And what we found was that, reducing the other line item to 92% leaves them with less money for next year than they are currently expending during this year. It's all well and good to make a point about some of the shameful things that have taken place within the Department of Rehabilitation Services. I would point out that this Bill also carries an Amendment that increases the appropriation for the Illinois School for the Deaf, the Illinois School for the Blind, the Illinois Visually Handicapped Institute and the Children's School and Rehabilitation Center, in accordance with the requests of those advisory groups. So, this is a Bill that if it were to fail at this point in the process, the concerns that the deaf parents... or the parents of deaf children and the parents of blind children and the parents of orthopedically handicapped children have would not be addressed in any legislation in this forum and conceivably would undermine the efforts to put these monies in later on in a Conference Committee. So I think that those people who are voting red or present ought to... at least some of them ought to reconsider their position so we can get this Bill out today for the Illinois School for the Blind, the School for the Deaf and the rehabilitation school for orthopedically handicapped kids."

She's talking to her seatmate. We found that in Lake County they've been anything but a Human Rights Authority. They've been an evasion of Human Rights Authority. They've staged midnight raids on a very respected school, the Grove School, in our area. They've been insensitive to the legislative inquires 21 STATE OF ILLINOIS 83RD GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 126th Legislative Day May 29, 1984 from both Representative Frederick and myself. They've caused quite a bit of ill feeling in our area, divided the community of people interested in special education. And I would think that the Appropriations Committee of the House would take a much more careful look at this Human Rights Authority and the Guardship and Advocacy Commission than they have. It's kind of a Lucy-Goosey bunch of storm troopers running around our state picking on certain private agencies they don't like, while the Department of Menatl Health Agency in Waukegan is having all kinds of trouble, all kinds of people being injured, dying and so on. They're afraid to tackle that because that's the state. That's the Department of Mental Health and Developmental Disabilities. Instead they pick on some of our not-for-profit, fine, old line special education facilities. And if there ever was an agency that is a disgrace to the State of Illinois, it's the Human Rights Authority of the Guardianship and Advocacy Commission. I'm not on the Appropriations Committee, but if I were there, I would have certainly have looked carefully at the appropriation of this irresponsible and unresponsive group. And I'm one who has worked in special education for years and found them to be the least temperate and the least reponsive group I've ever run into."

I think that if there are problems like that that he ought to bring it to the Committee's attention so we can try and work them out, because surely we do not condone the sorts of things that he is discussing, but we will be happy to look into it further. "Mr. Speaker and Members of the House, during Committee hearing on this Bill, there was an Amendment passed that related to funding levels for certain of the line iters. And agreement presumably was reached that we would fund a number of those line iters at 92% of the request from the State Board of Education. However, after that action had been taken, and I supported that action, we found that the result was that for the line item that reimburses special education personnel who work within our public schools that we would, in fact, be giving them less money in next year's budget than is currently being expended in this year's budget. At the same time, there was an extraordinary increase in a line item for 28 STATE OF ILLINOIS 83RD GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 126th Legislative Day May 29, 1984 extraordinary services. We have not been able to find the real justification for the tremendous increase that the State Board of Education is asking for, for extraordinary services for handicapped children. They are talking in terms of identifying some additional 10,000 special education students in need of extraordinary services. I feel that that is totally out of line. There are not that many students coming into the system who would need that level of service and that we would be far better off putting part of that requested funding back into the line item for personnel reimbursement for those regular special education students, if there is such a term. What I have done in this Amendment is not to increase the bottom line at all but simply to transfer some money from extraordinary services into personnel reimbursement. In that process, we would end up with a 6% increase over the current year's budget for personnel services, and we would have a 6.3% increase in extraordinary services. I believe that that is a much more equitable distribution of the money that we have determined we would like to put into education this year. And I would ask for a favorable vote to accept Amendment #2."

I would point out that the Bill as it came out of Committee provided a consistent 92% funding level of expend... expected expenditures in those mandatory programs. I appreciate the Lady's concern in terms of the extraordinary service costs and the estimates there. However, you must realize that there is a concerned effort being made to 29 STATE OF ILLINOIS 83RD GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 126th Legislative Day May 29, 1984 bring the students who are funded out of the extraordinary services back into the state, and that is going to cost additional money. We funded everybody at 92%. If this Amendment were to be adopted, it would break that funding and drop the extraordinary funding to 83% of the projected expenditures and increase this line item a mere 3% to 95%. And so, with all due respect to the Lady, I believe the Committee process has worked well. They have crafted a reasonable Amendment, and I would ask a negative vote on this Amendment."

I reluctantly rise to oppose the Lady from Champaign on this issue, but I do so on a couple of grounds; one of which is, there are many other worthy places in the budget where this money could be transferred. The line that she selected is indeed a worthy one, but the budget falls about $350,000,000 short of what the State Board of Education requested and so, I'm sure each one of us can probably think of some other place where they might like to see the money go. But in addition, I would just point that the people seeking this change and lobbying for at the present time did not even testify in Committee. The Committee had no way of knowing that their concerns were not being met because they didn't bring them to our attention. And I think it's unwise to act precipitously. If there is, indeed, a problem, we'll be happy to look at it. I can assure the Members of this Assembly that we haven't heard the last of the education budget. This is one that will probably go right down to the wire as always, and there will be time to work on it. "Mr. Speaker and Members of the House, I know it's rather confusing if you have not looked in detail at the budget for the Board of Education. However, I find it rather ludicrous to say that we're being equitable by prorating everybody at 92% of the State Board's request when, in fact, that penalizes your local school districts who will receive less money for the reimbursement of their special education personnel then they are currently receiving this year. What my Amendment would do would, in fact, provide equity. It would provide for a 6% increase in that line item for personnel reimbursement for special education personnel, and it would also allow for more than a 6% increase in extraordinary services. I believe that in this numbers game we frequently agree on something that turns out to be foolish. And in this case, the Amendment that was adopted in Committee turns out to be foolish because it reduces the level of funding from that currently 31 STATE OF ILLINOIS 83RD GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION CEBATE 126th Legislative Day May 29, 1984 provided in our local schools. It is true that we are trying to conserve funds, but this Amendment in no way adds additional money to the schools. It simply transfers it, puts it in a more equitable distribution. And I believe that it is also ludicrous to say that there should have been public input on this at the Committee hearing time, when this Amendment had not been circulated publicly and, in fact, it was only after it was circulated that the problem was really brought to my attention. And so I would urge the Members of this House to really provide equity by providing for a 6% increase for your personnel who work with your special education students."
