Reverend Deem

"Thank you. I'm grateful to be here and grateful for your service to the citizens of this state. Let us pray. Gracious God, we pause today in this Illinois Statehouse to acknowledge Your presence. We do so with gratitude for all of Your blessings past and present. We thank You for the gifts of this world, for our nation, for our state and its people. We thank You for national freedom in which we live, for freedom to gather and to discuss and debate in determining courses of action impacting quality of life. Keep before us, Oh Lord, in all our deliberations a commitment to serve the needs of citizens up and down and across this state. People of this state have placed great trust in the hands of these Representatives. May what transpires within these walls serve to improve the quality of life for all, for all people loved and precious in Your sight. Mindful of tremendous responsibilities and opportunities, may words and actions to follow reflect the highest principles of public service. All this we bring before You with humility and reverence, amen." 09500025.doc 1 STATE OF ILLINOIS 95th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 25th Legislative Day 3/13/2007

"…cat… he indicates he'll yield." 09500025.doc 55 STATE OF ILLINOIS 95th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 25th Legislative Day 3/13/2007

Kevin Joyce (D)

"Thanks. Representative, one of the concerns that I had after going back to the district and talking to some of the… the South Suburban Environmental Council was the waste stream in which the wood would come from. Is there gonna be an inspector or an auditor or would you accept an Amendment to the Bill that would possibly coffer an independent third party inspector who would report back to the agency on the waste stream?" Davis, W.: "Well, Representative, from what I understand, the wood product will be dealt with even before it gets to the facility. So, it will be sorted or whatever that process is it'll be taken care of even before it gets to the facility to make sure that it is… that it's appropriate and that it fits the specifications that are being identified."

Kevin Joyce (D)

"But that's… that's not mandated in your legislation and the developers were in front of the South Suburban Environmental Council and they did ask that question and they were not clear on whether that material will be barged, whether it be transported or whether it be come from the… the transfer station that is next door on the same facility's grounds. So, I'm… I'm asking if possibly we could just have an Amendment that would call for those loads to be inspected just to make sure that that is the clean wood stream that I know that you designed this Bill to, ya know, the intent of… your intent to make this a nice green plant. Because if there… if you get materials that might be from roofing materials, for example, there's arsenic in that and once that's burned it gets into the atmosphere and, ya know, communities that are downwind from that facility may 09500025.doc 56 STATE OF ILLINOIS 95th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 25th Legislative Day 3/13/2007 be suffered the air pollution that we don't want… wanna come out. So, and I'm open to workin' with ya and I don't wanna… I'm not trying to hold up your Bill at all. I just wanna see if you can… if you can talk to Robbins and… the mayor there and see if we can get this Amendment." Davis, W.: "Well, I appreciate your concern, Representative, and it's funny that the groups that spoke to you, I'm sponsoring the Bill, I've not heard from them. I've not heard what their… if they have particular concerns, they've not picked up the phone and simply called me to discuss this. So, in the interest of the Bill, I'd like to adopt the Amendment, move it to Third Reading and then we can talk about what you're… what you're talkin' about. I don't know if I'm ready to commit to an Amendment, but I'll be more than happy to discuss it with you, but I'd like to move this Bill to Third Reading. And this is a very important Bill to one of my communities. It obviously means a lot to it financially and we'd like to try to move this Bill forward."

Kevin Joyce (D)

"Well, and I was contacted by them on Friday, this past week when I was home and they were not contacted. And they've been very involved in this particular… in Robbins and this particular site for a number of years and they were never contacted by the developers or by the Village of Robbins 'til last Thursday was the first time that they were asked to sit down. They weren't invited to testify on the Bill in committee and some of the questions, not of the Village of Robbins, certainly not of you, but really of the developers to make sure that this project is one that is truly a green project and environmentally sound for all… for 09500025.doc 57 STATE OF ILLINOIS 95th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 25th Legislative Day 3/13/2007 not only the Village of Robbins but all the surrounding communities also." Davis, W.: "Well, again, Representative, I'd like to… like to move it to Third, but it's my understanding that these types of facilities already exist in the State of Illinois. So, is this a standard that you're asking all the facilities to… to then adhere by?"

