And number two, it urges the commissioners to rehear the matter and upon rehearing reach a decision that reflects statutory directives in the intent of the General Assembly. With regard to this Bill… this Resolution, whether or not you were an original supporter of the Leucadia legislation, on five separate occasions we have passed Bills out of this chamber with Supermajority pluralities in both the House and the Senate and concurred with the Governor which authorized the intent in how the Leucadia sourcing agreements were going to work in this legislation. If you believe like I believe, that the intent in the will of the people of the State of Illinois is the supreme law, that is, the Bills that we pass here in the House and the Senate, that we send to the Governor, that he signs, where we clearly lay out the intent on how a Bill is suppose to be injected into our State Law and how it is suppose to reflect the will of the people who voted in Supermajority fashion, then you should vote for this Resolution, regardless of how you feel about Leucadia. We knew that allowing an open-ended rehearing process would draw out the time frame possibly forever. "…quite frankly, this was a discussion argument that came up in the original vetting of this Bill. Chicago Clean Energy and Leucadia, in a very painstakingly way, went through more than 40 integrations with regard to controlling the costs of this gas… of this gas. We have, in through the legislative process, laid that out in our Bill, in two of our Bills. In the last Bill that we passed, both out of the House and Senate, laid out in crystal clear fashion in terms of how those prices would be negotiated. There is no truth to that. I think anybody who's trying to predict such a price spike, and quite frankly, there was an argument that was made right here on the floor which was also rejected at that time. Representative, I appreciate your support. I realize that you were with us. I would appreciate if you would be with us in this regard as well. To the point of the Resolution… to the point of the Resolution, your 'yes' vote on the Leucadia Project, after being properly vetted, both in committee, in discussion with the gas companies, in discussion with regulatory Bodies, we clearly laid out the role of the ICC. What we're not… we're not talking about gas prices in this legislation. Maybe they didn't vote for the Bill, maybe they didn't support the project, maybe they did but now some issues have come up that they may feel differently about, but I think what we can agree on in this Body is what is written in this Resolution. Very, very succinctly and a point that needs to be made now, more than at any other time since I've been in the General Assembly, and that is the General Assembly as a Body has certain authority and 09700100.doc 11 STATE OF ILLINOIS 97th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 100th Legislative Day 2/8/2012 when that Bill passed, the administrative agencies of this State Government do not have the option of picking and choosing what they implement based on the will of the General Assembly. If we were to allow that to happen, the entire checks and balance… and balance of power in this state falls apart. What the Representative is simply saying is what courts have upheld and it's very well written in the Resolution, that the Illinois Appellate and Supreme Courts have consistently held that public policy in Illinois is expressed by the General Assembly and it's not the province of an administrative agency to inquire into the wishes and propriety of the Legislature's act. Their duty is to enact, to follow the direction of the General Assembly. We don't have to look any farther than the Medicaid situation in this state to see this type… this type of ignoring that takes on by administrative agencies of the intent of the General Assembly. Last year this Body passed other Medicaid initiatives, reforms that were supposed to be enacted by votes in the House of 114 to 4. If we don't stand up for the General Assembly, we may as well go home. I applaud the Gentleman for bringing this to the House Floor and I would urge everyone in here to support this because you're not simply supporting the underlying theory of this, you're supporting the balance of power and the right of the General Assembly for the people of the State of Illinois. I urge an 'aye' vote."

When… when that Bill was circulated amongst the State Police, the Secretary of State, and the suburb… and the Police Chiefs, what came back was this language. So, my best answer to you is if we could come to a consensus among the Secretary of State and the Illinois State Police, I think that this is as safe as we can make the roadways, while again, keeping in mind the cost of… the cost factors that you mentioned."

