So I want to congratulate Coach Keith Peoples, Principal Gail Lewis, and the entire Hilltoppers' team on their victory and on a superb end to a great season. The Hilltoppers were already winners in the way they represented their school, their families, Danville and Vermilion County so well during the season, but a State title is a great way to cap off such an incredible season. Varsity Coaches: Tiffany Hickox, Sara Gray, and Katie Armstrong, along with Junior Varsity Coach Stephanie Bezler. The varsity team received first place in Class AA Hip and Class AA Pom Dance at the State Championship this year and the JV team received first place in Lyrical and Pom Dance, as well as high score award for their lyrical routine and the JV Grand Champion Award. That's a lot of awards. And within the team, there are also individuals who -- who did well on their own. But on behalf of the State Senate, I would like to congratulate the young women at Jacksonville High School for their achievements this year. SENATOR McCONCHIE: So we added some text in here in order for them to really be confident that the -- would -- this would not become a regular practice. I do believe that we need to come up with a procedure for eliminating drainage districts and merging those into municipalities and county in unincorporated areas in very highly congested areas that have been built up, which is what this drainage district represents. Thank you, Mr. President. Senate Bill 2577 amends the Use Tax and the Service Use Tax. Provides that, if a retailer or serviceman makes a sale to purchaser in Illinois from outside of Illinois, then that retailer or serviceman is considered to be "maintaining a piece of business in this State". If then the cumulative gross receipts for the sale to the purchasers in Illinois are a hundred thousand dollars or more, they need to collect a tax. We call this the Marketplace Fairness Act. It's very poignant, considering that right now in -- at the Supreme Court, the Supreme Court justices are hearing oral arguments in South Dakota versus Wayfair. You know, we have suffered -- we have a lot of small businesses that are -- cannot compete with online retailers and -- and -- you know, a lot of brick and mortar. They invest in our communities and this will level the playing field to help our small businesses continue to do business in Illinois and -- and continue to contribute to our economy. Ladies and Gentlemen, what this case actually comes down to is that for about twenty-five years or so, we've been operating under a Supreme Court decision that we -- we commonly refer to as the Quill decision, and that was essentially that when catalog companies were coming -- or becoming more prominent that you had to have a nexus in the State in order to collect a sales tax, you know, like, to be in it, and it just wasn't enough that if you had a catalog in your place, your home, ordered something from another state, got it delivered to your home, that that was considered a presence in the State of Illinois. Well, as we all know, we don't shop or -- and our economy doesn't operate the way it did twenty- five years ago. So the case that's in front of the Supreme Court today - today, today, today, today, today - we're very excited about this, it's South Dakota v. Wayfair, because it really says that because of the -- the prevalence of online activity and the amount of people that people are delivering to in each individual state, that these companies ought collect this tax. Amazon does this in all forty-five states that actually impose a sales tax. So, right now, what we're saying is, in light of the fact that there is an uneven playing field between online operators and 27 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 110th Legislative Day 4/17/2018 brick-and-motor establishments, which we all feel in our districts, because you know, as well as I do, you can pick up a phone, walk into a store, see all the stuff, touch all the merchandise, figure out which one you want, decide how it's going to look in your home, and then pick up that trusty little smartphone and order that thing online and avoid sales tax in certain situations. Most major corporations are already doing this. Walmart does it. Amazon does it. Most major online retailers are doing this in those forty-five states. However, we still have a significant way to go, in the absence of any action by Congress, for states to not leave so very much money on the table. It really is a matter of fairness. I would also add that in my capacity as the President-elect of the National Conference of State Legislatures and the work that we do at the State and Local Taxation Task Force, which is headed by our very own Senator Pamela Althoff, we've been working on this issue for over a decade. So it's an exciting day that this is now coming to bear in the Supreme Court. We're hoping that as many states as possible will move to do exactly what it is we're doing right now and what South Dakota did to push this case to the Supreme Court. I urge everyone in here for an Aye vote. Thank you.

I'm going to say how old it is, because former State Senator Steven Rauschenberger was the Chair of the national task force and that was over twenty years ago. I now serve in that capacity. It's time to pass this legislation so that those people, those businesses, doing business in the State of Illinois with our constituency, pay their fair share of taxes that are duly owed the State for doing that business. This is not an increase in taxes. So, just want to say thank you to the sponsor for carrying it to fruition. It's an honor to be one of the sponsors on the legislation and it's about time Illinois took this measure. So thank you very much.

