Alpha Phi Alpha holds the distinct honor of being the first intercollegiate fraternity established by African Americans. Its founders, Henry Arthur Callis, Charles Henry Chapman, Eugene Kinckle Jones, George Biddle Kelley, Nathaniel Allison Murray, Robert Harold Ogle and Vertner Woodson Tandy are collectively and endearingly known as the Seven Jewels of the fraternity. With its cardinal principles, manly deeds, scholarship and love for all mankind, over 175 thousand men have been initiated into this fraternity in more than 700 college and alumni chapters worldwide. Aside from the lasting friendships, fraternal bonds that are provided, Alpha Phi Alpha has dedicated itself to a number of philanthropic programs. The language of the Bill provides that the sanitary district of Decatur may enter into an agreement to sell, convey or disperse treated wastewater and/or accept wastewater for treatment with a private entity located within 50 miles of the district's boundary. The agreement may not exceed 30 years. I have a coal gasification plant in my district that's currently moving along and one of the items that is necessary in order to make that a success is water. The sanitary district of Decatur has come up with an innovative idea that they'd like to sell water to this private entity, but they feel that they need to have statutory authority to do that. And so that's what this Bill does. Ladies and Gentlemen of the House, in all due respect to the Sponsor and I think I know who the individual is who would be impacted by this Bill and I certainly have the highest regard for that individual, but we are currently facing a debt in the pension system of this state of approximately and you can argue a billion here, a billion there, but about $40 billion. We rank dead last in pension funding for our public systems. IMRF I understand is a different system. It is financed by property tax revenues levied on the property taxpayers of a county or a municipal government and I know many counties were shocked a year ago to find that their IMRF rate had increased considerably. Now, we may have done this in the past, but given the general state of funding for public pensions in this particular State of Illinois, where... where do we draw the line? Why... why not allow staff members of the General Assembly to participate in the General Assembly Retirement System. Why not allow other members who work in some capacity for State Government to join the General Assembly Retirement System. This could become... ya know, and the Bill itself is innocuous. The Gentleman means very well. The gentleman that it impacts for... from all of my dealings with him is an extraordinary gentleman and very good at his job, but I... And I know this in and of itself would not put an undue burden on the Illinois Municipal Retirement Fund, but the taxpayers, the property taxpayers will be paying the pension contributions for an individual who is not technically an employee of any local unit of government. That's why this Bill is necessary. It's an extension; it goes beyond what I think the intent of IMRF was anticipated and expected to be and at some point we have to say, no, we cannot continue to add pension liabilities if we're not willing to face the voters and tell them how we intend to see that local units of government fully fund IMRF. There's a... a city in my district that is behind $14 million in pension payments to firefighters and police officers. You can't continue to do this if you aren't willing to stand up and tell us how you intend to pay for the ever increasing liabilities of pension plans. And this particular Bill would become the liability of property taxpayers in the membership of the United Counties Council of Illinois. I reluctantly rise in opposition. I think it's time we have to be very serious about any desire to further increase our pension debt and our pension liabilities. Reluctantly, I intend to vote 'no'."

As a result of a court decision, a legislative remedy is urgently needed to clarify the design professionals how they are hired by local government. Senate Bill 1453 clarifies that. It requires that they not be bidding based on dollars that are on their experience in excellence in dealing with public buildings. When we're dealing with funds coming from the public treasury and we're asking to build public buildings, I think we could also take another line from that same speech and use it to inform ourselves and that line is, 'that a house divided against itself cannot stand'. Representative Miller, I want to assure that the architects of this state make sure that our houses and our public buildings do not become divided but that they stand by themselves. "Well, it seems to me that this Bill eliminates the option for a local government entity to know the price of a proposal in terms of dollars, hours required, percentage of construction cost or any other measure of compensation because you first must qualify any of the respondents to your RFP based on the qualifications of or their ability to perform the work. "Well, I think, the issue centers on an incident that happened on a Member of your side of the aisle and an incident that happened on my district where a school building was built and there were major problems after this building had been... was built. Okay. And the Legislator did, ya know, what she did best to try to remedy the problem. Now, I'm not sure if it was an engineering problem or whether it's from that point of view, but when you start just equating cost to the situation then it do... does two things. One is, it's a race to the bottom. So, if... if somebody who is not qualified has the cheapest cost, doesn't mean that they're the best qualified, just means they've got a lower price. The second intention is the fact this can open it up to smaller entities that are qualified. So, if you worked at a major firm each start your own and you had an expertise in any... and... with any particular engineering aspect of it, then you can at least be competitive... competitive on that qualification. "Thank you, Mr. Speaker, Ladies and Gentlemen. This is an issue that comes to us from the City of Peoria and is a kind of an emergency situation. The City of Peoria is the only municipality in the state that has... allows for cumulative voting in their city council elections. And this was set up in 1987 under a consent decree with the federal courts coming out of a voting rights suit. They have five members who are elected by district and five members who are elected at large. And voters can cast cumulative votes for the at large members. The City of Peoria now has a problem with the new election regulations and the requirements that all ballots be counted in precinct. The technology they have will not allow them to count cumulative votes in precinct and so they're asking for an exemption from the law for the coming municipal election only, SO that they can count those cumulative ballot... cumulative votes at the election commission where they have done in the past and then this will give them time before the next municipal election to work with their vendor to correct this situation. I know of no opposition. It is a... simply a measure that will help the City of Peoria get through the coming municipal election. The provisions will sunset in December 31 of 2007. But as I say, all the Bill does is to say that any spec... specifically says 'if ever' there is a decision no longer to use the facility, Loyola Medical Center would have the right of first refusal. Nothing in this measure precipitates a sale or a decision to close the Madden Mental Health Facility. There is no current plan to do that, but earlier this year a private entity non health care related expressed an interest in having a part of that Madden property. And I think that the Loyola people are concerned that should it ever happen that the state wants to divest itself of that property this area should remain a health care program available to the citizens across... across Cook County."

