…Madam President. Senate Resolution 1153 urges the U.S. Congress to support funding for research of Lyme disease and to further provide {sic} (promote) awareness of the effects of this disease. We further allocate {sic} May 1st as Lyme Disease Day, because Lyme disease is a bacterial disease transmitted by infected ticks. It was first recognized in the United States in 1975 after a mysterious attack of arthritis near Old Lyme, Connecticut. Since then, reports of Lyme disease have increased dramatically, and the disease has become an important public health problem. The Center {sic} (Centers) for Disease Control and Prevention states that reported Lyme disease cases are numbered at thirty thousand a year in the United States, but the actual burden of Lyme disease may actually be as high as three hundred thousand cases per year, and that's because this disease is so difficult to diagnose and detect. The signs and symptoms of Lyme disease can vary greatly from one person to another. They can vary with length of time a person has been infected. The initial symptoms of Lyme disease are similar to those more common diseases, such as the flu, cough, mononucleosis, and many other -- infected persons that do not recall having the tick bite. Further symptoms develop over time and can eventually lead to death. His daughter, he has a son- in-law that had it, and they both are infected by Lyme disease. He came from West Virginia and a coal mining family and has settled in Illinois and is really an advocate to make sure that every branch of government is aware of this disease, puts the amount of funding towards this disease, so that we can help battle that and help his daughter. This bill raises minimum penalties for coming into a church, a mosque, a synagogue, or a place for religious worship armed with a weapon of some sort, particularly a firearm. The -- the case -- the -- the matter came to me through an Edwardsville police officer, who was a member of a church, a Baptist church in Maryville, where the pastor was murdered in front of the congregation on Sunday morning, shot to death by a deranged individual, who didn't know the pastor, as a matter of fact. And this mirrors somewhat that terrible -- those terrible murders in 20 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 117th Legislative Day 5/1/2018 South Carolina of those four {sic} individuals in that small Baptist {sic} church by a man named Roof, who's now on death row, where he ought to be, and -- although the one in Maryville did not have a racial component, as South Carolina did. It adds the aggravating factor to murder of a -- someone going into a church with that evil intent. And that's basically what the bill does.

The whole objective of this process, which Senator Syverson and I have been -- we've been having many, many, many conversations and meetings, is to improve, expedite, and make the application for Medicaid and the redetermination process more efficient. As I said, Senator Syverson, House Members Hoffman and Hammond, our staff, the financial institutions, and long term care associations have been working with us. And specifically, this bill, the architect of the form that we've created, a statutory form, was -- heavily involved was Steve Olson from the Credit Unions. …Madam President. Senate Bill 2386 creates a distinction of a "reckless dog owner". So I have to give you the history here. So I have a constituent whose neighbor's dogs broke loose and came into her garage and killed her Yorkie Terrier. So, unfortunately, I'm finding it's more and more common that this occurs, that a dog kills. And it's not really the dog that is the problem; it's often the owner that has trained this dog, or not trained the dog. So this creates a category of a reckless dog owner. It provides that the dog will -- has to be declared dangerous - and this is already in statute - a dog is declared dangerous upon a kill. If it violates again and is declared -- in a dangerous dog act, then it will be removed from the home and the owner, after due process -- the dog gets due process, the owner gets due process, then the dog can be removed from twelve to thirty-six months, depending upon a judge's decision. This covers, I believe, everybody's issues and concerns. All of the people that advocate for dogs have been involved in this discussion for a two-year period of time. And I believe we've answered all of their questions and they're all in agreement to the bill. So I'm happy to entertain any questions. If there are none, I just ask for an Aye vote.

The Administrator, which is animal control, the State's Attorney, Director, or a citizen can file the complaint that starts the process to go back to a State's Attorney or animal control or all of those entities. And then the circuit court.

