He is the official representative of the State of Israel in nine states, including Illinois. Mr. Ezra joined Israel's Ministry of Foreign Affairs in 1999. He served at posts in his home country, as well as in Egypt and in Atlanta, Georgia. Prior to being named Consul General, Mr. Ezra spent eight years in the Ministry's Congressional Affairs Office, working on Israel's relationship with the United States Congress. One of the great stories he told me this morning, as we sat here, he was on a plane and the plane stopped and they -- you know, there was a guy in a cowboy hat and who's that guy? It was John Wayne. And Irwin ended up spending the -- the -- the rest of the plane ride sitting next to John Wayne playing cards with a couple other GIs. And so we've got a real hero here. And by the way, what did you say -- what did you say - John Wayne, he was a -- he was just a real nice fella, is that what you -- real nice fella. But, anyway, we've got a real hero here, World War II veteran, Pacific theater, and if -- if we could give him a -- a great round of applause, I'd appreciate it. These students, back when the Parkland incident occurred, instead of just doing a walkout and talking, they actually formulated a forum, which ended up bringing over thirty schools together and we also had multiple legislators, including Senator Rooney, myself, Senator Nybo. We had thirty schools at Willowbrook High School to talk about the -- what occurred at Parkland and school safety. So, today, Scott Helton brought down the students from Willowbrook and Addison Trail, who put that all together. They are right -- right behind me and right over there in the President's Gallery. It establishes procedures for replacing the Adjutant General of the Illinois State Guard in the event of death, disability. It adds provisions to the Illinois Code of Military Justice regarding a -- court-martial proceedings and mental capacity. Yes, thank you. So this bill amends the Public Aid Code to prohibit the Department of Healthcare and Family Services from requiring Medicaid managed care organizations to use a single, statewide preferred drug list and prohibiting the MCOs from negotiating drug pricing concessions or rebates on drugs with the pharmaceutical companies. This is to make sure that -- the single PDL would create barriers to care for a large number of Medicaid patients and so it's to try to ensure that patients with complex -- complex chronic illnesses have access to options for their pharmaceutical requirements. I would urge an Aye vote and I'm happy to answer any questions.

Yeah, I think the agency had put a price tag, I think of somewhere -- seventeen to twenty million, because it's taking away that -- that ability to negotiate a single contract with -- as opposed to each -- each agency -- or each MCO having their own -- their own prescription contract, it would be the State trying to negotiate and work on a -- a bigger contract where you could get better discounts and better rebates. So my understanding is, it's -- they're saying that it would be up to twenty million dollars for that. Would you -- would that -- would you agree that there's got to be some cost to that; otherwise, I'm not sure why the Department would be opposed to this outside of the cost.

That is not my understanding and we never got that number from HFS. We're continuing the status quo. So perhaps there's some future savings amount that they don't -- that they think they could -- achieve that we won't be under this, in terms of some rebate losses. But there's -- to my knowledge, we have never gotten a cost estimate like that and this is -- this is maintaining the status quo.

Yeah, I mean, I'm -- my understanding is that, you know, they don't like to limit in any way what the MCOs are doing, so I think that just on principle, philosophical, they don't like doing that. That's my understanding. And I just did confer with our staff and we have not gotten any cost analysis associated with this bill from HFS.

House Bill 4242 would require units of local government, school districts, community college districts, and other local taxing bodies to provide notice to the public if they enter into a severance agreement with an employee or contractor found to have engaged in sexual harassment or discrimination. The amendment simply -- as the bill came over from the House, it had the Civil Rights Act incorrectly printed, as in 1963, instead of 1964, so that was what the amendment caused. Mr. President, I want to bring to the attention of the Body -- it's a historical footnote to the Senator's great bill. I want to bring the attention of the Body to the fact that the Civil Rights Act that he refers to, that was part of a scrivener's error, was the third Civil Rights Act in the history of the United States. The second one was in 1957, which marginally did some good. The first one was a major change in federal policy and it was in 1866. It was authored by a former Illinois Supreme Court Justice, Lyman 29 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 129th Legislative Day 5/23/2018 Trumbull, whose statue is in the area as we walk out of the door. As you come out of the Speaker's Office, his statue is -- to the immediate left. Trumbull was also the author of the Thirteenth Amendment - he wrote it himself, the Fourteenth Amendment, the Fifteenth Amendment, and also the Ku Klux Klan Suppression Act, which was used by Grant and Sheridan to crush the KKK. Trumbull lived in Alton, Illinois. His home still stands in my neighborhood, three blocks from our home. So I wanted to bring this important figure -- there was a -- there's a classroom in Northwestern University named after him. He's an important Illinois figure, kind of the Illinois' other emancipator, Senator Trumbull. Thank you, Mr. President.