Kevin Joyce (D)

"Well, any… anyone that would be bringing in something to be burned, the waste stream should be… no one has made clear what the material is gonna be. They say it's wood material…" Davis, W.: "Right. It's right here in the Amendment. As I understand the Amendment, wood for… that it accept only… accept and burn only wood material as included in a fuel specification approved by the department, which is the Environmental Protection Agency here at the state. So, we're setting a standard with the adoption of the Amendment and that's why they asked for an Amendment or an Amendment was brought on to clarify…"

Kevin Joyce (D)

"Well…" Davis, W.: "…exactly the type of wood that would be used in this facility."

Kevin Joyce (D)

"Well, the stream is… was my concern and not so much the specification that you're saying the steam of material that is coming in and then I… and I'll talk to you offline. And I'm sorry, I didn't know it was comin' up today, so…" Davis, W.: "No, no, no. I'd like to move… adopt the Amendment and then I'll be more than happy to sit down and talk to you and I would love to talk to the environmental council." 09500025.doc 58 STATE OF ILLINOIS 95th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 25th Legislative Day 3/13/2007

Kevin Joyce (D)

"Thank you. Okay." Davis, W.: "Thank you."

Gary Hannig (D)

"Any further discussion? Then all in favor of the Amendment say 'aye'; opposed 'nay'. The 'ayes' have it. And the Amendment is adopted. Any further Amendments?"

Mahoney

"No further Amendments. No… All notes have been filed."

Gary Hannig (D)

"Third Reading. Mr. Clerk, read House Bill 246."

Mahoney

"House Bill 246, a Bill for an Act concerning public health. Second Reading of this House Bill. No Committee Amendments. Floor Amendment #1, offered by Representative McCarthy, has been approved for consideration."

Gary Hannig (D)

"Representative McCarthy."

Kevin A. McCarthy (D)

"Thank you, Mr. Speaker. Floor Amendment #1 to House Bill 246 is a agreed Amendment out of the committee. It basically changes one word in the definitions section for the Smoke Free Illinois Bill. It changes the word 'income' to 'revenue', so that the exemption matches the definition section of the Bill. And I know of no opposition for this Amendment."

Gary Hannig (D)

"Is there any discussion? Then all in favor of the Amendment say 'aye'; opposed 'nay'. The 'ayes' have it. And the Amendment is adopted. Any further Amendments?"

Mahoney

"No further Amendments have been approved for consideration. No Motions filed."

Gary Hannig (D)

"Third Reading. Mr. Clerk, read House Bill 1074." 09500025.doc 59 STATE OF ILLINOIS 95th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 25th Legislative Day 3/13/2007

Mahoney

"House Bill 1074, a Bill for an Act concerning regulation. Second Reading of this House Bill. Amendment #1 was adopted in committee. No Floor Amendments. No Motions filed."

Gary Hannig (D)

"Third Reading. Mr. Clerk, read House Bill 3374."

Mahoney

"House Bill 3374, a Bill for an Act concerning State Government. Second Reading of this House Bill. No Committee Amendments. No Floor Amendments. No Motions filed."

Gary Hannig (D)

"Third Reading. Mr. Clerk, what is the status of House Bill 1119?"

Mahoney

Clerk Mahoney: "House Bill 1119 is on the Order of Third Reading."

Gary Hannig (D)

"Return that to the Order of Second Reading at the request of the Sponsor. And Mr. Clerk, what is the status of 773, House Bill 773?"

Mahoney

Clerk Mahoney: "House Bill 773 is on the Order of Third Reading."

Gary Hannig (D)

"Return that to the Order of Second at the request of the Sponsor. And what is the status of House Bill 998?"

Mahoney

"House Bill 998 is on the Order of House Bills- Third Reading."

Gary Hannig (D)

"Return that to the Order of Second Reading at the request of the Sponsor. And Mr. Clerk, what's the status of House Bill 1347?"

Mahoney

Gary Hannig (D)

"Return that to the Order of Second Reading at the request of the Sponsor. And Mr. Clerk, what is the status of House 18… the status of House Bill 1855?"

Mahoney

"House Bill 1855 is on the Order of House Bills- Third Reading."

Gary Hannig (D)

"Return that to the Order of Second Reading at the request of the Sponsor. Representative Berrios, for what reason do you rise?"

Maria Antonia Berrios (D)

"Purpose of an announcement."

Gary Hannig (D)

"Make your announcement."