And what... what this Bill does is simply... it preserves the intent of the juvenile court by removing new statutory language requiring juveniles convicted as juveniles, if they were... if they were convicted as a sex offender as a juvenile. So that means, adjudicated by the juvenile court as a sex offender that their case be heard individually by a judge to determine if they should register or not register as a sex offender. Now, this summer, all summer long, we've held hearings all over the state to listen to how sex offenders are registered and the effect that it has had on the law and the different laws. And we ask that you override the Veto. Thank you. I'll take any questions."

"Thank you, Mr. Speaker. Ladies and Gentlemen of the House, I stand in strong support of the Lady's legislation. You may recall that it passed by a small majority during general Session. Not often would I say that the Governor is wrong in a Veto, but he's certainly wrong in this one and here's why. This particular legislation deals predominately with cases that could be considered Romeo and Juliet-type crimes. In other words, an 18-year-old young man and a 15- year-old young lady in the backseat of a '49 Hudson... I'm dating myself a little bit there, it was a little newer... but the fact remains for that young person to have a stigma 09400133.doc 135 133rd Legislative Day STATE OF ILLINOIS 94th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 11/15/2006 attached to them for at least the next 10 years is absolutely wrong. I'd like to ask you to consider, Ladies and Gentlemen, what we do to a young person when we do that. For the next 10 years, we tell him he cannot return to his high school football or basketball games. We tell him the only way he can get in the college is with the dean's personal attention. We tell him that he cannot live within so many feet of a school. We tell him for 10 years, at least, that he is basically a bum. Then 10 years later we may tell him, go ahead, now you're a productive citizen. How do you become a productive citizen after we've spent 10 years telling you you're a bum. The Lady's legislation is good; it is solid. It deserves the support of everybody in this Body. And I encourage an 'aye' vote to override the Governor. Thank you, Mr. Speaker."

"Thank you, Mr. Speaker. I think Mr... Representative Sacia is correct that we have to look at these Bills with a face on them. That we can't just look at this in fear what might happen or let our biases about our judicial system come into play. I have a rehabilitation center in my district called Focus House that deals with adolescents who have gone afoul of the law. And it was an experiment that has been approved by this House of Representatives and provides funding each year so that we can provide educational services to train these young men and women in new ways to live their lives. They have commented to me that the current law that we have discourages that kind of 09400133.doc 136 133rd Legislative Day STATE OF ILLINOIS 94th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 11/15/2006 rehabilitation that they may, for 5 or 10 years, about when they are convicted of this kind of juvenile crime, reform their ways and go on to a better lifestyle. And then they hit 17 years of age and then right away they're classified as an adult sex offender and for the rest of their life will be transformed into the type of lifestyle that we all discourage and hope can be remediated. This Bill is a good Bill at giving judges discretion, not to rubberstamp every particular case, but to have discretion in looking at the situation, at the case and the individual and to look at rehabilitation and to supporting that rehabilitation rather than to continue the stereotyping that Representative Sacia just talked about. On behalf of all of those that work with juveniles that have gone afoul of the law, I encourage you to consider this Bill and to support Representative Collins' Act. Thank you."

