"Thank you, Mr. Speaker. Amendment #2 deals with making this a statewide idea. What the concept of the Bill is that the delinquent tax sales should be printed. This Bill makes it applicable to downstate Illinois, and it says that they should be printed and listed by address. It is a ma and pa Bill. If you have a home, and put it out and list it by a lot number, it could be missed. The thing is, I'm saying I think it's an excellent Bill. It's an excellent concept, and I have agreed with the Sponsor of this Bill of the concept of the Bill. What I'm saying, if it's good for downstate Illinois, it also...there's a lot of people with a lot of parcels of property that it would affect also in Cook County. And those people, you know, should have the right to be able to look in a newspaper, see their property listed by address - not just by an index number - and be 8  STATE OF ILLINOIS 83RD GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 27th Legislative Day April 6, 1983 able to address that problem and rectify the problem if they so do indeed have delinquent properties. What this Bill does is simply make it uniform across the State of Illinois."

"Thank you, Mr. Speaker and Ladies and Gentlemen of the House. I reluctantly rise in opposition to the Gentleman's Amendment. It's true that it is a very good Bill, but there are reasons why Cook County and its assessment practices are treated differently than outside of Cook County. In Cook County, we have over a million point three parcels of land. We have so many parcels of land that we cannot assess our property every year, but rather have to do it once every four years. The fact of the matter is, for the Cook County Assessor's Office to provide this service, the cost would be phenomenal. And for that reason, the representative of the Cook County Assessor's Office indicated that they would try to do this when they can. But to be mandated to do it would just provide too excessive a cost. If the Amendment goes on, the good Bill will have to be defeated. It'll have to be tabled by its Sponsor, myself. So I would ask that you please defeat this Amendment, even though it is well-intentioned. I just think that it's unfortunate that it has to be in the form of an Amendment. Perhaps Representative Hastert could prepare a Bill to do what he wants to do, and we can discuss the merits of that and not jeopardize my Bill. But that's not the position we find ourselves in now. So I reluctantly again rise in opposition to this Amendment as the Sponsor of the Bill, and I would ask you to please defeat it."

And they should have the right to see, you know, if you're downstate, or in the City of Chicago or in the suburbs of Cook County, it should be uniform across the State of Illinois. I'm not arguing with Representative Cullerton. It's a good idea, and it's an excellent idea. But what I'm saying, it's an excellent idea for all the people of the State of Illinois. And this is what that Amendment does. I respectfully ask your support of this Amendment."

"Yes, Mr...yes, Mr. Speaker and Members of the House. Amendment #2 was proposed in the Pension and Personnel Committee by the insurance industry. I think it is a valid argument on their part. What it simply provides is that if there is continuing coverage of those persons who have retired in a group insurance policy that covers municipal firemen and their retirees, that if the group policy originally provides for a reduction in benefits and premiums for those insured who became eligible for Medicare, that the continuing coverage of the new people 13  STATE OF ILLINOIS 83RD GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 27th Legislative Day April 6, 1983 would also provide for the offset of Medicare payments. And it would reduce the cost of the Bill. As I indicated, it was proposed by the insurance industry, and I would move its adoption."

"I don't believe, Mr. Speaker and Representative Terzich, that the Bill has any impact on pension benefits. It's strictly an insurance Bill. It has nothing to do with pensions per se. There was never a pension impact statement filed to begin with. It still only has impact on insurance costs, and I don't think that that particular request is in order."

And one of the provisions says that if the fireman is under arrest or he is likely to be placed under arrest as a result of interrogation, he shall be completely informed of all of his constitutional rights. Rather than have the interrogator read the entire Constitution either of the State of Illinois or of the United States Constitution, we thought that we would propose this Amendment which specifically says that the constitutional rights that should be...that the firemen should be informed of are the traditional Miranda warnings. So, Amendment #2 simply clarifies that, rather than have to be read the entire Constitution, that you simply have to be read your Miranda Rights. I would ask for the adoption of Amendment #2."