As we're out talking to constituents, I think we typically understand that folks see this as a -- a more fair tax, because we understand how it's hurting our bricks and mortar; also, because it's a tax they used to pay that is now no longer getting paid by a lot of them and this only brings up to speed what's going on online. The reason I stood to speak is because I want to challenge us. That -- we have a serious infrastructure problem. I hate to see us take any new revenue unless that revenue goes specifically to infrastructure. We're going to be talking about motor fuel tax, other things. We're being taxed to death in our State. If this one happens to come into place, I ask that it go to IDOT, be part of that lockbox and be handled in that way. Thank you.

Thank you, Mr. President, Ladies and Gentlemen of the Senate. I rise in strong support of the Senator's bill. To pick up on Senator Althoff's remarks, this is certainly a bill with a long history. When President Cullerton asked me to take it over at one point, we called it the streamlined sales tax and I teamed up with Senator Althoff and we failed to get it across the finish line. I know there have been many other hands. Senator Hutchinson spoke. She was involved. Senator Castro, I congratulate you on putting it in this position. But I do want to emphasize just a couple of things that have been said. This is not a tax increase. This is not a tax increase. We are extending or ensuring that the existing tax be applied to the transactions to which it should be applied. I would also point out: This is not new revenue. This is a replacement of the eroded revenue that has been lost over time from brick-and-mortar stores to Internet commerce. And just to close, I want to say this is the beginning of a conversation. We are going to have to have a really substantial conversation on what the future of retail is in this country in this world, because our entire model of financing government based in part on the sales tax is at risk if we do not modernize our system to keep pace with the changes. We're going to have to look at what it means for local jobs. Things are going to be different as this economy continues to evolve. But this is a critical first step in making sure we stay in sync with the real economy, not the one that we imagine or wish existed. Thank you. Actually, what -- we -- we've had many discussions with IRMA, IML. The plan is, obviously if we get this passed, depending on what happens with SCOTUS, we will have a vehicle put in place and then we'll have that discussion, because they are - you're right - they are currently, right now, being affected by e- commerce. Case in point, Batavia. The administrator of Batavia had actually talked to me about -- they lost Sam's and that's because Sam's is looking at how online retailers, they don't need to have brick and mortar. That was three million dollars that they took in a hit in their budget - three million - countless jobs. And they were a big supporter of this, because we need to take e-commerce seriously and look at how municipalities can reap that revenue, but also the economy, jobs. So there's a domino 32 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 110th Legislative Day 4/17/2018 effect with the explosion of e-commerce. So I -- I welcome you to be a part of that conversation, Senator, as we move this bill across and get it passed and see what SCOTUS does. If they make amendments to it, we'll make amendments to ours and then we'll talk about how we disperse that money.

I cannot tell you how many times I talk to a business owner who says I lose sales to online sales because the people save ten dollars or twenty dollars in tax, when if the -- playing field was level, these people would then go and shop local. They can get it today. If there's a problem, they can easily return it. But they're going online just because they are saving a few dollars, and so this levels that playing field and I encourage an Aye vote. Thank you.

Senator, I -- I'm not sure whether I'm a Yes or a No vote. I may ultimately have to abstain on this, but I have a question I'd like to ask to clarify it. If, for example, a Florida resident orders Oberweis ice cream online and we ship it to them, which we do all the time, would Oberweis Dairy then become liable to pay the sales tax on the ice cream that's sold?

If I understand it correctly, I don't believe Florida has this law, so, no, you wouldn't. You would fall under what Florida's laws are. This is dealing with people who are in Illinois, who purchase goods from like, say, we'll use Wayfair for example or Overstock, and they have -- Wayfair and Overstock sell their product to someone in Illinois. They would have to collect and remit sales tax. It's very similar to what Amazon -- Amazon does right now. If you buy something on Amazon, they collect and remit the sales tax to Illinois.

I think what we need to do is -- we're -- we're creating fairness for our business community. Our small- and medium-sized businesses continue to struggle with the explosion of e-commerce to be successful and this is a vehicle for them to not only stay in business, but create more jobs. On top of the fact that our local municipalities are struggling to keep up with the change in e-commerce, because let's -- frankly, we all -- we all shop online. We all do. In some areas, we remit sales -- pay sales tax; in other areas, we don't. But if we don't level that playing field for our folks here, you -- we will see a domino effect, which will result in municipalities having to make up that revenue somewhere. Other things, and we -- Senator Weaver talked about infrastructure. They would have to forgo certain things - services, infrastructure - because that playing field is just uneven. Thank you, Mr. President. 2660 is a cleanup bill for the ABLE accounts. ABLE accounts, which, of course, were created just a few years ago, allow families to save for their dependents who have disabilities. Now what we're trying to do with the amendment and with this new bill is to try to kind of clarify what happens upon someone's death from -- once the money's placed into an ABLE account. So the new language will allow for the proceeds of an ABLE account to transfer to a person's respective estate or other eligible individual. The -- the language would also bar the State from seeking payment under the Revenue Code. Obviously, sometimes when someone has some of these conditions, their mortality might be in question and it's been a bit of a deterrent for families to put money into this not knowing what will happen to the money if that person were to die at an early age. This tries to -- to try to address that in the way that we would have wanted when we created the accounts.

