"I guess on a point of order, simply to inquire of the Chair and the Membership as to proper procedure in... in our Committees. All I want to do is just factually describe what happened with respect to a Bill in our Committee today. In the course of the morning we considered and the Chairman fairly considered a whole series of Bills, including a number where the Sponsors of the Bill weren't there. They were handled by Members of the Committee and others who were in attendance. Representative Tate got to the Committee meeting even ahead of the Spokesman at 8 o'clock in the morning and was there for five or five and a half hours. He asked that a Bill, House Bill 1417, be placed on the appropriate order for consideration of that Committee. I gave that to the Committee... the Committee Clerk, the Committee staff person. Representative Levin, I believe, brought the same Bill to the attention of the Chairman, at least two and maybe three occasions. The subject matter of this important Bill, a time sharing Bill, was asked to be considered. At the end of the day with some of the Membership there and a quorum there, the Bill was considered - I think a minute or two before one thirty. Representative Tate then went to the microphone and described or started to describe what he felt was either an abuse of the Chair or improper consideration. At that point, the Chairman of the Committee recessed the Committee with nothing more and that Bill has not been heard at this time. I simply want to inquire and I think, perhaps, Representative Daniels, or Vinson or others want to inquire in a little more strong terms as to what the proper procedure is for Committees in that particular situation."

"Well, for the enlightenment of the Members of the Committee and everyone interested in the subject matter of the Bill, which was raised momentarily ago, the first information I had as Chairman of the Committee, anyone wished the Bill called was when the lobbyist supporting the legislation mentioned the Bill to me, and I indicated to him I would try to squeeze it in. We were against the time deadline for calling. I put the Bill into rotation, which turned out to be the last Bill, at the earliest opportunity. There was an outburst. We were against the deadline to come here on the House floor. The Committee is recessed until 4 p.m.. All Members are urged to be there. The Sponsor is urged to be there. The interested groups are urged to be there. We will meet at 4 and continue as long as we have good Membership to give everybody an opportunity to hear Bills. Bills were called all morning long - Democrat Bills, Republican Bills, Member... Committee Member Bills and no one ever requested that I call the Bill to which they refer, and I would have been happy to... to call. And I don't think there are any other disgruntled Members of that Committee on either side of the aisle. As a matter of fact, the Bill prior to this one, I was going around the Committee asking if any other Members 4 STATE OF ILLINOIS 84th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 54th Legislative Day June 12, 1985 had Bills to be heard. The Chairman of the Committee had allowed 5 STATE OF ILLINOIS 84th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 54th Legislative Day June 12, 1985 other Bills, other Sponsors and... to call their Bills that were not present at the Committee, which is common practice in this chamber. And I consented as a Member of that Committee - went along with that. When I got to the Chair to hear my Bill and brought it to the attention of the Chair that I had waited five and a half hours, that several different Members had asked and I had asked the Clerk to put it on the Roll, he then had recessed the Committee when he knowingly... he did know that we had the votes to pass the Bill, and it's a noncontroversial Bill. And all I'm saying, and all... the inquiry of the Chair is, Speaker, are we going to... if we're going continue this nature of conducting business, then... then maybe we shouldn't even have Members attend meetings and let every other Sponsor handle every other Bill. And maybe that would suffice. But I object to sitting in a Committee that I serve on allowing other Members that aren't in attendance to have their Bills heard and not have the opportunity to hear my Bill because the Speaker (sic - Chairman), which, quote, unquote, told me that if I didn't shut up that he was going to recess the Committee. That's not fair. That's not right. And I resent that, and I ask the Chairman for a personal apology."

"Well, Mr. Speaker, of the many, many Committees that we have in the House, this Committee, run by this Chairman, has received the most complaints of any Committee in the House. There are 33 Committees in the Illinois House of 6 STATE OF ILLINOIS 84th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 54th Legislative Day June 12, 1985 Representatives. And over and over again, this is the one Committee that we receive more reports of abuse on. One of my assistant leaders came in this morning, totally separate from this one, to explain what he considered the abuse to have been afforded him at the hands of the Chairman. This is a man who has designs, as we understand, to become a Judge. This is a man who's now talking that he doesn't know if he's going to run for reelection because he wants to be a Judge. Well, maybe this is a kind of judicial temperament that the Gentleman would show if he exceeds or if the citizens of his area were to place him in that trusted position. I guess we'll have to see. But one thing we do know is the man that we're talking about, the Chairman of this Committee, is a man that's running it in a very shoddy fashion, that has no concern for the Members of the Committee, has no concern for the process that we're talking about. And the Bill that Mr. Tate is talking about happens to be one of great interest to the citizens of this state. And, yes, the Chairman, himself, has just told you it's relatively uncontroversial. Yes, Mr. Speaker, I do think that the Chairman owes Mr. Tate an apology, and I think it should be forthcoming immediately."

"Mr. Speaker, Ladies and Gentlemen of the House, I think all of this is a real waste of time. The reason I say that is, I'm no different than anybody else here. I have waited in Committee this Session for four hours too. That's part of the political process. It is true that there are more complaints, I'm sure, from the Judiciary Committee than any other Committee. But what are the complaints? The complaints are about waiting. Now, I think that if you are going to be a State Representative, you can't expect to come into a... into a Committee room 7 STATE OF ILLINOIS 84th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 54th Legislative Day June 12, 1985 and expect your Bill to be heard right away. We'd all like that to happen. If any of you have been Chairman, you know that's a difficult job. You cannot be fair to everybody. It is impossible. Also, every Judiciary Committee through the years has had similar complaints. This is not a complaint against John Dunn. John Dunn is a fair person. Many Committees also have a policy that they wait for Bills that are sponsored by the Members of the Committee, because they have to be there. That's not a bad policy. Other Committees do that too. Mr. Speaker and Ladies and Gentlemen of the House, I think we ought to go on with the business of the House. All of this discussion was unnecessary. Committees are run fairly. They're run fairly to the other side of the aisle. All you have to look at is the number of Bills sponsored and passed by Republicans in this Session, and you know that you have been treated fairly."
"The Minority Leader has spoken to this very clearly. Some Members of the Committee have spoken. The Chairman has spoken. The Chair would prefer not to recognize another six people that are seeking recognition. So to answer Representative Johnson's point that he made, I think the Chairman answered that the Committee is in recess. The Bill will be heard later this afternoon. The only comment the Chair would make is that for the most part, if you're a Member of a Committee, out of courtesy, Members who are not Members of that Committee, their Bills are heard first, because the point is a Committee Member must sit there and hear every Bill until the end of the Committee. And so, traditionally in the House, we have asked the Committee Members to wait until last to have their Bill heard.