"I don't think it's improper to direct a question to Representative Cullerton, and I still think there's a lot of people, on both sides of the aisle, that are concerned about why we want this Amendment that distinguishes Cook County from downstate counties with respect to rights of teachers. Now, this isn't a joking matter. I think people are concerned about it."

"Mr...Mr. Johnson, I believe the answer that's been offered is that the Bill so provides, and that this particular Amendment is purely technical. So that, maybe we'd be better to debate the question of equity between Chicago and downstate on Third Reading rather than at this time."

It's...it was our understanding that Section 24, by its nature, did not apply to the Chicago Public School District, and it never applies to Chicago. However, there is nothing in the statute that makes that clear. So, it is an area that is very unclear. And it was 31  STATE OF ILLINOIS 83RD RD GE GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 27th Legislative Day April 6, 1983 my intent, with this Amendment, to clear up that confusion, to make sure that the intention of the Sponsor, for whatever reasons...for whatever intentions they were, for whatever reasons they were, was to clearly not have the Bill applied to the Chicago public school system. And that is why I put the Amendment in. So I think that if you want to debate whether or not Chicago should or should not be included, it is clearly something that should be debated on Third Reading. We're only addressing the issue of...as to...the question as to whether or not Section 24 applies to Chicago or not, and that is the purpose of the Amendment. I'd be happy to answer your questions whenever you pose them to me. I'd appreciate it if you'd listen to the answer though."

"Members of the public, taxpayers, I believe, do not mind paying property taxes, so long as they are being assessed fairly in comparison with their neighbors or those people that they feel have homes of comparable worth. What this Amendment would allow is for some light to be shed on that process SO that people can more easily compare their assessments to those of their neighbors. What it says is that when the assessments of real estate are published in newspapers of general circulation, instead of them being published by index number, which is almost impossible to figure out if you are an average homeowner or taxpayer, they will be published by street address. That is much more clear, much easier to look at your street address and compare it to another street address that is known to you. And I would recommend this Amendment to all the Members of the General Assembly who are for fair assessments, who are for taxpayers, and who are for shedding light on the assessment procedure. The result would be a phone book type of a listing, which would be of little or no value to the average citizen. "Mr. Speaker, Ladies and Gentlemen of the House, I didn't rise earlier on this Amendment, because I do believe in the Committee process, and I believe in working things out. However, I do feel that we have to enlighten ourselves for a minute on what this Bill does. Throughout this state, we depend on Local Government. We depend on property taxation to fund Local Government. In order to bring integrity into that system, people must have the ability to make sure it's a fair system, that it's...it's put across the board fairly, that each person should be able to have an open book that he can look down. He can compare his assessments with neighbors, and SO far, this hasn't been done. There seems to me that over the study of this issue, over a period of time, that we put a cloak, that we put...we close the lights out, that people...we confuse people. They can't see the issue, that we don't want them to see the issue. This lifts that cloak. This puts...gives people access to what the truth is. It makes them be able to, in a very simple way, by comparing addresses, so they can tell what their assessments are. They can tell, you know, whether they're being assessed fairly in comparison with their neighbors. It's a good concept. I said before, I didn't stand up and support this initially, because I believe in the Committee system. I think we must talk to the issue, and that's what I'm trying to do. Thank you."

"Mr. Speaker and Members of the House, the genesis of this Bill was a license fee for remittance agent over in Madison County, who called it to my attention that remittance agents are required not only to furnish a bond with the Secretary of State, but to furnish a financial statement. As near as I can determine, it's the only license fee in the State of Illinois where both is required. I introduced the Bill without talking to the Secretary of State about it, but after I had, they told me that this would save considerable money in their operation because they didn't depend on the financial statements in the first place. And the second place, they were required to file them and keep them in order and so on. This does not eliminate the necessity for a bond on which the Secretary of State depends. I would say to you that if a person default, the bond is the first thing they look to, not the financial statement because in all possibility the financial statement is deteriorated anyway. As far as I know, the Bill is not controversial. I have no personal interest in it, because I only know this one remittance agent. But it is a simplification of government, and I think it should pass."

