So, as amended, this bill would allow someone to select their secondary from the ages of sixty- five to seventy-five around their birthday. They would -- also would be able to provide an increase or decrease in the benefit courage under the same provider. We negotiated, I believe, all of the issues in this bill. And I'm happy to answer any questions, but I would ask for an Aye vote.

This Commission is charged with ensuring that high-quality services are provided to ensure equitable outcomes for high-cost special education students by doing the following: review the current system of funding for high-cost special education students in the State; review the needs of high-cost special education students in the State and the associated cost to ensure high-quality services are provided to these students; review how other states fund high-cost special education students; and review, if available, other proposals and best practices for funding high-cost special education students. This bill, very simply, provides for a two-year data call and reduces the categories that the industry would have to collect regarding dog-related incidents from fourteen categories to seven. So Senate Bill 1747, as amended, creates the Energy Transition Own Act -- Zone Act, under which municipalities may apply to be designated as an Energy Transition Zone. In order to be designated an Energy Transition Zone, the area must be -- in addition to meeting other criteria, contain a coal energy plant, coal mine, or nuclear energy plant that was retired from service within ten years from the application for designation, or contains a nuclear plant that was retired from service within ten years from the application for designation. Once designated as an Energy Transition Zone, green energy enterprises - companies engaged in the production of solar, wind, water energy, geothermal, bioenergy, hydrogen fuel and cells - will be eligible to apply for tax credits. I know of no opposition, and I would appreciate an Aye vote. Happy to answer any questions.

And this was an amendment that was asked for by the Department of Labor, and I do not believe that it's a requirement in any other of the -- the DCEO programs.

Yes. EDGE credits have really helped businesses provide jobs in the State of Illinois and they've been used to do projects such as the one that would be covered in this bill. All over the State we have coal power plants that are closed and we have nuclear facilities that have been closed. And so this is a great idea to offer a business the opportunity to avail themselves of EDGE credits to hire employees, to do these projects, to take over these buildings and -- and facilities that have been vacated. However, we don't require prevailing wage to be paid. These are private enterprises that are doing these projects. This is far more reaching than we've ever done in the past. And the problem is, we have facilities that need to be redone, that need to be renovated, that need to be remodeled, and this would be a perfect way to do so, but these private companies will walk away because they will not pay prevailing wage, especially in the downstate areas. The projects might be very small on some of these coal power plants that have very little use for their properties, but -- it would be incentive for private enterprise to do so with an EDGE credit, but 22 STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 36th Legislative Day 5/6/2021 this will be the death now to accomplishing what this bill is meant to do. So I can't support it because it won't get done what needs to be done because of this provision that has never been done on any other EDGE credit bill or law and it's a stretch too far. Thank you. Sorry. You know, I'll -- I'll do this. No one's around me. This is a really important issue. A -- a few years ago, you may know, we finally got to a place on coal ash, you know, because we know that as these plants retire, whatever they are, whether they're nuclear, coal, whatever that retiring energy is, those communities are left eviscerated. I represent a community where a -- a -- a nuclear facility shut down about twenty years ago. They are millions of dollars behind at the municipal level in their -- their funding, and they are suffering, truly. And as we continue down this road of no coal - you know, possibly, at some point, no natural gas - as we continue to move forward, we need to make sure there's something in place for these communities. I mean, there are coal mines, you're right, that have shuttered in the southern part of this State. There are facilities that have shuttered all across this State. And if we don't plan now and make sure there are programs available for them, we're not doing our jobs. We should have done it before. I ask you to vote Yes. I promise that I will continue to look at that issue, and if there isn't prevailing wage on a preponderance of those programs that are created, I will do everything I can to make sure it's taken out in the House. Thank you, Mr. President, Ladies and Gentlemen of the Senate. Senate Bill 2103 creates a -- a system of automatic enrollment in a deferred compensation savings -- savings for K through twelve teachers and State university employees throughout the State of Illinois. As many of you know, when the State adopted Tier 2 pension legislation, we adopted a pension benefit that will be woefully insufficient to meet the needs of our public sector employees in their retirement. In fact, most experts suggest that people planning for retirement should replace eighty-five percent of their final salary. Tier 2 falls at about fifty-six percent of your final salary and does not grow with inflation. Deferred compensation is a way for our public sector employees to make up the shortcomings of their pension savings so that they can live out their golden years in dignity and continue to contribute to our economy. However, when the option is that they're not in and they have to proactively enroll, only about twenty-five percent of our employees take advantage of it. With a system of automatic enrollment, which we've already instituted for State employees, the percentages are in excess of ninety percent. This is a good thing. It costs no money for the State. It helps people prepare for their retirement. It is industry-accepted best practices, and it helps do our part to stave off the coming financial crisis that's going to be due to the vast majority of Americans being undersaved for their retirement. This bill is important because it creates an opportunity for our locally -- this bill creates an opportunity for local county boards who have a -- a -- a direct or potential conflict of interest with their State's Attorney, who would normally represent them, to go to circuit court and ask for a special counsel to be appointed to represent them in the event of that potential conflict of interest or actual conflict of interest. Right now, this is allowed for criminal cases, but not for civil matters, which is what this bill would add to it. This came up in a situation in my district over the summer and it needs to be clarified. It does have the support of the State's Attorneys Association, because the requirement is they go to court and have the court make a finding that there is an actual or potential conflict of interest. It's a big deal that lawyers don't represent people they have a conflict of interest with, so we're trying to resolve that ambiguity. Ask for its passage. Thank you, Mr. President, and apologies to the Body for the chaos that was caused there. Senate Bill 2-63 -- 6-6-3 is very important. We have a -- many of you know that -- actually, you've heard me talk about the Mahomet Aquifer, but I've actually got about a hundred homeowners whose drinking water isn't just in jeopardy, in some cases they can't drink it at all because of a natural gas leak that occurred five years ago. Via court order, many of these homeowners are receiving bottled water, but they can't drink the water out of their own taps. As part of and as a necessary predicate to solving this problem, we need the ability of the Sangamon Valley Public Water District, which is closest to these homes, to -- to be able to extend water lines. Well, there's a boundary issue there that, in the current law, they can't do that because they don't have these areas currently. There's also the Village of Mahomet, which is further away. And so what this amendment does and what this bill does is it creates a new boundary line between the Village of Mahomet and the Sangamon Valley Public Water District, agreed to by both parties, that would eventually allow, as the funds become available, allow the Sangamon Valley Public Water Authority to go ahead and extend those water lines to these people who haven't had fresh water for going on five years now. It's a terrible situation. It's a terrible circumstance. Some of these people are some of my best friends in the world and, you know, imagine what it's like when you -- when you can't drink your own… In fact, one household, the Eisenmann Family, you can actually light their drinking water on fire out of their tap. Think about that. You can light their drinking water on fire out 39 STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 36th Legislative Day 5/6/2021 of their tap. So it is a terrible situation and this is a necessary predicate to fixing it and helping these people get clean, fresh drinking water. So I would ask everybody to please vote Aye. I appreciate -- this was Senator Bennett's bill. We share Champaign County. He gave it to me, as these are my actual constituents. I also appreciate Senator Hastings' assistance in Energy Committee this morning and -- and five minutes ago when he was the only person that figured out the mistake we made. So, thank you.