Thank you, Mr. President. I -- I simply want to raise some concerns that were briefly addressed in committee about this proposal. I certainly commend the -- the sponsor on her work on this. I -- I think this is one of those initiatives where you might wonder whether this is a solution in search of a problem. We heard no testimony in committee that there were any issues with the school board members. In fact, the sponsor made that statement here in her opening comments. I think there's some legitimate concerns about whether this legislation may create ambiguities, because it does not define "educator" in any manner, yet imposes on the Office of the Governor a requirement that appointees satisfy this undefined term of "educator". Again, there's no complaints or concerns that's been raised about them. It went to another committee and it didn't change, so… I'm not going to say that it won't ever come back to Public Health, maybe it will, but it doesn't look like it's coming back, and I'm still opposed to this bill. I understand we want to be safe, but I think we should've -- the Members should have been listened to and I think this should be a -- the first time should be a warning and that would have been a much more practical bill and we still would have delivered safety to the public as we wanted to. So, first and foremost, this codifies existing law. Under existing law, it says that a child should be secured in a proper restraint system. According to the Illinois Chapter of the American Academy of Pediatrics, their -- their recommendation, which is under law, but it is vague, is to secure a child until the age of two years to be properly secured in a rear-facing child 42 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 129th Legislative Day 5/23/2018 restraint system. This bill was also -- when we were in Public Health Committee, it was opposed by the Illinois State Police. The reason why we went through the House Chamber is so that we were able to go through negotiations and to get zero opposition to this bill. The other thing is, is that this bill was assigned to Transportation because it was -- it was felt that Transportation had jurisdiction over restraint systems for two-year-olds. Now, nowhere in Illinois statute, nowhere in the Illinois Criminal statute does it state that there should be given a -- a waiver or a warning or some sort of probationary ticket, nowhere in the Illinois Criminal Code, and that was the Illinois State Police's issue. So we were able to clarify that and codify the existing law and clarify whether or not a child should be restrained in a rear-facing child restraint system. Senator Oberweis, just recently, with all of the technical updates being done by the State of Illinois, now what occurs is those individuals who inspect the barns now do it via a tablet. If you don't have - you, the -- the dairy farm operator - if you do not have a printer or a computer onsite, you don't get that inspection report until they go back to the office, whenever that might be, and then mail you a copy of the report. It's extraordinarily important for most dairy farmers that if you don't get that inspection and you don't have it available in your barn and someone else comes to inspect the site, you can be downgraded five points, which would mean that you go from a Grade A quality milk to a Grade C, which obviously lowers the price of your product. And at a time when, in Illinois, dairy farmers are disappearing like people in Illinois are disappearing, this is extraordinarily important for us to support that industry. And right now, many farmers, dairy farmers, do not have that equipment, so we're trying to provide a little bit of a span of time for them to go ahead and then purchase and get ready for the new flip to 50 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 129th Legislative Day 5/23/2018 technology, rather than the old practice of providing a paper copy on site at the time of the inspection. And would you ever believe that I, the little girl from McHenry, know that much about milk?

So it does -- it's trying to accomplish two things.

Senator, I may have misheard you, but -- but it -- if -- if I heard you correctly, it sounds like that one of the main objectives that we're trying to fix here is to get more people who are incarcerated to vote. We're -- we're trying to make sure that we have more of them participating in the electoral process.

We -- we are trying to get people that are registered to vote, that are presumed innocent, the ability to actually vote, because they're registered to do so. That's -- that's one of it. To make sure that the people here in this Body and across the Rotunda are serving their interests as well, all our interests.

So there will be a voter application -- voting application to register to vote for those that have served their time. And simply what this bill creates is that for those same county clerks and recorders that -- to go and work with the -- the sheriffs in their areas so that, in the county jails, those that are registered and are detained at the moment, but are still registered to vote, just letting them know that there is a way for them to vote, either by mail or -- or absentee.