House Bill 451, basically consolidates the two lending laws of the consumer finance companies are licensed to operate under in the State of Illinois. The Bill repeals the Consumer Finance Act and corporates its unique features into the Consumer Loan, Installment Loan Act. Each Act is supervised by the Consumer Credit Division of the Department of Financial Institutions. And lenders are required to obtain two specific license under the present law, and they operate under two separate and sometimes conflicting regulations for basically the same type of operation. As far as anything that is strong in one area, weak in the other area, no, I mean what have they done? They've been corporated to make one strong Bill. This is from the Department of Financial Institutions. This is a product of the Department of Financial Institutions, and the Finance Companies, and a small group of banks in the State of Illinois to come up with a strong law that they can work under."

I remember standing on the floor of this House and listening to the debate over the machine gun Bill last year. And... and we got very glowing reassurances that the Bill was okay, and there was no problems with it, it was a technical change and law and behold, we really got caught pretty badly and a bad mistake on that one. And I think before we repeal the Consumer Finance Act at the request of the finance companies, we ought to take a real good look at this, and I urge everybody to vote 'no', until they know exactly what's in that Bill."

"As far as...under which Act are you talking about now?"

"Well, I am looking at page 16, of the original Act, and I see no real estate security. That's what it says. Isn't that right, that licensees can't take real estate as security?"

"So, that now you've changed that though, haven't you? You've DOW said that any loan over $3,000, we can tie up the homestead. Am I right? You've extended the amount of security that a lender can grab on to. Isn't that right? Regardless of the fact that the property itself may be well worth, we hope it's well worth, the amount of the loans, since the seller is selling OD a loan basis and has adequate security. Hopefully, if he's been an honest dealer, he's had adequate security in the personal property. Isn't that right?"

"Okay, what this basically would cover would be a home improvement loan, where they would take a second lien on it."

"That's not what this says, it doesn't limit to home improvement loans, does it? It says, you immediately allow loans to be taken on homes. You've got to put up the old homestead for the consumer loan, right?"

"Well, but we understand that how chummy you know, you can talk about with the lender. But a lot of us can't talk that chummy with our lender. A lot of us are stuck with just going in and right now we protect borrowers from having to put up the home. And now we're going to just make a little change. We are going to say 'sure', old banker says, 'Put the arm around, you've just put up the homestead, kiddo'. That's what it does, that's what this Bill does, right? Among other things, right?"

"Well, you know, you were saying that I was more chummy with them. If I had the money you had, I wouldn't have take out loans now."

"Oh, well, don't let this tan fool you. I have a limp. But isn't that the case, in fact... Also, isn't that the case that under the Bill consumers have to pay an additional charge for an NSF checks, although they might have had to pay a charge anyhow, a penalty?"

"Thank you, Sir. I think this Bill is a very significant change, I think it adds a lot of baggage to borrowers. I think that if you are concerned with consumers and concern... and we also have a concern by the way with lenders. I mean, I'm not so calloused, I'm not so consumer oriented, that I don't believe we have to protect the consumers as well as people who loan. But I think this Bill makes some very significant changes. And to see this Bill whip out of the Committee and not have great deal of study, to whip and then be here on Short Debate disturbs me a great deal. There's 5% penalties on unpaid balances that appear that weren't there before. There's a question of reimbursement of amount of charges, where the lender has not done the appropriate thing. There is security on real estate. There's a number of things, that just make me not ready to change the law in a very significant substantial way for consumers in Illinois. And I think we should be very careful, and if ever there was a time when we have to be very tender, I mean tender, to people who are borrowing money in this critical economic crisis, this is the moment. It ain't the time for us to say, 'let's help those lenders, let's give the borrowers a little hand and a little consideration'. I'm going to vote 'no' on this, cause I'm just not convinced that there is anything in there that helps anybody who's borrowing money on short loan, short term. And that's why I'm voting 'no'."

