It's worth pointing out that many of these refugees are individuals or their families who served alongside the US military or the International coalition during the Iraq and Afghanistan war. Senate Bill 2697 requires a group policy of accident and health insurance or managed care plan to provide coverage for clinical genetic testing for an inherited gene mutation for individuals with a personal or family history of cancers, as recommended by a health care professional. Beginning on January 1st, 2026, the coverage also limits the total amount that an individual is required to pay for a clinical genetic test to $50. This is an initiative of the Susan G. Komen Foundation. This bill was worked on for several weeks with the Insurance Industry and CMS. I believe this bill will go a long way to saving a lot of lives, and I'm very proud to bring the bill to 3rd Reading this afternoon. Happy to answer questions. So -- so, Senator Chesney, there is a program right now for the Secretary of State that it would be no cost to those individuals who are coming out of institutions, transitioning back into society. Yes, and I appreciate that Senator, we were aware of that in our analysis. I think our concern is, is that right now, if you have a poor, working, poor person in the State of Illinois that is of the age of 18 to 64, they have to pay a fee of $20 for an ID, presumably also that will help them get a job. And -- and yet you can be a convicted felon or convicted of a misdemeanor of a jury of their peers, and they get a free ID. Senator, I vividly recall our -- our debate over that in committee and Senator, I do not think that you could go in over a weekend and come out, and this applies to you. I really think that it's for, people who are incarcerated for a length of time and then who are transitioning back into society, not those who will either come in on a furlough or those who are just locked up over the weekend and are five days or six days and then gets released from a county jail or anything like that. I don't think that's the spirit of the -- the bill. And let me remind you that the bill, the genesis of the bill came from a chief probation officer, federal officer, probation officer who wanted to lessen the recidivism rate of those going out and then turning around, coming back in because of the prohibitive factor of trying to get an ID. But this bill has been amended to also include county jails and Department of Corrections. In my experience, 20 years in the Department of Corrections once someone who's incarcerated, who really wants to make sure that they get everything that's due them while they're locked up, will in fact ask for this ID card simply because they can. And so, we run the risk of having those who are locked up for a weekend or a furlough, as Senator described, simply asking for that ID. Now, I would say that in committee someone testified from the Secretaries of State, Secretary of State's Office that they don't -- they're not concerned about that, that they would be willing to do that, and that they also are not concerned about the cost that will be incurred here. So, as we vote for this bill, for those who vote yes, just please keep in mind that the Secretary of State's Office said they don't have any concern about what this might cost. I urge a No vote on the bill. I did vote Yes in committee in order to move it out, but I don't support it, in this form, and won't support it today. Thank you. Senator the -- the whole idea of and I understand what you're saying, but the whole idea surrounding this is to give IDs to people who -- are persons who are incarcerated, who are transferring -- transitioning back into society, not those who want to usurp. Paying the $20 for, the DM - Secretary of State fee and go to jail in lieu of paying the $20. Not those who, are in jail or incarcerated in prison, they won't get it. It's designed for those who are coming out of those, jail or those who are coming out of prison to get them an ID card so that they can go further on with their life. And I know we're putting a real emphasis on the cost. Some of you are, I would also remind you that when we, recidivate and we go back to prison, that that or go back to jail, that that cost pales in comparison. Cost for an ID pales in comparison to putting someone up and providing meals and all those things for them as well. So, I hope I answered your question, Senator. I -- I have the greatest respect for Senator Belt. What he's trying to accomplish, I think the -- the constituent or the person that was a parole officer that brought the idea had a very good idea. We all want someone exiting a correctional facility or a jail to have an opportunity to work, to become a productive citizen. I think Senator Chesney had a very worthwhile discussion about the difference of someone who isn't incarcerated, having to pay a fee regardless of how much money they have. And the fact that this bill, is meant to say upon release, but it doesn't. And as we know, all the words in a bill matter. And it's true, a person that is incarcerated could avail themselves of as many as IDs as they want. All they have to do is apply to the Secretary of State, and it says they will issue them. We're stewards of the State's money. The Secretary of State didn't think they'd have any problem doing this. And I say good luck. I think you are going to see that it's going to be a high cost, because anybody incarcerated can ask for this and will and the person on the street cannot. They have to pay a fee. And that's not fair. Anyway, that's why I can't support the bill. And -- and I appreciate the intent. Senate Bill 2919 sets out a framework of rules and regulations that would permit the use of online auctions in judicial foreclosure proceedings. The bill was extensively negotiated with multiple stakeholders, and most of those stakeholders have been moved to neutral. The Administrative Office of the Illinois Courts still are opposed, but yet they're not able to tell us because they've been unable to meet on it, what the nature of their opposition is, and how we could address it. The propionates of this bill will continue to have given our assurances they will continue to negotiate the bill in the House Chamber, if it were to pass today. What I would point out is that, people