Abby's earning her bachelor's degree, Elementary Education with a focus in Kindergarten/Primary, at Ball State University. Senate Bill 2560 deals with those websites that collect booking photographs and other information through public records requests and posts 'em online. The problem is, that information is often not updated when a person is released or charges are not even levied. And what happens too often, these websites will then charge people hundreds, if not thousands, of dollars to get that information and those photographs removed. Basically, it's extorting money, I believe. So what this bill does, it tries to toughen up current language that the State has in barring these websites from charging fees for people to remove that photograph. Also, it provides a path for people to get that information corrected. For example, these websites must correct the records within five days of receipt 13 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 115th Legislative Day 4/25/2018 of notice. It also provides attorney's fees and fines of one hundred dollars per day that this information is not corrected. The amendment also addresses numerous issues that removes, I believe, all opposition to this bill. I'm happy to answer any questions and I ask for an Aye vote.

The reason being is the same reason I gave for the bill -- the previous bill. Senate Bill 2619 amends language that we passed last year that the bill passed pretty much unanimously and it makes changes to update and clarify current training requirements as well as alternative training recommendations to become a fire chief. This bill covers fire departments that hire firefighters based on current statute in law. So volunteer departments don't apply to this. The amendment that was added was a request by the City of Chicago. The City of Chicago would not apply under the current language, but in the art of compromise to make them feel more comfortable, we added the language. That was the last amendment - that exempts cities with a population under {sic} one million. So, again, the -- the amendment was more of a -- a compromise for the City of Chicago, but, again, it wouldn't apply to them anyway. Again, the -- the 23 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 115th Legislative Day 4/25/2018 background of this bill is we just want to make sure that fire chiefs hired in municipalities have at least ten years' experience or a list of -- of other things. And there is -- there is a little opposition to this bill, but this is a public safety issue, and being a firefighter from a department that had a public safety officer that had no fire background, I know how devastating this can be. So we just want to codify in law to make sure that fire departments that hire under the current standards are hiring fire chiefs that are qualified.

We're mandating that our schools that -- we're always talking about unfunded mandates. And while there may not be too many statewide organizations showing up on your screen - none are showing up on my screen, by the way, for -- for anyone who would like -- like to be interested in that - there are several organizations who do not agree with this. So vote this bill accordingly. Understand that the Illinois Coalition for Informed Consent is opposed to this. Many of your superintendents are opposed to this. Basically what we're doing with this is in -- in federal law and State law the sale of CBD oil is -- it -- it -- it doesn't define it. It doesn't say it's legal and it doesn't say it's illegal. What we're doing here is we're just -- we're -- we're making sure in law that 40 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 115th Legislative Day 4/25/2018 everybody knows that it's okay to -- to sell and use CBD oil. CBD oil is -- has been proven to help with a lot of different ailments. It is extracted from the male hemp plant, not from the plant that you get THC out of, so it's very, very low THC. I think in the bill it's defined as under .03 {sic} (0.3) percent of THC. I know of no opposition and I would ask for an Aye vote.

Can you explain to me what "low THC" is? Because I know that THC is the -- the chemical in -- in marijuana that causes the getting high effect and I thought that THC was not in CBD oil.

Thank you for the question, Senator. So, again, in the bill, low -- low THC is defined as under .03 {sic} percent. The CBD oil is extracted from the male hemp plant, which has very low THC and 41 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 115th Legislative Day 4/25/2018 it's where all the -- the good cannabinoids are. The female strain of the plant is the marijuana plant and that is where all the -- the THC lies. So, by definition, it's under .03 {sic} percent.

So, is it legal to actually use the term THC when it's not supposed to be legalized here in Illinois? That's what I'm trying to figure out.

But, again, you know, this is not going to get anybody -- anybody high. It's not going to give you that effect. This is, again, as defined under .03 {sic} percent.

Senate Bill 2846 adds a new provision that certain youth who do not receive a scholarship or a fee grant from the Department of Children and Family -- or a fee waiver, excuse me, from the Department of Children and Family Services shall receive a grant of all tuition and fees for any community college, university, or college maintained by the State of Illinois. This applies to youth who the Department has court- 50 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 115th Legislative Day 4/25/2018 ordered legal responsibility for, have aged out of care at age eighteen, who were formerly under care and were the subject of an adoption assistance agreement. This is -- to explain it, this is more like a grant. This is a last dollar grant. You -- we look at a lot of the students who have aged out of the -- the DCFS system who have a -- a lot -- a harder time. They are more likely to be unemployed. They end up in the jail system. This is an opportunity for them to go to college to learn a trade. It is a last dollar grant, and what I mean by that is, you must complete a FAFSA; Pell and MAP must get applied first. Grant is whatever -- is for what's left as far as tuition. I ask for an Aye vote.

I appreciate what the Senator is trying to do with this legislation. My concern is that this -- this population does need assistance and does need help. They qualify for numerous other grants and programs and -- and student loans. What this does is pick up the balance of all the expenses that aren't picked up anywhere else, and so ends up giving -- making college at a hundred percent paid for, as opposed to at least having some skin in the game or some involvement. The other concern is that just because a -- a child was in DCFS doesn't mean necessarily that their needs are any greater than a child that wasn't in DCFS before. And -- 51 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 115th Legislative Day 4/25/2018 and this basically gives a child that was in DCFS a ability to obtain more dollars than another individual that may have greater financial needs or have greater personal needs. And -- and so from that standpoint and the fact that, obviously, we don't have the funds to do this, I would seek a -- a No vote and maybe work on coming up with something that'll treat all struggling students the same in Illinois. Currently, the cost of investing funds and keeping them safe in the State treasury is borne exclusively by the General Revenue Fund. This bill allocates those costs across all of the funds that are being administered and invested on -- on behalf of the Treasurer, thus reducing the dependency on the General Revenue Fund. So it -- it seems a roundabout way to add extra funds or -- or the like when it's -- it's all taxpayer money that's using -- that's -- the -- funding the Treasurer's Office, GRF or any of that. So, to me, I -- I think this is an unnecessary tool or addition of layer of non-transparency to State government. So I would urge a Aye -- a No vote. Thank you.

