SENATOR McCARTER: Ladies and Gentlemen, in my nine and a half years here, I have been, as well as you have been, advised by our ethics officers to -- to handle ourselves in different ways, here in the building 4 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 122nd Legislative Day 5/10/2018 and on campaigns. One of the things that has taken place is that when we hire people in our campaigns, we recognize them as independent contractors. We give them 1099s - some -- some of us do; some of us don't. I don't, because I, as a businessman, know what an independent contractor is in the State of Illinois. And there are very few according to our definition. So there's a way that we can make this better and we can make it more ethical and more according to the law for all of us in our campaigns if we go according to the Fair Labor Standards Act, instead of what we've created, is a list of things that need to be met that cannot be met by those working on campaigns. So, in mine, we take out payroll taxes and they're actually employees, which everyone else's are as well. Now, we haven't done this correctly, even though we've been advised that this is the way to do it. There's a better way. There's a more ethical way to do it. And there's a way to correct this. Now, if you're interested in correcting this, I'd sure like to talk to you about that within the next two weeks. And it can be done, it can be done correctly, and we can be held, as politicians, to the same standard as every business in this State. If you'd like to be part of that group, let me know. Thank you.

Senate Bill 2522 simply requires a rental car company to notify their customer of the option to use an electronic tolling -- a transponder prior to the rental agreement. This is simply an attempt to make sure that transparency is there when customers rent their car and they're aware that a transponder is in the vehicle. The amendment will remove some language that the rental car companies finds objectionable. I find there's no more opposition to this bill. I'm happy to answer any questions.

This bill is changing the rate methodology for institutions that take care of people who have -- that are medically complex developmental disability individuals. There's ten such facilities, serving about nine hundred individuals. Been working on this with Leader Syverson and the Medicaid working group. There's general agreement that this is the right methodology. We'll still be making some - - making some tweaks to it in the House around seeing whether we can sort of phase in the cost of it or make some adjustments to how much it costs. But there's agreement that we should do this, send it to the House, and there'll probably be an amendment there that will come back for concurrence. I would urge your Aye votes. Thank you.

I was going to do that, but I do -- I'm going to take this opportunity, while people are on the Floor, to wish every of my - - all my sister legislators a happy Mother's Day that's coming up on Sunday, that we're all going to get to go home and do. Those of us who know what it is to be working moms here, know that we do so much and then we get home and then you do so much when you get at home, it's going to be nice to have a minute to just cool out and relax and let everybody love on us for a minute. But I did want to just share a really quick story. My daughter is in New York and she's watching right now - I told her to -- to do this - so she's in New York and she's studying dance at a conservatory for the performing arts and she -- she was robbed and it wasn't - - luckily, she wasn't hurt, everything was fine, but she lost everything. Yesterday, she was walking dogs in Central Park and found a purse on the side of the road that had everything in it. She went through it. It had everything in it - plus three thousand dollars. I just found this purse; I want to turn this in." And the officer says, "We don't want that. Take that to the station." She's like, "You should help me with it. Like, this -- it has a lot of money in this purse." And he said, "Take it to the station." So she went to the station and when she got in there, the officer said, "Wait a minute. There's a woman sitting in lockup {sic} right now in tears, because she can't find her purse. What's the name?" And Camryn said, "The name is… Here, I found her wallet." The woman came running out. Turns out she had just flown from Iowa to New York. Had all her travel documents, all of the money they were going to spend. The bill would prohibit any State or local government agency from using government resources to participate in or provide support for the creation, publication, or maintenance of a registry program. And concerns were raised by various organizations so we have made appropriate amendments. Initially, we -- concerns were raised by the Department of Revenue that the bill would prohibit use of State tax forms that request demographic data, so we provided that exemption. Then, the Secretary of State and other law enforcement groups were concerned that the bill's original language would limit certain databases. We took their amendment. And we did the same thing for the Clerks of the Courts. And we can say that this legislation is not intended to limit use of existing law enforcement databases that are used for non- discriminatory purposes. But, the bill is still a needed piece of legislation. The -- during the last Presidential campaign, there was a lot of talk about registries. It's of great concern to many minority -- minority groups in the State of Illinois. And I think it's a very -- very important statement by passing this legislation, especially after we've removed all the opposition. Thank you, Mr. President. Mr. President, I -- I have not followed closely the -- the path of this bill. The reason that I -- I rise is, these days -- and you're exactly right. I mean, the more -- the less privacy people have, the larger government gets, the more registries and lists people maintain. I know you've -- you've -- I think I heard you say something about the lists that law enforcement maintains, such as the Sex Offender Registry, the Murderer Registry, the Arson Registry. We also have -- the State Police keep other lists and other registries - FOID Card, conceal carry, I -- I mean, other things like that. My first question is, what is in the bill - and maybe you can't answer it this way, but I'm going to ask it this way - what is in the bill that makes it clear that we will not impair the ability of State government, through an agency or set of agencies, to maintain the lists that, quite frankly, we've told them we want them to create and in some instances, publish?