As amended by Senate Floor Amendment No. 3, Senate Bill 1089 modifies existing requirements for construction and demolition recycling under the Environmental Protection Act to adjust the landfill diversion rate to a minimum of forty percent. It also requires permitting by the IEPA for all the facilities and for rules to be adopted regulating such. Further, 1089 requires the use in best management practices to identify and remove all drywall and other wallboard containing gypsum, which contains dangerous levels of sulfur. This will also require C&D recyclers to file regular reports with the State to input and output of materials coming into their facility. Today I rise in recognition of five amazing teachers residing in the 28th District who have achieved Board certification by the National Board of Professional Teaching Standards. I'd like to congratulate Cheryl Frawley of Betsy Ross Elementary School in Forest Park, Lauren Tatman of Deer Path Elementary School in Cary, Maria Villalobos-Flores of Churchill Elementary School in Vernon Hills, Christine Halblander 57 STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 36th Legislative Day 5/6/2021 of Jefferson Junior High School in Naperville, and Justine Rovin of Barrington High School in Barrington on receiving this prestigious honor, the most respected professional certification available in the K-12 education arena. In order to become National Board Certified Teachers, applicants must demonstrate evidence of the positive effect they have on student learning as well as exhibit a deep understanding of their students, content knowledge, use of data and assessment, and teaching practice. They must also show that they participate in learning communities and provide evidence of ongoing reflection and continuous learning. This achievement is made all the more special in this -- that this is also Teacher Appreciation Week, which is observed the first week of May every year to celebrate the educators who work so hard to build up our next generation. And we can all attest to the last fourteen months how difficult their jobs have been. Kids spend hours every day with their teachers, learning and growing by their example. Over the past year, teachers have been more than just educators - they've served as our lifelines to our students. They've stepped up to provide social interaction, engagement, and just a little bit of normalcy during what has been an intensely challenging year for all of us, and particularly for our children. So, once more, I'd like to congratulate -- congratulate Ms. Frawley, Ms. Tatman, Ms. Villalobos-Flores, Ms. Halblander, and Ms. Rovin on their Board certification, and to wish them many years of continued success. And to every teacher across the -- the 28th District and the entire State of Illinois: The power of your positive influence on our youth cannot be understated. Thank you for all you do.
