"Speaker Madigan and Members of the Illinois House of Representatives, it is a pleasure and a privilege to be with all of you today. It is, I know, not necessary for me to remind any of you of the numbers of Americans who are hungry and homeless. You are our Illinois Leaders and you work through public policy to help meet the needs of the hungry and homeless. Many of the hungry and homeless are adults, but increasingly and unfairly, we see numbers of children who are hungry and homeless. I am here, however, to tell you about Hands Across America and to ask your support for this most historic and unprecedented effort to involve the private sector in the fight against hunger and homelessness. On Sunday, May 25 at 2:00, 6 million Americans will join hands across 4,000 miles of the United States to demonstrate their concern for the hungry and homeless in the United States. People will pledge $10, $25, $35 for their place in line. And the goal is to raise 50 to 100 million dollars to fund our local community food banks and food pantries and shelters as well as to fund into innovated programs that can get people led toward self-sufficiency. Hands Across America is a program by Americans, for Americans, with Americans. It has tremendous corporate support. House Amendment #1 corrects and gives the State of Illinois and the vendor a chance to work together to meet our Prompt Payment Act that's already statute, as we know that it already is required that we Amendment have our bills and vendors being paid promptly. #1 allows different payment terms other than what's called for in the statute now, so that a vendor and a department head can work out any differences because of delays possibly under construction or items such as that. And at least, a vendor would know in advance when a payment would be made. Secondly, if the vendor does not receive prompt payment, they would have to at least call to the attention of the department by a written request spelling out the specifics of the bills, of the warrant number, the invoice state, so that again, the department would not have to automatically search through thousands and thousands and ton of thousands, actually, of bills to be paid that would be required to pay interest. Secondly, the Illinois Court of Claims, we've changed that from being mandatory to a may type of requirement in providing for interest penalties when the bills meet their particular court of claims office. So, I think we've answered all the concerns that all the departments have indicated to this Bill. And I do ask for its adoption."

Cook County being so large, we could find ourselves in a situation whereby a juvenile may be assigned some work which may be, you know, too many miles away from his home. And SO I thought, initially, we should expand it to the counties. start it off without Cook and then try to, hopefully, work in Cook at a later date."
Let's Cullerton: "Okay. So, now with the effect of Amendment #2 then, wouldn't Cook be involved... included in the Bill in some fashion?"
"Yeah... Cook would still be covered in the sense that the municipalities and townships within Cook are covered, but the county itself would not be, so that we... for example... you know, the whole county will not be covered. A Judge couldn't assign a juvenile work outside of his township or outside of his city within Cook County. It's still in Cook County. It applies only to the townships and the municipality regions."

