Senator, just one question, I just want to check on. In 19 STATE OF ILLINOIS 103rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 95th Legislative Day 4/9/2024 regards to the - I understand the need when you're talking about a family, caregiver taking care of their loved ones, of not needing the necessarily that -- that automatic check in. But what happens in some of these cases where we've heard about some of these, where the family goes on vacation or leaves town and leaves their loved one at home unattended. In this case, you know, there's a possibility that a person could be - literally leave and have that, either that senior or that disabled child unattended and yet still be paid for -- for treating that individual. So, what kind of safeguard is there to assure that -- that families are, in fact, taking care of their loved ones?

I'm concerned about this on many fronts. First of all, this was -- this rule was put in place years ago after blatant abuse and neglect was in the system was found where people were cashing paychecks from the State taxpayers without ever providing a service. So, despite the sort of fraudulent element to that, which triggered this, the more important issue here, however, is the direct care of seniors and those with developmental disabilities. Because to the extent that someone is cashing a check, when they're not actually there, by implication, that senior, that individual with developmental disabilities is not receiving the care that they need, that they deserve. Taking away this check, as inconvenient as it may be, for those who are doing the right thing and providing the care, taking away this easy check though maybe inconvenient, but not terrible. This one check to make sure that -- that senior, that individual developed disabilities is actually receiving the care they're supposed to receive. Vote for this if you want. But the next time you pick up your paper and read about - Senator Syverson, just pointed out, you know, somebody went on vacation and left their loved one alone at home, and they end up in the hospital or died or something awful happened. Don't come back here complaining about it. Because you're on warning. Thank you, Madam President.

