I stand today in memory of Evelyn Alexander, who passed away last Friday, May 14th, at the age of eighty-four. Evelyn was born 4 STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 47th Legislative Day 5/21/2021 November 1st, 1936, in Evanston, Illinois, to Milton P. and Bessie Mae Harrison. She attended school in Evanston public school system and was committed to excellence from the start. She graduated with honors from Evanston Township High School in 1954. Two years later, she married her husband, Benjamin F. Alexander, Jr. -- Jr., and they had four children together. Evelyn was committed to her children's excellence. All the Alexanders were educated in the North Chicago school system; with her guidance, went on to pursue high-level careers in a range of industries: Cynthia has a law degree from the University of Iowa; Cheryl has a dual master's from Ohio State; Christina has an associate's degree in merchandise marketing; and Benjamin is a former firefighter, paramedic, and United States veteran. In addition to raising her four wonderful children, Evelyn volunteered with numerous community organizations, including the North Chicago Rotary Club, Partners in Progress, Big Brothers Big Sisters, the North Chicago Housing Authority, Eureka -- Eureka Temple #1172, and the University of Illinois Cooperative Extension Council. Evelyn's longest volunteer service was as a member of the College of Lake County Lakeshore Campus Advisory Board, where she served for more than thirty-five years. Evelyn was also a champion for children in North Chicago, investing more than sixty years of her life in ensuring kids were afforded the opportunity to receive an excellent education. Evelyn chaperoned field trips on sports events, opened her home as a safe haven to children in the area, and never lost a single school board election. She served on four school boards and the Independent Authority of North Chicago Unit School District 187. And to this day, she's the only resident to be appointed and/or elected to every school board district in the history of 5 STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 47th Legislative Day 5/21/2021 the City of North Chicago. In 2017, in honor of her service, North Elementary School in North Chicago was renamed Evelyn Alexander Elementary School, forever cementing her legacy in the community as a staunch advocate for education for all. Evelyn was also an active member in the First Corinthian Missionary Baptist Church. She attended several years before officially becoming a member in 1968 and continued attending services there for more than fifty years, being present at youth-led services, helping with Easter speeches, supporting fundraisers, her proudest achievement — serving on the Pastor's Search Committee. And if you can -- if you can believe this, Evelyn also found time to hold a number of jobs in service to the community. She served as a dispatcher with the North Chicago Police Department, Health Commissioner and Emergency Services Disaster Coordinator, and Chief of Staff to Mayor Bobby E. Thompson. She also served as Legislative Aide to my predecessor for more than fourteen years during his time as a Member of this Body, retiring in 2011. Evelyn received too many awards to count from federal, State, and local entities. Perhaps most deserved, she's a member of the North Chicago Hall of Fame. Evelyn leaves behind four children, eight grandchildren, and nine great-grandchildren, who will no doubt cherish the memory of this amazing woman. Her celebration of life services will be held this Saturday at her beloved First Corinthian Missionary Baptist Church, and - generous of spirit even in death - she has asked that in lieu of flowers, attendees make donations to the North Chicago Public Education Foundation in her honor. Illinois has lost one of its brightest lights. But thanks to her lifetime of service to the children of the North Chicago community, her legacy lives on in the next generation - and the next, and the next. 7 STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 47th Legislative Day 5/21/2021 I rise to honor the life of Marcos Muñoz, a mentor of mine and a pillar of the Little Village community on the southwest side of the City of Chicago and of the farmworker movement. I wanted to take a -- take a moment to share part of his obituary that ran in the Chicago Sun-Times a couple of days ago. Marcos Muñoz was born in Cuidad Acuña, Coahuila, Mexico, and crossed the border at the age of thirteen looking to work in order to help feed his family. After working for a Texas rancher who promised him three dollars a day, thirteen-year-old Marcos asked to finally collect his pay because he missed his mother and wanted to go see her back in Mexico. At night, he'd slept -- he'd sleep in the barn with the livestock that he tended to, and when -- when he went to go ask the rancher for his wages that he was promised, the rancher promised that he'd get them to him in the morning, and he went to sleep happy at the prospect of seeing his family again. However, the next morning, the border patrol had detained him. The agents -- agents had told him that they had gotten a call to pick him up. While Marcos was deported due to -- to this incident when his employer stole his wages, he recrossed the border and entered the migrant stream, picking crops in Texas, Arizona, Colorado, California, Idaho, Nebraska, and Michigan. But he never forgot how he had been exploited and cheated. This helped fuel his eventual union work. Though he never learned to read more than a few words, he became a -- he became a top organizer for Cesar Chavez, the legendary cofounder of what became the United Farm Workers. He met Chavez while picking grapes in the San Juaquin Valley in California in the mid-1960s, where workers routinely labored in baking heat with little access to clean drinking water or portable toilets and were often exposed to pesticides. Marcos 8 STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 47th Legislative Day 5/21/2021 successfully led the United -- United Farm Worker grape boycott in Boston from 1968 to 1971. He then went on to be the East Coast Boycott Coordinator and then was sent to Chicago as the Midwest Boycott Coordinator from '72 to '75. It was during his time on the East Coast that he met his wife Andrea, who in her own right is a pillar of our community. Marcos, a farmworker with less than a second grade education, wound up speaking about the farmworker struggle at Harvard University, at Boston College, at Brandeis, and at MIT. When Marcos left the United Farm Workers, he settled in our neighborhood, the Little Village in Chicago, and went on to become a steelworker for eleven years and then he spent his last eleven years before retirement working at Cook County Hospital. He has been an important part of our community as an activist, helping to organize block clubs, working to elect representatives from the community, and fighting alongside his neighbors to build strong neighborhood schools and establish a family medicine primary care -- care clinic that provides care to all regardless of insurance coverage. He is a mentor to Congressman Chuy Garcia and myself and dozens of other elected and appointed officials. Marcos passed away on to heaven on May 15th, 2021, in peace, surrounded by his family. He is survived by his wife, Andrea O'Malley Muñoz; their daughter, Maria; his grandson, Anthony; and his great-grandson, Zion; and many other family members. According to his wife, Marcos would often say, "The greatest poverty in your life is not the lack of money. It's the lack of knowing what you are capable of. That's what Cesar taught me. He gave me the understanding that I am good for something." Marcos Muñoz is deeply missed by all those that loved him and by all of those -- of us who had a privilege of being in his presence and knowing 9 STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 47th Legislative Day 5/21/2021 him. I leave today to go back to my community to celebrate his life this weekend. I ask for a moment of silence.