who unfortunately have the -- the -- the burden of having to go through foreclosure proceedings are facing one of the more difficult financial situations that they deal with in their lives. When their property is sold, the purpose is to satisfy the debt that they owe to that lender, and so therefore the highest possible bid, the - provide the best possible outcome and limit the liability that a person going through for foreclosure may have after the sale. This bill provides that, it provides an opportunity for better outcomes for the people dealing with this, incredible financial burden, and it sets rules and regulations to make sure that fees associated with doing this are reasonable and there is a framework that is transparent. So other than the opposition that I stated, I believe everyone else is neutral at this point. This is an initiative of Equality Illinois, and this bill is designed to support diversity and inclusion in the nonprofit sector and build upon the General Assembly's previous efforts to highlight and elevate leadership, diversity, equity, and inclusion in Illinois. This bill accomplishes this by requiring -- requiring nonprofit organizations that provide $1 million or more in grants each year to report the aggregate demographic data of their board of directors and officers of public facing -- on their public facing website. Some not-for-profits might not have any problem with disclosing demographics, but the fact is, very many nonprofits grant - make grants of over $1 million. Many small not-for-profits do that, and many of these not-for-profits are run by volunteers, they have a volunteer board, and the board members are often chosen for unique characteristics, experience, and whatever the not-for- profits mission is and the like. This bill, could and I have spoken to several not-for-profits and they have confirmed this, this bill can have an effect of making those volunteer board members decide they don't want to serve. And that's a shame. Our not-for-profits in Illinois do great work and are needed. So, putting a burden on them, that makes it more difficult for them to get volunteer board members. I think it's a bad idea. And the fact that you have an obligation to put on your website. We've got two board Members that don't disclose. Well, it's easy enough, if you've got six board members and two won't disclose and four do, it's easy enough to see who the one's aren't. It's a - it's a just bit of a burden to put on a not-for-profit that certainly want diversity. But as 76 STATE OF ILLINOIS 103rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 96th Legislative Day 4/10/2024 I said, it's a unique situation for a not-for-profit in choosing who to ask to be on their board because of their certain mission. And many of these, as I said, are run by volunteers. Does it make sense that they're going to have to hire staff to put this all together, to get the disclosures, and the like? And -- and, you know, for this reason, I just don't think this is a good idea. It's a bit of a burden that doesn't need to be there. Any not-for- profit wants diversity on their board, but many are going to be tied and many volunteers, as I said, I've had this confirmed, they just aren't going to be bothered with it. We've seen this in our -- our statements of economic interest. Many townships and -- and the like are having problems finding people to fill the spots because it's a burden to have to disclose personal information. This is personal information that may or may not be disclosed. And the fact that you have to post that you didn't disclose, is an invasion of privacy. Thank you. He's just always ever present with his camera. And I'm sure you all have seen Lee taking pictures on the Floor, in press conferences, and just about anywhere and everywhere in the Capitol. So today we honor his lifelong commitment and legacy to Springfield. After going to college, serving in the Army, and having a stint in Washington, DC, Lee moved back to Springfield in late 1974 to marry his wife, Cindy, and has been an integral part of the Capital City ever since. It tries to end surprise sales that result in new owners coming in, raising rates, and seniors on fixed incomes, and low- income residents are basically economically evicted. What this 82 STATE OF ILLINOIS 103rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 96th Legislative Day 4/10/2024 legislation specifically does, it creates a right of first refusal for residents of a mobile home park. If a park owner elects to sell that park, the homeowners through a Homeowner's Association may exercise their right of first refusal. The Association has 60 days from the date of notice to enter into a contract to purchase the park from the park owners, otherwise that right of refusal is void. We did work with the Illinois Manufacturers Association to come up with agreed language on this legislation. They are in support of this bill. Happy to answer any questions and I ask for an Aye vote. Certainly, I understand what Senators trying to do, and certainly we want to provide affordable housing for Illinoisans. However, this is a precedent that infringes on personal property rights, real estate rights. It invades a person's right to own property. If he wants to sell, she wants to sell their property to Cousin Eddie, to a child that - one of their children, to anybody. They first must go through this, that's an infringement, that is not the way we view property rights in Illinois or in the United States. And it's too much of an infringement on real estate rights. That is that person's property. That's embedded in our democracy in this country, that is that person's property. And we're taking away from that and eroding from that and it's bad precedent. And for that reason, there is no way I could support this. It really erodes too far a person's right to own property in this State. Thank you. Senator Stadelman, when Senator Tracy asked the question about what -- what -- what the bill actually does is this force them to provide the opportunity to another group, your -- your answer was it provides an opportunity to the HOA to actually, make an offer. What presently prevents the HOA from making an offer, if they want to buy the property? PRESIDING OFFICER (SENATOR AQUINO) Senator Stadelman.
