Sydney was elected by her Social Studies teacher to be part -- to be part of the school's Student Leadership Council, where she is -- and others were selected by taking governing leadership role within the school. Her favorite classes are Social Studies, Science and Math. Sydney's also active in extracurricular activities, such as cheerleading, volleyball, soccer, and track. Sydney always has been interested in politics and government. After visiting the Capitol last year, she has set a goal to be a Senator, representing the people of southern Illinois. Despite the many hardships, Leyda - her name is Leyda Garcia - during her -- she faced during her childhood, including countless uprooting and seven years in Illinois foster care system, which resulted in attending twelve different schools, her resilience and perseverance have allowed her to find a passion in advocacy. As a product of substance-addicted parents, Leyda became the default caregiver to her family, to her young five siblings while she herself was a child. She credits this backdrop for providing her the motivation to play an active role in her community as she advocates for herself and others with similar experience to the end. Currently, Leyda serves as a board member for Omni Youth Service {sic} (Services) as a youth representative and -- and the NSW {sic} (NASW), which is the Illinois Chapter of the BSW. She -- she attends the University of Illinois School of Social Worker {sic} (Work) with plans to pursue a master's degree and later a law degree. After obtaining her degrees, she -- wanting to defy dismal statistics of poster -- post-foster care success outcomes. Leyda would like to concentrate on child advocacy, trauma-faced {sic} child therapy, and social justice. Donnika is a student at Parkland College, where she's studying theater and anthropology. After she's done with college, she plans on going to Korea to teach students there English. He was -- we're very proud of him. He was named a Rhodes Scholar last year, and later on this year, he will be going to Oxford to study. This bill allows municipalities, counties, and other units of local government that are required to file audits under the Government Accounting {sic} (Governmental Account) Audit Act to continue to file audits with the Office of the Comptroller -- Comptroller using the cash basis accounting method if that is what they currently are using -- using by the beginning of FY'19. There is a body of opinion out 24 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 124th Legislative Day 5/16/2018 there that the municipality should be allowed to use either accrual or cash basis accounting. I think this is the settlement that we've agreed on, which is the municipalities will be given until June 30th of 2019 to decide whether they want to be a cash basis or accrual basis in terms of their audit reports to the Comptroller. And that's what they'll have to live with. It's my understanding that the Municipal League is actually a supporter of this legislation now as it's been drafted. I would urge an Aye vote. Thank you.

Thank you, Madam President, for that kind introduction and bringing the Chamber to attention. This is an important bill. Senate Bill 337 is the heir to the gun dealer licensing bill that the General Assembly passed and Governor Rauner vetoed, but it is very different as well. And I want to first off thank all of my colleagues for their input on this effort, particularly Senator Nybo, who I believe is going to speak on it as well. We are back with a very different approach to regulating gun dealers in the State of Illinois. Senate Bill 337 is the Combating Illegal Gun Trafficking Act. It has three key components. The first is the federal {sic} (Firearm) Dealer License Certification Act. We heard the -- the critics of gun dealer licensing and we have eliminated much of the bureaucracy and the red tape that was in the earlier bill. It should be much friendlier to business. We simplified the structure without compromising the results. So gun dealers will still have to follow best practices with respect to identifying straw purchasers, securing their inventories from theft, maintaining safe stores, and a well-trained workforce. There are consequences to dealers if they engage in behavior that is likely to put guns in the hands of criminals. Importantly, we treat all federal firearm licensees the same, whether you're a small business or a large store. We recognize, however, that gun dealers are not the only source of illegal guns and so we are also enacting the Gun Trafficking Information Act, which will empower 27 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 124th Legislative Day 5/16/2018 the State Police to conduct an honest study of the data on crime guns and on straw purchaser patterns. And finally, we are enacting a change to the existing law on private sales. This has been the source of some frustration. If a gun used in a crime is traced back to a dealer, it is easy to find the first purchaser, but that first purchaser can say I sold that gun to someone and have no records to document the sale. For the first time, we're imposing penalties on a failure to keep those records. I -- again, grateful for all the input so many of you have had in this process. I think we are back with a much better bill that addresses the Governor's stated concerns about burdening business -- business, but, again, we've done it without compromising safety and this bill will have a meaningful impact on the availability of guns in the State of Illinois. I ask for your Aye votes and I'm happy to answer any questions.

Leader Harmon, before I speak to the bill, I know that you've been having conversations with some of the retailers about their concerns with the bill. Can you give us an update as to where we are with those conversations and whether they have remaining concerns with this bill?