Maria Antonia Berrios (D)

"Thank you. Ladies and Gentlemen of the House, today at 4:00 we will be having the Biotech Committee and we are having a speaker from Amgen come in. So, if anyone is interested in finding out what biotechnology is, feel free to join us at 4:00 today in Room 115. Thank you."

Gary Hannig (D)

"Representative Scully, for what reason do you rise?"

George Scully Jr. (D)

"For the purpose of an announcement."

Gary Hannig (D)

"Proceed."

George Scully Jr. (D)

"The Electric Utility Oversight Committee scheduled for 8:00 tomorrow morning will convene at 8:30 tomorrow morning. Thank you."

Gary Hannig (D)

"Representative Boland, for what reason do you rise?"

Mike Boland (D)

"Purpose of an announcement. The Financial Institutions Committee is canceled for today."

Gary Hannig (D)

"Representative Rose, for what reason do you rise?" 09500025.doc 61 STATE OF ILLINOIS 95th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 25th Legislative Day 3/13/2007

Chapin Rose (R)

"An announcement for the Body, Mr. Speaker. Ladies and Gentlemen, tonight at 6 p.m., U of I football coach Ron Zook will be at the Illinois State Library. This is an event that's being put on by the Illinois Student Senate. And many of your constituents are students at the University of Illinois and they will be there as well. The event's gonna be from 5:30 to 7 at the State Library, but Coach Zook will be there at 6. And I would invite all of you to come and attend. Thank you."

Gary Hannig (D)

"…Representative… Representative Reitz."

Dan Reitz (D)

"Thank you, Mr. Speaker. Purpose of another announcement. The downstate or the, excuse me, the Legislative Sportsmen's Caucus will have an organizational meeting tomorrow morning, 7:30 in the Rathskeller, 7:30 in the Rathskeller. Hope to see you there. We'll have breakfast."

Gary Hannig (D)

"Representative Nekritz, for what reason do you rise?"

Elaine Nekritz (D)

"Thank you, Mr. Speaker. I'd just like to announce that the Railroad Safety/Industry Committee for Thursday at noon is canceled."

Gary Hannig (D)

"Representative Black. Representative Black, you're recognized to make a Motion."

William B. Black (R)

"Yes. Thank you, Mr. Speaker and Ladies and Gentlemen of the House. Pursuant to 25 ILCS Ch. 63 par. 42 that clearly outlines what a balanced budget note shall be prepared for and it's only prepared for a supplemental appropriation Bill. On page 7 of the Calendar I have House Bill 618. It is not a supplemental appropriation Bill. I would move that 09500025.doc 62 STATE OF ILLINOIS 95th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 25th Legislative Day 3/13/2007 the balanced budget note request be ruled inapplicable and the Bill be moved to Third Reading."

Gary Hannig (D)

"You've heard the Gentleman's Motion. Is there any discussion? Then the question is, 'Shall the note request be declared… shall the note request be declared inapplicable?' All those in favor should vote 'aye'; opposed 'nay'. And the voting is open. 'Shall the… shall the note request beclare inapplicable?' So, have all voted who wish? Have all voted who wish? Mr. Clerk, take the record. On this question, there are 77 voting 'yes' and 38 voting 'no'. And the Gentleman's Motion prevails. And the note is declared inapplicable. Representative Black."

William B. Black (R)

"Mr. Speaker, the second part of my Motion was to move the Bill to Third Reading."

Gary Hannig (D)

"The Clerk advised me that there's still other note requests."

William B. Black (R)

"There has never been another note request filed on that Bill since the day it came up here. If any… if any note request was filed on that Bill, it was when you held the Roll Call open for about three and a half minutes. There's an identical Bill sponsored by a Democrat that doesn't have one note request on it. Now, I don't mind playing these games, but I've been here for a while and I've paid my dues and I'm not gonna play this game. There were no note requests on this Bill when I moved that the note be ruled inapplicable in accordance with statute. And you did everything in your power to get the board to reflect that the note was not inapplicable in violation of the statute. Now, you play another game with a note request? I would 09500025.doc 63 STATE OF ILLINOIS 95th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 25th Legislative Day 3/13/2007 rule any further note request be ruled inapplicable. I'm sick and tired of these games. If you wanna vote against the Bill on Third, vote against it, but I have a right, an inalienable right, to call my Bill."

