of really curtailing his own state budget it's always attacking local governments. Representative Matijevich just offered a series of 104  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 49th Legislative Day May 26, 1981 Amendments that would have reduced the budget of a million and a half and yet it was the same Republican administration that was against those Amendments because indeed they would've restricted state budgets in state departments. The easiest way in the world is to always blame it on the other guys. When President Reagan tries to reduce his budget by curtailing our sums of money all of us are incensed by it. Just think what these local governments are thinking by this kind of action on our part. I stand here saying to Mr. Pierce and agree with Mr. Pierce that we should not take money always away from local governments. It's not a holy war against local governments. If we have to resolve our own budgetary problems they ought to be solved within our own budgetary constraints and not at the expense of local governments."

As he mentioned quite earlier and Representative Bluthardt mentioned it very succinctly a week or two ago, we have done more to damage local governments in this Session the Legislature than we have in the past two or three years. This twenty-four million which you're talking about taking out right now is just another slap in the face at local government. Most of this is to take care of the mandates that have been put on in the past. It's put on by a good formula, one that was worked out by the previous Governor Ogilvie. It has worked. It was put on a as floating Amendment to take care of the escalation of costs that go on. Let me say that we cannot do it because there is yet no substantive Bill passed the Legislature to change the Illinois State Income Tax Act. This is a part of the Act and it was a part of the Act because when we passed the State Income Tax Act the rational for passing it was that we try to alleviate the burdens on the property tax owners. If we take away this money from the twenty-four million dollars from the local government all that will do will place the burden on the property tax. We are not for uping the property tax. None of us are for that. And let me tell you that the next years are going to be difficult for local governments. They're in addition to the shrinking federal revenues we have the matter of inflation. I don't think that any economic recovery program no matter what it does is going to help the inflationary factor that local governments are facing themselves with. They have the rising cost of public utilities, the rising cost of gasoline and motor oil, auto truck, equipment maintenance repair, the cost of new purchased equipment of every type, the cost of concrete, petroleum products, of electronic data processing. And I want to read into the record what this Amendment will do to specific cities because I want you to vote against it after you find out how much money you are taking away illegally from those cities. And all you are doing is putting it into the state revenue pockets. Away from the property tax owners. I'd like to point out that the Economic and Fiscal Commission's revenue estimates are some two hundred and forty-four million dollars below the Governor's Bureau of the Budget. And I know it's nice to vote for everything that comes along just like the Members of Congress which has only balanced the budget twice since Dwight Eisenhower was President and now the chickens are come home the roost and I want to ask you a question. Where's it coming from? You're going to get up and you're going pose against cut for the mentally retarded, for the special education. You're going to be here to bang us on the school formula. Add, add, add. And I'm asking you, where the heck is it coming from. You're sent down here to make some tough decisions and this is a tough one. "Thank you, Mr. Speaker. Ladies and Gentlemen of the House, long before most of us were down here the State of Illinois adopted an income tax. And the Mayor of Elmwood Park over there can tell you that when that was adopted it was in agreement that the local municipalities would receive a certain percentage of that income tax. It was a time when we had the personal property tax and we were trying to get rid of that. And the agreement with our local municipalities was that they would get percentage of that income tax. And now we have a Republican Governor and he's saying let's balance the budget and let's not give that money to our local municipalities. Well, Ladies and Gentlemen of the House, the Mayor of Rock Island, the Mayor of Moline, the Mayor of Milan, all the other cities in my district came to me and they said, 'See whatever you can do to prevent this from happening. We need that money. Inflation is eating into our budget. We can't go ahead and have the projects that the tax payers want and the services that they deserve without this money.' And you heard Representative Matijevich call out the amounts of money that would be cut from the local municipalities. I tell you, Ladies and Gentlemen of the House, we're going to have a balanced budget if this is passed but it's going to be balanced on the backs of the real estate owners, the senior 108  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 49th Legislative Day May 26, 1981 citizens who can't pay their real estate taxes, those on fixed incomes. Because when we cut this off, municipalities have no where else to go. No where else to go but to the real estate tax and we're going to see that real estate tax bill going up and up and up. In Rock Island County those bills just came out and they went up substantially. And they will go up again and again and again as long as we cut this money out from the local municipalities. And I tell you that there are many Members on your side of the aisle who want to vote with the Democrats on this issue but are being held back by their leadership. And I say to those Members, vote your conscience. Vote for what the people want back home. Don't be led by the nose. Make sure that the real estate taxes don't go up. Go by your campaign pledges and vote with the Democrats on this issue. Thank you."

