"Thank you, Mr. Speaker. To the Bill. Ladies and Gentlemen, we had a very lengthy discussion about this in the Education Committee. And in that discussion, we really pointed out a difference that occurs in the metropolitan area around Chicago and in the Chicago Public School System and the rest of the state. In areas where there are Regional Offices of Education, they have staff that are called truancy officers. And these truancy officers work with the parents. They work with various incentives to try to get children to come to school and to deal with the State Law that we have that requires children to be in school. These officers though are not always successful. And that's why the law has provided that if parents refuse to help their children get to school, there is a hammer. There is a stick, if you will, that they can take that parent to court. The judge may fine them or may give them or threaten them prison time. Generally those sticks are strong enough that people don't serve prison time and don't have to pay a fine. But without that threat, the Regional Office of Education and the schools are unable to get all the children to attend school. So, it's important that we have laws that encourage, if you will, very strictly, that parents cooperate. And while the Sponsor of this Bill has a wonderful idea that we need to educate parents about the importance of their child attending school that doesn't always work. And she wants to persist to take away that stick that has worked well around the state. And again, it's not an issue of putting people in prison or finding them dollars that they don't have. It's a matter of threatening those individuals to comply with what is good practice in education and to get people to do the right thing with their children or the children that are under their… their custodial care. So, while the Sponsor has good intent and while training may be helpful, it's not appropriate to take away that stick. And that's why I would encourage you to not support this Resolution or this… this Bill. Thank you very much."

What you're doing with this Bill to southern Illinois is you're going to cause students not to go to school because their parents no longer have that threat. Nobody in my district has been locked up, but going in front of the judge has scared those parents into the fact that they then will bring that child to school. So, down in my district, you will have parents not bringing their children to school because you've taken that incentive away from them that threat that they could go to jail. It means that the family would be without a job. It is not cost-effective to lock up a parent up to 30 days. It is not cost-effective to charge a parent $500. There are reasons for these parents who may allow their children to be truant, some knowingly some unknowingly. But when you're working three part-time jobs and other problems in the families, things can occur, mental illness and others."

So, you know, we have a certain number of people there. They are costing us tens of millions of dollars a year in court claims and also consent decree claims. We cannot afford, I don't think, to reduce what is already viewed by many as inadequate health care and open the state to future liability. If at some point in the future the reforms that we have put in place bear fruit and we're able to divert more people into, you know, community-based treatment and those kind of things, then we should come back and revisit that but I think that will be several years from now."

ICCB will still approve all projects using state funds. During 2015 the ICCB approved 95 locally funded projects or leases, the smallest was a $1 land purchase. Most of the approvals were for projects such as parking lots, lighting, tuckpointing, roof repair, new sidewalks, et cetera. I found out at the end of break when I went to file my tax returns. In doing some research, both with conversations with the IRS and more lengthy conversations with the Illinois Department of Revenue, I tried to figure out what factors might have contributed to the identity theft perpetrated against me. And one of the things that we do as a state and… is that we post on the transparency portal the specific names and salaries of many state employees. Last year I was an employee of Northern Illinois University and was listed accordingly. I would like to read into the record a very brief e-mail message that I received back earlier this week from the Department of Revenue. Representative, following up upon our discussion over the phone this morning, to answer your question, I have received official confirmation that, yes, as you suspected, the published wages of state employees, such as those listed on the Comptroller's transparency accountability site, can be used as fodder for tax fraud and identity theft; therefore, making state and university employees potential targets. This Bill actually passed out of this chamber last year. Instead of trying to do it on Concurrence or something of that nature, we decided to file and draft a completely new Bill. The one thing that we added is with regard to whether or not the parent who can appeal the decision of a school district whether or not that appeal can be done from the very beginning of the school year. The Bill is primarily to address students that have been allowed to enroll and attend school and then the district determines that they… that their residency is no longer valid. This Bill is for that purpose. We did not include in there if a… if when a student originally enrolls in school if they're denied because of residency at the very beginning. This does not allow for that student to… to participate in this process. Again, we passed this Bill out. It got to the Senate. We made a change, brought back a brand new Bill and this is the reflection of the change that we made on behalf of one of the advocacy groups. I'd be more than happy to answer any questions."

I'm not trying to mitigate their ability to do it. My concern is about the process to get there. Right now, the school board or the… or the district makes a decision, the family goes before the school board. And the challenge that I have with that is that it doesn't create what I'm… what I'm calling a due process type process, for lack of a better way of putting it, relative to once the school district makes a decision. So, they can make a decision. If they stick to their decision, then that family then has to go to Circuit Court. So, again, one of the things that we've added is an appeal process to the ROEs or in Cook County, the ISEs to review that case just to make sure that all the information, that there's an opportunity to rebut the assertions of the school district, all of that is in place. And that's what I'm calling the due process side of this so that a very fair and valid decision can be made based on substantial factors not just whims, not just a phone call of a… of someone who says this child doesn't live in the district and then that district investigates and based on their investigation, they may come up with the same decision. But when you look at the investigation itself, you can see where there are holes in the investigation where they really still haven't determined where the child actually lives. So, based on whatever evidence the district comes up with, the level of appeal is an opportunity the fam… for those families, a) to have access to that information, first of all, but then also there to rebut it as appropriate so that a fair and… a fair decision can be made as to whether or not the child lives in the district. "But in the school board making their decision, isn't there a hearing that parents can question the evidence, the investigation?" Davis, W.: "Well, at that hearing."
"Yes." Davis, W.: "But if we're going to be fair about it, there's no reason why the parents shouldn’t be able to look at that information before the hearing. And the example I'd like to use is that this stemmed out of a constituent issue that I had. So, you've got a single parent who is a hairdresser, has hairdressing appointments sometime that takes place before the child actually attends school. So, the parent would take the child to the grandmother's house and have the grandmother to make sure the child got to school. She did not want to leave her child at home alone, so she asked her mother or the child's grandparent to participate in that process. So, what we found out was that the school district was indeed investigating that student and they would start their investigation at 7:00 in the morning and they would witness the child leaving the grandparent's house driving the parent to school. So, I asked him the question, well, where did the 09900118.docx 71 STATE OF ILLINOIS 99th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 118th Legislative Day 4/15/2016 child spend the night? And he said we don't know. All we saw was that the child left the grandparent's house that morning and went to school. So, again, had the parent knew that before the hearing, she could have provided affidavits from her clients. There are things that she could have done to at least say, well, this is why I dropped my child off at my… at my mother's house that morning and asked her to make sure she got to school, but the current process didn't allow for that. So, at the hearing is when you can evaluate the proof, but there's no time to prepare an adequate rebuttal which means that if the district decided that the child didn't live in the district then that parent then had to go to court to make that case. And I just thought that that was overburdensome to be quite honest with you…"

"So, it's your hope that by interjecting some kind of appeal process beyond the school board that will reduce the court action and the cost associated with that, correct?" Davis, W.: "Absolutely. And this… and they may be well-intentioned, but if they have to ask us to reduce their size so they can get to a quorum because they haven't been able to make a decision in three and a half years, it begs the question of why do we need them at all. So, I would suggest that we vote 'no', get rid of this commission completely and then maybe start over and ask the folks who are involved what they really do need and what people might be interested in going to, which may be nothing. Maybe there are other commissions that already cover some of these things. But I think we have so many commissions and so many things that, really, enough is enough. So, what I would ask for is a 'no' vote and maybe we should send a message that it's time to reduce the size of these commissions in government and go forward."