One it serves as a notification process, so homeowners, you know, mobile park residents can be aware of it. Allows them an opportunity to organize a Homeowner's Association, to allow that process and structure to take place. And again, I just would like to add that, while you may describe it as a mandate, the Association would have to match the offer that's currently on the table that the property owners want to sell. Not sure I understand the premise of your question, but again, there's a 60-day window for a homeowner's association to match that offer, and within 60 days it doesn't happen. Therefore, the park owners don't need to have to enter into a contract. PRESIDING OFFICER (SENATOR AQUINO) Senator Plummer.
Well, I understand your intent and things always. Sound good, but -- but in reality, the world works a little bit differently than we imagine. Sometimes in areas that we're not super experienced, is anyone in real estate knows anytime rights of first refusal are negotiated into leases, or rights of first refusal, or negotiated into contracts. It harms the value of the property that that lease or that contract is tied to. So, for instance, let's talk about a mobile home park. So, if you have a mobile home park and it's worth X amount of dollars, and the state creates this law that this right of first refusal has to exist, when you go buy a piece of property, you don't just agree on a price and sign the document and then pay for it. You have to go survey the property. You have to do environmental inspections. You have to hire attorneys to review leases. You have to spend a tremendous amount of money on due diligence before you even acquire the property. And so, if a company is going to put an offer forward, they're going to put that offer forward with the anticipation that if the 86 STATE OF ILLINOIS 103rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 96th Legislative Day 4/10/2024 offer is accepted, they're going to be able to buy the property. Otherwise, they're not going to want to spend hundreds and hundreds of thousands of dollars or tens of thousands of dollars on due diligence. If some other company or some other group of people is going to be able to skip all the due diligence and just match their offer. So, if a property is worth $500,000, a group is not going to offer $500,000. They're going to offer 300 or $400,000, because there's significant risk that they're going to spend all of this money, and then some other groups are just going to come in and take the property. So, if we pass this bill, we are in effect destroying value of property owners in Illinois. What are we going to do to make up for that? PRESIDING OFFICER (SENATOR AQUINO) Senator Stadelman.
I appreciate the Senator's remarks. I just want to stress this is language agreed to by the Illinois Manufactured Housing Association, who represents mobile park owners. They think this is a good thing. They helped us draft this language because they realize the benefit that an association is willing to match their offer that they have on the table. It accomplishes a couple of things. They're able to sell the park to the residents, and the residents are able to maintain affordable housing as often as may happen in your own districts. You have new owners coming in. They jack up the rates. It economically evicts seniors on low income and also low-income residents. And this prevents an affordable housing option. So, the association represents the property owners that you're talking about, thinks this is a good deal. And they're willing to allow this option for associations to come forward to 87 STATE OF ILLINOIS 103rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 96th Legislative Day 4/10/2024 match that offer within 60 days. The Illinois Manufacturers Association helped draft this language, there in support of the bill, if anybody has anything to gain or lose by this legislation, they drafted this language. And fundamentally this is what seniors on fixed incomes, this is what low-income residents who are in these parks deserve. They deserve protection, because sometimes and way too often, you have new owners coming in, jacking up the rates, they're evicted, they have no place to go, they do not have affordable place to go. So, this is an area where hotel owners want to give the excuse when they have guests stay in their establishments, that oh, they can't provide this sanitary single use bottle because it's not in your room. Because -- not because we don't want to put in your room, but because the State of Illinois, again, is coming down on us and forcing us to comply with a mandate. This is unnecessary, if all the hotels are for this. If they're in favor of this, then let them do it. Let them do it. But don't use the State of Illinois, as an excuse, as to why someone's trip to our State is a little bit worse because they -- they go to a bathroom or a shower, and whatever is supplied is not adequate for them because of this legislation. Additionally, it's troubling, I shouldn't say troubling. Additionally, it's an extra burden on States Attorney's Offices. Right now, they are just dealing with the SAFE-T Act, whether you support that piece of legislation or not, it is undeniable that it's causing issues with staffing and issues with the burden that prosecutors have to meet every single day in courtrooms. They do not have the resources right now to also have to police each hotel to ensure that they are not using single use plastic bottles. So, it overburdens our States Attorneys who not only are battling, crime right now, but also having to deal with the implementation of the SAFE-T Act. And they're the ones who decide how and from what source to fund the economic revitalization.