It includes several provisions regulating insurance companies, including prior review of premium rates and giving the Department of Insurance the ability to declare a rate excessive, which are intended to pass more of the savings achieved by the 2011 work comp reform bill onto employers in the form of reduced premiums. It includes items discussed in bipartisan, bicameral working groups over the past several years, including language regarding travel -- traveling employees, categorizing hip and shoulder injuries as leg and arm injuries respectively, proper use of AMA impairment guidelines, electronic billing, spine crediting, creating prescription drug formulary, adding new procedures to the medical fee schedules, and providing benefits to first responders who have -- who are injured on the job. I urge your support.

I don't know exhaustively, but I know one of the opponents is the Illinois Policy Institute and you may be familiar with them. But some of the proponents are Illinois State Med Society, the Illinois Federation of Teachers, Illinois AFL-CIO, Operating Engineers. The Insurance Association is certainly against the bill.

I suspect, Senator, that I'm as familiar with the IPI as you are with the Illinois Trial Lawyers Association. But moving past that, what -- the -- the groups that represent the people who actually get to live under these laws, the business groups, where do they line up on it?

Well, there are a wide range of business groups. Physicians are certainly in business and the physicians are proponents of -- of this bill. I'm not certain where the Hospital Association fits -- what their posture is on this bill, but Manufacturers' Association is against the bill. Thank you…(microphone cutoff)…five minutes or so of our lives we'll never get back. Ladies and Gentlemen, this is a rewind from what we've seen before. We have meetings, Republicans and Democrats, we get together, we talk about different ideas and then certain ideas are picked off that list, they're put into a bill and they're run and people who are for it say, well, these ideas were raised at these bipartisan meetings. The ideas aren't bipartisan, the -- the -- the -- that are put in the bill, some of the concepts were. This bill will perhaps pass the House, pass the Senate, it will get vetoed by the Governor, and you know what? We'll be right back where we started, Mr. President. And the problem with that is that while employers in Indiana and Missouri and other states enjoy remarkably lower rates in their workers' compensation premiums than Illinois, employers in Illinois are looking at Springfield and saying, what are you doing? This is one area where we can really help people without spending more money, and that is by making an honest change in workers' compensation that in the end will benefit both the employee and the employer. I just want to inform the Ladies and Gentlemen of the Senate of the progress that we've made as a State 68 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 110th Legislative Day 4/17/2018 as a result of the 2011 reforms. We have the largest decrease in medical benefits paid compared to all of the other states in the United States of America. We have the second-largest decrease in total benefits paid compared to all of the states in the United States of America. We have the eighth-largest percentage decrease in the country in terms of indemnity benefits. And the third- largest decrease in the country for benefits paid altogether. With regards to how we measure up to states comprehensively in terms of how we compare to other states in terms of employer costs per hundred dollars of covered wages, during these conversations which I partook in - these bipartisan conversations, which I partook in - what I consistently heard is, we don't want to be -- race to the bottom, we want to be in the middle of the pack. Well, we have arrived. We rank number twenty-five in terms of employer costs per a hundred dollars of covered wages. We have arised {sic} and so we don't need to engage in the race -- in the race to the bottom. We -- there are some reforms in here that I think will - - can be well received by folks on both sides -- side of the aisle. So I'd like to see fifty-nine lights light up green on this. Thank you.

Mr. President, Members of the Senate, I'd like to indicate that it was many, many years ago that I served with a gentleman here by the name of Kenny Hall, and when he left, he was replaced in the Senate by - twenty-three years ago today - by a Senator who is my seatmate - and I only have one seatmate - and that would be Senator Clayborne, who's celebrating his twenty-third anniversary here in the Illinois Senate. So, to commemorate this, we're going to have some cake. We're going to celebrate and we're going to congratulate him on his many years of service here in the Illinois Senate. So let's please do that today.