It's supported in -- by both Leaders in the House and the Senate on both sides of the aisle. It's a culmination of about three years of work that was created -- or at the request of the Illinois Supreme Court regarding problems we have in our fees and costs structures of our statute. We've been criticized by the appellate court of how -- how those get enforced. 72 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 129th Legislative Day 5/23/2018 Currently, our -- there's thirteen different statutes or areas where the fees and costs are. This legislation is designed to create one area where the fees and costs are delineated. There's schedules that are going to be implemented. We have -- and it's going to be -- the -- the fees and costs are going to be designated by certain crimes, distributed to State, county, and -- and the local agencies. The clerks have asked us for help on this to make it more efficient in collecting the fees and distributing the fees. The task force consisted of practitioners, judges, clerks, AOIC, Representatives {sic} Andersson and former Representative Nekritz. On our side, it was Senator Righter and myself. So this bill basically creates one Act where the fees and costs are for criminal cases and puts them into one -- one place so it be -- will be easier to understand by the clerks, more -- be more efficient and be more consistently applied throughout our State. And I think - - one other thing, that we are -- this is going to get implemented in July of 2019. It's got -- it's going to sunset eighteen months after that. We have this sunset so we can actually check our calculations to make sure that they're accurate and make adjustments where necessary. I'd ask for your support.

So our analysis has ILETSB. It's the Illinois Law Enforcement Training and Standards Board. I recently heard from the child advocacy centers - not sure exactly why their anxiety still exists. CASA, the -- the Child Advocates -- Children Advocates Special -- I might -- I have that screwed up. It's CASA. They're special advocates to act as -- in addition to like GALs, but they're actually volunteer positions, and I think that may be it, unless I'm -- I may be missing one, but -- so everyone else -- a majority of people either are proponents or are neutral. This is going to be relying on faith. We are making projections, but that's why we have a sunset, to come back and address those and modify just in case our calculations are off. But our calculations that we've done are actually conservative in nature. They're conservative on conviction rates and they're conservative on collection rates. So ILETSB, CAC, I guess their intrepidation {sic} is -- is more they're not sure they're going to get what we are telling them they're going to get. That is true. The Farm Bureau, the Truckers, and they -- they come into play for overweights, and those are situations in court where trucks are over -- over their weight, and they -- in current statute, they're assessed fees and fines based on the amount of overweight. They've been intimately involved in the negotiations and that's why they are in support. We actually attempted to help ILETSB and -- and I filed Floor Amendment No. 2, for purposes of discussion, that would have increased fees for ILETSB. It would have removed their opposition entirely, but the -- with that amendment, created opposition that weighed a whole lot more than ILETSB's, and I just ask ILETSB and anybody else that has anxiety to just be -- give us -- you know, be -- join us and -- and give us a -- sort of some faith in the process here. And I've committed to coming back and -- after that six months, we're going to collect data. If it's inaccurate, we're going to make adjustments.

Thank you, Mr. President, Members of the Senate. This is an important bill that affects families with medically fragile children. It amends the Public Aid Code and prohibits the Department of Healthcare and Family Services from requiring children on Medicaid through any home and community-based waiver for medically fragile and technology dependent persons or children receiving in-home shift nursing services to enroll or transition into the State's medical managed care program. Under FH -- F -- HFS's new Health Care Choice {sic} (HealthChoice) Illinois program, mandatory enrollment is to begin October 1st of this year. I have a family with a medically fragile child. This absolutely terrifies parents. Their children are fragile and they depend on these services or the technology, and if they don't get it and it doesn't continue at the same level of quality, this could mean the death of their child. This passed out of the House 90 to 1. I hope we have the -- all unanimous vote in the Senate, because, again, this is very important for the parents of children in this 97 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 129th Legislative Day 5/23/2018 situation. The bill would allow 98 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 129th Legislative Day 5/23/2018 someone who has been auto-enrolled into a managed care plan to disenroll and then engage in a fee-for-service plan, or it would allow anyone to disenroll even if they weren't auto-assigned?

Now, my understanding is that they are already receiving in a sense a waiver. This -- this would stop the mandatory enrollment, which is set to begin this October. So this continues the status quo for them in terms of what they have now in terms of medical services or technology for their fragile child.

And -- and if -- if this didn't become -- if this didn't become law, what is your concern that would happen if they are auto-enrolled?