Gary Hannig (D)

"Mr. Clerk, read the Bill. …Clerk, what is the status of the Bill?"

Mahoney

"House Bill 618, a Bill for an Act in relation to public aid, is on the Order of Second Reading. No Committee Amendments. No Floor Amendments. Notes have been requested, but not yet filed."

Gary Hannig (D)

"…Clerk, what notes have been requested?"

Mahoney

Clerk Mahoney: "A state mandates note, a Home Rule note, judicial note, state debt note."

Gary Hannig (D)

"Representative Black."

William B. Black (R)

"Mr. Speaker, those notes are nothing but harassment, were not filed by the time I made my Motion. Not anybody in this chamber be you Democrat or Republican and you don't even know what this Bill does. It increases the personal needs allowance for people in nursing homes. Has nothing to do with tobacco. Their personal needs allowance has not been increased since 1988. There isn't one of those notes that's applicable to this Bill. I would rule that all of those notes be ruled inapplicable. They are nothing but harassment and I'm not here at my age and at my term of service in here, I'm not gonna sit here and put up with this kind of harassment when you've got a Democrat Bill that I haven't filed one note on and I've asked my fellow Republicans not to file a note on and it's the same Bill. Now, where in the hell's the fairness." 09500025.doc 64 STATE OF ILLINOIS 95th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 25th Legislative Day 3/13/2007

Gary Hannig (D)

"Representative, all I can tell you is that the Clerk…"

William B. Black (R)

"Then I rule every one of those notes be ruled inapplicable on one Roll Call. They are nothing but harassment notes and you know that as well as I do."

Gary Hannig (D)

"And Representative, all I'm suggesting is that everyone has the right to file a note and you're…"

William B. Black (R)

"They don't have a right to file some ridiculous, stupid note on a Bill that has nothing to do with Home Rule. Now, you know that."

Gary Hannig (D)

"Actually, they have the right to file it, Representative. Now, you have the right…"

William B. Black (R)

"In other words they have a right to be obstreperous. They have a right to be vindictive. They have a right to be whatever they wanna be, but you know those notes are not applicable in any case."

Gary Hannig (D)

"Representative, why don't you make the Motion. We'll go through 'em one at a time. Will that be okay?"

William B. Black (R)

"I rule that all of the notes be ruled inapplicable. There isn't one that you read that has anything to do with this Bill. How in the world does this Bill meet the standard of a Home Rule note or a judicial note?"

Gary Hannig (D)

"So… so, Mr. Clerk, just for the clarification of the Body, why don't you tell us once again what are the notes that have been requested on this Bill and then we'll go to a Roll Call?"

Mahoney

"The following notes have been requested: a state mandates note, a Home Rule note, a judicial note and a state debt note." 09500025.doc 65 STATE OF ILLINOIS 95th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 25th Legislative Day 3/13/2007

Gary Hannig (D)

"Representative Black has moved that those notes shall be declared as inapplicable. Is there any discussion? Representative Winters."

Dave Winters (R)

"Thank you, Mr. Speaker. Could you refer to us the time at which those notes were filed?"

Gary Hannig (D)

"Mr. Clerk, could you tell us when those notes were filed?"

Mahoney

"Those notes were filed earlier today."

Dave Winters (R)

"I'm a little bit more specific. Were they filed any time after 1:30? Do you have a time stamp on 'em or simply a date stamp?"

Gary Hannig (D)

"The Clerk, can you tell us? No."

Mahoney

"There are no time stamps on notes that are requested."

Dave Winters (R)

"Well, I think we all have had a weekend with a time change that many of us have woken up on the wrong side of bed as we moved our clocks ahead. I think in this case the clock was not moved ahead on time and that those notes were, in fact, filed during the discussion on the previous note and I stand in support of Representative Black that these were not timely and certainly not applicable notes."

Gary Hannig (D)

"Anyone stand in opposition to the Gentleman's Motion? Representative Monique Davis." Davis, M.: "Thank you, Mr. Speaker. The rule states that if you desire to file a fiscal note, a judicial note, a Home Rule note, you have a right to file those notes. No one in this Body nor anyone's Bill is beyond the scope of a Legislator requesting those notes. Now, I believe, Mr. Speaker, that if we're going to vote that the note is inapplicable, they 09500025.doc 66 STATE OF ILLINOIS 95th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 25th Legislative Day 3/13/2007 should be voted on individually. They should not be voted on at once, but the rule… the rule…"

Gary Hannig (D)

"Yes. So, Representative…" Davis, M.: "Listen to me. No, I'm sorry, apologize."