The judge has found by clear and convincing evidence that the dog should be removed from the home. Where does the dog go? I mean -- I mean, I -- I -- I mean, is there a -- are we setting up a new dog detention center, a -- a dog jail? What? Where -- where are they going?
PRESIDING OFFICER: (SENATOR MARTINEZ) Senator Murphy.
We specifically maintain the dog's rights in this. And the dog would go to a shelter, to a rescue, to a restorative behavioral place, where often there's a lot of volunteers. So the dog has that opportunity to go to all of those places. And the dog initially, of course, is impounded, which is currently in statute. The dog is then evaluated to make sure that it is appropriate for one of those levels and can be adopted or go to any of the other entities.

So, Senator Murphy, you and I represent different areas of the State and I would assume that one of the differences in our areas of the State has to do with -- might -- might have to do with capacity - in other words, the ability to place a dog - and I know that's a phrase we usually use with people and -- and whatever - but to place a dog. So if there is a capacity issue, what - because that's the call I'm going to get - if there's a capacity issue, how do we deal with that? I -- I'm told by a number of the animal people we worked with that there are a number, throughout the -- the State - and people will drive - that there are a number of adoptive agencies, the restorative behavior agencies. And -- and the people in animal control and the Best Friends of Animals {sic} (Best Friends Animal Society), and all of the other groups, the shelter people, felt that they would not have an issue in placing the animal.

Thank you, Madam President. Senator Murphy, you described in your opening - and I apologize, I -- I don't think I recall - the length of time for which a dog can be removed. Can you give me that span of time again and just some feel for the criteria that the judge will take into consideration in making that determination?

The dog would be removed upon a kill and then subsequent dangerous dog violations, which is already in statute. It's the people that wouldn't be able to own a dog for twelve to thirty- six months, based upon a judge's criteria and based upon all the information that goes into the court case from all the entities.

I -- I misunderstood that part. So, once the dog is removed from the home, the dog cannot be returned -- can that dog be returned? I mean, I understand what you're saying is that the owners can't own a dog for the next twelve to thirty-six months, but can that dog be returned to the home after twelve to thirty- six months?

Well, the dog would be evaluated and I -- I don't honestly know the answer to that, Senator. We didn't specify in the legislation if the dog may be returned to that home environment. But realize that the dog has already killed; it's then been declared a dangerous dog, which is required subsequent acts of malicious behavior. So it would be a judicial discretion if the judge wanted to do that.

Senator Murphy, let's walk down that path for a moment. So the -- the dog is seized from the home and is incarcerated somewhere and the dog is evaluated, and the family very much wants that dog back, after that time of -- that period of time that you suggested passed. You said that the dog would be evaluated. I mean, is there -- I know nothing about this, but is there -- are there treatments available? Can the dog be -- you -- you -- you -- you used a phrase, rehabilitative, I think it was. And it basically does not take SIDS as a solution to death, but it also requires a panel be put together to make sure that we're protecting these -- these children from people who may be abusing them. There are reports around the country of schools publicly identifying or stigmatizing students who owe money by putting them at different tables, stamping their hands, 39 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 117th Legislative Day 5/1/2018 or, in some cases, maybe even throwing away their meals if they can't pay. What the legislation basically says, if a student is standing in line that that student should be served a meal and if there are questions about payment, the school district should reach out later to their guardians or parents and try to figure out the -- the form of payment. This is an opportunity to make sure that the kids get the meal they need to get through the day and not stigmatize students. I'm happy to answer any questions. I'd appreciate an Aye vote.

Thank you. I appreciate the concern. Obviously, the biggest pushback we have is from school districts and wondering about payment. But this bill addresses that issue in several ways. One, 40 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 117th Legislative Day 5/1/2018 what this really tries to do is encourage school districts -- districts to get parents applications for free and reduced lunches. Many times, this paperwork doesn't get signed. Parents are unaware of what's involved. And they're -- basically, encourages school districts to get free and reduced lunch applications to these students so they can get reimbursed. Also, under the USDA, many school districts may not be aware that they can actually fill out applications for parents to make sure they can recoup those payments. And also, under this legislation -- under current law, school districts may request the State Comptroller to collect the owed student fees from tax refunds. So, under this legislation, a school district gets to request a setoff from the Comptroller if the payment's more than five hundred dollars and the school district has made reasonable efforts over the year to try to recoup those payments. So, I guess most parents, once they've been confronted by the school district, will make that payment. But, again, the bottom line is, students should be served those meals; adults can figure out later how to make that payment.

