House Bill 3761 bans the sale of padded crib bumper pads in the State of 09900035.docx 27  STATE OF ILLINOIS 99th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 35th Legislative Day 4/21/2015 Illinois. It is substantially similar to House Bill 5348 which passed this chamber last year. While stopping the sale of padded crib bumper pads, this Bill allows for the sale of mesh crib liners. The exception for the sale of mesh crib liners is the result of a compromise with the industry. Several companies currently produce and market mesh liners. I am not aware of any manufacturers of crib bumper pads in the State of Illinois. Padded bumpers are manufactured overseas. This Bill has an effective date of January 1, 2018, which is also the result of a compromise with industry that allows manufacturers additional time to adjust their product lines to be in compliance with the law. This Bill would include sales in retail settings as well as online. I believe that banning the sale of crib bumper pads is an important step for our state to take. The American Academy of Pediatrics guidelines tell parents not to use bumper pads because of the risk of suffocation, strangulation, and falls. Research has shown a link between crib bumper pads and dozens of deaths in numerous other industries. Specifically, research conducted by Bradley Thach, an M.D. and a Professor of Pediatrics at Washington University in St. Louis, reviewed data and concluded that 27 deaths were reported by medical examiners or coroners as attributed to crib bumper pads. Twenty-five nonfatal injuries were also reported. Additionally, NJ Scheers, Project Manager of the Infant Suffocation Project, reviewed an additional 76 deaths and in reviewing the medical examiner's findings, concluded that 48 of those deaths were causally related to or associated with crib bumpers. There is no dispute that crib bumper pads are inherently dangerous and have been linked to infant deaths. This ban is a necessary step to prevent additional unnecessary deaths. Previously, we have taken steps in this Body to decrease the incidents of sudden infant deaths by requiring education of new parents and continuing education for child care providers. Our state already bans the use of crib bumper pads in licensed child care settings. And while certainly those education efforts are critical, alone they're not enough. Through those education efforts, the incidents of sudden unexplained infant death has decreased, but so long as crib bumper pads, a soft bedding with only a decorative purpose remain available for sale, that message that ‘bare is best’ is confused. Care givers, family members mistakenly believe they're purchasing a safety product and… without understanding the lethal dangers. This is an important step to protect against additional preventable deaths. Because of the dangers that they pose, the State of Maryland and the City of Chicago already have bans. The use of crib bumper pads is banned not only in child care in Illinois, but in many other states. An important next step to ensure the safety is the ban of… sale of crib bumper pads. There's a broad coalition of supporters that include the Attorney General, Lisa Madigan, the Commissioner Joseph Mohorovic of the U.S. Consumer Product Safety Commission, the Illinois Chapter of the American Academy of Pediatrics, Kids in Danger, SIDS of Illinois, Ann & Robert Lurie Children's Hospital of Chicago, the Ounce of Prevention Fund, Illinois Action for Children, Ever Thrive Illinois, and numerous others. "I'd have to disagree with you, Representative. Per my information from the manufacturers, there are actually 19 businesses in the State of Illinois that manufacture all or part of a bumper pad. Nineteen businesses in the State of Illinois that we are basically saying, you are what… we don't want your business here. We do not want you to continue to hire our employees here in the State of Illinois. We don't want the tax dollars that you are paying to the State of Illinois. You are more than welcome to go to Indiana or Wisconsin. 19 businesses that you are saying, you are not welcome here. Now, let's talk about the employees of those 19 businesses. We're talking a couple hundred families that you are looking to impact. Families that you are looking to unemploy, Representative. "I am aware that there are numerous companies that do manufacture and market the mesh liner, which would be allowed under this legislation. Because I don't know specifically who those companies are or what exactly their products are, it is quite possible that those companies are already manufacturing a mesh liner. Certainly, it seems that the children's product industry is moving toward manufacturing mesh liners. One of the components of this legislation is a very long effective date. It's not effective until January 1 of 2018. "You cannot purchase those in the City of Chicago. The City of Chicago has had a ban of the sale of crib bumper pads that went into effect in 2012. In fact, that ban in the City of Chicago is even stricter than this legislation. In the City of Chicago you may not purchase the padded bumpers or the mesh liners. This legislation represents a compromise allowing for the sale of the mesh liners. The State of Maryland also bans the sale of crib bumper pads. That ban went into effect in June of 2013 and was the result of a very lengthy study within the State of Maryland looking at both the benefits and potential benefits and risks of using this product. They concluded that it was inherently dangerous and confused the message of safety experts including the American Academy of Pediatrics and so many others and chose to ban the sale in the State of Maryland. Another important note with regard to the ban is that in child care in the State of Illinois, we already ban the use of bumper pads in licensed child care facilities because of the dangers and the risks and the numerous suffocation deaths."