You know, we'll trot our Amendments from this side over to your side and distribute them if your Pages will not. It is a good faith Amendment. It's Representative Klemm's birthday for another good reason and you ought to let him hear it. But, nevertheless, I can suggest to you that you're losing some support for your Bill. A lot of us are either Cosponsors that support the Bill and that I don't think that on a Bill of this magnitude, you need to get into some kind of wrangling and draw up sides over the fact that an Amendment is not distributed when it is true that your Pages are not active. 33 STATE OF ILLINOIS 84th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 113th Legislative Day May 6, 1986 And we can't control the distribution or printing process. That's controlled from your side of the aisle. And it appears to be contrived that we would have it and that you don't have it. So, just in simple fairness, I think you should at least have Representative Cullerton and yourself and others who would like to take a look. We'll run the Amendments over to you and let's hear the Amendment, debate the Amendment and up or down. And I think that's only fair and I don't think we need any acrimony. We're kind of humming along here. And why should everything come to a stand still, because I know there are at least 30 or 40 people on our side of the aisle who wish to speak on this issue of tabling this Amendment out of simple fairness to everyone else? And why should we get into that posture today or tomorrow or the next day? So, I would implore you, Representative Terzich and the Chair, to exhort your Pages who, apparently, are not distributing Amendments on one side or the other of the aisle to coordinate their activities, Mr. Speaker, if you're listening, to coordinate your activities with the Pages so that... if we get an Amendment, you guys ought to have an Amendment and if you can't, have your Pages come over and we'll give you some copies of it and take them over to Representative Terzich and Representative Cullerton and to your floor Leaders if they are on the floor and then we can talk about the Amendment, because I know there are a lot of people interested in hearing Representative Klemm's Amendment, as am I, and a lot of people who want to support this Bill with some reasonable modifications if that's the will of this House. But certainly, we cannot proceed in an orderly fashion without some sense of cooperation from the Speaker and from the Democratic staff and from the Democratic Clerk who control the machinery of the process. "Thank you, Madam Chairman. I appreciate the chance to speak and I'm a little confused. It seems as if we are acting as if this is the end of June, rather than the beginning of May. We have a Bill. Obviously, there is some break down in the communication on the other side of the aisle. There's some problems with obtaining the necessary Amendment, an Amendment that may, in my opinion, improve the Bill and yet, we are seeing resistance and we are seeing folks that aren't willing to play by their rules in attempting to make this process work. I could understand that occurring perhaps later in this month or even later next month when we come down to a showdown. But, if we are starting this early to play footloose and fancy free with the rules to use the process in an abusive and a partisan manner, then I think it forbodes a rather dismal picture of what's going to happen in the next few weeks and couple of months. We have a situation in which a very good Amendment appropriately sponsored by a Gentleman has been offered, and for some reason, which is obviously not on our fault, or, at least, the folks on this side of the aisle, you folks don't have it. "Thank you, Madam Speaker and Ladies and Gentlemen of the House. I appreciate your indulgence. Sorry for the confusion, it was not intentional, as you all know. On Amendment #5, basically, the Bill simply excludes restaurants from being a public place. A great deal of discussion has come on the Clean Air Act. I'm a non-smoker, I support the Bill. I helped, I guess, on our side. Many of us supported Representative Terzich's attempt in Executive Committee to get the Bill out. and I was one of those who did support it. But, I also noticed since it come out of Committee, that the Senate also had tried the very identical Bill, and it did not even get out of Committee and therefore, it died in the Senate. So, I 44 STATE OF ILLINOIS 84th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 113th Legislative Day May 6, 1986 was concerned about some of the questions and problems that I anticipated this Bill would have. In Testimony at the House Executive Committee, many had mentioned that the City of San Francisco has a very effective... or Clean Air Act, but they do exclude restaurants. In traveling to San Francisco several times, seeing the success of it in San Francisco and realizing that we do not have a Clean Air Act in Illinois, which I do support, I thought perhaps we can use an exemption for restaurants to, perhaps, make the Bill more palatable for those who oppose it. In the travels of my wife and I in going to various restaurants throughout my community and all over in Illinois, and in Chicago, so many of the restaurants now are doing it voluntarily, in fact, it's almost an exception in my community where the restaurants do not have a no smoking area. So, this particular Amendment would allow the restaurants to continue to be exempt to provide a no smoking area as a good business practice, and that's the reason they do it. And I think when you and I go to a restaurant and ask for a no smoking area, you will probably find one, if not, if we were to leave, I'm sure they would put one up. But in the meantime. there are hundreds and hundreds of places in Illinois that we should have designated no smoking areas, and this Bill would at least address that. So, I do support the Bill, I think the Amendment will improve the Bill, both in passage of the House and then moving it through the Senate. I do ask for your favorable consideration on Amendment #5."

"Well, that would be, to me, a reason why I would vote against your Bill. Do you certainly think that restaurants are a public place?"
"Yes, I do, and I feel that all those that are public places restaurants could do it voluntarily, but some, perhaps, do not and the perceived notion is that we want to have restaurants excluded at this particular time. And that is the reason for the Amendment."
"Right. Well, Madam Speaker and Ladies and Gentlemen of the House, I don't know how the Sponsor of the Bill feels about it; but, if I was to draft a Bill that Representative Terzich has drafted and I wanted to do it on an experimental basis, if I was going to start some place to prohibit or have a smoking or non-smoking section, the first place I would have it is in a restaurant. First of all, it is clearly a public place. Secondly, it is a confined area. Thirdly, it deals with, by definition, the eating of food, so, that not only do you have a health factor involved, but you also have just an irritant factor. And so, this is not a question, Madam Speaker, to the Sponsor of the Amendment. Maybe, we could... alright, thank you. So to me, I'm very curious about such an Amendment, because it seems to me that of all the places intended to be protected, the areas to be protected, the 46 STATE OF ILLINOIS 84th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 113th Legislative Day May 6, 1986 restaurants would be number one on the top of the list. And so, to take restaurants out, to me, just makes no sense at all."

