Is this the way of killing Bills so that the Speaker doesn't have to put a down arrow on it some point along the line? I mean is this an intentional act or is this something that's not intentional? "I'm trying to Mr. Speaker. Yes, Mr. Speaker, and I also noticed that there was some applause from the Gallery, we don't allow that but when we talked about our Bills being killed in Committee I think the word is getting around. I think we have to get some order back in this place. We have to move our Bills along. We all have legislative agendas that are important to our Districts and that's important that we have the opportunity to handle them. I would like to see some order in this House and some order in the Committee."

"We now have Representative McCracken, for what purpose do you rise?"
"Well along the same lines, we had an interesting experience in the Judiciary Committee today. The multiplicity of Committees has forced people to leave in order to be in more than one place at a time, so as to comport with the scheduled Committee Meetings. But rather than cut back the number of Committees, we are now moving toward proxy voting. Today we approved over Republican 7 STATE OF ILLINOIS 86th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 30th Legislative Day April 26, 1989 objections the use of an Open Roll Call by which Roll Calls can be opened virtually at the discretion of the Chairman or the Majority and in effect allowing what amounts to proxy voting and we objected to that. That is the practice that has been discredited and discarded by this institution and it is a direct result of this plethora of Committee assignments. People are unable to carry their Committee's load and be responsible to all of their voting requirements. In effect, what you do by leaving these Roll Calls open is to give the Majority the opportunity to vote as it sees fit and to make all of it's other commitments. In effect, what you do is sanction proxy voting. Something that has been discredited and discarded in the past. Now I think the time has come where we have to make the stand. I don't want the press to think we're crying wolf. This is important. It goes to the very heart of this matter. It goes to the very heart of this process and I told the Committee this morning we would not let it stop there. It is a problem. It is a question of abuse of power. And I'll tell you something else and I know you're not going to respond. you'll look over shoulder and talk to the real Speaker, but let me tell you something else, the point has arrived where we are now being told repeatedly that if your Bill amends a certain title of the Illinois Revised Statutes, we'll let a Democrat carry it but you can not carry it. We are seeing also that our targets are being discriminated against for no better reason than they have incurred the wrath of the majority by having the nerve to win an election. It happens to our Freshman targets. It happens to our targets no matter how long they've been here. And the time has come where it has to stop. Now I propose that we take some strong action today. We start putting a freeze on this place and we take a good lesson 8 STATE OF ILLINOIS 86th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 30th Legislative Day April 26, 1989 from our Brethern in the Senate. We're being treated unfairly and we won't stand for it. Now we want some changes made and we want some commitments to those changes. We want to end proxy voting. We want to end discrimination against Republican targets. We want end discrimination against Republicans because you don't want to vote on the Floor as to a particular issue. And let's be candid about it, it's in the medical malpractice area among others. We can not sponsor a Bill which amends the Code of Civil of Procedure because you are afraid of a Floor vote. Even though you've got the majority, you're afraid of a vote. You will not let us carry any legislation which could even remotely offend your sensibility. And I'll tell you something, I had an experience with it this morning and the lobbyist who asked me to carry the Bill, a former Democrat was shocked that we have gotten to a point where we are openly and notoriously told that we can not sponsor certain types of legislation. They don't disagree with the Bill; we just aren't fit to be the Sponsors."

"Thank you, Mr. Speaker, Members of the House. On the same point, I also was in Judiciary this morning and when the Chairman of that Committee said he wanted to have an open Roll Call, I objected. At that point and time they deferred until the Parlimentarian came in and they went ahead with the Motion. The Bill at hand you should know about, the Bill happened to be a Gay Rights Bill which has been around this process and this Chamber as long as I have been in the General Assembly. It was a Bill obviously with 9 STATE OF ILLINOIS 86th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 30th Legislative Day April 26, 1989 very strong ramifications and a very strong issue to many people and there obviously are those on the opposite side as well who feel the same way. But the issue, of course, was what happened there. The Speaker...the Chairman opened that Committee for a vote, allowed two Members to vote and about 45 minutes later when they actually took a vote on the Bill itself, those Members were both gone. It seemed to me Mr. Chairman, Mr. Speaker that that's improper. Now I'll acknowledge that we have in the House have over time as a courtesy off and on, allowed that to occur. But what I see going on now, is that's going to happen over and over again. The flaw is so much not the diligence and the assiduous nature of the Members, but the fact they have too many Committees to serve on and even the best Member can't be at all places at all times. It's a bad procedure and to allow us now to have a normal occurrence of an open Roll Call is a very very great flaw in this process. It weakens not only the General Assembly, but it weakens democracy as a whole. It's a bad idea, let's not let it happen any more. I urge you to stop that policy."