"Thank you very much, Mr. Speaker. My colleagues, with the release of the movie Red Tails, the Tuskegee Airmen are again in the public spotlight. As you know, these pioneer fighters were highly effective during the latter half of World War II. What you might not have known is that two of the Tuskegee Airmen have roots in Central Illinois. Ellsworth Dansby Jr. of Decatur was the second black man to be sworn into the Army Air Force and the first enlisted man in the group to receive the rank of Master Sergeant during World War II. Dansby, a graduate of Decatur High School and Millikin University, was perhaps the first to report for duty when the first black aviation unit, the 99th Pursuit Squadron of the Army Air Corps was activated at Chenute Field in Rantoul, in March of 1941. The 99th later moved to Tuskegee, Alabama, where it became the foundation of the Tuskegee Airmen. Illinoisan Dansby began applying to the Air Force shortly after his graduation from high school. At that time blacks were not accepted in technical units. Then on March 19, 1941, the 99th Squadron was activated at Chanute Field in Rantoul and sent to Tuskegee. He had always been fascinated with flying. As a curious boy he had a flying experience launching himself from a steep hill on a frame strung with bed sheets. He and friends built countless model airplanes and at the age of 12 Dansby flew an airplane alone at a farm airstrip near Dalton City, taking off and landing safely. He was a member of the Decatur School Board from 1968 to 1971. In 1987, he received a pioneer airman plaque from the Harris Bank of Chicago. He died in June of 1989. Major Charles 'Charlie' B. Hall graduated from Eastern Illinois University before going on to earn the Distinguished Flying Cross after shooting down two German fighters during one mission with the 99th Squadron. You will recall that the saga of the Tuskegee Airmen goes like this; in 1944, after enduring racism throughout their recruitment and training, a squadron of young black fighter pilots is finally sent into combat in Italy. Although flying worn-out Curtiss P-40 Warhawk aircraft, they scored their first aerial victories and when losses and bomb raids… bomber raids, that is, reach alarming proportions, the Tuskegee Airmen are given the role of protecting the bombers over Germany. Up against the best Luftwaffe planes and pilots, the Tuskegee Airmen proved to be effective fighters. They make a difference as the air war continues over Europe, becoming the most requested escorts for bombers. They were called Red Tail Angels by the Germans, signified by red paint on the plane's tail section. They referred to themselves as the Lonely Eagles, in reference to their isolation as a result of segregation and discrimination. Hall's connection to Charleston started before the war when he attended Eastern Illinois State Teachers College as the University was then known from 1938 to '39. He was a halfback on the Panther football squad and a sprinter for the Eastern track team. After leaving Eastern, Hall started aviation training with the Tuskegee 09700100.doc 22 STATE OF ILLINOIS 97th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 100th Legislative Day 2/8/2012 Airmen project. The training at a military airfield near Alabama's Tuskegee Institute, one of the earliest higher education centers for blacks, was intended for them to prove they could fight in any capacity for their country. Hall excelled at the training and by 1942, he and his fellow aviators were facing war duty. In early 1944, near the Allied beachhead of Anzio, Italy, Hall shot down two German fighters during one mission. Other Tuskegee pilots earned kills in the air that same day. Hall earned the Flying Cross, one of many earned by the Red Tails and more congratulations from American generals. Hall emerged with three swastikas on the side of the P-40 Warhawk fighter, noting his three battle kills. With several dozen combat missions completed by late 1944, Hall came back to the United States and participated in war bond drives, which helped raise millions of dollars for the war effort. Hall, who finished his military career as a Major, then moved to Oklahoma City, where he went into the insurance business. He died in 1971. We honor all of the Tuskegee Airmen because as history tells us, they were real heroes because of Dansby and Hall, we Illinoisans can feel a special sense of pride. Thank you."

When we do it, we do it with as much seriousness as we can muster because it is an important document clearly for the state. What I bring to you today, HJRCA29, is an important endeavor. It deals with the crime… the rights of victims of violent crime. This Resolution amends the Illinois constitution to ensure that there's a remedy for violations of the rights victims have already had under Illinois law for over 25 years. Just as an offender has a remedy when their Constitutional or statutory rights are violated, so should a victim of violent crime. They've had rights under the law for years. This Constitutional Amendment will confer upon them actionable rights and enforceable rights. The first movement on this type of action came in the State of California, and this Amendment today is named Marsy's Law. Marsy's Law came about as Marsy Nicholas, a California college student who was stalked and killed by her ex-boyfriend. A week after she was murdered, Marsy's mother walked into a grocery store after visiting her daughter's grave and was confronted by the accused murderer. She had no idea that this murderer had been released on bail. This story is typical of the pain and suffering that family members of murder victims and victims of violent crime have endured. She was not informed because the courts and law enforcement, though well-meaning, had no obligation to keep her informed. HJRCA29 will remedy that in the State of Illinois and will give the family members of the victims of violent crime the ability to protect themselves, the ability to go into a courtroom, the ability to be advised of all proceedings that will affect their lives. I'm gratified that 80-plus of you have signed on as cosponsors of this Constitutional Amendment. It's an important Amendment for our Constitution. The gravity of these issues is dealt with every day in the 102 courthouses across the state. Having been in those courtrooms and advocated for victims in Will County, I understand how difficult it is to be part of that process, how the victims can easily be intimidated by the gravity of the situation, by the fear of retribution, by the difficulty of losing a loved one and not exactly sure what happens next. While I'm fully aware that Assistant State's Attorneys across the state do everything that they possibly can to accommodate this, we want to make sure that it is the law of this state, it is a part of our Constitution, that they will be able to be a part of the process and afford the same due process and notice provisions that defendants would have, to be apart of the process from the start of the court proceedings, to be able to advocate on behalf of their loved ones at a bond hearing to discuss the amount of fear they may have of what could happen to them if they testify on behalf of their family or themselves, what the collateral damage is to their family, and to make sure that the court is fully aware of all the circumstances of the case not only read by an Assistant 09700100.doc 31 STATE OF ILLINOIS 97th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 100th Legislative Day 2/8/2012 State's Attorney but of the family themselves and to have some type of relief if they feel that there has been something wrong throughout the proceedings. Would your Bill make it impossible for someone like that to phone a person's home whose been a victim of crime and harass them on issues like this?"

I don’t think anyone would wish on their worst enemy some of the things that have happened to victims over the years. I am incredibly supportive of this Constitutional Amendment. You know, time in and time out, you look around the room and you see conditions of bail that are set, frankly with… in many cases without regard to the safety of a victim or a victim's family. How many times do you pick up a paper and read about a crime that's been committed by someone on bail? That is… that situation is dealt with here. The ability to make a statement before sentencing seems absolutely fundamental to the very core of who we are as a people and as a democracy. And all we are doing here today is supporting those who have gone through some incredibly awful circumstances and importantly, allowing their voices to be heard and ensuring that their voices are considered.