He's nothing more than a show for state government against local governments. Now, where's the money coming from, I was asked?"

If this Bill, if this Amendment to table does not prevail then you all better go out and buy telescopes and buy binoculars and buy all sorts of optical magnification instruments because you're going to need them to see the property taxes because they're going to be out of sight. They're going to be out of sight. The kinds of cuts that are being proposed by the Governor are taking away from local governments and local governments are going to turn to the only other source of revenue that they have at their disposal and that is the 111  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 49th Legislative Day May 26, 1981 local property tax. "Mr. Speaker, in answer to Representative Wolf, the Governor isn't cutting his budget at all. He isn't cutting the size of his patronage army. In fact, it's swollen for the next election. He hasn't cut state, state people off the payroll. He hasn't cut state services. He's putting it back on the cities, counties and townships that are almost bankrupt now. Matijevich mentioned what the city of Rockford would lose but everyone of us are going to lose money in our counties on the income tax return. You're all going to lose money in you county in your Health Departments. You're going to lose money they promise you to support your state's attorneys. You're going to lose money they promise you to support your assessors. And the money they told they're going to reimburse you for sending your policemen to law enforcement school. You're going to lose that. You're going to lose your fire department's training monies. You're going to lose all kinds of money and the Governor is going to sit here on the second floor fat and heavy. He's not cutting himself one iota."

A green vote here will be a responsible vote. A red vote will be a vote to raise local property taxes. When the state income tax was passed and I think the Gentleman who's sponsoring the Motion is going to close and point that out. If we cap that fund at this time what we're going to tell those local people is that we're going back on our bargain at a time when they need revenues the most. They cannot eliminate all services. State government may talk and brag about balanced budgets but it won't be really balancing the budget if it's done at the expense of the local governmental units. These locals are going to have to provide services. They're going to have to get the funds to do them. They only have one way to replace money that we're taking away from them and that is to raise your property taxes. So if you want to go home and face your friends, your neighbors and your relatives and even those people who go out and knock on doors and campaign for you and tell them that you raised local property taxes you go right ahead and do that and vote red. I'll be voting green with the good guys."

"Thank you, Mr. Speaker. As I was saying, in legislation, if I can reach that same pitch of excitement again. In legislation we passed with the income tax in 1969 we promised the cities and the counties that they would receive one-twelfth of the income tax as revenue sharing. Now, we've had recessions before. We had a recession under Governor Walker and with all the promises he broke he never broke that promise. He kept Governor Ogilvie's promise and the Legislature's promise. The local government units would receive their one-twelfth of the income tax. And we had a recession then when the state was in bad shape then. Not until this year did anyone ever dream up that we wouldn't, based on population which is a very fair way to reimburse local government, reimburse 113  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 49th Legislative Day May 26, 1981 local governments their share of state income tax. Where's the money coming from, the Gentleman asked? The money's coming from you and me or from our voters at home. It's coming from the state income tax to the extent that the state income tax is collected. One-twelfth of that goes to local government based on population. If those collections go down local governments will get less money. If those collections go up local governments will get more money. We know where it's coming from. It's only coming from money that has been collected or will be collected during the next fiscal year by the state from your tax payers. And if that money doesn't go, if that money doesn't go to local government units the state is still taking it. And what the state is doing with it I don't know except your local government units we're going to have to turn to the property owner as it's been pointed out by previous speakers and to the home owner to obtain the money to run local government. Unfortunately, these home owner units can do that. The home rule municipalities have no rate limitations and they can collect that money from their home owners if they don't get it from the state. In Washington they're cutting out money for local government. In Springfield we're cutting out money for local government. We have a Bill we passed out, investment tax credit that come from local government. And now to break our word that's in statute to reimburse one-twelfth of the state income tax to local government units to me is a breach of faith so harsh that I can't understand how anyone in this House can support it. And, Mr. Speaker, I renew my Motion to table Amendment #10. The vote for local government is an 'aye' vote, the Motion to table Amendment #10."

