So, this bill, Senate Bill 3-1-7, in addition to the wide array of programs and facilities and services the Park District offer to their residents, many of their facilities also promote tourism. So, the DCEO makes grants to assist in attracting and hosting tourism events and then these funds are matched. So, park districts wanted to be included in these grant possibilities. We've worked with the sponsor, we worked with opposition and we were able to make everyone neutral. So, we're hoping that we can pass this bill today and I wonder if there's any questions?

And the purpose of it is to ensure that restaurants and retailers are not being taken advantage of by third party delivery services, and the language is based on a proposal from Rhode Island. I think we all understand that there are now, you know, companies that were certainly formed over the last couple of years, and we love to see that entrepreneurial spirit, such as Door Dash, and Stub, you know, and all the different Uber eats. But there, you know, have been some problems with that and number one, it's that they don't have agreements with the restaurants that they're delivering for. So, what this is doing is requiring that there is an agreement with the restaurant, if you're going to be delivering for them. Most -- most of you that have, you know, had delivery services may have had delivery issues, where, you know, the food is delivered, and it's, you know, it's -- maybe not what you ordered, the pricing, and you're going to call the restaurant to make that complaint. When actually, the restaurant doesn't know, if you order something from one of these companies, they don't know that the call is coming in from Uber Eats or whatever that company is. You know, they just think it's someone placing an order. So, we're asking that they have an agreement and we're also asking that -- these companies also post their menus many times and they're not updated, there're proprietary issues, so we're just merely really asking for an agreement between a restaurant and a -- a delivery service. And I'm happy to answer…

So, we did -- thank you for the questions. We did negotiate with these companies and -- and it was really pretty fruitful. They are no longer -- I don't believe they're in opposition and we'll continue to work. But, what we did is, we changed the effective date, because there was some question there. And, we also applied this only to companies that have an online presence. So, you know, an app that you order through, that kind of thing. And here's the thing where we couldn't get to an agreement. So, these companies want to be able to list all of the restaurants in their area that you can order food from, even if they don't have an agreement with those restaurants. We believe if they don't have an agreement, that's propriety, and they shouldn't be able to list that restaurant when they can't deliver for it, and they also list those menus. So, we believe that's proprietary. The restaurants believe that's proprietary. So, that is the one piece we couldn't get to an agreement on. And, you know, frankly, we think that they're wrong.

The answer is no. Those companies are not in the delivery business as defined by this bill, so they're outside of the scope of the -- of its obligations. Thank you, Madam President. So -- excuse me, Senate Bill 525 it, right now, represents an agreement between AFSCME and CMS. It seeks to restore a clear criteria as to who is covered under the Illinois Public Relations Act and who is not. The Labor Relations Board, primarily under the Rauner Administration, issued decisions overturning decades of case law, allowing employees to be designated confidential, supervisory, or managerial based on written job descriptions and not the duties an -- an employee actually performs. Employees who have been part of the bargaining unit for decades saw their collective bargaining rights taken away, despite never having performed the duties in the written job descriptions that cause them to be excluded. Senate Bill 525 would protect collective bargaining rights by making clear…

Thank you, Madam President. Senate Bill 525 will protect collective bargaining rights by making clear that that public employee's eligibility for collective bargaining should be based on actual duties and not solely on what was written in job description that is the current -- as is currently the case, the Labor Board would adjudicate issues of eligibility. This bill also clarifies that regularly scheduled steps increases are not considered wage increases for the purpose of the Act. And finally, it creates a reasonable timeframe to negotiate State labor contracts. Current law requires a new administration to organize, develop proposals, and negotiating new -- a new within the next first six months of the term which is not realistic, particularly, for brand new administration. This extends that timeframe to twelve months. I am willing to take questions, and ask for an Aye vote.