So, essentially, this is an industry-driven committee that writes an industry-driven standard. Something that is, you know, pro… pro their industry. It's not at all a safety standard in my opinion as well as in the opinion of safety and medical experts. Under that particular standard, the ASTM standard, the… the standard would allow for bumpers that are up to 2 inches in thickness. It would essentially say that bumpers that are up to 2 inches in thickness are safe. I think that that standard actually is a step backward, because I think that in… essentially endorsing a standard like that as a state, we are telling parents that a product that complies with this false safety standard is safe. And that's in fact not the case whatsoever."

I… you know, it's certainly delicate whenever you talk about issues like this because you always want to be respectful of the business interests and the interests at hand and you have to balance that against what's best for, obviously, new parents and parents of young children. One, in our analysis… and I know it's not fair because you don't have it… but in our analysis it says IDPH is opposed because of the high cost of the program. That it… the estimated cost is $6.2 million in personnel and enforcement. Are you… have any thoughts or comments? Are you aware of this $6.2 million costs?" Harris, G.: "I… you know, the concern I've heard from IDPH is what if abuse occurred. What if abuse occurred to a patient and they would have to sit down and watch the tapes through to verify, you know, who was at fault or what happened. They're saying there could be a cost. I… I think that… you know, that's… that’s specious at best. They've never come to me and said we have this cost. They've never come to my committee and said it, so I don't know what's on your analysis, but…" Wheeler, B.: "Okay. So, that would explains where that may come from. It was the most highly regulated law ever passed in America. And the purpose was to help some very sick people improve their quality of life. A year ago many of you joined me in a Bill that expanded that law to add epilepsy or children with epilepsy. That was a welcomed change. But now, as you know, during the interim almost two years will have passed between the time the law became effective and the actual beginning of the pilot program… the actual beginning where patients can go to a dispensary and purchase the product they need to alleviate their pain. This is unfair to them and it's wrong. It's also unfair and wrong to the entrepreneurs that have put hundreds of thousands of dollars into opening these businesses and hiring a lot of employees. Because of the delay and because we have a sunset coming up in two and a half years, you have a situation where these business owners… these licensees, who have put so much money into this… these businesses, will have to inflate their prices, so that they can make their money back. That's certainly unfair to patients. And if the prices are too high, patients will simply go back out on to the street to buy the product and it will hurt the program badly. So all this Bill does is keep a four- year pilot program, but it starts that four-year pilot from the time the first dispensary is ready to open. This will give us time to assess the program, to figure out what's right about it, what's wrong about it, and to make sure prices stay at a reasonable level for patients. Yet not a single patient has benefitted from that… from what we did in this General Assembly, because of bureaucratic haggling and delays and just bureaucracy taking so long to get this… this Bill enacted. The Gentleman has a reasonable approach. "Representative, I understand what you're trying to do, but I'm always reticent about allowing county boards to raise fees because I've never seen them not. And even though we say it's permissive, they always do. They always do. I… when I go to court, I hear the people always complaining about the court cost fees. And always the judge will say, well, talk to your State Legislator because they're the ones who set the fee. And then we look and say, no, really judge, we allow the counties to do it, but they always go to the max. So what this Bill would do would be to increase the maximum, how much counties can charge for the security fee. Is that correct?"

"But I'm not sure what the cost study means. Because, you know, right now we have the Governor saying, well, I'm… I'm going to cut 31 percent of the higher education budget unless they cut administrative costs. There's nothing here that would require any cost to be cut. Actually they could hire more folks and increase their costs to justify the increase if they wanted to."

"…I'm not sure we're reducing the revenue from other sources. How much would it cost under your Bill now, if this should pass, for someone who gets a… I don’t know… a ticket for speeding 12 miles over the limit and wanted to go contest that in court? What are the fees going to be, before any fine’s imposed, if they go and plead for supervision?"