Let me answer that next, but let me continue an answer for your last question. Okay? This states that any -- any children who meet the criteria under this paragraph and who are enrolled in the State's medical -- managed care medical assistance program on or before the effective date of this Act shall be given the option to disenroll, so that's -- that also answers part of your question. To go to your -- your -- your question, I think the fear is that any disruption of services, any -- any disruption to what -- you know, in the case of -- of a family that has a medical fragile 99 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 129th Legislative Day 5/23/2018 child in my district, this child is on a breathing apparatus that if that ever stops or malfunctions or whatever, that child dies. And so I think there's a -- there's just a concern that as they shift plans and -- and maybe shift, you know, equipment or shift in terms of who is the -- the person that comes and -- and -- and provides the home care, you know, any disruption of -- of any kind of services just affects them. And so I think there's that fear and it -- it makes sense that we would take this portion of our population and give them that exemption.

Senator Koehler, I mean, have you -- in your work on this bill, have you been given any indication that once one of these patients is enrolled in managed care that they're going to lose the medical equipment to which you're referring? I mean, I guess I'm -- I'm looking for your -- what you've learned that makes you fearful that they're actually not going to be given this equipment.

Thank you for the question. I guess personally because of all the hiccups that have been exhibited throughout the State in terms of how managed care has worked. I mean, there's been changes in -- in policies. Each -- each MCO has a little bit different criteria. There would be personnel changes. A -- a family gets used to having a -- a home care worker that -- that knows their child, that knows what that individual's needs are, and to have to shift that and to -- to train somebody new. Again, these are 100 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 129th Legislative Day 5/23/2018 children that -- that are very fragile. I mean, we're talking about nine hundred and forty out of a population of almost thirteen million. So I -- I think that their -- their -- their fear is that let's not wait till something happens as a result of this -- results in a death or whatever and then try to change the system. If the system is working now, let's let it continue for these families.

Thank you, Mr. President. I rise in reluctant opposition. I appreciate where the sponsor's coming from, but -- and -- and -- and he referred to wrinkles in the adoption of managed care and there have been. Those have been almost entirely related to rates paid. I'm not familiar with a single wrinkle that led to a -- a single significant health consequence for one person in this State thus far as we have moved forward on this. I'm sure this thing is going to fly out of here. The Department of Healthcare and Family Services is opposed, because, and I think quite rightly, is that if there is a carve-out for one group, it makes it easier for another group and another group and another group to say, hey, there could be a problem - even if there's not any evidence there will be - there could be a problem with something coming forward, a change in the way the program is managed, and we want out of the program. I -- I want to thank the sponsor for his work on this. This is a very important initiative. This is by far our most vulnerable population in -- in this State, these approximately - you gave an exact number - a thousand children throughout the State that have -- that are medically fragile. You know, these are children that oftentimes may have four or five different specialists that they are seeing and a lot of doctors and a lot of support that is required for them to live. Right now in the State of Illinois, there are only thirty-one nursing agencies and twenty-five specialized durable medical equipment suppliers in the State to service this population. So, regionally, we can get into tremendous difficulties with the auto-enroll into a particular MCO if that MCO and that -- that -- that the child is auto-enrolled into doesn't have a contract with the one nursing agency or the one durable equipment supplier in that region of the State. Not every region of the State has -- has multiple suppliers and multiple agencies available. Oftentimes, when you -- you know, one of the organizations I've worked with, Almost Home Kids, had experience in the MCOs and -- and there was tremendous disruption with specialists, in approvals on -- to office visits with specialists. But one of the -- one -- one of the real challenges 102 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 129th Legislative Day 5/23/2018 is nurse staffing in home, and oftentimes a child is stuck in the hospital waiting for the assignment of nurse staffing. If there's a disruption in nurse staffing, the end result here are going to be children back in the hospital, which is the most expensive level of care that the State provides, waiting, oftentimes months, for new nursing staffing to be built out for them, so they're back at home with their family in the best environment for them, where they belong. So, Senator, I think this is a very important bill and I -- and I thank you for your work and leadership on this and I would urge everyone to vote Yes.

It provides that no employer may discriminate between employees by paying wages to African American employees at a rate less than the rate of which the employer pays wages to another employee who is not an African American for the same or substantially similar work on a job that requires equal skill, effort, and responsibility and is performed under similar working conditions. What we recognize is that the gap appears to be expanding, rather than contracting, and it's my hope that this legislation will provide the tools that is needed to close the wage gap.