Gary Hannig (D)

"You're… you're correct." Davis, M.: "The rule applies to everybody. Thank you."

Gary Hannig (D)

"So, Representative Black, she does have the right to divide the question. So, we'll divide the question and then we'll vote on each one of 'em. Is that… is what we'll do."

William B. Black (R)

"Speaker…"

Gary Hannig (D)

"So, Mr. Clerk, what's the first one that was filed?"

William B. Black (R)

"Mr. Spea… Mr…

Gary Hannig (D)

"Representative Black."

William B. Black (R)

"Mr. Speaker, I have finally arrived. I have been lectured on the House Rules by Representative Monique Davis. And let me just say to that esteemed colleague, most of the votes on icapli… inapplicable fiscal notes for the last 18 years have been made and passed by Democrats. Whether we objected or not, it was standard practice that if a Democrat Sponsor didn't like a note request, all that Democrat Sponsor had to do was get up and rule them inapplicable and they were often ruled inapplicable on a voice vote, in violation of the House Rules. I will follow the House Rules. You can take each one."

Gary Hannig (D)

"So, the first one, the Clerk advises me, is the state mandates note. Representative Leitch, do you wish to speak on the issue?" 09500025.doc 67 STATE OF ILLINOIS 95th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 25th Legislative Day 3/13/2007

David R. Leitch (R)

"Thank you, Mr. Speaker. I wanna know who filed the notes."

Gary Hannig (D)

"Mr. Clerk, could you advise us who filed the notes?"

Mahoney

"Representative Monique Davis filed the notes."

Gary Hannig (D)

"The question is, 'Shall the state mandates note be ruled inapplicable?' Those who believe that the note is inapplicable should vote 'aye'; those who believe that it is appropriate should vote 'nay'. And the voting is open, Mr. Clerk. Have all voted who wish? Have all voted who wish? Have all voted who wish? Have all voted who wish? Mr. Clerk, take the record. On this question, there are 98 voting 'yes' and 5 voting 'no'. The Motion prevails. And the note is ruled inapplicable. What is the next note, Mr. Clerk?"

Mahoney

"The next note is a Home Rule note."

Gary Hannig (D)

"So, the question is, 'Shall the Home Rule note be ruled inapplicable?' Those in favor… Excuse me. Representative Monique Davis." Davis, M.: "Mr. Speaker, in respect for your time and the Body's time, I will Motion to remove the notes."

Gary Hannig (D)

"So, the Lady has removed her request for the notes, Representative Black. So, Representative Black."

William B. Black (R)

"Mr. Speaker, I thank the Honorable Lady for that. I know I have had to waive many notes in the past. I do appreciate her consideration and her kindness. And I would certainly hope to be able to reciprocate someday on a Bill that is important to her or a Bill that is important to a 09500025.doc 68 STATE OF ILLINOIS 95th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 25th Legislative Day 3/13/2007 Member on your side. This is a very important and very personal Bill to me."

Gary Hannig (D)

"Okay. So, Mr. Clerk, read the Bill, please."

Mahoney

"House Bill 618, a Bill for an Act in relation to public aid. Second Reading of this House Bill. No Committee Amendments. No Floor Amendments. All notes have been withdrawn."

Gary Hannig (D)

"Third Reading. Mr. Clerk, read the Agreed Resolutions."

Mahoney

"On the Order of Agreed Resolutions is House Resolution 188, offered by Representative Tryon. House Resolution 190, offered by Representative Coladipietro. House Resolution 191, offered by Representative Coladipietro. House Resolution 192, offered by Representative Ryg. House Resolution 194, offered by Representative McCarthy. Gary Hannig (D)

"Representative Currie moves for the adoption of the Agreed Resolutions. All in favor say 'aye'; opposed 'nay'. The 'ayes' have it. And the Agreed Resolutions are adopted. Are there any announcements? Mr. Clerk, do you wanna announce the committees for us?"

Mahoney

Mahoney