Yes, thank you. Just to say again, right now the Treasurer invests funds on all sorts of different funds, that they're investing for a return on their investment. This is just allocating those costs across all the funds that they are investing on behalf of, so it's not just exclusively the General Revenue Fund. It's not changing what they're actually paying to do the administrative work. It's just allocating the cost appropriately. I'd urge an Aye vote.

Thank you so much, Mr. President. Senate Bill 2866, as amended by Senate Floor Amendment 3, is a recommendation of Planned Parenthood of Illinois. It amends the Department of Public Health and Communicable Disease Prevention Act to expand informational material requirements concerning the human papillomavirus, which is HPV, to all students, both male and female, entering the sixth grade. Additionally, the bill permits for the Department of Public Health to adopt emergency rules to implement the bill. This is just an expansion to boys. Since 2007, girls have received this information, and this bill simply includes males. It does not require students to get the HPV cancer prevention vaccination. It just requires the information be provided about HPV's link to cancer. I would respectfully ask for an Aye vote.

Thank you, Mr. President, Members of the Senate. This bill addresses something that we've been reading a lot about, you know, in terms of the prompt payment interest that's getting paid by the State. A very creative suggestion that's being put forth here by the State Treasurer, to allow the Treasurer to purchase qualified accounts receivables from State vendors, like Vendor Assistance 57 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 115th Legislative Day 4/25/2018 Program is doing right now, but they would do it at a -- a lower interest rate to the State. They would be working with the Comptroller's Office to make sure they only do this as appropriate for cash flow purposes. We do need an amendment on this. The agreement has been that -- and they're working with the vendors on this to get to an agreed amendment. We want to pass it over to the House. Agreement that it'll be held there until we get to an agreed amendment on that. And we'll get it back over here for concurrence. I would look for an Aye vote on this and appreciate your time.

In -- in State Government Committee, I -- I think we -- we tried to address why the Treasurer would want to do this. It -- it seemed to us on the Republican side that it seemed a much more streamlined way, if we have money that's sitting out there, that we should use that to pay down our bills before we -- it's either -- ever sold. And so it just made no sense to us. How much money do you envision that the Treasurer would have to invest in paying or buying our debt?

58 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 115th Legislative Day 4/25/2018 Well, that's something they would go through their asset allocation to determine how much of a cash flow they have available to make these investments. The return that they're looking for, though, is at 3.6 percent. Right now, we pay one month -- one percent per month. So we are paying at least twelve percent interest, so this is a much lower rate that the taxpayers of Illinois would be paying for those interest penalties. And the Treasurer would only do so according to their guidelines that they would have to put in place and in working with the Comptroller's Office on cash flow. This is nothing -- you know, this is not a new -- this is their investment portfolio. It's not their spending or appropriation authority. Very different. So it has nothing to do with appropriation authority or spending available dollars to purchase that State debt.

Yes, but still -- surely the Treasurer has in mind how much money they're going to allocate to this investment.

Any accounts receivable they purchase at an interest rate to the taxpayer of 3.6 percent versus the twelve percent that's getting paid under the Vendor Assistance Program is going to save money. I don't know how much they'll be able to do that for. That'll be depending on available cash flow as they work it out with the Comptroller.

Several years ago, we thought this would be a good idea to do the Prompt Payment Act, where it'd have a huge amount of interest, because we thought it would be encouragement that we pay our bills on time. Unfortunately, that has not happened and it's become a snowball. And now we have this cottage industry that invests and buys our bad debt. And it seems that the easiest, most simplified solution to this whole problem is let's do a new State Prompt Payment Act. Let's get it back to where it needs to be, put it on a -- a consumer index, but get it, you know, so that our vendors have interest when we don't pay our bills in a timely fashion, but recognize that we have created a monster here, and that is the 60 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 115th Legislative Day 4/25/2018 most simple way to rein in these exorbitant high interest rates that hurt vendors, that creates a -- a industry where they buy up the debt so that the vendors can get paid on time. I mean, I'd ask all of you, let's just do the most simple thing of what we need to do, still get our vendors the -- an appropriate amount of interest, but not the amount that it's going now that we've created an industry that feeds upon our bad debt. And most of all, let's try to live within the means so we don't get into this horrible mess again to where we can't pay our vendors that want to deal with the State of Illinois. So that's my recommendation. I do not -- I -- I applaud -- I -- I said to the -- the sponsor, I said to the Treasurer, I applaud you thinking out of these -- the box in these financial times that we found ourself in, but let's go back to the most simple way to do it. Let's redo it and try to get our finances in order and start paying our bills on time. Thank you.

But listen -- listen, folks, the easiest way to address this is to pay our bills. Just pay your bills. The problem with factoring accounts is it only works with other people's money. This is the reason you factor 61 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 115th Legislative Day 4/25/2018 accounts, is so that you use other people's money. This is our money. Comptroller in one pocket; Treasurer in the other. You're -- you're -- this is our money. It's not going to work. And talking about factoring accounts, this Vendor, you know, Assistance Program, folks, we've let retired politicians take advantage of this at twelve percent. 3.6 percent was recommended. It's good enough for the program right now. If it's good enough for this new program, it's good enough for the old program. The solution is to pay your bills. Now that we've -- not we, I should -- I'm -- I'm being very careful - I didn't increase the taxes. But we have more revenue than we -- we've had ever. It's time to use it to pay our bills and catch up. And if you want to -- and -- and we do need to change the Prompt Pay Act to 3.6, as you've suggested, but that bill was put on the -- it was put into the Executive Committee a year ago and refused. So now's the time to do it. Senator McConchie's bill, let's pass his bill at 3.6 percent. We couldn't figure out what that percentage is, now we know. Let's do the right thing. Let's take these past retired politicians out of the business of factoring the accounts of this State, because they know that this government may -- is just big enough that it's going to survive and they're going to make their money. And they're -- they're politicians on both sides of the aisle. And so let's address that and let's pay our bills and do something that's just a little bit common sense putting this State back in order. Thank you.