Thank you, Madam President. Senator Nybo, thank you for the -- for the question. Let me start by addressing the big issue. One of the significant criticisms of Senate Bill 1657 was what folks refer to as the big-box exemption. We had an exemption in the bill for what I would call incidental sellers. If less than twenty percent of your revenue is derived from the sales of guns, you are not primarily a gun dealer, so we exempted those stores. Hearing the criticism, we have removed that exemption, so now all gun dealers are subject to the same provision, but we have recognized that if you operate a hundred stores in Illinois that sell guns, you face different issues than you would if you just owned one store. So we have included in the amendments a recognition of that and have tried to adapt the existing practices to account for that, how you would license -- or certify licenses at a hundred locations. We've also tried to deal with concerns that a -- a store in Ohio would end up afoul of some local ordinance and that would somehow taint all of the licenses in the State of Illinois. We've added those provisions. I am working with the Illinois Retail Merchants Association. I have listened to their concerns and tried to respond. They are reviewing this now. This is a Senate bill going to the House. We will still have an opportunity to refine it if we need to, but we are running out of Session days, so… We've had good conversations. I have not heard heated opposition. I've heard very reasoned and thoughtful concerns raised and I'm happy to continue those discussions, but I would like to move this over to the House. Madam President, to the bill.

Leader, I appreciate all the work that you've done on this bill and -- and I'm going to explain in a moment why I'm a supporter of this bill. But -- but I want to start off with the comment about working with the retailers and making sure that their issues are sufficiently addressed, because I think you were making significant progress in that direction. I'm not sure we're completely there and so I am somewhat concerned that we are moving at this point without getting their signoff as they're reviewing the bill. But I know that things are moving in the right direction and so I'm -- I'm still going to support this bill and I want to explain why. So this -- this bill, as you noted, started off in -- in one version last year and then it has -- coming back to us in a different version right now. When we deal with gun safety and when we talk about gun bills, you know, in this Body, they fall into generally two types of categories: They can be what we consider to be gun control bills - you know, who can have 'em, what they can have, when they can have 'em, et cetera - or they can be crime control bills - you know, if you do this, it's a penalty, here's what the penalty's going to be, and -- and approach it from a -- a criminal justice perspective. I'm prepared to support this because I think this has moved this bill from an overly burdensome regulatory, solely gun control bill, or 30 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 124th Legislative Day 5/16/2018 primarily gun control bill, more in the direction of where I think we need to be, which is focusing on the law enforcement aspect. So I consider this a good crime control bill. Now there are six reasons -- or six ways in which this bill significantly differs from what we considered before. And so, for anybody on the fence, this is the part where I'd ask you just to pay attention and understand what these -- what these significant differences are. First of all, it's a lot easier to get the certificate and it is a certificate. But there's no more interview process. There's no more examination process. There's no more letter from a county sheriff inspection. If you have the federal license and you show your federal license and you give an affidavit saying that it's - - it's authentic, you get your license -- you get your certificate. Once you get the certificate, the requirements for holding the certificate are much less onerous. We've cut through the red tape. We've eliminated a lot of the paperwork and what we are left with are conditions that pertain to operating a gun dealership safely. And I think that that's one of the most important goals of this bill. Third, I think it's important, the State has a much less - - or -- or -- or a much more restricted ability to impose more rules and more regulations on top of what we're enacting today -- or what we would be enacting today. Before, we gave the State significant rulemaking opportunity. There was a licensing board that could come up with new regulations. What's in this bill is what dealers need to comply with and we -- we've tightened and clarified what they need to deal with and we've restricted the ability of the State to impose new rules. We also have provisions for if you're a bad actor, if we're going to penalize you, if we're going to suspend your license, if we're going to revoke your 31 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 124th Legislative Day 5/16/2018 license. Now that started out being about seventeen different ways in which we could go after you, and in my opinion, some of those ways had nothing to do with operating a gun shop safely and -- and preventing the -- the enabling of gun trafficking or straw purchasers. Now what we've done is we've eliminated mostly bureaucratic non-safety-related reasons as a basis for the State to -- to enforce this measure and penalize a dealer. And then most significantly, Leader, there was a lot of argument on this Floor when we dealt with this bill last year that it was not fair to the small mom-and-pop businesses. Why were we treating them differently than we were treating the large big-box retailers? We have now eliminated that distinction. I think it's important. I think it's a good step in the right direction. My cautionary note is, let's keep working to address their concerns, 'cause I'm not sure we're right -- we're -- we're fully there. But the bill that we have in front of us today does two things: It says if you're going to run a gun shop, you need to do so safely and here's the best practices that we're going to require you and ask you to comply with to run your shop safely; and then, two, and -- and arguably more importantly, if you don't run your shop safely or you enable gun trafficking or you allow straw purchases or you do anything else illegal in connection with firearms transactions, we will go after you, we will stop you, and we will attempt to penalize you. And I think that's the main goal here is preventing further illegal firearms transactions and -- and -- and very unfortunate tragic situations, because people get into their hands firearms when they shouldn't have 'em. I -- I would encourage a Yes vote on this bill. I think it still needs to be worked out, a few items, but it's a much better bill than where it was last April. 32 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 124th Legislative Day 5/16/2018 And, Leader, I appreciate your -- opportunity to work with you on this and get to this point. Thank you, Madam President, Ladies and Gentlemen of the Chamber. I rise in respectful opposition to Senate Bill 337. It seems to me that whether we're talking about the increasing spiral of violence that we see in our society or issues with our public schools or the Medicaid program or the way to fix our roads and bridges, the first issue always needs to be is identify where the problem is coming from, and there is no demonstrable evidence that the people who are abiding by the law and legally selling firearms in this State are the issue here. There's no demonstrable evidence that there are gun dealers out there breaking the law, selling guns to gang members or other people who commit -- who commit acts of violence with a firearm. There's no question that on occasion the police recover a firearm that has been used in a commission of a crime that at one point or another was sold by someone who was legally selling. That's absolutely true. That's also true for people who steal cars and then may wreck them or something like that. I mean, that's not the responsibility of the person who's complying with the law and engaging in a perfectly legal business. This is putting something on top of them when there's no evidence 33 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 124th Legislative Day 5/16/2018 that they really have a -- a -- a significant hand in the issues that we are facing. And there are good things in here and I'll give the sponsor credit for that, the -- the Trafficking Information Act. I -- I think that's good to help us identify who actually are the bad players, who are dealing in firearms perhaps illegally. So, with that, I want to thank the sponsor for the work that he has done, but respectfully ask for a No vote. Thank you.

