House Bill 5377 will help keep senior citizens in their homes by providing consumer protection provisions for people throughout the State of Illinois who choose to live in manufactured home communities, more commonly known as mobile home parks. This Bill only applies to the unique nature of living in a manufactured home community because of the homeowner’s dual role as owner and renter. It is clear that our pop… as our population ages many of our senior citizens will consider manufactured home communities as an affordable housing alternative for their retirement years. "I am unsure of that number. Many, many mobile home parks, about 300 thousand people are estimated to live in manufactured home communities throughout the state."

"The difficulty that we are trying to address with this Bill were landlords increasing rents beyond market rate in order to force vacancies. This would only deal with those kinds of situations. The Lady’s request for an override makes sense if you look at what a mobile home community is. You then move this mobile home onto a piece of property that you do not own and it is hooked up to water and electricity and then that becomes your home. If for any reason the owner of that park decides that the value of the land is more than the rent, one of the great injustices that has taken part… taken place throughout the country is that the owner of the mobile home park will simply raise rents to the point where no one can pay them. They often then don’t have the money to hire someone to come in and move the home and they are, for lack of a better word, evicted. The owner then sells the mobile home, if he can get clear title and it is… it is a personal property issue, that’s not right and that’s not fair. It’s not the same due process as you or I would have in a condominium or the home on which we live because it’s built on land that we own. I don’t think we should be encouraging landowners to raise the rent above fair market value simply to get out a tenant that they don’t like or to get all of the tenants out so that he or she can then sell the land to a developer at a much better price than the rent that is paid. This gives the mobile home owner a modicum of due process. The Lady has already explained that the Governor is not quite right on his figures and I’ve had people call me today and said, well, it would impact a manufactured home. I don’t think so. If you put a manufactured home on a piece of ground, you generally own the land. We’re… we’re not talking apples to apples in modular, manufactured or true mobile homes. I think it’s a reasonable Bill. I think more than 80 of us voted for it when the… the last time we saw it and I hope the Lady will get the requisite number of votes to give people who need our protection that measure of protection that I think is fair. I think it’s fair to the owner of the mobile home; I think it’s fair to the owner of the park because he or she can raise the rent on any fair market value after an appraisal. It doesn’t deny that individual a fair return on his or her investment either. I intend to vote ‘aye’. I hope you’ll join me in doing so."

But assume we provided then did it not a way for seniors to have a nice community to live in along with other seniors?"
"This indeed is an affordable option for senior citizens many who have sold their primary home and used some of their proceeds to purchase manufactured and mobile homes and then find themselves in a situation where they no longer can afford to live in what should have been an affordable community and what was sold to them as an affordable community. They have their market rate rents indicated in their contract and yet these rents are now being based on assisted living facilities and active adult communities."
"Correct. And so, just… to the Bill. Again, I wanna say, this is a particular piece of legislation that did pass the House with 87 votes. It is a way to provide to the seniors of this state something that was given to this state as affordable housing for seniors. I have many manufactured home parks in my district and it certainly is a way to have affordable housing for senior citizens and to have that change in the midstream to where now the whole concept has changed is not fair to the seniors and to the people that have moved into these mobile home communities. It is good for our seniors and it is good for anyone that has to have that kind of housing in order to have a nice, safe place to live. The renter, in my opinion, should just find some place else to live. "In response, the… in fact, the situation that exists between mobile home owners and the landlord is a unique one. The mobile home owner cannot just simply move like a renter in an apartment situation. In fact, before that mobile home owner can move, they must sell their home. What we have occurring is rents that are beyond the marketability, so rents have been increased to the point where no one will buy this home, a mobile home owner cannot sell their home, they cannot afford to live there, they would love to leave. So, they continue paying rents that they can’t afford for a year or more in an effort to try to sell their home and when they cannot sell their home, they turn over the keys to the landlord. Now, these homes are valued in our community between 30 and 60 thousand dollars. They are giving away an asset because they can’t afford the rents that are ranging between $730 and 11 hundred and 35 hundred dollars. This is just too expensive for senior citizens on fixed incomes and then they have no recourse. They are in a Catch-22. There is not an even playing field between owners of mobile home communities and the homeowners who choose to live there." "Thank you, Mr. Speaker. I stand in strong support of this Bill. The reason the fallacy about rent control is totally wrong is the fact that if you… if you have an apartment and you’re squeezed out because of the rent, you take your possessions and you leave. The apartment is still there; you don’t own it. And so there’s no problem there. So, I don’t see how it would be a correlation or a piece of legislation that would provide any kind of rent control. I think they’re totally wrong. On the other hand, with a manufactured house in some instances in years gone by the owners of these mobile home parks or manufactured housing parks have enticed seniors and other people to come, buy a home which they say is low-income which will save you money and then they proceed to raise the rent and there is no place once you are pushed out. You cannot pick up that mobile home and move it, no parks will take old homes. So, it’s a total loss of their money. So, they have not just lost what they have, as Representative Munson has said, they’ve lost an asset. This is totally different and certainly departs legally from any kind of rent control for an apartment for the simple reason that you’re not losing an asset if you're forced out of an apartment. You help with the small people. I think this deserves an override. I urge an ‘aye’ vote. This is really helping people that are up against a… their back's up against a wall with losing their home or having rents raised beyond their ability to pay for them."
