First of all, as I understand it, the Bill was designed to... it was drafted by public utility lobbyists, as I recall, who were concerned with people who were stealing free service by using devices that bypass meters. And what the Bill did was to prohibit that activity and to increase penalties for repeat offenders. And one of the provisions of that Bill was that the mere existence of this tampering device constitutes prima facie evidence of commission of the offense. And that's the way we passed the Bill. In other words, the idea is that you have a device that bypasses a utility meter. What other reason would you use it for, other than to break the law? So, we had a good tough Bill 12 STATE OF ILLINOIS 84TH GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 142nd Legislative Day November 18, 1986 that said that the mere existence of having one of these meters... one of these devices to bypass meters, that was prima facie evidence of the commission of the offense. It didn't mean you were convicted of it, it just means that it was prima facie evidence that you committed the offense. Now, it seems like the Governor is weakening this Bill that we passed by... weakening it by saying that there's only a rebuttable presumption and not prima facie evidence. So, what do you have to say to that?"

"Proclamation. Whereas, I outline inadequacies in the insurance crisis legislation in my signing message to the Honorable Members of the 84th General Assembly concerning Senate Bill 1200, Public Act 84-1431, entitled: An Act in relation to the insurance crisis, approved on September 26, 1986; and whereas, Senate Bill 1200 does not resolve many of the problems which contribute to the present insurance crisis, and whereas, the veto of this Bill would have been a retreat from the minimal gains obtained by its passage, and whereas, true tort reform can only be obtained by further legislative action to address the le... legitimate insurance concerns of the business community and of the citizens of this state. Therefore, pursuant to Article IV, Section 5(6) of the Illinois Constitution of 1970, I hereby call and convene the 84th General Assembly in Special Session to commence on November 18, 1986 at 12:00 p.m. in order to consider House Bills 3116, 3118, 3119, 3120, 3121, 3122, 3123, 3124, and Senate Bill 2263 and any other legislation new or pending, new Bill or pending that will result in the effective and meaningful insurance or tort reform laws, which the people of the State of Illinois so rightfully deserve.