"Thank you, Mr. Speaker and Ladies and Gentlemen of the House. I missed some of the debate but I guess it's about opening Roll Calls and let me set the record straight with regard to Judiciary I Committee at least. I have no comments with regards to other Committees. It was indicated by the Chairman of House Judiciary I Committee and I am the Chairman. Early in the Session that the Chairman does not approve of opening Roll Calls. However a number of Members on both sides of the aisle ask that Roll Calls be opened so they could go to other Committee Meetings and with Leave of the Committee that was done in House Judiciary I Committee and I didn't object to it; 10 STATE OF ILLINOIS 86th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 30th Legislative Day April 26, 1989 figuring that's the will of the Committee, I'm the Chairman but whatever the will of the Committee is, is the will of the Committee. This morning there was a request to open a Roll Call and there was an objection. I indicated there would be no more Open Roll Calls in my Committee. And again it is my philosophy, that's my statement of policy. Subsequent to that announcement there was a Motion to open a Roll Call and a majority of the Members of the Committee voted favorably on that Motion. The people on the other side of the aisle who were objecting to the procedure ought to realize that, in effect, what happened in the House Judiciary I Committee this morning was that the net result was a Motion to overrule the Chair and the Members of my own party voted on that Motion and overruled me. I'm not bent out of shape by that. The majority of the Committee ruled, we opened a Roll Call. I didn't like it at the start of the semester; I don't like it today; I didn't like it yesterday; I won't like it tomorrow; but the majority of the Members of the House Judiciary I Committee voted to open a Roll Call. If they did that, that's their business. The Roll Call was open. It'll stand that way and if there are other Motions, they will pass or fail depending upon how the majority votes on the rule. So in House Judiciary I Committee, if you have a complaint and don't like the way things are run, get a majority of the Members to vote your way and the procedure will change. If you like the way it's run, then vote with the current procedure and if you have a complaint come and see me and we did the very best we could this morning to call Bills for Members of both parties giving preference to people with out of town witnesses. So I hope that we can put an end to this nonsense about arguing about open Roll Calls. "Well thank you, Mr. Speaker. It's sometimes hard for me to understand why this is all necessary. I was reminded yesterday in the Insurance Committee when Leave was asked to open the Roll Call and we were told when we objected that we got... the Democrats have the votes, that if we want to play hard ball, that we'll be taught how to play hard ball. The simple objection to the rules is being called playing hard ball and that we'll be taught a lesson; we'll be showed how to play hard ball and that we should take that message to our Leadership. Mr. Speaker I don't understand: you've got the numbers; you've got the rule book that you wrote; you have everything on your side. When you want to pass your Bills you can do that. Why should you try to extend the rules to benefit your Members and to do injustice to the people in the State of Illinois. I just...it's beyond my comprehension why you want further advantage. You have all the advantage you need to accomplish whatever it is your goals for the state are. We are sometimes confused by the rules and what your goals are, thank you."

"Speaker Madigan chose to cancel Session in the month of March. We have 2,811 Bills introduced by 118 Members of this process and as Speaker representing the entire state and representing all of our Members, I'm sure that his intent was to have some type of orderly process to this. 12 STATE OF ILLINOIS 86th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 30th Legislative Day April 26, 1989 But what has happened now is: we have one week left of Committee deadlines, we have close to 500 to 700 Bills that haven't even been printed yet, we don't have analysis on Bills and what this process is turning out to be is a sham because what he has forced his own party to do, he has instructed his Chairmen to open up Roll Calls to get Member's Bills out and we have limited public input. We don't even have time in some of these Committees to hear testimony for and against the Bills. This is a Democratic process. Everyone of our Members, both Democrat and Republican care about the Bills that they introduce. They want an opportunity to represent people, have their issues heard, have their views heard, have people come from back home and testify on those Bills and do SO in an orderly fashion. But this fashion, this process has been circumvented and now what we have is we have a process of choas where you're passing your Bills out on a whim and nothing happens. Let's put some order to this process, this Speaker can put some order to that process. Let's sit down with a Member of both sides ... both parties, both sides of the aisle and let's work out some kind of an agreement to get some order back in this process."