"All right. And that's… and… and I understand what the Gentleman’s trying to do. To the Bill, Mr. Speaker. We have a real problem with access to the courts in our… in our communities. If you're poor… if you're making minimum wage, and you get a park… if you get a traffic ticket, it's almost impossible for you to afford to fight that ticket. It's almost impossible for you to go and ask for court supervision, simply because of the fees. Even if you're only granted a fine of $50, by the time you walk out of there, it's going to cost you $250 because of all the extra fees that our counties place on those tickets. If you are a small business and someone sends you a bad check or doesn’t pay you, and you want to go try to collect that money, now it's going to cost even more. It makes it cost prohibitive. Understand that every time that we vote to increase the fees, what we're saying is we're limiting access to the court to the people who need it the most. With a… it’s a… it's a third part of our… of our government and it’s equal… it’s a coequal branch, but it really isn't if people can’t use it. So I'd encourage everyone to vote 'no' and we should continue to discuss this. But let's stop jacking up the fees so poor people cannot use the courthouse."

"Thank you, Mr. Chairman. House Bill 3428 was brought to me by my local high school students at Stevenson High School. It is a college affordability measure. It guarantees when a high school student takes an Advanced Placement exam and receives a grade of 3 or higher, that he or she will receive either general education credit, if there's a corresponding course at the Illinois public university or community college, and if not, an elective credit which will count towards their degree. To specifically outline how many credits and which course is appropriate, the Bill will assign this process to the IEA. That is the Illinois Articulation Initiative. That is a panel of university professors that currently review community college courses and some of the 36 AP tests. Now they will be asked to review all of them. Fourteen states already guarantee a credit… guarantee credit for an AP grade of 3 or higher. I do want to offer some special thanks to Representative Batinick for his support in counsel on this initiative. "No. I'll explain it. Not exactly. So what the Amendment does is two key things. It’s… it says that if you get a thr… a grade of a 3 or higher, that you will get… one of two possibilities will occur. You will get credit either in general education, as a general education credit, if there's an applicable course at the university or community college that you're going to. If there isn't an applicable course, then you will get elective credit. Either of those two scenarios will count towards your degree. It cannot go, with a 3, towards your major or a prerequisite to a major. The second thing the Amendment does is create this whole process for transparency and it invites the IEA which Representative Fortner is one of those college professors that serves on. And it identifies the specific course you would get credit for and the amount of credits for each of the 36 AP tests."

And frankly, they're sending letters of solicitation to our students to come to their excellent schools. And frankly, I'm tired of it because this is one of the criteria that students use when they pick what school to go to. It speaks to college affordability. We've been discussing this problem in the state. We need to keep our students in Illinois."

"Absolutely. Now, some of the universities, the University of Illinois in particular, they already accept students who get 4s or 5s. Am I correct?"

"Yes. And they do accept some 3s. The problem is there is not consistency. And the students are not sure what… they do… they can go to their website, but they're not guaranteed to get credit for a 3…"

"So, this gives us a sense of uniformity and clarity as it relates to Advanced Placement classes who score above a 3 and above, correct?"

As a chair of Appropriations for Higher Education, I, along with my Committee Members, we do a number of special inquiry as it relates to what schools are doing, how current and progressive they are with relation to students of all sectors, in particularly, students who are taking advanced courses. And what this Bill simply does is it comes up with a sense of clarity, uniformity, and it really helps to attract and incentivize students to really look at a lot of our state institutions and to take these advanced classes that are in our respective high schools. And it gives them an advantage when they go to some of our state institutions and it also incentivizes them to go further with their education because they're that much more advanced. This is a good Bill. It is about time that our state is coming up with a uniform system that we can our… have all of our youth stay excited about school and stay in the advanced sector of achievement academically. I would encourage an 'aye' vote."

And basically all it does is provide that when people commit infractions and they are not in a middle of a sentence, rather they are pending trial or sentencing but they are detained in a jail, the jail is able to revoke their good behavior allowance days for infractions. And this is opposed to charging them with a new crime which would already burden the system and just create more time and more expense for the institution. So, I’d be happy to answer any questions."
