Staff Sergeant Paul Smith died in the service of the United States in Kandahar, Afghanistan, in the summer of 2009. What's very notable here, Mr. Speaker, is that he actually retired from the U.S. Army in 2006 after serving his full term and completing tours in Kuwait, Bosnia, Iraq, and Afghanistan. Sergeant Smith left behind a humble home on Jay Street in East Peoria. He left also behind his wife, Kim, and their two adult children, Sara and Ben. Sara, Kim, and Ben join us today behind us in the back in the gallery to recognize and commemorate the service that Staff Sergeant Paul Smith gave to his community, to his state, and to his country. One of the things that, as I understand what was often the case, is that municipalities right now have the authority, or might have the authority, some municipalities, to establish their own fines, which could be as much as $750 under the current… the current law as it stands for a petty offense such as this that you're describing in your Bill."
"Well, the Bill is simple. It's simply decrims the sale of loose cigarettes and make it a fine by $50. That's all the Bill does. We don't have to make it a bigger deal than it is. I believe that Illinois should have a law in the books that decrims the sale of loose cigarettes and take the taxpayers off of the responsibility of paying for individuals for their act of selling loose cigarettes and put it back on the perpetrator. It's as simple as that. We don't want to incriminate people for a petty Act of selling loose cigarettes in Illinois. We want them to pay the cost for their act, and it's a fine of $50. That's all the Bill does."

The previous Member who rose on this Bill also pointed out that this type of restriction is going to tend to encourage the sale of these loose cigarettes because, in those jurisdictions where there might be higher penalties, those penalties are going to be reduced by the… should this Bill become law. He testified as to the effectiveness of the program. He also testified that the number one reason it was successful is because it forced the sheriff, the judge, the public defender, and the state's attorney in one room to figure out why people were staying in… in jail waiting for their court case beyond the time they should have been sentenced to.