"Yeah, thank you, Mr. Speaker (sic - Madam Speaker). I guess... I think it is somewhat of a tragedy to have to say that if I don't want to go into a restaurant, even though it does allow for smoking and non-smoking; but, if it is not, statutorily so, that... I couldn't go there because of the fact that they did permit smoking all over. There are a number of outstanding restaurants in this country. And, to think because it would permit smoking is certainly unfair too. I really think that this Amendment as the previous speaker mentioned, is one that justifies being disapproved because of the fact that we are involved with food and we are Involved in a socializing and that part certainly should be taken into consideration. And I know many restaurant people do that, but certainly, as evidence by many of my constituents, certainly not enough restaurants are concerned about that. And I certainly think that we ought to look very seriously on not supporting this Amendment."

"Yes, out of all of the surveys that 92 percent of the people favor a no smoking area in a restaurant. How is it if you take your children to a restaurant and have them sit with all the cigarette smoke and the passive smoking going around, or someone blowing smoke in your face? The Bill only provides that they set aside a non-smoking area and whether that be 20 percent of the total area, is really great that because you're a non-smoker that is not causing 47 STATE OF ILLINOIS 84th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 113th Legislative Day May 6, 1986 the problem that you have to go seek another... restaurant because of other peoples' smoke. All the Bill provides is that they set aside an area which I am sure that the majority of them that do certainly have more area for the non-smokers than they would for the smokers. And if anybody in the entire State of Illinois based upon public opinion. that the restaurant is the number one area that they want a smoke free environment and certainly it would be a good practice. I want you also to keep in mind that if they... all the area... if all the restaurants in the State of Illinois have a designated no smoking area, where else are people supposed to go to a restaurant that has smoking. So, with the Bill being applicable throughout the state, then its a very easy piece of legislation to comply with. The public will be better off. Business will be better off. And I urge a non vote... a no vote on this Amendment."

So, I think restaurants are even less critical, and I don't know what the definition of a bar is versus a restaurant, but I would assume it's where they serve food as their main course of business."

Is it also true that if an individual comes in with a table of maybe five or six people, a party comes in and the gentleman happens to be a smoker and he wants to sit and have lunch and the gentleman says we have nothing available but non-smoking areas, and this gentleman says well, I want a smoking area, and he says you are going to have to wait, and I only have an hour for lunch. Does that mean that this party has to leave and go to another establishment?"

I would hope that Representative Terzich would just hold the Bill on Second Reading even and see if he can work some of these problems out with legislation. We are exempting more and more. If you look at line ... I think 65 STATE OF ILLINOIS 84th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 113th Legislative Day May 6, 1986 if you look at the Amendment, you will discover that one of the impacts of the Amendment is to require a nurse to provide a kind of medical advice that we have typically regulated the the medical profession. I think the concept of, in this particularly fatal disease, substituting nurses for doctors is a mistake, and that we ought to continue to retain the confidence in the medical profession to provide the kind of advice to patients about this disease. that they have traditionally provided to patients about all diseases. I don't think we should substitute nurses for doctors in dealing with AIDS in and counseling patients on Aids. And I would urge a no vote on the Amendment for that reason."

What the Amendment does specifically is to state that the Department of Public Health must determine and publish the magnitude of the risk associated with a swimmer swimming in water contaminated with naegleria fowleri so that other agencies who were called upon by the Bill to do certain things in this regard would be on notice as to what the specific magnitude of risk was, and that is a key factor in the over all operation of the Bill. I think it is a very simple Amendment, both Mr. Curran and I agree, that it does what I promised him I would do in Committee, and I would ask for your favorable consideration of Amendment #2 to House Bill #2946."