Thank you, Madam President, Ladies and Gentlemen of the Senate. Thank you for the respectful debate. I -- I would like to respond to the last speaker's point, though. Every gun used in the State of Illinois to kill someone, every gun used in my district and in your districts by someone who shouldn't have a gun to shoot someone else starts as a legal gun. Every gun starts as a legal gun. Somewhere between the manufacturer and the crime scene, someone who is pretending to be a law-abiding gun owner is not. This bill attacks that problem. I -- I believe the gun industry refers to it as leakage. That's a understandable, but very sanitary term for guns being stolen, sold, hijacked, whatever it is. Guns start off as legal guns and they end up as illegal guns. This is a commonsense effort to crack down on that, to regulate the process as the Second Amendment calls for. This is a bipartisan bill and I am grateful to my Republican colleagues who have worked on this and joined me as cosponsors. This bill is responsive to the criticisms that were justifiably leveled at Senate Bill 1657 for whatever degree of overreach and enthusiasm 34 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 124th Legislative Day 5/16/2018 we may have brought. This is a much better bill and it doesn't compromise our objectives. And finally, this bill does nothing to infringe on anyone's Second Amendment right to have and keep a firearm. This provides for a well-regulated system of gun sales by dealers. I'm grateful for your support and I ask you for your Aye votes.

This legislation is in response to those actions. Senate Bill 2387 has three components. First, the firearm disposition form, which currently must be given -- will be given to the local State's Attorney, where both the transferee and the transferor reside. Currently, it only goes to the Illinois State Police. Secondly, the person receiving the firearms will sign a sworn affidavit that will go to the State Police, along with the State's Attorney's Office, confirming and acknowledging the responsibility that he has taken with receiving of the -- of the weapons and acknowledging the penalties should he violate this trust. And thirdly, this aligns with other firearm transfers in statute that the transfer of a firearm without FOID card verification would carry a Class 4 felony, as it already does for handguns. I'm happy to discuss this legislation with anyone.