All right, Senate -- Senate Bill 928, Floor Amendment No. 2 looks to provide that upon the effective date of the Amendatory Act, Centreville Township in St. Clair County is dissolved. It provides that the rights, powers, duties, assets, property, liabilities, obligations and responsibilities of the Centre -- Centreville Township shall by operation of law vest in, be assumed by the new City of Cahokia Heights, including the authority to levy property taxes for -- for -- for township purposes in the same manner as the dissolved -- as the dissolved Township. Just a little background on this. Three villages came together to become Cahokia Heights. There were three different elections to come together, and at each inflection point the whole idea of getting rid of the Township was invoked. And so, Senate Bill 928 20  STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 33rd Legislative Day 4/29/2021 just looks to hold true to the promise of dissolving the township, now that Cahokia Heights is now a reality.

The local proponents would be -- they would be the mayors of those individual towns, Centreville, Alorton, Cahokia. They would be the township supervisor, they all agreed, and put it in referendum -- put it on a referendum to -- unify these three municipalities. Also, too, Senator Plummer, I want to correct something that you and I spoke of yesterday. You -- I just got off the phone with Tom Holbrook, St. Clair County. It is not coterminous, because of Signal Hill and Parkfield Terrace. Now having said that, Signal Hill will be going into Stookey's Township 21  STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 33rd Legislative Day 4/29/2021 and Parkfield Terrace will be annexed by Cahokia Heights. And before -- there's an intergovernmental agreement that Cahokia Heights will continue to provide township services until Signal Hill is a part of Stookey Township and Parkfield Terrace is a part of Cahokia Heights. So, I just wanted to make sure, we're on the same page with that.

Well -- on -- on April 26th, the representatives of the -- the elected officials of the current Centreville Township voted to dissolve the Township. And so, those are the elected officials, currently, that the people of the Centreville Township voted as 22  STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 33rd Legislative Day 4/29/2021 their elected officials. So, they acted on -- on this, on April 26th, and voted to dissolve the Township, that's number one. Number two, precedent has already been set, that in 2009 my predecessor dissolved Belleville's Township by a Act of General Assembly. And, so, that's why we're here, those two reasons.

I would assume it was; I'm not one hundred percent sure, but I would assume that's a safe assumption. Yes, sir.

Senator Plummer, last week we talked about not having additional officials. This gets rid of a whole form of government, a township form of government, right? And a -- and a -- and again those elected officials, currently of the Centreville Township, that the people put in - including Signal Hill - who were a part of the -- or, who are a part of the Centreville Township currently, voted these officers in who on the 26th took action to vote to dissolve the Township. Now, extensive conversations were -- were had with the people in -- in -- in Signal Hill. They did not want to become part of Cahokia Heights. They wanted to become part of Stookey -- Stookey's Township, and that's what's going to happen. You have another underserved community that's unincorporated, currently, and that's the Parkfield Terrace. The Centreville Township currently provides all the services for Parkfield Terrace and will be annexed, relatively soon, into Cahokia Heights. But before that happens, Cahokia Heights will continue to provide those services that the township provides for. So, to your point, there will not be an additional cost. We're reducing government, not adding on government.

On three different occasions, you've had locals who on -- through the election process, have voted to merge cities. First, you had Centreville and Alorton, they merged to become Alcentra. Then there was a second election for -- Cahokia to adopt or annex Alcentra. Then there was a third election that voted officers for a new city in this unification - not consolidation - but this -- unification effort. And at every step, as I said in the committee hearings, at every single step of this process they were told of the intent to dissolve township government. Now look, this is the route that they chose to do it -- and -- and -- and so this is why I'm here. We vote on a lot of things, in here, that local government could do. You know, we vote on TIFs and every other thing in here. So, I am asking that 27  STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 33rd Legislative Day 4/29/2021 we vote Aye on this -- on this proposal. The citizens have voted overwhelmingly, seventy-five percent and higher, to be at this point to merge a new city that would ultimately dissolve the township government. There's no cloak, there's nothing that's being done under the -- the cloak of night or anything like that. It's been expressly and explicitly stated, the goal of the new government. And for that reason, I would like Aye votes.