Mr. President, I have been advised that, in multiple committee hearings, there has been conflicting rulings given on the manner in which legislation is heard multiple times during that hearing. Specifically, in a Higher Ed committee recently, Senate Bill 1832 was voted on and was not adopted in an initial vote; then, in a subsequent vote that occurred as a result of a motion to reconsider that measure, moved -- advanced. Separately, in -- in Executive Committee this week, House Bill 3437 failed an initial vote and then, on a motion to adopt, was reconsidered in the committee and subsequently pushed forward and I think reported as favorably passed. Those rulings are in conflict with one another. And we need some guidance as to what the proper procedure is when a manner {sic} has been voted down in committee and whether Members can rehear that same measure during that same committee hearing.
PRESIDING OFFICER: (SENATOR MUÑOZ) The ruling in both of the committees were the same. The one in Higher Ed, they had a correction on that one - in the report.

PRESIDING OFFICER: (SENATOR MUÑOZ) According to our Parliamentarian, he doesn't recall that. We can double-check and get back to you on that one, Senator.
Let me -- let me go further. More recently, the motion to adopt -- or move on HB 3437, the second motion to adopt, the ruling I believe by the Parliamentarian was that that second motion was in order. Is that correct?
PRESIDING OFFICER: (SENATOR MUÑOZ) That's correct, Senator.
Under what Senate rule is that motion allowed - that second motion?
PRESIDING OFFICER: (SENATOR MUÑOZ) There is no prohibition to that rules {sic} in the book and that's been done for decades.
Mr. President, I would call the Body's attention to Senate Rule 12-2, which says that, in such an instance, the 2010 edition of Mason's Manual of Legislative Procedures {sic} (Procedure) shall govern. And in fact, Section 159 of Mason's rules says that such a question may be considered only once. And so I object to the second motion that occurred on that manner {sic} and the ruling by the Parliamentarian at that time.