"Thank you, Mr. Speaker. To the Bill... to the Motion. Ladies and Gentlemen, one of the previous speakers brought up... brought up a situation that he referred to as Romeo and Juliet. In that specific situation that is less... less than 2 percent of the registered sex offenders in this state, less than 2 percent and I really think that that is something that should be taken into consideration when dealing with what is on this Bill. What we did learn in these hearings that were taken over the sum... that were done over the summer when Representative Molaro and Minority Spokesperson Representative Lindner formed a subcommittee on the sex offender laws in this state was that a piecemeal 09400133.doc 137 133rd Legislative Day STATE OF ILLINOIS 94th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 11/15/2006 approach has been taken to some of those laws. And in the Spring Session, what we can do is do a complete revamping of how the registration system is done in this state. The override of... of this... of this law, the Motion to override, should not go through at this point and I would urge a 'no' vote on this Motion. Not because I don't agree what the Lady and the Sponsor is trying to do... she is an advocate for juveniles in this state and she's an outstanding advocate... but in this situation, this law and leaving it up to the judges is not the correct thing to do at this point. In traveling the state as a prosecutor, we found many judges who do not take this seriously. We found judges who think that people just get caught up in the laws and that they don't understand the situation and that the sex offenders and the type of criminals that they are and we have found this information out from the Attorney General's Office and from the experts who deal with the sex offenders on a daily basis. I think that we should allow this Veto to stand and in the Spring Session take what we've learned from the hearings that we've had over the summer and apply a good law and do it that way to what we have here in the State of Illinois so that we have good, strong laws to protect our communities. And I would ask for a 'no' vote on this Mo... on this Motion. Thank you."

A lot of us took a chance and voted on this before and I acknowledge the leadership of Annazette Collins on the Bills that she has done for juvenile justice in Illinois. A lot of us have served on that task force for the last 2 years and it's something that we're trying to make Illinois a model of to create juvenile justice. Illinois was the first state in the nation to create the Juvenile Justice Law and now we're trying to even out that there are other states that base their sexual laws on age or other circumstances. We are working on that now with the task force in Illinois, but this Bill is a Bill that will help juvenile defend... juvenile offenders not serve in prison for the rest of their lives when a judge can make that decision as to whether they should be allowed to continue their life and not be recidivism for the rest of their lives. So, I stand in support of that and thank you for your initiative in this movement."

"You're asking to override his Veto and you don't know what he said as to the reason why he vetoed the Bill?"

"All right. Let me... let me share what he said in his Veto message with the Body. The Governor stated in his Veto that he cannot condone leniency towards sex offenders whether the sex offender is a juvenile or an adult. Ladies and Gentlemen of the House, the Cook County State's Attorney opposes this Motion for about three distinct reasons. And in all due respect to the maker of the Motion and those who have spoken in favor of the Bill, this involves, as a Lady on the other side of the aisle said, much more than some innocent high school activity that may take place in the backseat of a car. If you have a 16-year-old who commits aggravated sexual assault, penetration by a foreign object, assault and battery, sodomy, oral copulation, and because he is... he is 16 years old and you give the sole discretion to the judge, that individual may not, because it depends on the judge that you go before, may not have to register as a 09400133.doc 140 133rd Legislative Day STATE OF ILLINOIS 94th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 11/15/2006 sex offender and yet the act that he committed is just as violent and vicious an act as if the perpetrator was 26 or 36. I think another reason that the Cook County State's Attorneys Office opposes the Motion is that you have changed, in this Bill, the standard of proof. If you go before a judge and you give the judge discretion, all the judge now needs to hear is a preponderance of the evidence, not clear and convincing evidence that the assault in question was particularly vicious, that lowers the standard of proof. I don't think it's in anyone's best interest... and I certainly appreciate the remarks of my colleagues who differ in my opinion and they may very well be right... but to suggest that all of these juveniles will be treated as somebody who simply kissed a girl in the high school gym against the girl's wishes, I don't think even under existing law that individual in a current court of law would be adjudicated a sex offender. But it makes no difference to the female whether a violent and vicious rape and assault and battery and other indignities that may be inflicted upon that victim, I don't think it makes any difference to that victim whether the perpetrator is 15 years old or 16 years old or 50 years old. The nature of a sex crime demands that society be protected to the highest level possible from those people that research has shown time and time and time again are likely to commit that act in the future. Yes, it's a tough sentence. Yes, it's difficult. But if you commit a violent and vicious rape, I don't think nine weeks after your court date you should be prancing around at the basketball game and going to your senior prom. "Ladies and Gentlemen, I would simply remind the Body that the subcommittee of the Judiciary II-Criminal Law Committee had a task force on this, they met over the summer. They're gonna issue a set of recommendations, as I understand from Representative Gordon, that cover not just this area but a number of areas. It is entirely premature to be handling this at this time. Beyond that, as Representative Black just so eloquently stated, there have to be consequences of actions. This is fundamentally bad policy at this time, particularly in the absence of the informed opinion of the subcommittee which is yet to issue its recommendations. So, I would urge everyone in this Body to strongly consider not overriding this Veto. Thank you, Mr. Speaker."

