I think it makes perfect sense to require that in daycare facilities, that there not be a handgun lying around. This didn't come out of the air. It came out of a tragedy that happened in a daycare facility where the operators had a handgun. The handgun was loaded and the child got ahold of it and there was a tragedy that occurred. We're not making any great prohibition, just where the facility is located, there ought not be handguns when there are children there."

Ladies and Gentlemen of the House, in response to the only person who spoke against this Amendment, I would just point out that he's dead wrong, that we did not consider this Amendment before. We considered the issue before, but, in response to concerns that were raised on the floor and then the last time it was debated, and then again in Committee, when the Bill went around again, this Amendment, in its present form, has not been seen before by the House. The language in this Amendment was developed in conjunction with staff on the other side of the aisle in response to specific objections which were raised. The simple point to make is this: That 9 STATE OF ILLINOIS 85th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 60th Legislative Day June 11, 1987 kids and guns don't mix. That the Department of Children and Family Services says they don't have the authority to write into their day care regulations any... anything that would pertain to how guns were... if guns were to be on the premises, or how they were to be stored if they were on the premises, or anything like that. This gives them that authority. It also establishes the right for parents to know if the guns are on the premises. I think, if you had a child in day care, you would want to know. And if you would want to know, you ought to vote for this Bill... this Amendment."

This amends the Bill to provide that any person who car is wrongfully towed has direct recourse against the tower, who in turn has direct recourse against the city or other authority which ordered the tow that was later determined to be illegal. Currently, the Bill requires that any person that has had the car towed away illegally must pay the towing company regardless of whether the tow was authorized, and then must seek reimbursement against the municipal authority, only after the tow hearing is conducted. We think that this places the responsibility and burden of enforcement in the wrong place, and offer this Amendment for that reason. Let me emphasize. It does not change ultimately who pays for an unauthorized tow. What it does is provide a very prompt recourse on behalf of the person whose car was unlawfully towed against the towing company and between the towing company and the city. The city or other agency which ordered the tow, they must go against... or the towing company must go against that authority for reimbursement. The importance of this, of course, is that, typically, one would be in a better position to collect under this Amendment. One would be able to collect more quickly, in light of an illegal tow under this Amendment. And for that reason I move the adoption of Amendment #2."

Ladies and Gentlemen this Amendment is offered at the request of various concerns of the members of the Elementary and Secondary Education Committee to conform with what, they think, the Bill would do... or should do effectively. First of all, it addresses the issue of whether or not we should have a maximum capacity or population limit on school districts that this should affect. The Amendment as drafted requires that the maximum capacity, or maximum population, be 600. However, it allows the State Board of Education to issue a size waiver when they see that it would significantly increase the educational opportunities of the district's students. In addition to that, it provides that if two or more of the participating districts approve an extension of the agreement, the... if there are more than two involved in the agreement, those people can opt out at the end of the contract period. We made that clear that that was our intent in Committee, and I think this Amendment will continue to make it clear to all who would read the law at a later time. It also indicates that if a district should wish to enter into a cooperative agreement with another district, they do not have to have equal voting rights on the Board, if they contract otherwise.