I don't think this is an partisan issue and far be it from me to try to make it a partisan issue. I sat in on Committee today and will be here until late this evening and I see your Members having just as many problems as we are. They are running from Committee to Committee. They're trying to present Bills. I've seen Committees that have had to stand in recess because we don't have enough Members to conduct the business that we're sent here to 13 STATE OF ILLINOIS 86th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 30th Legislative Day April 26, 1989 conduct. Now I would simply appeal to the Speakers capabilities and abilities: there has to be, Mr. Speaker a better way to conduct the people's business than this. Either we reduce the number of Committees or we get together and figure out a better way to do it. This isn't a partisan issue. All of us are running all over this capitol trying to present our Bills, trying to serve on Committees, doing the best we can to represent the people that sent us down here, trying to conduct state business. I appreciate the fact that you've said he will respond to us in writing and I look forward to that memo. But in the words of that great statesman, Mr. Speaker, let us move about the business of this House in a kinder and gentler fashion. All we ask is please, there has to be a better way to do this than what we're doing and I look forward to that memo and I look forward to that kinder and gentler way of doing the business that we're sent here to do."

We all have the same running from Committee to Committee, but there is not a problem with us extending courtesies. The blatant way of ignoring Republican initiatives, the blatant way of ignoring targeted Legislators, those that you don't know. If it weren't for getting Leave this morning to open up the Roll Call there's about 4 or 5 Republican Bills that would not have gotten out, and as a result of that they did get out. So in deference to what we've been hearing in the political diatribe, certainly we've been doing our job in that Committee and I think that everybody that's on that Committee on that side of the aisle can probably agree. So Mr. Speaker, I think you're doing a wonderful job, things are running very smoothly and don't worry about all of this stuff that what we're hearing from over here and I would just ask my colleagues to stay with that policy and that principal because things are moving smoothly in that Committee."

"Thank you, Mr. Speaker, Ladies and Gentlemen of the House. I would ask your support for Senate Bill 651. One of the most profound and far reaching Bills to ever be passed by this Chamber was Senate Bill 1840, the Chicago School Reform Bill that we passed last Fall and that the Governor signed. As passed, Senate Bill 1840 is effective July 1st of this year. After the passage and signature of that Bill, there has been a great deal of activity to begin to plan for it's implementation. There have been 18 Task Forces established within the Chicago Board of Education to involve both the public educators, the parents and Members of the Board, in preparation for implementation of different parts of this School Reform Bill. In addition, various civic organization parents groups have begun to undertake the training of the parents SO that they are better equipped to handle the new responsibilities under this Bill. Unfortunately, there is one glitch in the timing of Senate Bill 1840 as we passed it, and that is since it takes effect on July 1st and provides for the appointment of an Interim Board by the Mayor of Chicago 30 days later, we'll be faced with a situation where union negotiations will begin with the 23 unions that represent Chicago Board of Education Employees while we have 2 different Boards in existence. What this Bill does and it does only one thing, the Bill we have before us today is to accelerate the effective date of the School Reform Bill that we passed last year so it would be effective on May 30 STATE OF ILLINOIS 86th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 30th Legislative Day April 26, 1989 1st, rather than July 1st so that an Interim Board can be appointed that much sooner so that we have a Board in place to negotiate with the various unions when the union contracts expire on August 31st of this year. If there are any questions I'll be able to answer them. We have bi-partisan sponsorship of this Bill and I would just encourage your support so that we can begin school reform in Chicago that much more expeditiously."

We now are standing at a point and time after months and months of work with parents, teachers, administrators and citizens and interested businessmen and women in developing a program, a beginning, a start for some reform in the City of Chicago that has long been overdue. I rise in support of this because the sooner we can put the basic beginnings of School Reform in place, it is better for the children of the City of Chicago, so moving it back 2 months for the implementation is a good idea and the work of the reform should get, should have the ability to get going. So, I rise in support of this Bill."

"Okay, and that in fact we have had discussions of the 31 STATE OF ILLINOIS 86th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 30th Legislative Day April 26, 1989 necessity to insure that, because as you know, there is some concern among parents about the acceleration of the councils before they are ready, that in fact an Amendment to an Accompanying Companion Bill has been agreed upon and that Amendment in effect says that the Amendatory Act of 1889 (sic 1984) is to accelerate the taking effect of only those provisions of Public Act 85-1418 which amends Section 34 of the last three of the School Codes which abolishes... by abolishing the terms of all current Members of the Board of Education and the appointment of the Interim Board and not to accelerate the taking effect of any other provisions of this Act. In other words, the only purpose is to accelerate the appointment of the Interim Board and not to accelerate the entirety of the Act in and of itself, is that correct?

It now changes the title to amend, to be an Act relating to Vocational Education amending certain Acts. What it does, it implements one of the recommendations of a Committee on Vocational Education and Higher Education admission requirement. That Committee has met and made conclusions and issued a report and one of it's recommendations was that the Board of Higher Education in Colleges and Universities should make sure that High School students and others are aware that the admission requirements do not apply to occupational and vocational 35 STATE OF ILLINOIS 86th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 30th Legislative Day April 26, 1989 programs at community colleges.