This bill honors a commitment I made last General Assembly for Senate Bill 1881 which was signed into law being Public Act 101 {sic} (101-0628), which created the Local Government Revenue Recapture Act. This Floor amendment provides that the amendment amends definitions, allows third parties to directly access a municipality or county's financial information via electronic means, requires the destruction of certain records within three years of third party receiving them, makes a technical change to clarify intent granting a third party the ability to negotiate or receive a contingency fee, it allows the Department to go past the sixty-day deadline if agreed by all parties, makes language changes to ensure they're consistent with sales tax statutes, clarifies that audits are from the Department and not from practitioners. Senate Bill 2043 is a continuation of ISBE's efforts to streamline the School Code provisions and amend or repeal outdated or otherwise problematic provisions to the School Code. ISBE has introduced similar measures of legislation in the past. And, specifically, the amendment that we just adopted is removing the portion of the bill that pertained to the school technology program and retains current statute in that Section. There's about ten other provisions, like I said, to streamline language and be up to code in compliance.

House Bill 2877, the COVID-19 Emergency Housing Package responds to the impending eviction crisis with a comprehensive approach to -- by sealing evictions during the COVID-19 period from 2020 through March 2022, the foreclosure crisis by creating a moratorium on filings through May 1st, judicial sales through July 31st. Lastly, this bill also creates clear guidelines for administering the Emergency Rental Assistance Program effectively and efficiently by increasing access, prioritizing those most in need, and requiring notice for deficiencies and denials. Through negotiations, removed the vast majority of housing providers to neutral, including the Chicagoland and Apartment Association, and the Illinois Realtors Associations {sic}, as well as the Illinois Bankers Association 64  STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 33rd Legislative Day 4/29/2021 and Community Bankers. I just wanted to say that this bill, essentially, is trying to keep people in the State of Illinois in their homes. Be it if it's - if they rent or own a home and trying to pay for the mortgage. And I would just say that we require IHDA to simply make, again, best efforts to prioritize the -- the communities hit, hardest hit rather, by 65  STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 33rd Legislative Day 4/29/2021 the COVID-19 pandemic, in an effort to provide targeted relief in response to the pandemic and to stabilize the housing market. Those communities include: (1) located within a disproportionately impacted area based on positive COVID-19 cases; (2) that have documented history of housing instability and homelessness; and (3) that have a larger rental arrears. This does not prevent households outside of the i(mpacted) a(rea) communities from -- from receiving relief; households with large rental arrears, regardless of their location in this -- in -- of the State will still be prioritized. And just, you know, again, better stated, we are -- are putting this -- we put this language in there specifically as -- as again, a best effort. There's no "shall" or "may" in the language. It is that IHDA make a best effort, because, although the last housing stimulus package and program works fairly well, there were some problems that we saw in -- in -- in many parts of the State. And, so, we want to prioritize, again, those folks that have been hardest hit by COVID or that have experienced homelessness before. We want to make sure that it is targeted, that we are efficient, and effectively getting those dollars to those most in need and affected by this global pandemic that we are still living in after over a year and a half.

And I would say that earlier there was a comment on the other side that's yelled out, well, if you're broke, you know, you're still -- if you, again, three things, it's not an and, if you live in a disproportionately impacted area by COVID, it's one thing that you're prioritized. Secondly, not that you have to have that, but, secondly and separate, if you've experienced homelessness in your life, be it if you live in a DIA or not, you are prioritized. And lastly, if you have arrears because, as on the other side I heard yelled out, because you're broke, it doesn’t matter if you live in a DIA or not. If you live in the State of Illinois, you are being prioritized based on those three things. Not and -- one thing -- you have to have all these things -- it's or. And it's, again, the language is very specific in the prioritization, where it's offered in a suggestive manner as -- as -- as making the -- the best -- best attempt -- greatest attempt to -- to prioritize those three things that we -- that we lay out in the bill. It's not a may or a shall or what not. It's not a requirement. It is that we are asking that -- that IHDA, in creating this program, be super diligent and effective in -- by -- by targeting specific folks throughout the entire State -- entire State.