Maybe the best way to answer that is to say that all databases that exist now are -- are -- can -- can remain in existence. It 21 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 122nd Legislative Day 5/10/2018 was -- the bill initially was -- was in response, quite frankly, to the last Presidential election, where it was indicated by the President that he wanted to create a federal registry of Muslims. There was a six hundred percent increase in the rise in hate crimes toward -- against Muslims. So the original purpose of the bill was to say we are not going to allow for any registries. That raised concerns among the various agencies, the Clerks, the Secretary of State's Office, law enforcement, that existing databases would be eliminated. And so I adopted three amendments in response to their concerns. So there are no databases, existing databases, that would be eliminated, but we still would have on the books a -- a prohibition on a registry that's specifically aimed at a particular minority or ethnic group.

Thank you, Mr. President. And, Mr. President, I appreciate -- and I -- I listened in your opening, your -- your referral to the Presidential campaign, but as -- as you know, better than I, that what we say our intent or what drove the creation of the bill in the first place doesn't necessarily speak to the consequences later on. And that's the only issue I'm talking about. And so, it's my understanding what you're saying is that the bill, based on its language - based on its language - would not prohibit the State Police from maintaining lists, whether that has to do with CCI or FOID or gang-related activities; that none of that information gathering and -- and -- and the maintaining of those lists will be impaired by the language of this proposal.

In fact, you and I recently had a conversation about military service, and I noticed that one of the identifiers in Amendment 2 would prohibit a public entity from -- compiling a database based on military status. One, I'm curious about why that particular identifier is in there and, two -- I mean, I think of -- I think of the veteran's preference that we have in Illinois. It would -- and -- and, obviously, knowing whether someone's a veteran or not is pretty important if you're going to have a veteran's preference in hiring. How does -- how does that specific prohibition play in with those issues?

Well, you're referring to Amendment No. 2. I think the question of whether or not if you're applying for a public job where there is a veteran's preference, whether or not you're required by law to disclose you're a veteran, I don't know the answer to that question. So we -- we are -- we're just trying to make a statement here. I think it's an important one. It's very important for the community. Senate Bill 2271 - and Amendment 2 becomes the bill - the bill tolls the statute of limitations for sex offenses committed against an adult for one year after discovery by the victim when corroborating evidence is available. The charging document must state that the statute of limitations is extended and the circumstances justifying the extension. This was an initiative of the Adams County State's Attorney and it corrects an anomaly in the statute of limitations where an adult victim of a criminal assault was unaware of the crime at the time of being drugged or unconscious. In this instance, the crime was discovered during the execution of a search for another crime and recordings on the defendant's computer of an unconscious woman being sexually assaulted were discovered. The statute of limitations for the -- the offense had -- had expired. There are no provisions in current law which extend the statute of limitations for sex crimes against an adult that are later discovered. Unfortunately, the charges were dropped against the defendant, who had been convicted of a prior sex crime. None of the current provisions of the extended statute of limitations contemplate the possibility of a criminal sexual assault or criminal sexual abuse not being discovered by an adult victim until after the felony statute of limitations has expired. This bill amends the Personnel Code to provide language to allow Civil Service Commission the ability to -- to remand disciplinary appeals for additional evidence or argument. The Commission currently is required to issue a ruling within sixty days from the receipt of the transcript of proceedings. A previous court ruling had made that the six -- sixty-day time frame was a hard deadline and gave the Commission little recourse to seek additional evidence and allow for additional argument. Oftentimes, both parties in the appeal will request leave to submit written closing briefs, which further intrudes on the sixty-day deadline the Commission has to rule. This bill will allow the Commission to remand the appeal for further evidence and argument and start a new sixty- day time frame from the date the transcript is received by the Commission. This language was negotiated by all parties affected and involved and it -- Amendment 2 removed all opposition. And I would ask for an Aye vote.

Thank you, Mr. President. House Bill 2984 amends the Public Health Powers (and Duties) Law. As amended, the bill would allow health care employees to decline a flu vaccine based on religious objections or medical grounds, but would not let employees refuse a -- a flu vaccination based on philosophical objections. When I say "employees", I mean employees of hospitals and other public health institutions. The amendment is a product of negotiations with the National Vaccine Information Center and I believe removes all opposition to the bill. It goes through a series of ways and updates a law that was largely written in the fifties and sixties and expands powers and it -- for example, it does expand the power of the Merit Board, including allowing the Board to issue subpoenas. I know that was one of the things we talked about in committee. But I know of no opponents and would ask for an Aye vote.