Lindsey is an eleventh and twelfth grade teacher, English teacher, at Dwight Township High School. She actually teaches a number of courses. She teaches AP English, American Lit, Poetry, Drama, Creative Writing, Shakespeare. She has served as the Drama Director, Cheerleading Coach, Musical Director, Gamers Club Supervisor, Polar Plunge Team Coordinator - we all know what that is these days - and Student Council Advisor. Senate Bill 193, as passed, empowered the Attorney General's Office to enforce employment laws, specifically laws concerning the Prevailing Wage Act, Employee -- Classification Act, Minimum Wage Law, Day and Temporary Labor Services Act, and the Wage Payment and Collection Act. It would allow the Attorney General, who under current law has to wait for the Department of Labor, to refer these cases. When we originally presented this bill in committee, we heard testimony of cases where founded cases were referred to the Attorney General's Office after the statute of limitations had expired. I've since learned that there are at least sixteen such cases where the statute of limitations had expired, yet those cases are still in the jurisdiction of the Department of -- of -- of Labor. The Governor's veto message raised a concern of the Attorney General usurping the authority of Department of Labor. That's not the intention here. We still would anticipate that the Attorney General's Office would work collaboratively with the Department of -- of Labor. The Governor also raised a legitimate concern about whether or not a -- a Department of Labor representative would serve on the task force that is contemplated by this bill, and I'm committing to pass a trailer bill to address that concern raised by the Governor and make sure that a Department of Labor representative could serve on the task force. I urge your support on this.

Thank you, Madam President, Ladies and Gentlemen of the Chamber. Just as a refresher, this bill was vetoed by the Governor. There is an attempt here to override the veto. A couple points to make. First of all, this is what the Department of Labor does. This is what your constituents and mine and the taxpayers pay the Illinois Department of Labor to do. Second, and I think that -- probably something that's less apparent is that we typically in our system try to divide the duties of investigation and prosecution between separate entities. That's why, we in Illinois, we have State's Attorneys, but we have also police forces that do investigation. Under the model that's being proposed here in the motion, the Attorney General's Office will be both the investigator and the prosecuting authority. That, at the very least, raises serious issues of whether or not the prosecuting authority in this instant can be objective since they are looking at the investigation that they themselves had conducted. The way it works now, the Department of Labor does the investigation and then refers the case over to the Attorney General for prosecution. So the Attorney General already has a hand in this. It does not make sense for us to, one, duplicate the investigatory effort, which this bill does, and then allow the investigating body and 41 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 124th Legislative Day 5/16/2018 the prosecuting body to be the same. In response to my distinguished colleague who just spoke, I would say that many State's Attorneys throughout the State have investigators that work for them that assist the local police. It's not novel at all for a Attorney General to have investigators to investigate, especially what is in essence a civil remedy to a Prevailing Wage Act violation. Here, the Department of Labor may -- is under the control of the Executive Branch. Perhaps that Executive Branch is not favorable toward the PLAs -- or, I'm sorry, the Prevailing Wage Act cases, so they are slow-walking them. Here the -- the -- the Constitution clearly states that the Governor is the Chief Executive Officer and is charged with the duty to enforce the law. The Attorney General, however, is also charged with the duty to be the chief legal officer of the State and to enforce the law, and what we're doing here is just assisting her in her office and expediting a key provision that assures fair wages - fair wages, especially on public jobs that reduces the possibility of fraud and exploitation of workers. It -- this is a sensible bill. It's a reasonable remedy and it certainly enhances the authority of the Attorney General, who always acts on the -- on -- on behalf 42 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 124th Legislative Day 5/16/2018 of the State and the public interest. I would urge an Aye vote.

If the County sells the property, then ten percent of the proceeds shall be paid to the State. It also amends the School Code by allowing elementary schools and high schools, which are currently required to do so, use this Black History as a unit of curriculum to -- to meet these requirements. We want the doctors to inform women if they have dense breast tissue and the necessity for other tests that they may want to consider. As I said, this is a -- a measure that forty of my colleagues here have been kind enough to cosponsor. This is a bill dealing with Lyme disease and it was brought to my attention and it's a bill that's initiative of 55 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 124th Legislative Day 5/16/2018 Representative Swanson, here to my left. It was also an issue that was brought to my attention from a couple residents in my district. The bill does several things with regard to Lyme disease prevention and treatment for Lyme disease, and the most important thing, in my opinion, that it does, is that it amends the Medical Practice Act to make sure that physicians that are prescribing a certain type of treatment for Lyme disease cannot be disciplined by DFPR solely for prescribing that method of treatment. We have worked hard. Representative Swanson and I have worked hard to get agreement from the Medical Society with respect to this language. They are no longer opposed to the bill. I think this is a good bill. Illinois residents are increasingly having to deal with Lyme disease-related issues. Physicians are reluctant to prescribe certain treatment across the country because of disciplinary issues that -- that are out there. This is one step forward so that we can get these people their right treatment and that physicians have more tools to be able to deal with this epidemic. This bill is actually called the Lauryn Russell Lyme Disease Prevention and Protection Act and it's named after a -- an amazing young constituent of Senator Anderson's and Representative Swanson, here, who came down and testified on behalf of the bill.