Senate Bill 2540 has a long story, which I'll make brief. It makes amendments to the Grant account -- Accountability Transparency and Accountability Act {sic} (Grant Accountability and Transparency Act), as well as other Acts. It's the result of some lengthy negotiations and an agreement between GOMB and the Comptroller's Office. And it all is a result of a rather scathing audit that the Audit Commission has reviewed. This bill came to me from the Illinois Telehealth Network and it amends the Public Aid Code and expands the originating site provider for Medicaid telehealth services to include any Medicaid- certified facility or organization. Currently, only originating site providers are able to bill Medicaid for telehealth services under certain -- certain categories. So this would be stepping a little bit further into telemedicine. We discussed in committee how we believe this is an effective use of Medicaid dollars and would expand services to predominantly rural areas, but also urban areas that don't have services currently provided. Be happy to take any questions on the bill.

So it -- it doesn't -- it doesn't create new providers for Medicaid; it just simply expands originating site providers for medical services beyond what's included today. So, today, originating site providers are a physician office, podiatrists, local health departments, community mental health centers, licensed DHS providers, and I think there might be a few smaller ones. But this would be taking a full step into medical services that are permitted and approved under Medicaid.

I'm not sure I understand your question. I think the answer is yes, because were not proposing any changes to managed care contracts.

So, in this case then, for a -- a given patient, if the patient needed certain telehealth meds -- or telehead -- telemedicine, then the -- the provider that they're going to would have to be in that MCO network, that MCO would have to approve that service, and they would have to approve that telehealth service with that provider.

Well, I think -- well, first of all, the only -- the only reason a Medicaid patient would need telehealth services is because the service in person isn't available. So -- so I think I should 57 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 117th Legislative Day 5/1/2018 -- we should acknowledge upfront that the reason this is before us is because there's large parts of the geography in the State where there just aren't services available. So geography is limiting the ability to access health care. So this bill is intended to break down that barrier so that more individuals can have more health care. So -- so an individual I don't think would seek out telehealth medicine; that would just be an option for delivering the health care that they're seeking through Medicaid.
PRESIDING OFFICER: (SENATOR MARTINEZ) Senator Syverson.
But the legislation doesn't necessarily state that -- that that health care isn't available locally; it would just be that choice. It could be if they're in one MCO and another MCO has that doctor or that if a certain doctor wasn't available for a -- for a week, they could use this telehealth. So it's not necessarily -- I don't think it says that if no doctor is available within X area, then telehealth is available. This would actually be an option, the way it's drafted, that they could use telehealth even if a doctor was available. Is that correct?

Yeah, I think that -- that could be a circumstance. I think the more predominant circumstance is, someone lives in rural southern Illinois and they can't find a -- a provider because a drive to get some type of mental health services is three hours so that is going to check them off the list of having the ability to get the service; so therefore a telehealth option could be set up 58 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 117th Legislative Day 5/1/2018 in order to provide a linkage for that need for that patient. But I think, to your original question, I think the answer would be yes.

Thank you. And the -- the medical provider that is part of that, that they are consulting with, that provider also would have to be in that MCO network and have to be a -- have an Illinois license for that as well?

Yeah, we're not -- we're not promoting additional Medicaid licenses to providers. So, in order for someone to be able to provide telehealth services, they would have to be a licensed Medicaid provider, just as they would have to be for an in-person patient visit.

Okay. And I -- and I think the answer is yes. I think I agree with you, but -- but the -- yeah, I think I agree with you. I think the question just is, though, if -- if a MCO was contracting with a -- with a telehealth service, that doesn't mean that that MCO potentially couldn't use one of their contracted people that were outside of Illinois. Now I know with some of the other telemeds we've been looking at, they had to be Illinois-licensed physicians, for example. I don't know if that's necessarily the 59 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 117th Legislative Day 5/1/2018 same when it comes to Medicaid. So if it's a -- if it's a contracted provider for an MCO, it's possible that MCO may be using a telehealth service that they have working for four or five states and may not be licensed in Illinois. So, again, I don't know, maybe that's something that gets addressed in the rules. I don't know if this talks about that with -- with the Medicaid. I know the -- I think the private insurance one, when it was for physicians, we said they had to have an Illinois physicians license. But in this case, if we're talking about more than physicians, other services, and I don't know with the Medicaid rules if they have to be -- have an Illinois license or they just have to be contracted with that MCO to be part of that telehealth conversation - if that makes sense.