First of all, I'd like to say that I generally agree with the comments made by Senator Tracy and Senator McCarter. I think they make a lot of sense. However, having said that, this proposal, if I understand it correctly, makes all kinds of common sense that we ought to all be supporting, whether Republicans or Democrats or - - or whatever. It -- it sounds like a very intelligent plan that a son or daughter of a smart banker would come up with. I don't know. But let me just make sure that I understand this. If -- if I understand it, what this is saying is, if we have some allocated segregated funds in account A, I don't care if it's for DNR or whatever it's specially set aside for, while it's waiting there, instead of investing it at maybe one percent interest, we borrow it from ourselves, more or less, and use it to pay down our bills and we keep that twelve percent interest, instead of paying that twelve percent interest to the retired politicians that Senator McCarter was referring to. Senator, is that -- am I correct in my understanding of this bill?

Why wouldn't we support that? I can't understand why there would be opposition on that. I absolutely agree. It is a no-brainer. I understand the frustration with the Prompt Payment Act and how we're paying such high interest rates. I would support that. I've had CMS tell me they don't -- they think we would lose out group health vendors and whatnot if we did that right now. They could not support that. This we worked with them on and they're at least neutral, if not supporting this bill. I think it's a great alternative to reduce the cost to taxpayers on that interest that we're paying in a way that makes a lot of sense and really appreciate the Treasurer coming up with this solution. Thank you, Mr. President. This bill does -- amends the Department of Human Services Act to do two things. The first is, this -- when there's a -- an investigation and it's substantiated, this -- the report is shared with the accused. This allows the Department to share that same report with the victim and also the -- the victim's guardian. Secondly, what this bill also does is it -- it -- it permits the Department to share an unredacted copy of the report with local law enforcement without a subpoena. Currently, local law enforcement has to issue a subpoena. This cuts down on that administrative burden and -- and streamlines the process for local law enforcement in continuing the investigation from -- after a substantiated finding. There is no known opposition to the bill and I would ask for an Aye vote.

Thank you, Mr. President. Senate Bill 2889, as amended, would allow FDA-approved prefilled syringes, epinephrine syringes, to also be used in our Epinephrine Auto-Injector Act. This will help us save lives. As many of you have read the accounts of -- of how expensive the auto-injectors have gotten, a prefilled syringe is about five bucks compared to a six or seven hundred dollar EpiPen, and so this will help us get more lifesaving medicine in the hands of people and they do have to be FDA approved. We have events scheduled all the way from a Route 66 motorcycle ride, a celebration dedication at the Jackie Joyner- Kersee community building. We are promoting agriculture, literature, history, technology, innovation, art, and architecture. Go to the Illinois Bicentennial Commission page and you'll see all these things. And it culminates with a birthday party on December 3rd, 2018. I see no purpose in -- in taking away from the Executive Order that's in place. I think that this -- this measure is really important, because, to be perfectly honest with you, I am very disappointed in the way the State has handled -- in the celebration of the one hundredth-year anniversary -- two hundred anniversary. Last year, I was asking the Senate President, where -- "Where's the schedule? What are we supposed to do?" I thought maybe, maybe… And, Senator Manar, again, I have met with many individuals with regard to this proposal, this piece of legislation, as the request was, is to include more labor participation. We have offered. I have done several things individually with regard to recognizing not only the labor organizations and the labor movement here in Illinois, which is extraordinarily important, but also have offered to work very closely with them on a historic site, Pullman, which was the beginning of the Black labor movement. We've made many concessions. We've tried to do those kinds of things. The Commission has been in existence for six months, formally, through Executive Order. We have many events planned. I would, again, welcome any opportunity, as I serve as one of the Commission members, I would welcome any opportunity. But to begin anew when the celebration is actually scheduled for our anniversary, which is in December, which is really a mere seven months away, I think is probably out of order. And, ultimately, we can -- be happy to work with all of those organizations and wrap them into what already exists. I offer that assistance. But I would respectfully ask that the Body understand that we've already expended huge amounts of resources, both in human capital as well as financial, and let that continue to work, and come forward and we'll do what we can without creating an entire new entity. Senate Bill 2925 is the -- is the SRO's legislation that creates the school resource officers and establish them as police officers that are stationed inside our schools and trained properly across the State. I know that we've been having some scares across the country as it relates to school safety, and this would definitely be a measure that would allow our schools to be better protected. There was a lot of negotiation that took place on this legislation. All opposition was removed. I want to thank the Shriver Center, the lead attorney there, Michelle, who did a magnificent job on bringing all parties together, and all law enforcement, who were participants in this matter to make sure that we provided for NASRO training. We included social-emotional learning, making sure that the officers are trained in the areas of mental health, and many other concerns that were brought forth by Senator Connelly and Koehler and McConnaughay. We took all of the Members' suggestions to heart and crafted what I think is a really good forward-thinking piece of legislation that will provide another safety measure in our schools. And I -- and -- and I'm not one of those that's -- I don't smoke, I don't promote it, I - - I don't think it's a good thing, but at eighteen years of age, you should be somewhat responsible in ability to make the decision as to how you're going to live your life. If you can make a big enough choice as to whether you're going to serve our country and give -- and -- and -- and possibly even give your life for our country, you should be able to make the decision to whether you're going to smoke or not. So, as much as we want to care for people, show them that we care, we, as government, just cannot change everything. And this is one of those times where we need to step back and say "let people make their choices". And I think -- you -- you think about the changes in our culture over the last thirty years, things have changed. People don't take big buckets of trash and throw them out of your car, because if you do, the next guy next to you is going to show you road rage. If you light up a cigarette in the -- in the elevator or in this building, people 81 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 115th Legislative Day 4/25/2018 will look at you like you're crazy. When seatbelts came out, you had to actually weld them into the car. Nowadays, if you get in the car with your kids and you don't put your seatbelt on, they won't start the car up. Now that's kids telling parents. So the culture has changed. And I think we all know the dangers of smoking, but, at eighteen, a person is able to make that decision on their own and -- and -- and I, for one, am not going to make it for 'em. I urge you to vote No on this bill.

