Thank you, Mr. President, Ladies and Gentlemen of the Senate. Senate Bill 1722, as amended, creates the Safe Neighborhoods Reform Act. It provides a guidance for sentencing individuals who have repeat convictions for gun offenses. It sets up a structure where, for repeat offenders, the judiciary is -- is advised to have a heightened sentence, but there's a departure mechanism in the bill 13  STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 32nd Legislative Day 4/6/2017 that allows -- that preserves judicial discretion, operating under the current range for UUW by a felon - subsequent offense. And the judiciary will be able to consider certain factors, such as the age, immaturity, limited mental capacity of the defendant; nature and circumstances of the predicate conviction; time elapsed since the predicate conviction; the defendant's primer -- prior criminal history; whether the defendant aided in the apprehension of a -- another felon; and whether departure is in the interest of the person's rehabilitation, including employment, education, and vocational training. In addition to this sentencing mechanism for repeat gun -- gun offenders, the -- 1722 also incorporates some of the recommendations from the Governor's Criminal Justice Reform Commission and other recommendations, including -- that were suggested by the State's Attorneys Association, including expansion of eligibility for the Offender Initiative Program, expansion of Second Chance Probation eligibility and drug probation to provide increased alternatives to incarceration and alternatives to having a criminal record. The bill also deals with enhancements that come about because of protected areas for drug crimes, and we reduce the distance from one thousand to five hundred feet and require a proving of a nexus. The bill also expands -- allows for the access for sentencing credits for a certain class of truth-in-sentencing inmates, for primarily drug offenses. It's important, this bill has been characterized as something that focuses heavily on gun offenses, but, actually, the most weighty -- the most weighty component of this bill deals with recommendations on criminal justice reform. The Governor and I penned a op-ed letter approximately two years ago, where we agreed and acknowledged that our criminal justice system -- our criminal 14  STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 32nd Legislative Day 4/6/2017 justice approaches of the past were not well thought out and has led to an over-incarceration and that we need to reduce the prison population by twenty-five percent. Some of the components of this bill help move us in that direction. There were other components of the bill that drew some objection from the -- the other side of aisle, Senator Connelly, and others in committee, and we've had ongoing conversations over the course of the last couple of weeks, conversations with the Governor's Office. The Governor's Office has indicated that they remain committed to the criminal justice reform. There were some concerns expressed by the Police Superintendent in Chicago about high-level drug dealers and how some of the recommendations previously included in this sent the wrong message with regards to high-level drug dealers who are dealing heroin and other substances in -- in high-level amounts. These are not just individuals who are possessing drugs; these are high-level drug dealers. And so those recommendations that did not remove a judge's ability to give a stiff session -- a stiff sentence, but lowered the potential minimum, those recommendations have been taken out, as well as there was a recommendation to reduce the time of -- mandatory supervised release. Because we still maintain a component that allows the Prisoner Review Board to -- discretion to reduce time of mandatory supervised release, it was a reasonable request to -- at the -- to -- to accept the Governor's Office's recommendation. I ask for your support on this and I will yield for any questions.

16  STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 32nd Legislative Day 4/6/2017 Because I respect the sponsor and all the hard work that he has put into trying to drive this discussion, serious conversation about how do we penalize those who continue to prey on our communities, I want to, for the record, just explain what will be my Present vote on this bill and I'd like to speak for the record. Locking up more people is not the solution to gun violence. Seriously addressing gun violence requires reordering our priorities. What is needed is economic development, police reform, and stopping the flow of illegal guns in communities ravaged by deep concentrations of poverty and hopelessness. Harsh gun laws are particularly counterproductive for young people who are less likely to be deterred by threats of punishment. Studies have shown criminal penalties for non-violent gun possession seldom increase public safety; instead, the increased contact with higher-risk offenders strain families and create economic devastation in communities. If an individual is involved in the drug trade or is a shooter in a street gang, he will be quickly replaced and safety is not increased. Tough sentencing is not new and evidence shows that it hasn't worked. Since 2000, Illinois has increased its penalties for gun offenses six times and yet Chicago homicide rates are spiking dramatically. You stop gun violence by adequately and fairly funding public education, providing access to jobs, and stimulating economic development and investment in neglected communities. An educated child will not pick up a gun. A gainfully employed individual will not pick up a gun. But when guns freely flow in and jobs flow out, when schools close, and disinvestment and disadvantage exists, gun violence is the effect, but not the root of the problem. The cause and root of the problem is decades and decades of discriminatory and misdirected governmental 17  STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 32nd Legislative Day 4/6/2017 policies that have crippled and handicapped highly segregated communities on the south and west sides of Chicago. For that reason, I will be voting Present on my colleague's bill. Thank you.

Very thoughtful effort went into this. You and I have served together, along with Senator Connelly and others, on the Criminal Justice Reform Commission, which I think has been some of the most important work and continues to be some of the most important work that we do here. And it is sometimes difficult to separate those who make a mistake and deserve every opportunity to get their lives on track and those who are a serious threat to our community. It is very difficult to strike that balance and I think that this bill does a lot to - - to -- to rightsize our criminal justice approach in the State of Illinois. And I am happy to support and recommend an Aye vote. Thank you.

Thank you. Senator Raoul, has this bill been analyzed -- analyzed by the Sentencing Policy Advisory Council.