On Thursday morning I asked the Speaker why it appeared that we had armed guards from the Secretary of State in both the balconies and the back aisle...or the back corridor, and in the front. I was told that there had been discussions between both the Minority Leader and the Speaker after the assasination attempt on the Pope. It seemed to me that firstly, this is a matter if some pretentiousness on our part to suspect that first that the President would be attacked, and then the Pope, and next in line would be State Representatives, somehow is a little staggering to me. Moreover I note that our brethern and sisters across the rotunda seem to be secure. Now, they have a very tall doorman who is a very large man, and it may be that he brings some security to them. We have smaller people, but I am satisfied that, except on occasional situations, our fine people in red coats, although red coats has an English tradition as to Parliaments, I think they can serve to protect our doors adequately. I find on a more serious vein, that I am not intimidated certainly by the fine people from the Secretary of State's office, but I just think as a matter of principle. A Legislative Body, if it is to be free and open and thoughtful, should not have people in arms. Traditionally, the French Chamber of Deputies at the time of the Revolution was ringed by men at arms. During the long Parliament in England, arms were in the balcony of the 125  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 49th Legislative Day May 26, 1981 Parliament. During the Cranwell era, again, armed men entered Parliament. A Legislative Body should be free of armed men just as I believe polive officers generally leave their guns when they walk into a court to testify. And so it is that we want to make sure, very sure, that it is we who are...it is our protection that is being guarded rather than our minds that are being guarded. And it seems to me just a...something contrary to the Democratic institutions that we hold dear, Democratic institutions of Parliamentary government. "Thank you, Mr. Speaker, Ladies and Gentlemen of the House. It is with some amount of regret that I rise in opposition to the Gentleman's Motion. I think in the some 127  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 49th Legislative Day May 26, 1981 two and a quarter years that I have served in the House, this is the first time that I have found it necessary to oppose Representative Greiman. I think that the Representative is incorrect in his statement that we have armed guards here in this chamber. Indeed, the armed guards are present in the gallery surrounding the chamber itself. They have not been present on the floor of the House. There are guards who guard the Congress of the United States. We have crowds in here at all times. Certainly the access is open to crowds, and we have had a number of occasions when we have had demonstrations in the gallery of one type or another. I think it is entirely appropriate for the Speaker to have the gallery guarded, security arrangements as he sees fit, as well as outside of this chamber. And for that reason, I would ask the people of the House to oppose this Motion."

It is instead merely that we express a sense of it. I know in no way do I want to take away that jurisdiction, that right. However, if we believe in Democratic process, if we believe in an open kind of Democracy, then we should just give our sense that we ought not to have armed guards in this room. As far as the necessity, Representative Preston's comment, there are 128  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 49th Legislative Day May 26, 1981 now 13 or 14 very undangerous looking folks up in the gallery. And I don't know that we need to have an armed guard to protect us from those 13 or 14. I would agree on those days at those moments when we have lots of people, lots of turmoil, lots of anger, lots of things going on, let's have them here. That is okay. I'm not against that. But on a day like today where, God, most of us had trouble keeping awake, I just don't think we have to have armed guards because of the fervor of activity that was shown here this afternoon. It is for this reason and the other reasons that we should just suggest to the Speaker that perhaps we don't have to be guarded, that perhaps we're not so damned important that everybody is going to try and come after us and that we do our business without the spector of armed guards."