You know, I -- I -- I listen to a lot of these arguments and I have for a long time, about they're old enough to go in the service, I agree, but the point is, is even the -- even the military is curbing the idea of cigarettes. Yes, in World War II, they used to give packs and cartons of cigarettes to the men and women that were fighting. They don't do that anymore. Times have changed and acceptance of smoking is not there anymore. And we have stopped it in public places and this State did it, one of the most restrictive bans in the United States. But also what we want to do in this bill is very simple: Start 'em early -- stop 'em early. And that's what we're doing, is stopping them early, at twenty-one, because what we did -- when the previous speaker said we -- we -- government shouldn't get involved, we get involved in a lot of things and thank God we do get involved, because I don't 82 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 115th Legislative Day 4/25/2018 like the "Wild West". I don't like the times when everything is open. Government should get involved. And in this particular case, the number of lives that we will save in the future will be astronomical, because we will stop individuals from starting at a young age. I wish that we could put a ban permanently to save the lives in this State, and we haven't done it yet, but I think this is a good step forward to make sure that these young men and women do not start smoking at an early age. I do this for my grandkids and your grandkids and your kids to make sure that their lives are healthier and safer for the future. I commend Senator Morrison for doing this bill. It's long overdue. And actually everybody should be voting in favor of this. Thank you.

Smoking is an addiction and a burden on our society. This legislation will effectively start to stem the flow of tobacco products to 83 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 115th Legislative Day 4/25/2018 fourteen-, fifteen-, sixteen-year-olds, whose supply chain, quite honestly, is the eighteen- and the nineteen-year-olds. This is an important measure to try to change the next generation's health, Senator.

So can you list some of the other things that we've drawn a line at for twenty-one, because I can only think of a couple. Generally speaking, we draw a line saying as an adult -- you're an adult, unless it has to do with drugs or weapons, so… And I'm -- you know, alcohol, possibly marijuana, which are things in which we are concerned about someone in way -- the way in which they will affect other people, drinking and driving. This is a - - a health risk to others. So, again, I'll come back. You indicated your concern about eighteen-, nineteen-year-olds and this pathway to fourteen, so why does it go all the way to twenty- one, given the fact that the other lines in which we draw for twenty-one have to do with danger to others?

Senator, twenty-one is -- we're trying to stop the social connection between fourteen -- between those people eligible and old enough to buy and those who just want to use. They also think twenty-one is the right age. I can tell you that the -- the current law doesn't do much to 85 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 115th Legislative Day 4/25/2018 dissuade teenage smokers. What we have found to be effective is to raise it to twenty-one and to put the emphasis instead, the responsibility, on those people who are selling and vending those cigarettes and those tobacco products to the young people. Let's put the responsibility on the people making the money. Let's look at some of the factors that Big Tobacco has incentivized.

The first thing is that this eliminates penalties for underage smoking. So, if we're talking about wanting to provide incentives for people to not smoke -- currently, it's the case that if an officer sees someone who's obviously under the age of eighteen smoking, they can interject in that situation. We're removing those penalties. Okay? So if you want to vote for removing penalties for underage smoking, this is a -- a bill that will do that. Secondly, I want to talk about the fact of what adulthood means. Becoming an adult, reaching the age of majority, means a number of things that you're able to do. As previously mentioned, you can join the military, but also you can get married, you can have a child that you're now financially responsible for, you can buy property, borrow money you can afford to pay back, essentially make all sorts of decisions that are personally problematic, potentially personally destructive to you. 86 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 115th Legislative Day 4/25/2018 And while I would entertain a bill that would prohibit smoking entirely, I'm very wary of drawing a line in the sand, especially at something that is not an -- a danger to other people - Right? This is -- this is something that someone is choosing to do to themselves - saying that we do not trust you at age twenty or at age nineteen to be able to make an intelligent decision on this, yet, you know what, you're intelligent enough to be able to decide who's going to be President of the United States. Well, I do not believe we should begin bifurcating adulthood in this manner. If we want to change the age of majority to twenty-one and say, you can't smoke, you can't drink, you can't do these other things, you also then can't vote. Because if you can't make a smart decision on this, given everything that's out there in the culture, then I don't -- I believe that -- that we should actually change what adulthood is here in the State of Illinois. Ladies and Gentlemen of the Senate, this is a public health measure. It's not a -- a liberty at all costs bill - or that's the argument against it. It's a public health measure. Tobacco products have been shown to be highly addictive, highly addictive, especially for young people, just as alcohol is. It may be more so. So, therefore, the State has a reasonable interest in assuring 87 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 115th Legislative Day 4/25/2018 public health among its young citizens. And the fact that somebody can go in and vote at eighteen doesn't mean that the State can't restrict their supply of unhealthy, dangerous substances between eighteen and twenty-one. The hallmark of the law, Louis Brandeis, the Justice of the Supreme Court, once said, is "reasonableness". Reasonableness is taking a highly toxic, highly addictive substance and restricting its distribution among those of the population that are most vulnerable. To argue that, again, they are free to make a decision to join the Army or to vote, misses the point. The -- the point is that we are restricting their access to a toxic substance, which will give them a longer life of voting, will make them a better career soldier than if they started down a road of cigarette smoking. In fact, General Randal Thomas has indicated to me that he strongly favors this type of approach. He is a -- he's familiar with those problems with young recruits who have started smoking. And the studies indicate that, as the Senator aptly put it, the distribution change -- chain is from eighteen to twenty-one down. And this substance is highly publicized. It's -- it's made attractive and it's being promoted, and frankly, it tastes good, especially if you're an addict. Now, the last point I want to make, Mr. President, I appreciate very much Senator Morrison taking out any sanctions to young people. We don't need another negative collision between the police and our youth. She's attacking this from the distribution angle, which, again, is most reasonable, not in rounding people up and arresting them on the street corner, and it puts the State on the side of those responsible parents who wish to tell their children, this is a toxic substance, even the State bans its sale to you, and that's the nexus of this bill that, in -- in my view, makes it 88 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 115th Legislative Day 4/25/2018 a public health measure for all of our citizens, which is -- should be one of the primary duties of the State. My entire district borders Iowa. People already go over there to buy gas anyway. They're going to go over there. They're going to -- they're going to purchase tobacco and they're going to come over. So, again, with -- and I mean this with all due respect, I -- I -- I understand what you're trying to do and I have a lot of respect for you, Senator, I just think that this -- this isn't quite cooked yet. First, like to make a -- a couple of comments about smoking, as a former smoker. For anyone that has never smoked, let me make this clear. When you have a cigarette, it don't taste good, never does, but you become addicted because of what it does to your brain. My mother died at sixty-nine years old in 1999. By that time there was some method -- some things that had been done to 91 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 115th Legislative Day 4/25/2018 curtail smoking. I remember when she said to me, "How am I going to fly to Denver without a cigarette?" Since my mother died from emphysema, where she could walk from here to a bench about where Senator Morrison is because she couldn't quit - she tried many times - we've made it easier for people to quit smoking by different help that's out there, by changing laws. I was still a smoker when my mother died. After that, I remember walking into a bar in San Francisco and thinking, what the hell am I doing in here if I can't have a cigarette while I'm having a drink? And then the laws continued to change. I couldn't smoke in restaurants. I couldn't smoke in public places. So, for a smoker, some of those breaks in smoking make it easier for you to start thinking, maybe I can quit, 'cause I didn't smoke for two hours. I didn't have my cigarettes in my hand. So we've made it a little easier to quit smoking. I don't think there's anyone in this room can argue with me that we know the manufacturers of cigarettes put addictive materials in smoking material to create addiction. Doesn't just happen. They wanted it to happen. Three out of four teenagers under eighteen that start smoking, continue to smoke into adulthood. It is time for us to make it harder to start smoking. And if you want to argue about the brain development, when someone really is an adult, let's read that. And we know cognitively the brain really isn't an adult till we're twenty- five. I'm all for changing it to twenty-five for someone to join the military. Do you want to join me on that? What I am saying is these are children. I was sixteen when I started smoking and I can damn well tell you it was somebody that eighteen -- was eighteen that bought the cigarettes. Now I'm fortunate. I quit before my father died from cigarette smoking. I'm proud to say 92 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 115th Legislative Day 4/25/2018 I'm a nonsmoker. I will never smoke again. You think you do it because it tastes good. Why don't you go have one? It's absolute addiction. It's not like drinking a bourbon. It's not like drinking a glass of wine. It's not like drinking a glass of beer, which we can all argue there is alcoholism and there are people who have serious problems with substance use. Everyone who starts smoking will become addicted. That is a fact. My county, many of my municipalities, I'm proud to say have taken a position and said, no one can buy tobacco under twenty-one. I urge you to join me and do something. Do something. Let's tell children, because they are, that are eighteen and that are under eighteen years of old -- under eighteen years old that we're not going to let them buy something they will become addicted to and most probably die from. So I'm more than happy to step over that line and I -- I just urge an Aye vote and I thank you for bringing this and I'm really proud that I live in a county where most of my municipalities said, our kids matter. But if they know that they're going to get in trouble for smoking, they're going to think twice about starting to smoke. The idea of sending the message out that you can smoke now, you can smoke in front of your -- in front of the -- the police, you can smoke in front of your friends, you can smoke at any age and not be held accountable for it, then there's no -- why -- why would -- why would a young person not want to do it? Because my guess is, there's a lot of people that don't start smoking because they are afraid, like I did with my kids, you get caught smoking, you're paying the fifty dollars and you're going to do the twenty-five hours of community service. That's not going to break an individual. It's going to send a message to that individual - if you're going to get caught smoking, you're going to do community service. And at least they know that it's illegal. Under this, when you're not making it illegal and these kids are allowed to smoke, where's the incentive for them not to smoke? All they have to do is try to get it, just like they do with illegal drugs, except for with drugs, if they get caught with possession of it, there's consequences for it. So why, I guess, is the -- the question, why are we taking out any sanction or any penalty to send a message to young people that this isn't appropriate behavior?