An area can be an urban, suburban, or rural area. No matter where you live in the State of Illinois, it -- it tries to prioritize and -- and -- and -- and -- surgically utilize the money that we are getting, a onetime money that we're getting from -- from the federal government to assist those people that truly need it the most. The -- the other thing that this bill does is that we know once the moratoriums are lifted there are going to be a lot of -- a lot of eviction requests -- out there. We are trying to stabilize our economy and communities that cannot afford another collapse of a housing market. Be it if you are renter or you rent -- the apartments and you're a landlord. I'd like to thank the sponsor for introducing this bill. As a former State Board of Education Secretary, I constantly and endlessly urged the Board to adopt measures to bring about what we call healing centered engagement. This is a strategy to address trauma, mental and behavioral health. The Board took it to the fact that it was so important it was imbedded in our strategic plan, which we adopted and now is -- now the -- carrying out the vision over the past three years or the next three years. I think the point with Chicago Public Schools to really bring up is that, as of March 26th, CPS put out a notice that they're going to invest twenty-four-million dollars in a healing centered framework. This is going to ensure that every single Chicago Public School has a behavioral health team, that they have at least one staff member trained in these group interventions, and they're going to also have community supports and partners. What this demonstrates is an institutional, systemic commitment of a school district that perhaps says, hey, this is a model. Therefore, we don't have to 84  STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 33rd Legislative Day 4/29/2021 mandate them to do this at this particular point, because they are leading the pack. And so, I really would like to urge an Aye vote, because I think this is proactive, given the fact that two million of our children have experienced trauma throughout this pandemic. And, if we are not proactive about the way that we address this, and starting with leadership, such as the school boards, we are going to see some very difficult times for young people in the next generations to come. So, thank you sponsor for bringing this bill to the table. And I urge an Aye vote.