Mr. President, I rise today to lift up May as Mental Health Awareness Month. The National Alliance of {sic} (on) Mental Illness reports that one out of six of our teenagers -- or young people between the age of six and seventeen is struggling with a serious mental illness, oftentimes in silence. And so today I rise to give some visibility to teenagers and young people and -- and the district I represent who suffer in this way, and certainly the young people that come from all across the State, who oftentimes are suffering with mental illnesses and don't have the language to talk about what they're experiencing and, tragically, often don't have the resources that they need to navigate that struggle. I would also ask my colleagues to -- I would implore my 12 STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 47th Legislative Day 5/21/2021 colleagues to keep these young people in mind over the next couple of weeks as it starts to get hotter outside and as our young people oftentimes struggle to find productive activities to do, and so you have that working in tandem with mental health which creates a -- a really unstable situation in a lot of our communities which oftentimes affects public safety. And so I think if we -- if we keep mental health -- keep that in the front of our awareness as we go into our budget discussions and -- and, more importantly, as we go back into our communities, we certainly can be a source of hope for a lot of our young people who oftentimes feel like no one sees or hears them and their -- in their struggle. At this point, I would also like to ask that we have a moment of silence for those who are suffering currently and -- and for those who we have lost prematurely to serious mental illnesses.

Yes. Thank you, Madam President. Senate Joint Resolution Constitutional Amendment No. 11 proposes to amend the Illinois Constitution to provide that no law passed on or after the amendment's enactment may prohibit the ability of workers to collectively bargain over wages, hours, terms and conditions. As many of you know, wages have been stagnant for a generation despite sizable increases in overall productivity, incomes, and wealth. For instance, our nation's output of goods and services per hour worked grew sixty-four percent from 1979 to 2014, while the inflation-adjusted hourly wage of a typical worker rose by just six percent. The falling rate of unionization has lowered wages, not only because some workers no longer receive the higher union wage, but also because there is less pressure on non-union employers to raise wages. The ability of unions to set labor standards has declined. Last point I'll make - happy to take questions afterwards - is in the 34th Annual Corporate Survey conducted in 2020, right-to-work once again ranked outside of the top ten factors cited by corporate executives in business location decisions. And with that, Madam President, I'm happy to answer any questions and ask for an Aye vote.

Thank you, Madam President, and thank you, Senator, for that question. The Workers' Rights Amendment would establish a new Section in the Illinois Bill of Rights that would limit the power of the General Assembly, State, or any unit of local government to pass a law that restricts or prohibits collective bargaining over wages, hours, and terms and conditions of employment with respect to certain employees, or that impairs private sector workers' right to contract for union security agreements. It is the drafters' intent that this new Section creates a constitutional floor for bargaining in Illinois; however, it does not and is not intended to preempt or disturb any portion of the Illinois Public Labor Relations Act or the Illinois Education {sic} (Educational) Labor Relations Act, or any accompanying regulations or judicial precedents, as currently construed upon the passage of this proposed Amendment.

As you noted, Senator, the Amendment refers to "employees" and not workers or individuals. This was done with intention. As the Members of the house should be aware, the National Labor Relations Act governs organizing and collective bargaining in the private sector and, as such, preempts any direct State regulation of the subject. Therefore, as federal law stands today, labor -- excuse me, therefore, as federal labor law stands today, the Amendment could not apply to the private sector. With that in mind, the drafters referred to "employees" in the context of collective bargaining and organizing with the understanding that it implicitly incorporates the well-organized {sic} and accepted understanding of an "employee" for purposes of organizing under the IL -- the IPLRA and the IELRA as understood and construed upon passage of this Amendment.

Senator, with regard to the public sector labor law in Illinois, what would change if this Amendment passed?

Therefore, we contend that the status quo would be acceptable under the Amendment.