There was a -- a previous analysis of -- of the bill -- of some of the portions of the bill by the Sentencing Policy Advisory Commission {sic}. There's an amendment that was filed today that removes some of the components and obviously those components -- I think were -- some of those components were analyzed by -- by - - by SPAC, but -- yeah, the bill was previously analyzed by SPAC, as well as a fiscal note was returned from the Department of Corrections.

Did you remove any reforms from the bill, and if so, what were they?

PRESIDING OFFICER: (SENATOR HARMON) Senator Raoul.

Again, as I explained in the introduction, the -- there was a recommendation that the time of mandatory supervised release be reduced down to eighteen months because the Prisoner Review Board 19  STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 32nd Legislative Day 4/6/2017 already has the discretion to use risk assessment to reduce that time. We thought that that -- it was reasonable to take the Governor's Office's request to remove that mandate. There was concern about Super X and Super 1 minimums for high-level drug offenders, based on drug dealers who are -- who are dealing heroin and oftentimes one-and-done drug dealing that leads to deaths in our community, so those -- a reduction of those minimums were taken out. And then, finally, there was a reclassification of -- based on weight that was removed.

Senator, is there a fiscal impact connected to this budget, and if -- to this bill, and if so, what is it?

So, I don't know what it is right now with the recent changes, but under the previous version, it was projected to save, over a ten-year period of time, sixty-two million dollars.

…right, because I was told that it -- that -- that -- that the fiscal impact is going to cost like thirty-four million dollars more than the last controversial version, and especially since the reforms were -- were removed. Can you speak to that? Or is that an accurate statement?

I wish I could ask a question and ask who told you that. I know -- I see everybody reading from sheets that they were provided. So I -- I'm curious as to who told you that, 'cause there hasn't been a -- a fiscal note filed on this.

I believe this document came from Loyola legal clinic. You know, they are the ones that challenged this bill in committee several weeks ago. And, if you can recall, they did -- also indicated that. And it also -- could've come from Shriver as well. But, you know, they also said that -- that Illinois has the largest amount of gun bills on the books than any other state in the nation and we -- we continue to have more crime than anyone else. And so I'm not really sure if this is the right direction in which we need to go.

Thank you, Mr. President. I appreciate the messages sent to me during this debate and I appreciated the debate that occurred in committee a couple of weeks ago. Kids are dying. I drove home 21  STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 32nd Legislative Day 4/6/2017 last week to two sets of murders in my district that occurred while I was on the drive home. I've committed my last twelve years to criminal justice reform. And quite frankly, over the last several weeks, I've been insulted by some of the advocates, who haven't read -- who hadn't done -- done their fundamental homework of reading the language of the bill. I got to go home, like all of you all have to go home, to this carnage. And what this does, this does not lock up a single additional individual, and if these advocates would read the language, they would know that. What this says -- because, guess what? News flash: We already have mandatory minimums. But what we're saying is somebody who's either previously been convicted of murder, rape, armed robbery, or carrying a weapon on the street, been convicted, goes out gets another one, hits the street with it - I tell you what, that's somebody more likely to be a shooter. And I was offended in committee when somebody said, "Well, if your son was in the Roseland neighborhood, he would have to carry." That's the type of philosophy that leads -- leads to racial profiling, that they're all doing something wrong, and it's offensive. And I don't care if it's Loyola, Northwestern, or whatever academic, that's the type of philosophy that leads to stop-and-frisk and racial profiling. I heard all about, "Oh, it's going to lock up more black and brown people". It's not going to lock up any additional -- not a single more person. But the black and brown people that I'm most concerned about are the ones that are getting shot. Yes, we've got to do something about investing in education. Yes, we've got to do stuff about other criminal justice reforms. Senator Trotter has a bill today on -- on bail bond reform. I've filed another bill to address one of the concerns about folks who have 22  STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 32nd Legislative Day 4/6/2017 endured trauma, and I'm -- and I have been speaking to Representative Sims and Representative Zalewski in the House about potentially including it in -- in this bill, to make sure that first-time offenders who have been the victims of trauma and who could substantiate it have an opportunity to be deferred. But the individual who keeps going back to the streets, that's the person who's going to be the shooter. The individual who, after convicted, keeps going back into the streets with a gun, that's a shooter. We have to absolutely invest in -- in -- in our neighborhoods, but in the meantime, people are dying as a result of these guns being so easily accessible. Senator Harmon has a bill on gun -- gun dealer licensing - I'm enthusiastically supportive of that. But everything doesn't happen in one bill. We've all been around long enough to know that. It's an ongoing process. And so, if we throw out the good in the interest of perfect in an instant, there are going to be consequences for that. If this saves one life, just one life, I think it's worth it. So I would just -- police reform was mentioned. I've -- you know, Senator -- Representative Sims and I worked on a comprehensive police reform bill. It's not as if we can't walk and chew gum. We work on these policies continuously; otherwise, we'll just have one Session and we'll never reconvene again. We'll continue to work on this and there's no -- I don't care who claims that there's a single policy that will end the gun violence, they're lying. And I'm not putting this forth as a single policy that will -- will end it, but I think it will help and I urge your support.

Thank you, Mr. President. The goal of this legislation is to make PTAB appeal processes more taxpayer friendly and reduce the length of the process. Senate Bill 609 amend -- the amendment provides that if the Property Tax Appeal Board lowers the assessment of a property, a taxpayer may aggregate appeals of subsequent years' assessments - that's a mouthful - within the same general assessment period. Currently, the taxpayer must file a separate appeal within thirty days after PTAB's date of decision for the prior year. I know of no opposition to this and I'm happy to answer questions.