The statistics that have been provided to me by the American Lung Association and all the health advocates that are promoting this legislation indicate that simply having a fine is not a deterrent for the eighteen- to twenty-one-year-old. It's -- it's a -- it's a resolved fact.

Thank you, Mr. President. I'll wrap it up with this. We know that consequences to actions have a difference. That's why we have rules in place. That's why young people know if they're going to drink and they're going to be -- and they're caught, they're going to be held accountable. If they do drugs, they're going to be caught and they're going to be held accountable. If they possess guns, my gosh, we're talking about passing all these gun rules that give penalties for people, including young people, that have guns, instead of saying, you know, let's just -- let's blame somebody else for that. Consequences are what drives a lot of behavior, especially for young people, and the -- the fear or the concern of being caught and the potential of -- of being penalized is -- does have a factor. And for these people who say that -- that the fact that getting caught is not a -- a factor or the concern of getting in trouble or having your parents called or being scared by a -- a police officer that's calling your parents does not have an impact on -- on kids, I don't think had -- had 96 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 115th Legislative Day 4/25/2018 children, and I think we're going to rue the day that -- that if -- that we're going to eliminate any penalties for young people to smoke. As Senator Anderson said, I live along the border. They're just going to go to Wisconsin and buy it and now they're going know for sure that they can smoke it and they can't get in trouble and their parents aren't going to find out, and this is going to create I think more of a problem in the long run than -- than not. But, again, I appreciate the opportunity to share my concerns and, again, I understand what you're trying to do. I just think that taking out the penalties is a mistake. Thank you, Mr. President.

Thank you, Mr. President, Members of the Senate. I rise in support of this bill, this measure. There are so many reasons to support this bill, both publicly and privately. The true fact is, cigarettes kill you. That's the main reason we want to stop people from smoking. And on your way to your death, which is a miserable death that leaves you gasping for air, cigarettes will destroy your vital organs, like your heart and your lungs. So if that's not enough, there's plenty more. Think about the cost to the individual. These packs of cigarettes cost twelve to fifteen dollars a pack, and if a person smokes a pack or two a day, it costs that individual four thousand to eight thousand dollars of their hard-earned money that they use while they're killing themselves. So I think we should do everything within our power to prevent that. The -- probably the most compelling reason for me to stand up today, though, is, if you talk to smokers, they will tell you that they wish they never started, because it's so 97 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 115th Legislative Day 4/25/2018 addictive. And the magic number, twenty-one, it's evidence-based. The evidence is that you -- if you don't start smoking by the time you're twenty-one, it's unlikely that you will start, in addition to the access issues that have been -- been already raised. Regarding the military, I want to protect our military members who serve us, serve our country, as much as I want to protect the civilians in Illinois. And there was a speaker ahead of time -- or earlier on that said we can't change everything as a government - and that's true - but when we have the opportunity to save people's lives, to save people's money, and to save our government two billion dollars - two billion dollars - related to health care costs attributed to smoking cigarettes, we should do it. And I'd ask for everybody to vote Aye.