I have filed a Motion to discharge the Committee on Transportation to move Senate Bill 125 to the order of Second Reading Second Legislative Day in part as a result of an extreme emergency which has been brought about by the actions of the Regional Transportation Authority last Friday which involved the City of Joliet Mass Transportation District. Senate Bill 125 simply amends the Regional Transportation Authority Act and authorizes any county or township to disconnect from the authorities territory by action of the county board as the case may be and.......the matter to disconnection by referendum. Now, as I point out, this is...this Bill comes about by the desire of the people who reside in some of the surrounding counties of the County of Cook because of their feeling and the feeling of the Legislators in that area that the Regional Transportation Authority is not operating in the best interests of mass transportation in the collar county area. And you will note that the Senate sponsorship of Senate Bill 125 is bipartisan support. Lead Sponsors being certain Democrats representing certain collar county areas and including Republicans representing Cook and collar county areas. Now as I pointed out, last Friday the 131  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 49th Legislative Day May 26, 1981 Regional Transportation Authority in direct violation of the Regional Transportation Authority Act, Section 4.01, refused to make the regular contribution to the Joliet Mass Transit District in order to meet a payroll of a mere $21,000. Now,..."

I am addressing the merits of the Motion, and the merits of the Motion go to the extreme emergency presented by the actions of the Regional Transportation Authority in regard to my home city of Joliet by shutting the life line of funds from the Regional Transportation Authority. Now, this agency has acted in direct violation of the Act by refusing to return proceeds which are collected by direct taxation of the authority by way of the sales tax which this Body imposed upon Will County some year and a half ago. So the Regional Transportation Authority continues to levy a tax every day since Friday, including today, on all measures purchased at retail within the confines of Will County and the City of Joliet including food, clothing, medicine, and other necessities. Now, it refuses to send this money back. Now, it takes out of Joliet and Will County approximately $10,000 a day, some $66 to $70,000 a week. It refuses to return any of that money which is exactly contrary to the law. So I want to discharge the 132  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 49th Legislative Day May 26, 1981 Transportation Committee and get Senate Bill 125 immediately to the floor so it can be read a second time Second Legislative Day so that we can proceed to passage stage as soon as possible and send this good Bill to the Governor of this state so he can sign it so Will County can take steps to get out from under the Regional Transportation Authority and its illegal attempts to withhold funds which lawfully belong to the Joliet Mass Transit District. We want the authority to levy our own tax and carry on our own transportation services which will be far superior to the ones that are currently being provided at much less the cost. So, Ladies and Gentlemen, Members of the House, and Mr. Speaker, I urge all of you to vote for this Motion on Senate Bill 125 so we can get on with solving the immediate emergency problem that Jol...the City of Joliet faces by virtue of the enforced shut down by the Regional Transportation Authority of the City of Joliet buses."

It is am important Bill with the impending, and it looks as if the shut down is going to occur, and I can't understand, however, why the 42nd District in Will County was singled out for the crude attempt to start shutting us down first. But since that is the case, I can tell you that Senate Bill 137  STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 49th Legislative Day May 26, 1981 256 throughout the RTA region will indeed have a positive effect on transportation in the event of an emergency shut down and probably even beyond that as we go through the next few years. Senate Bill 256 deregulates taxi cabs and other forms of surface transportation in the RTA region. I suggest to you that any Bill on Second Reading at this point dealing with this subject at this time in the history of mass transit and in Illinois, is not a bad idea to have it on Second Reading where you can take a look at it and move it quickly to Third if we can and get it back to the Senate for their concurrence or their rejection or whatever the Senate chooses to do. I simply recommend to you it is a very good idea. The subject matter of the Bill, its time has come. It is an idea that we can proceed forward with and offer reasonable alternatives in the event of a close down of the RTA and as sure as I am standing here, Joliet and South Suburban Safeways are just the beginning of that shut down, and I can tell you I have it on reliable authority that today the RTA Board turned down a 12 1/2 percent fare increase and negated any service alterations on weekends or at night. So apparently we're on a collision course with that particular Board, and I suggest to you that this is a very good Motion that that both vehicles 125 and 256 should be in front of us for our consideration and not go through the Committee process. I respectfully request an 'aye' vote."

The one Bill deals with legislative reapportionment and the other deals with congressional reapportionment. I suspect that the Rules Committee, through the friendly hand of the Speaker and the Parliamentarian will provide a smooth path for these two reapportionment Bills through the thicket of the rules and its deadlines.