"My name was used in debate. Ladies and Gentlemen of the Body, several speakers have made reference to the fact that there has been a subcommittee meeting throughout the summer. I've been a member of that subcommittee and one of the things that... that is coming out of it is, yes, I used the example of a Romeo and Juliet-type crime, but there's numerous other crimes and one that stands out in my mind is a young 13-year-old boy who rang a doorbell of a 13-year-old young lady and when she answered the doorbell he fondled her 09400133.doc 142 133rd Legislative Day STATE OF ILLINOIS 94th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 11/15/2006 breasts and ran away. Now, what you have here is a young man who when he reaches 17 must register for the next 10 years. I submit to you, that is absolutely wrong. This young man has received extensive counseling, he is proving himself to be a model young citizen and we are marking him for the rest of his life. For us to say that judges use no judicial prudence is absolutely wrong. This is the kind of case that deserves to be considered on its merit; it deserves to go away when he has proven himself through counseling and adequate probation to move on with his life. Once again, I strongly endorse the Lady's legislation."

"Thank you, Mr. Speaker. Originally I supported this Bill and I got up and I spoke to it. I think some of the issue here is clouded and part of it is that I hear also that the Attorney General would like an Amendment. I find it interesting that the Governor, who I am pretty sure is a former assistant state's attorney, did not do an Amendatory Veto on this Bill that could have fixed up some of the problems even though they weren't said. I think the main problem here is setting forth some kind of categories. But I think that the whole problem is the Lady passed this Bill which was really difficult to pass. It's very hard to ask people to pass a Bill even though there's some common sense to it, if you think it's going to be a bad mail piece. And I think you have to make a distinguish... distinguishing rank between young people who are caught up in something that might be a dare or parents are unhappy and they press charges and someone that is a violent sexual offender which 09400133.doc 143 133rd Legislative Day STATE OF ILLINOIS 94th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 11/15/2006 we know some young people are. That's probably the problem with this, but I think the Governor instead of doing just a Veto could have had a little courage to stand up and straighten this out and do a proper Amendatory Veto. Also, I think the Bill can be amended later. I'm loath not to support it again for the simple reason that I think there is a real problem with passing something like this which basically has some common sense to it. The common sense is there is... there are a number of people here that shouldn't have to be on a sex offender list for the rest of their life or for any lengthy period of time. They can't get a job, people look them up, they're marked and maybe they haven't done anything. And yet, we have on the other side, the people that we're worried about that may hurt somebody or something may happen. And I think the other main problem that's been brought to my attention and has happened in my district, you have overzealous state's attorneys that don't care what the person did, they just want a notch in their belt that they got a conviction or you have a judge that may or may not pay attention to the actual issues of the case. I very much... am still in the throes of I told the Lady I was gonna support her Bill again because I think it's a commonsense thing and it's something that we need to do in Illinois if we're honestly going to look at juvenile justice. On the other hand, I still think the Bill needs some tweaking and I would like to ask her, if anyone came to you and what did they suggest to you that they would like changed in the Bill?"

They think it's gonna cost a lot of money to implement the Bill, but the Bill already... last year when Brosnahan passed this Bill to say sex offenders had to register... before last year, juvenile sex offenders have never had to register. "When I spoke for your Bill originally, and I will probably go back to that position again, I think we passed a lot of laws because it looks good for the Legislator to say I'm tough on crime and sometimes what they do is they don't take into consideration what the total impact will be as far as overall sentencing, as far as what's going to happen to a person's life and not take into account the people that are doing the trying and... and the prosecuting and the defending are all human and that means there are a lot of foibles and so that people get caught up in it. We seem to think that we can make laws that are one size fits all. I don't think the General Assembly can do that. I think there ought to be some flexibility because I think what we found is we've got a lot of laws here that are piled on top of each other that are really not good laws anymore. I think, when you talk about a young person that's an important thing in their life and I think I will continue to support the Lady's Bill and I would also support something to tweak it and send out definition, but I think it was difficult to pass this to begin with.
