Senate Bill 100 is an attempt to help deal with the overreaching aspects of student discipline to try to limit exclusionary discipline measures like suspensions, and expulsions. But o… obviously, under certain circumstances, those types of disciplinary actions are indeed necessary. What this Bill represents is well over a year of negotiations back and forth with all of the respective parties, schools, law enforcement, advocates, you name it. The Bill, as it stands right now, does not have any opposition. The most recent Amendment cleared all of the opposition from the school groups. It makes them neutral. While it does have many, many proponents, again, we are… are very happy that this is an initiative like what Representative Poe did earlier, where young people… and as we encourage young people to engage in the political process, in the legislative process, they did. In the gallery, I think primarily behind me, are a lot of students from an organization called Voice. They were the ones that brought this issue forward, have worked hard over the last year as advocates… talking to many of you here in the chamber about the Bill, in support of the Bill. But when we're talking about the impact of exclusionary discipline, these students represent those students that sometimes are… are over impacted by these types of… of measures. Some of the information that we've learned is that when students stay in school longer, they have a better chance at success. While we do have what we call alternative programs, and there's money that we fund for those programs, the idea is to try to keep students, to the best of our ability, in their regular school settings. And so, that being said, I certainly hope that all of you can support this Bill. We do appreciate all of the conversation and questions and… and requests that Members have made as it relates to this. "And Representative, I just wanted to get to that issue, because I've been getting a lot of e-mails and calls from folks who are in opposition to this particular measure. And… and one of the key things they talk about is that the… the guidelines for parenting time, which they are contending is the equivalent of custody, that that has now been put to a standard of preponderance of the evidence and that that may be unconstitutional as a de facto termination of parental rights. So, can… can you just address that point for me?" Burke, K.: "Representative, what I would say is that the… the way that the standards are set forth in this statute is what is basically in current statute. And I'm not aware that there is a challenge to the constitutionality of a… of standards that have been in place for many, many years. So I don’t really know where that argument comes from."
"Fair enough. And… and I think one of the comparison points was that grandparents or stepparent visitation was subject to a higher standard of review as opposed to actual natural parent standards. And I think that was one of the objections that had been raised." Burke, K.: "I… I don’t think that's actually factual. So… there are a couple differences. First of all, the… the… for parents, both parents are presumed to be fit. And the… the court shall not place res… the… the Bill says the court shall not replace strictions on parenting time unless it finds that by the preponderance of the evidence that a parent's exercise of parenting time would seriously endanger the child's physical, mental, moral, or emotional health. And both parents are presu… that the decision of a parent not to let a grandparent or sibling visit with the child is… is given great deference by the court. So for that grandparent to get visitation time, they've… they’ve overcome a high burden already just to get… just to get that. And I… I can't stress strongly enough that the… the… these burdens of proof that are in the current… that are in the Bill are, in fact, in the current statute. They're worded differently in the terms of the parents, but it… it is not a change from current law."

Of the six highest states with the six highe… the six states with the highest divorce rate, five of them have… are cause as well as irreconcilable differences. There's only one that's no fault. So I don’t think that having a no-fault standard leads to a higher divorce rate. For legislative intent, this legislation is not meant to be unnecessarily punitive. It's really written for public safety and the clearance around a fire hydrant so that the fire department can get access to water and fight the fire as necessary. It's certainly been the practice of fire departments and districts over the years to work with the parties that might be offending. And if they need more than 30 days, it's certainly the intent that they can negotiate additional time. Be happy to answer your questions."

"Thank you so much. To the Bill. One of the concerns I have is that, in essence, this is a backdoor way to actually impose a tax on poor people and people who use the court systems in our communities. And I believe, as a former county board member, we dealt with this issue over and over again. Each time we wanted to purchase a new vehicle, new equipment, new phone system, that fee was not applied equally to all of the people of that county but really applied to the people that either have cases that are… either guilty or not guilty but who come through the courthouse and have to pay this additional fee. And in essence, it's just a way to actually tax people without having to pass a actual tax. And I think people should really consider that when you start applying the removal of these caps because each county board then could set that fee at any particular rate they… that they so choose. And so, I'm really concerned about this Bill. And I'm… I'm more concerned about the impact. And I didn’t bring with me any stats and figures, but I can tell you, just from experience of our courthouse, that the majority of people who are assessed these fines or fees are people that look like me. And it's quite unfortunate, if you go to our traffic court, that 90 percent of those people that are in traffic court look like me. And this Body has done, I believe, an excellent job starting to collect data around the impact of traffic stops, traffic fees, and fines. But the… the people who bear the cost of these things are usually poor people, usually people of color and that is a unfair tax on the poor. And so, I… I really am concerned about this. All revenue collected pursuant to this Section shall be distributed to school districts solely on a per pupil basis. The General Assembly by law shall provide for the implementation and enforcement of this Section. SCHEDULE This Constitutional Amendment takes effect upon being declared adopted in accordance with Section 7 of the Illinois Constitutional Amendment Act and applies to taxable years beginning on or after January 1, 2017.