I'll attempt to answer your question. If you provide Medicaid today, you can provide Medicaid under this bill. If you don't provide Medicaid services today, you can't provide Medicaid services under this bill.

Right. I think I understand -- I -- I understand that. That's what I -- so the patient is with a Medicaid MCO, they go to the -- they have a telehealth conference with one of the other MCO providers, whether it's a psychiatrist or it's a dentist, or whoever it is - they're doing that. My question is, is whether or not that -- that provider on the other -- on the other end of that 60 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 117th Legislative Day 5/1/2018 telemedicine call, is that provider an Illinois-licensed provider or is it just a contracted provider with the MCO? That's -- maybe that -- a little clearer in the question.

So, to provide care in Illinois, you have to have a license, whether that care is done through an in-person visit or, in this bill, through telemedicine.

So, in the committee hearing, if you recall, I said I'm open to those suggestions in terms of how the language of the bill from their perspective could be better implemented. We have a -- a very distinguished citizen of Illinois here today, Ann Lousin, who began her distinguished career in service to the people of the State of Illinois in the field of constitutional law as a research assistant at the Sixth Illinois Constitutional Convention in 1970. She was a staff assistant to the Speaker of the Illinois House of Representatives from 1971 to 1975. She was actually the Parliamentarian of the House in the 78th Session of the General Assembly from '73 to '75, and - what that means is - Mike Madigan wasn't even the Speaker then. She helped to transition in the new Illinois Constitution. She has served on several governmental and civic boards. She is a graduate of the University of Chicago Law School and a Professor of Law at The John Marshall Law School in Chicago since 1975. She is, by far, the acknowledged scholar in Illinois and teaches a course in Illinois Constitutional Law. She continues to lecture and consult on the Illinois Constitution, public law issues, and commercial law in the United States, and she writes columns on "Law and Public Policy" for The Chicago Daily Law Bulletin. She has written several articles on the Constitution and authored the leading treatise on the 1970 Constitution. This piece of legislation is actually part of an initiative that Illinois is working on with ten other states through the National Conference of State Legislatures. It creates the Illinois Regulatory Sunrise Review Act. Ofttimes, in both Chambers, we have individuals who come to us and are seeking licensure for their profession. Unfortunately, we don't have any clear pathway. It's just, again, if somebody asks, we evaluate and we pass. Some people get licensure; some people don't. What this does, it creates a pathway for all of those professions to request an investigation at what level of regulation, if any, is necessary in order to protect the public health, safety and/or welfare of our constituents. It's -- I want to make it abundantly clear for the record that just because we pass this legislation and have a pathway, does not lock the General Assembly into following the recommendations of the study. That is absolutely the discretion of the legislators. That's our job. But this study would allow us to have data that would help us make a decision whether or not it's in the best interest of our constituents to have licensure of the profession requesting it. This bill would I think correct what was an -- an unintended consequence of the juvenile expungement statute, which was to add the phrase "evidence of interaction with law enforcement". This has caused a lot of problems in the field where perhaps a juvenile who is not charged with anything ends up becoming a witness or a bystander and then they end up having a record created. It's impossible to know where those are -- where those are. So, you know, a -- a car wreck, domestic, anything like that where a child might be present, their name is being written down as a witness. It becomes almost impossible anywhere to go ahead and -- and find those. And I don't think that was the intent. The -- the -- the -- the bill that -- the substantive part of the bill that deletes anything related to the criminal offense is retained. Nothing changes there. This fixes the unavoided -- or the inadvertent and unintentional consequence. With that, I'd be happy to answer any questions.