Mr. President, we -- and Ladies and Gentlemen of the Chamber, we've already had a lot of debate on this bill and obviously there's disagreement on how people will vote on this bill. However, I don't think there's disagreement on a lot of the underlying elements about why this bill is being brought. I don't think there's disagreement with regards to the health effects of smoking and I don't think there's been a speaker today that has disputed the health effects of smoking -- of smoking. I don't think there's been a speaker today that's disputed the -- the cost to taxpayers in -- in terms of what we have to invest in health care as a result of smoking. I don't think there's been a speaker today that has disputed the addictive nature of smoking. And I don't think there has been a speaker today that has disputed the notion that brain development doesn't fully occur until beyond twenty-one. There has been dispute as to penalties and the effect of whether or not you have penalties. What we do know is that municipalities have enacted this and it's worked. Nobody's disputed that. So if you were wondering whether the penalty 99 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 115th Legislative Day 4/25/2018 question is the linchpin to this, the proof is in the pudding. It's been enacted by municipalities and it has worked. It's been said it's distinguishable from other things where we draw the line at twenty-one - such as alcohol, because of how alcohol affects other people. What we do know is that the source of cigarettes to young people who smoke are other young people who smoke. So it does have an effect on younger people by limiting the access at twenty-one, because your supplier becomes your peer. And certainly we know about secondhand smoke, so it does have an effect clearly on other people. So you can't distinguish between alcohol and cigarettes on this notion of whether it has an effect on other people, because it -- it clearly does. And with regards to addiction and with -- with regards to people who are addicted, there's overwhelming evidence that they become addicted at a younger age. We've all embraced policy with regards to tobacco to not -- to make sure that tobacco products are not targeted towards younger users. We've banned flavored tobacco, because we've all agreed overwhelmingly that that's not in the interest of protecting our younger people from -- from use, because we know of the addictive nature of tobacco. With regards to those of you-all on border states, sometimes you've got to be a leader. Right? There was a point when I was young - I still am young, but, you know, when I was younger - when the age of obtaining alcohol in the State of Illinois was twenty-one, but you could go across the border to Wisconsin and it was eighteen. Guess what? Wisconsin followed. They changed because they knew that it was in their interest to raise the age up. So perhaps Wisconsin and Iowa will -- will follow, as we are following municipalities who have done this and who have demonstrated that it works. But I'm also happy to see that we have removed some of the penalties, because I know in my district how cigarettes are sold and how people go over to Indiana, bring over illegal cigarettes and sell it in my community. But I do believe this bill will urge young people to think twice about picking up a cigarette. And just for that reason alone, we should see all green lights on the board. There should be no No votes on this bill. I urge your Aye vote on this bill.

I have inhaled the smoke of the Iskandariya smokestack, the burning tires of the Taji disposal on the side of the expressway, 101 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 115th Legislative Day 4/25/2018 and I have probably inhaled more smoke and fumes from a burn pit in Iraq. I will probably become a statistic within the Veterans Administration in terms of people that may have respiratory problems, but that's okay. But some of the comments that have been made today in terms of military readiness -- I had the opportunity to sit with four generals that have retired from the -- the Army, and one of the biggest things that we say in the Army is, smoke 'em if you got 'em. And not everyone breaks open a pack of cigarettes. It's just a -- it's a form of speech that says, just let's kind of tone it down and relax a little bit. And probably the greatest concern that I had was three years ago when these general officers told me that seventy-one percent of the thirty-four million seventeen- to twenty-four-year-olds do not qualify for military service because of health and physical appearance and other issues. The U.S. Army and the other military services throughout our country are debating whether or not to expand basic training because our recruits are out of shape and they don't have the ability or capability to serve. To me, that's a national security concern. So, I understand that a -- an eighteen-year-old can go ahead and pick up a M4 and go to combat in Iraq or Afghanistan and I understand that they're not able to drink or smoke while they're in the United States, but I -- I truly believe that in the best interest of our country and the best interest of our State, so that we have people that are in shape that are willing to fight for our country, this is a great law. And I -- I want to commend the sponsor. I look back to the history of the drinking age and why we actually raised the drinking age from eighteen to twenty-one. Besides the fact that we were going to penalize states ten percent in their federal highway funds - 102 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 115th Legislative Day 4/25/2018 that's always a great incentive for states to do that - sixty percent of all the traffic-related accidents in the 1970s were alcohol related. When we changed the law in 1980 -- in the 1980s, the drunken driving accidents have decreased by fifty percent to thirty-seven percent. Now I was kind of debating whether or not to vote for this bill or not, and based on those statistics and the fact that this is a public health concern, I think it's absolutely necessary that we bring this bill. Last, I want to talk about a young man named Ian Piet in my district. Ian Piet had lost his father to lung cancer. Ian Piet has been though the trials and tribulations of -- of putting up with bullies, not having that father figure there to reinforce what it -- you know, what it means to stick up for yourself, what it means to defend yourself, what it means to do all these great things. If Ian Piet had his father today, I am convinced that he would not only be better than he is today - he's an awesome kid - but I think their family would be better off and I just wish that if this law was in place twenty years ago or thirty years ago when people like Ian's dad and his friends decided to smoke, maybe Ian would have had a parent. So for that -- for those issues, I urge an Aye vote. And normally, for these issues, I wouldn't vote for something like this, but this is so important for our State, so important for our country, I think it's important that we do this now and set the example. I live in Evanston which was the first municipality in the State to enact a Tobacco 21 ordinance and that was several years ago and we've had some time to evaluate what happened. And what happened is very, very simple. On the one hand, no one minds, the community's not up in arms, people aren't fleeing for other communities that don't have Tobacco 21 ordinances, but on the other hand, incidents of smoking in Evanston Township High School is down thirty-seven and a half percent. There are a lot of lives at stake. Please vote Yes.