April 6, 1983 a small loan license and, I also had a license to make the larger Basically, what this does, at that time, I had to have two licenses and this requires, that I have to have just one. It does not change the condition for the security that you have to have. And it will make it much simplier for the Department of Financial Institutions to do the audits and compliance audits. Frankly, I think its been blown out of proportion because the same regulation that's there...was there before, it just take one license, you make two different types of loans."

"Thank you, Mr. Speaker. Ladies and Gentlemen of the House. As Vice Chairman of the Finance Committee, I'd like for you to know that this Bill came before the Financial Institutions Committee. The Sponsor presented the legislation, it was deliberated upon. The Bill did have a fair hearing. There vas testimony on behalf of the legislation. The Department of Financial Institutions appeared. The Bill, prior to reaching the floor for Amendment, dealt with a structural change in the Consumer Finance Act, and also the Consumer Installment Loan Act. And the Department of Financial Institutions did not opposed the Bill, but merely offered suggestions for improvements. And an Amendment was adopted which in effect did that. A previous speaker said the Bill has raised issues that are extraneous to House Bill 451. House Bill 451 does not place in jeopardy one's property. It does in fact, makes some structural changes, adjust some fee schedules, because of the consolidation. House Bill 451 is a consolidation Bill. I stand in support of the Bill. "Why, why do you...why do you not want the consumer to pay his interest in advance? What's the problem with that?"

"I think, I note the analysis says here that, 'provides that the interest on a loan not exceeding 10,000 exclusive charges may not be received in advance'. Why do you resent receiving interest in advance?"

"It protects the consumer. If you listen to your seatmate behind you, he would be... a minute ago he wanted to protect the consumer. This protects the consumer."

"Mr. Speaker, about 3 years ago this House took... and took the interest off, the interest limits off, took the usuary rate off. Took the interest rate off all loans. Every loans can carry its own rate and interest. Besides that's the start of the recession. We also penalize people 5% for a late payment, which would indicate anyone that has trouble paying his consumer notes, would also be penalize 5% for not being able to pay it to the tune of almost 60% a year. You read in the Tribune about a month ago, where car dealers in the Chicago land area were charging 50% interest on car loans. There's no limit to what I would say today on this Floor that these type of loans are running 20 to 25%, and I dare appeal to refute that statement. You're paying now at Illinois for your Sears Installment Loan because ve took the limit off 20%. You're paying 20% to Visa. You're paying 21% to Amoco Standard Credit Cards, because you took the usuary rate limits off. I voted against it. But here's a case where, evidently, there's some flaw in the law...where the Small Consumer Act hasn't covered all those bases, and that's why this sneak place coming here. I suggest the Members of the Democratic Party vote against this Bill."

"Well, Mr. Speaker, there has been a big ado about nothing here. In fact, I'd like to remind the previous speaker, that he don't ever tell me how to vote. And I doubt if he tells very many other people how to vote and gets by with it. Now, this did have a fair hearing. We spent nearly an hour on it, there was one objection to the Bill and that was to permit the sale of insurance to all kinds of 56  STATE OF ILLINOIS 83RD GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 27th Legislative Day insurance. The insurance people objected Sponsor of the Bill agreed to take it out. permitted April 6, 1983 to it. The We took it out. We did have a fair hearing. So far as the loans are being on real estate property, the choice now is to take a complete new loan. Guess how much you save than with a new interest rate today. So, actually those persons who wish to take a new additional second mortgage loan are better off than they would be if they were to refinance the property altogether. It does do what Representative Friedrich says. It cuts down to one license as opposed to two for the lenders. I suspect the biggest thing wrong with this Bill is one of the Sponsors, the back Sponsor, my own паше. I know that certain people jump up and opposed anytime my name is on something, and I'm tickled to death because I like to be famous. I ask you to vote for this Bill."
