SENATOR McCARTER: Ladies and Gentlemen, if I can have your attention just a minute, I want to -- I need to talk about something that took place in my district. Tuesday night, I got a text from one of my constituents, Joseph Johnson, letting me know that at 6:30 that afternoon, his wife, Michelle, lost her battle to heroin. Joe was just a constituent, not the one you'd think I'd want to serve that well, because he doesn't think like me. Doesn't think much of our President. I like him. Doesn't think much about politicians at all. In fact, all he did was cuss 'em. But, you know, constituent service, we serve everybody. Right? And that turned in -- that service turned into a friendship, which turned into a relationship, and, in fact, just six/seven weeks ago, I had an open house and he and -- he brought his wife to the open house. And, you know, here this liberal Democrat, you know, was listening to me speak, and 15 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/19/2017 his wife was distant. And if you've ever seen anybody that's on heroin, they're distant. In their own body, they're okay, until they need more. Right? And so, this -- let me -- let me -- I want to -- I'm going to ask for a moment of silence just -- in -- in a just a minute, but let me remind you that the people that came to me at my daughter's memorial, they said, you know I just saw her three weeks ago at this apartment complex that I was working at, but that wasn't the right part of town. She shouldn't have been there. And I just want to encourage you that -- you know, it's very difficult to speak to people. It's awkward, right? But we have to get over that awkwardness, because when you see some of your constituents or their kids in the wrong part of town or with the wrong people, let me just encourage you to grab 'em, give 'em something else to do, maybe a cup of coffee, remind them that they're loved, and show some -- and hold 'em accountable. Because then, if you happen to have to go to their funeral, you can say, I did something. Because the worst part of that whole thing was the people that said, I did nothing. They -- they felt so bad, 'cause they did nothing. And so, let me just encourage you, 'cause we all know these people. In fact, they're probably in our family, and if they're not in our family, they're real close to us. And if nothing else, they're our constituents. And so let me encourage you to do something. It'll make it a lot easier if tragedy happens. So, to -- I'd -- I'd like us to have just a moment of silence to pray for the family of Joe Johnson and his wife, Michelle. They got two daughters, Brianna, who's nine; Shannon, who's fifteen. They just don't know what to think. So, if we could just do that and honor them, I would sure appreciate it. This -- this past week, for our district as well, we had a gentleman who serves nobly on our Amtrak line as a conductor - Mr. Michael Case is his name - was -- was shot by a -- a rider on the train. He was shot in the torso. He's at Edward Hospital right now. He's a great family -- a great family man, a noble public servant, who provides transportation to constituents that use the Amtrak line. He's a friend of the 19th District and he's also a neighbor. And I just want to have him kept in our thoughts and prayers as he -- we wish him a speedy recovery from his gunshot wound. And -- and for those that don't think that gun violence happens outside of the City of Chicago, it does, and it's starting to hit home in the 19th District. And I just want to make sure that Mike and his family understand that we're thinking about him down here in Springfield. Thank you, Mr. President.

And so this is an amendment to the Township Code to provide that a township may provide for the collection, transport, disposal, and recycling of brush, wood chips, and leaves within the unincorporated areas of the township by ordinance without referendum approval. Research strongly suggests that the expulsion of toddlers and preschoolers from early childhood settings is occurring at alarming high rates. The federal government recently released guidance for states in expulsion and suspension policies in early childhood programs, including the recommendation to eliminate or severely limit expulsions. Here in Illinois, we have House Bill 2663 before you in order to take first steps in prohibiting expulsions and then we can continue to work towards providing resources to support the 60 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/19/2017 programs, staff, and children and their families. The bill does three things. It provides protections for children in ISBE-funded early childhood programs and licensed childcare settings against preventable expulsions, similar to what we established with our K through twelve students. It identifies the trainings and topics needed to address the problem and asks State agencies to make this information available to programs. And, lastly, it strengthens data collection and dissemination by agencies funding early childhood services to help inform agencies, lawmakers, and advocates, and guide policy makers in practice -- planning. This is an initiative of the Ounce of Prevention. The Fight Crime: Invest in Kids really are -- was involved and engaged with this initiative. And I'd be happy to answer any questions you may have.

Senate Bill 326 reflects an agreement between the interior designers and the architects over some long-standing issues about practice areas and sharing. The agreement is limited to some continuing education requirements, as well as to including interior designers in the Mechanics Lien Act on the same terms that architects are currently permitted. This is an agreement that broke late in the Session and that agreement among the -- the principal stakeholders did engender some concerns among some other folks, including the -- the -- the title industry, as well as some concerns from the Department. I think that those concerns are -- 66 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/19/2017 could be easily assuaged with a little bit of time. I will certainly continue to work on this as it moves over to the House, but it's been a long road reaching agreement between the two principal stakeholder groups, and I'd ask for your support in sending it to the House, where we can continue the conversations.

Senate Bill 1993 provides that absent a State budget, the Court of Claims will receive a continuing appropriation for the purpose of paying unjust imprisonment claims. This is a direct consequence of the -- the language in this bill is a direct consequence of our budget stalemate; that presently we have twenty-two individuals who have been exonerated by the courts who are still waiting to get payment.

You know, Ladies and Gentlemen, I generally oppose continuing appropriations. I think that it pulls us out of the ongoing 72 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/19/2017 decision-making process that the Legislature should be making year to year. However, in this case, this is very different from everything else that we do in an appropriation. In this case, we have individuals who, in contrast of any other group that -- virtually that the State does business with, they have -- we've done something to them. Okay? We were the ones that incarcerated them wrongfully. We then recognized what we did. We said, "Oh, we're sorry, and that, by statute, we owe you something." The last step in this process would be to have an appropriation so that those funds can actually go out the door to right the wrong that we created in the first place. So I believe that this is a worthwhile exemption to typically what I think is -- should be subject to regular appropriations and I strongly encourage my colleagues to vote Yes. Thank you.