Well, Mr. President, Members, I would like to thank you for a vigorous discussion on a bill that I think's very important. We are often asked to carry different kinds of legislation and we all, in our own minds, have to decide which ones we want to prioritize and give our energy and our time to. Hank Jones started smoking when he was fourteen, and by the time he was fifty-seven years old, he was in a nursing home on oxygen in 1990, gasping for breath. The best part -- the most merciful part of his lung cancer was when it finally metastasized into his brain and he was no longer aware of the pain he was in and the morphine finally was able to take over. So I held my dad's hand when he died when he was fifty-seven. I wish there had been legislation like this beforehand. This allows the Illinois Math and Science Academy to admit non-Illinois students who have completed the academic equivalent of eighth grade and it also allows the Academy to charge tuition, fees and costs associated with room and board to non-Illinois residents. IMSA, it's a -- the flagship school in our State, taking extremely gifted children in math and science from grades nine through senior year. We are 107 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 115th Legislative Day 4/25/2018 expanding that to now come after eighth grade so they are an equivalent of the other high schools. IMSA has always been unique, in their funding has come from the Higher Ed budget. When we decimated Higher Ed by only funding it at thirty-three percent, we nearly lost IMSA. So what IMSA is doing by expanding to take non- Illinois students is going to allow us the ability to charge a tuition that will cover those students in addition to covering the Illinois students who pay a nominal fee. So this basically is now going to keep IMSA as -- as the flagship school it is without causing the problems that would have happened had we done what we were already doing to the Higher Ed budget. And to have lost the ability to be educating these brilliant students would have been a horrible thing to do in Illinois. While we're doing this, we are going to maintain that at least seventy-five percent of IMSA's student body will still be Illinois residents. Only twenty-five percent can come from outside of Illinois. So this is a way of having them be more self-sufficient and able to fund themselves and less dependent on the State. I would ask for an Aye vote.

It also provides that all permanent inside signs, tap handles, and similar items are property of the associated manufacturer or distributor and must be returned upon request. It also increases the two thousand per manufacturer cap on permanent inside signs in place and in use at a one-time six thousand per manufacturer. Additionally, the bill increases the three hundred and twenty-five per manufacturer cap on temporary inside signs to a thousand per manufacturer. I'll answer any questions.

For instance, a brewery in Michigan, licensed as a nonresident dealer, would sell their beer to an importing distributor in Illinois, even if that brewer also operated a manufacturing facility within Illinois and that product from the nonresident dealer will be shipped to the facility of an Illinois importing distributor. After that, it will be available to -- for resale to Illinois residents. This ensures that the product is making its way through entities who are licensed by all -- by the State of Illinois, all 120 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 115th Legislative Day 4/25/2018 appropriate tax is being collected throughout the process, and there is a means to tracking the product in the event that there is a product recall. So we're creating the Law Enforcement Partnership for Deflection and Substance Use Treatment Act {sic} (Community-Law Enforcement Partnership for Deflection and Substance Use Disorder Treatment Act). The intent of the Act is to authorize law enforcement to develop and implement a deflection program in Illinois that offers alternatives to traditional involvement in the justice system by creating immediate pathways for substance use treatment and other services. I know of no objections. I'm very happy to have had Senator Biss -- excuse me, Senator Bivins - boy, that was like not even close - as my chief cosponsor on this bill. We both have programs within our districts. Mine is called "A Way Out" and, I'm sorry, I don't remember the program in -- in your area, but these are both deflection programs that have worked very well and we're just looking for a way to replicate this across the State. Thank you, again, Mr. President. This bill attempts to resolve an age-old issue that's been swirling around Springfield for the last ten or fifteen years. It involves retainage. Retainage is an amount that is withheld by the owner from contractors or subcontractors after they've completed their work. Typically, it's ten percent from -- of a subcontractor or contractor's bill after they have completed their job, notwithstanding the -- and they -- and that is withheld until the complete -- the job is completely done, and that, at times, can take up to a -- a year and a half or two years. An example would be a contractor or subcontractor who digs the hole -- or tears down a building and digs a hole before a foundation can be laid. Their job is one hundred percent complete early on in the -- the job, but they are not going to pay the -- be paid a hundred percent of their bill until the job is fully completed, which could be a year and a half or two years later. Example, the -- the job -- or it costs ten thousand dollars. If they bill ten thousand, they will only receive nine thousand, even if they paid out ninety-five hundred to ninety-seven hundred dollars in wages, labor, material, or for…(inaudible)… So what this bill does is -- and we've had multiple attempts to this. We initially tried to cap retainage at five percent. What this bill does is cap retainage at ten percent, 129 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 115th Legislative Day 4/25/2018 which is the industry standard, but it would require the owner to release fifty percent of the retainage when fifty percent of the job is completed, so there will still be retainage of five percent until the job is fully completed, but the workers, the subs, or the contractors that completed their work would be paid, you know, the five percent that was withheld of the ten percent. With that, I'd be happy to answer any questions.

This is something that there -- that there is opposition to. I would add -- I would respectfully ask for a -- for a No vote on this one.

If I could just address that. The owners have -- they state the retainage amount and they control when the payments are made, notwithstanding the fact that somebody has a hundred percent completed their job. So, basically, that retainage amount is nonnegotiable and I think it's good public policy to pay people once their work is completed. And we -- we're not disrupting retainage. We're just reducing it after fifty percent of the job is completed. I ask for your Aye votes.

Its aim is to combat what I would say is a pretty extreme brand of workplace sexual harassment that's occurring right now, particularly at Cook County Jail. It's a growing phenomenon of -- of male inmates exposing themselves to female staffers and engaging in various forms of lude behavior. Been almost seven hundred of these such incidents in the last sixteen months. The aim of the bill to -- to reduce this behavior is to say that if an inmate is found guilty of this kind of behavior on two occasions, that they then would become eligible for placement on the Sex Offender Registry when they're released from custody. Be happy to answer any questions and I'd ask for the Chamber's support.

I think this is a -- a very good start to the problem that we're having with correctional facilities, but I'm just a little concerned because I don't see the -- the fact that juvenile justice is included within this. Could -- could you expound on that, please?