The number one job for a school -- elected school board member, is to hire, evaluate, and dismiss a superintendent. The other job is to pass board policy. Finally, it's to approve the budget. When you have elected school board members, who've never engaged with students, who've never -- maybe, you even had children who've never worked in the mental health field and they're not aware or don't understand the impact of trauma. It makes it very difficult for them to make sure that they're passing board policy, that they're asking the superintendent the -- the questions that need to be asked, in regards to what is being done within the school district to address these issues with their children, with the students that they're there to serve. This bill, SB 2133 would require State agencies to start collecting data on sexual orientation and gender identity on individuals who use major programs funded and operated by the State of Illinois. SB 23 -- 2133 builds upon existing race and ethnic demographic data requirements that were passed in the recent education bill by the Black Caucus. The LGBT community is diverse, with unique and significant health disparities and barriers to healthcare too often leading to poor outcomes in healthcare and mental health sector. We also know that this community, my community, often faces significant disparities and the social determinates of health and systemic barriers in accessing government funded services and programs. Currently, the State of Illinois does not collect data on sexual orientation and gender identity that would address the socioeconomic and health disparities that we often see. The COVID-19 pandemic has only 93  STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 33rd Legislative Day 4/29/2021 aggravated these inequities. Without data in our government funded programs and systems, my community is invisible when it comes to truly an understanding the brunt of suffering that this pandemic has wrought on all of our peoples across the State. Right now, my community is invisible in government agencies entrusted with insuring their health, safety, and wellbeing. Without systemic data inputs we don't know what disparities exist and are at a loss for how to address those disparities. Visibility is the first step in correcting systemic inequities. And this -- and this bill provides us with much needed data that will help us better shape policy and programs, and more smartly target funds for those programs over time, so that we can begin to address these disparities. Thank you, Mr. President, and Ladies and Gentlemen of the Senate. Senate Bill 2137, as amended, outlines a compassionate approach to connect nursing home residents virtually with family members, loved ones, and to religious or recreational activities, when in-person visits are prohibited or restricted due to federal or State rule or guidance. Today's measure is a bipartisan effort, as Assistant Republican Leader Senator Donald DeWitte, is a hyphenated sponsor of the bill, along with thirty-one cosponsors in this Chamber. Residents in long-term care have been disproportionately impacted by COVID-19. We know that seventy- seven thousand COVID-19 positive cases occurred in our nursing homes, with ten thousand or more deaths. In 2020, research shows us that the harsh consequences of isolation and loneliness on a resident's quality of life are alarming: Fifty percent increased risk of developing dementia, a thirty-two percent increased risk of stroke, and a nearly fourfold increased risk of death among heart failure patients. This legislation was crafted after listening to various sessions and meaningful discussions among AARP, IHCA, Leading Age, Illinois Department of Public Health and the Illinois State Ombudsman's office. Two of the State's leading nursing home organizations, IHCA and Leading Age, are neutral on the bill. IDPH remains neutral on the bill. At this time, even after numerous negotiations with HCCI, they are still opposed. But, we will, of course, attempt to continue the discussions in the House, to ensure that our residents' rights are protected and to combat social isolation in Illinois Nursing Homes. SENATOR DeWITTE: Thank you very much, Mr. President. I want to applaud the sponsor, Senator Collins, for her efforts with this legislation. It's had a few ups and downs, I would have to say, over the last several weeks, since it was introduced. But I just want to share with everyone that when I saw this bill get filed, it -- it touched me from the standpoint that my family's had personal experience with this situation, like many of us have in this room. My ninety- six-year-old father-in-law, my ninety-eight-year-old mother-in- law, both were locked into their nursing home in Louisville, Kentucky during the pandemic. The pandemic took a lot of things away from many of us, including my father-in-law, Jim, at 96 - he passed in October. So, I can tell you that it was very difficult trying to maintain connection with Jim and Helen. We got to see them through the window, on occasion. There were a lot of telephone calls and only through the flexibility of the facility that they were living, did we get to spend just the last few days of Jim's life with him in -- in Louisville. Since October, since Jim's passing, Helen, my mother-in-law at ninety-eight, has been locked up and isolated and it was only two weeks ago Kentucky went ahead and opened up their nursing home facilities and allowed for visitation. My point is this, this bill can do wonders, if we ever end up in a situation like we've all ended up with during the past fourteen months of this pandemic. I realize there's still some concerns on the part of the nursing home industry. I have a number of these facilities in my district, in the western suburbs. But, I have full faith and confidence that continued discussions will find solutions to the problems. One other quick point, this 97  STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 33rd Legislative Day 4/29/2021 is one of the few pieces of legislation that I've seen introduced in this Body that had a funding source identified to help pay for this initiative. And I want to commend the sponsor for having the -- the foresight to establish that as part of this bill. I strongly urge an Aye vote on our side of the aisle. So, Senate Bill 2563 would allow the Illinois Department of Transportation to accept portable emission testing from companies approved by IDOT with an annual fee -- application fee and a bond on the condition that IDOT rules are followed. So, this basically allows for mobile testing -- to -- to occur. An official portable emissions company shall only conduct emissions inspections for fleets of five or more diesel trucks and only at 104  STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 33rd Legislative Day 4/29/2021 the fleet owner's place of business. In Amendments 2 and 3, we did some negotiating, we had some -- some questions from Mid-West Truckers and truckers' organizations. They had a problem, frankly, with an amendment that came in a few days late. So, we negotiated. We removed basically that amendment. And, in Amendment 2, what we did is we took out the -- the opacity regulations that were as part of -- part of Senate, excuse me, the Amendment 1 reduced -- took those out and what we put in is that -- there would be a summary report and this is in Number 3. A summary report which would be released to IDOT in 2023 that just would include a summary of those opacity levels. That's something that we agreed to and there's no opposition to the bill. I would ask for an Aye vote.

The OSH Act and Mine Safety and Health Act promised workers the right to a safe job.