135 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 115th Legislative Day 4/25/2018 Certainly. You make a good point. This is happening in correction facilities outside of Cook County Jail. It's happening throughout the State. Juvenile Justice facilities were specifically exempted from this effort because of the remedy, because of the sanction, which involves putting someone who's found guilty of two offenses on the Sex Offender Registry. Juvenile offenders, obviously, are not eligible for placement on the Sex Offender Registry, so that didn't work out for this particular piece of legislation. But I agree with you, this is a problem elsewhere and one that we need to find remedies for too, in regards to juvenile detention facilities.

Thank you, Senator. I -- I agree. I -- again, I -- I applaud this. I -- I do know that having one of the largest juvenile facilities within my district and all -- there were correspondence that I received back from staff about the concerns with sexual lude acts within the facility, and its being called acceptable is -- is unprecedented and we have to take measures to include juvenile justice within this. I would -- I, again, I applaud your efforts and I will support this; however, I think it's imperative that we work toward a better juvenile justice system as well and teach these youth that this is not acceptable in a juvenile system. So I would love to be able to work on some form of initiative with that along the way, because I think we all know that -- maybe -- maybe we not -- not all not know, because of all the -- I receive these reports from my facility of all these occurrences that are happening and it's -- it's devastating to me to hear this and -- 136 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 115th Legislative Day 4/25/2018 and to be performed in front of -- in front of the staff is unacceptable. And there's probably more in a juvenile facility than there actually is in the Department of Corrections. So I think this is an initiative that we need to work together on and try to include them in this so we can, you know, improve this lude behavior. Thank you.

Furthermore, the bill mandates that the Department allows a license applicant to use a taxpayer's identification number as an alternative to social security number. Senator, I just -- I just want to confirm. My understanding is, this bill would encourage the State to issue licenses even though people are here illegally. Is that correct?

What this bill does is actually give the Department the right to go ahead and issue these licenses, which they are already doing right now. They have been doing it and we just wanted to make sure that it goes across the School Code, the Attorney Code {sic} 139 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 115th Legislative Day 4/25/2018 (Act), and also the -- the -- the Pharmacy Practice Act. But right now they are being -- they are being issued licenses by the Department. They've been doing it for many years.

Senator, I have to ask, you know, why should we encourage the Department to issue licenses to people who are here, breaking our laws? They're here illegally.

Thank you. Many of these students are through the DACA program; that, right now, they are eligible to go to college and -- and -- and receive their degrees. Why are we educating them and then sending them off to other states? I think, right now, the way it has -- has -- the -- the -- the way everything has been through the Department is that they do issue these licenses, except we want to make sure that they can actually use a ITIN number that they can actually check to make sure that they're paying their taxes and that they're paying child support or any other things that are -- that are due to the State. So this is another way to making sure that they're doing the right thing by paying their taxes, but we should not be denying their licenses, especially if we are educating them and giving them they're -- they're -- they're certification or diplomas at the end of their education years.

I -- I believe the Senator has -- has hit on a very important issue. It's really a federal issue. We need to resolve the legality of people who are here illegally, who should be allowed to have citizenship? The -- the DACA group should -- who should be allowed to achieve that citizenship, under what basis? But until we resolve that federally, I'm opposed to making it easier or more beneficial to people who are here illegally. So I urge a No vote.

Let me -- let me just answer that by saying that federal law clearly allows each state to run its own professional licensing, including this issue. So we have been doing this. These are individuals that have been here, went through our schools, or are here even on visa, actually getting these professions. We don't want to keep losing our -- our young men and women that we have educated all through the years to other states. These are professions right now that are so in -- in -- they're so important to us, as these professionals graduate from their prospective classes. So I want to make sure that it's -- that we're not doing this to illegals with the way you call them. These are undocumented students that are under DACA or these are students that have come in, that they've been allowed to study in our schools here, in our universities, and now are able to get a license, but there's a few of them that have not been actually confirmed with the rest of the other codes. We just want to -- want to make sure that the Pharmacy Code {sic} was included and the Attorney Code {sic}. We've done this before. We just want to make sure that we are able to allow the Department to go back through the status, since they don't have social securities, they can actually check the ITIN numbers, make sure that they are paying their taxes, make sure that if they owe student loans or they owe child support, that that's another way of making sure that these individuals that we are giving the licenses to are actually abiding by the rules of the State.

Thank you, Madam President. 3115 requires the Department of 143 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 115th Legislative Day 4/25/2018 Human Services to begin, on October 1 of '18, gradually increasing the maximum benefit levels provided by {sic} TANF -- recipients so that beginning October 1st of 2021 and each October 1st thereafter, the maximum benefit levels shall be annually adjusted to remain equal to fifty percent of the most recent U.S. Department of Human Services -- the federal poverty level guidelines for each family size. This bill also requires that the TANF families' grants for child-only assistance units to be at least seventy-five percent of grants for assistance units of the same size that consist of a caretaker relative with -- with children. And I would ask for an Aye vote.

Thank you for that question, Senator McCarter. We estimate that the first year the cost will be fourteen million dollars and the Governor's proposed budget reduces TANF funding by twenty-nine million, based on a decline in the caseload. So instead of taking 144 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 115th Legislative Day 4/25/2018 all of that funding away from TANF, we should reinvest half -- at least half of it into increasing the amount of the grants.
PRESIDING OFFICER: (SENATOR LIGHTFORD) Senator McCarter. SENATOR McCARTER: To -- to the bill. The -- the estimates that I have are over a hundred and forty million dollars on the next three years and if I add this to -- I think yesterday you proposed, which was eight hundred million, we're nearly an increase of a billion dollars. And so, if we just continue to say we're going to give more and more and more without, one, having that factored into a budget that's on the Floor that we can all agree on, which, by the way, there's no reason we shouldn't come up with a budget by the end of the -- in the time period that we have and -- and -- by the end of May. We've got more money than we've ever had. We've taken more money from the -- from the taxpayers than we've ever taken and there's no reason. Now the only reason we would not come up with a budget is because it would be political. So we -- there should be a budget. But to continue to add millions of dollars, hundreds of millions like this, is not the way to turn this State's finances around. And as much as we want to be caring and loving and giving, we have to live within our means, just like the people that we take our tax money from every day. Thank you. I vote No.