I appreciate the questions and the comments from my colleagues, but I do want to, kind of reiterate, that the federal government requires State Medicaid programs to implement an electronic verification system for home care services, and there was guidance issued by CMS in 2019 that allows State to have discretion about whether or not to apply these requirements to live-in caregivers. And as part of the most recent changes to the Home and Community Based Services waiver, HFS is no longer requiring this verification for live-in stakeholders. So that was one of the reasons for the impetus for this legislation. As a person that cares deeply about the seniors in our community and has spent a great deal of time being an advocate for our seniors, I would never advocate for anything that I thought was going to put any seniors in harm, in any way, whatsoever. I think that this is again, a piece of legislation that has been thoroughly discussed and worked on with HFS and Aging, the two entities that are -- we look to for services for seniors. What this bill does is it takes out some of the requirements from the bill that harnesses those of us that need to help our veterans, which is the electric vehicle charging stations and these small, tiny homes is what they're referred to as, if they're only about 800 square feet, and they have two bedrooms and a kitchen and a living room, and they don't have all these -- all these things are volunteer. So, it's a great expense to have electric vehicle charging stations within. So, it's a great bill. And I appreciate all of your votes on it. And there is no opposition to this bill. As amended, Senate Bill 2643 amends the Funeral Directors and Embalmers Licensing Code and the Crematory Regulation -- Regulation Act in response to the devastating story out of Carlinville, where over 50 families received the wrong remains or bodies of their loved ones. A complaint was filed with the Department of Financial and Professional Regulation in March of 2023. On September 29th, 2023, Sangamon County Coroner, Jim Allmon, went public with what he witnessed inside the funeral home. A week later, IDPFR took action against the funeral home. Since I filed the underlying bill in November of 2023, another horrific case was brought to light in Centralia. In that case, an anonymous source complained of the unkempt and unsanitary preparation room at a funeral home to the Department of Financial and Professional Regulations. Photos of that preparation room were circulated in the news. Ten weeks after receiving the complaint, and three days after journalists visited the Centralia Funeral Home with questions, IDFPR inspected the premise. When our loved ones pass away, we make arrangements while dealing with our grief. We find comfort in knowing that we are 25 STATE OF ILLINOIS 103rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 95th Legislative Day 4/9/2024 executing our loved ones wishes. When a coroner calls you months after your loved ones funeral saying, "I have your mom's cremated remains", and you think to yourself, my mom wasn't cremated, we buried her last April. Then the coroner tells you that the woman you buried wasn't your mother. It retraumatize and opens new wounds of grief for families. With that in mind, Senate Bill 2643 adds identification rules and regulations regarding the handling and storing of human bodies to the list of items that IDFPR is required to examine the knowledge of an applicant for a license under the Funeral Directors and Embalmers Licensing Code. The bill requires the Department to inspect the premises of the licensee when it receives a complaint for a violation of the Act. When the Department receives a complaint against a licensee relating to the mishandling of human remains or the misidentification of human remains, the Department shall inspect the premises named in the complaint within 10 calendar days after receipt of the complaint. Under this bill, a funeral establishment and a crematory authority are required to maintain "chain of custody records" that are "uniquely identified" to the deceased. The identification system shall ensure that the death care industry is able to identify the human remains in its possession through final disposition. This bill was drafted to create parity for all death care providers in relation to the penalties for bad actors. The amendment changes the penalty for intentionally and knowingly lying on documents and not following set statutory procedures that could result in conducting a method of final disposition that is not what the deceased provided for to a Class 4 felony. Under Amendment No. 1, operating without a license is a Class 3 felony. All other violations of the Act remain the same as current law, where the 26 STATE OF ILLINOIS 103rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 95th Legislative Day 4/9/2024 Department may refuse to issue or renew, revoke, suspend place on probation or administrative supervision, reprimand, or take other disciplinary or non-disciplinary action as the Department may deem appropriate, including fines not to exceed $10,000 for each violation. I think it's important to note, too, that the penalty enhancement creates parity in the death care industry. Currently, funeral directors and embalmers are held to a lower standard than crematory authorities and crematories. I want to thank all the stakeholders who engaged with me throughout this process. It was -- it was a very difficult process. There was a -- I -- I also want to thank the families of those that were impacted that participated and I know that it was very difficult for them because in oftentimes they were reliving their grief all over again. But I think that their participation really speaks to why this bill is so important. I'm really proud to say the amendment brought the Illinois Funeral Directors Association, Illinois Crematory and Funeral Home Association, Department of Public Health, Department of Financial and Professional Regulations, and the State Comptroller to Neutral. Senate Bill 2683 will strengthen the State's stalking laws and help keep victims and survivors safe from their abusers by expanding the definition of stalking to include electronic tracking systems. Illinois is one of several states that do already prohibits installing a tracking device without the consent of others. What this legislation does is simply expand that language to civil law. With advances in technology, more people are using these electronic devices to keep track of their luggage, wallets, and other personal belongings. However, unfortunately, some people are using them for the wrong reasons and using these devices to stalk others. This will hopefully provide another deterrent from -- from happening. Right now, when condo buildings are built and they sell off the parking spaces, the disabled parking spaces are generally sold off as well. They become then private property and not available for people that need it. So, what this bill does is says that whenever a new condo building is developed, that the accessible parking is going to remain a part of the common elements, to allow the condo board that comes in and takes over that new building can make sure that those can be handled for people who have disabilities and need it. Additionally, this requires that any existing condo building that has accessible parking that they come up with a plan on how they can best preserve that parking for people who have disabilities. And this came about because there was an individual in the City of Chicago who needed an accessible parking space. It was not available to them. It was owned by someone who was not disabled, who refused to sell it. They ended up actually having to move out of their condo into another building and actually buy a accessible parking space at the astronomical price of $60,000 for the space. This is going to make sure that those kinds of situations don't happen again. Thank you, Madam President. Senate Bill 2743, as amended, creates the Water Plan Task Force Act and codifies the State Water Plan Task Force. It shall be chaired by IDNRs Director of the Office of Water Resources and composed of members from various other State entities. The purpose of the Task Force is to identify critical water issues, develop recommendations, and assist State and local authorities in the implementation of those recommendations. The Task Force is required to publish a State water plan not less than every 10 years and maintain a publicly available website. It's required to meet once per quarter each calendar year.

Thank -- thank you, Madam President. This bill was -- here's what the bill does, Senator Rose. What this bill does is I had a constituent who was being raped by a parent. That student was moved from that parent's house into their other parent's house by DCFS. And unfortunately, the other parent did not live in the school district, that the school -- that the student was attending a school in. And so, this student, because of these horrific allegations, was forced to move out of this school district that they were currently in and move into a different school district. So, they lost all their friends, all their teachers, everything they knew. So, this is a bill that will correct that in the future and make it so that if there's a situation where a child is moved out of a home because of abuse or neglect, DCFS can decide what's in the child's best interest and override the school. Thank you, Madam President. So, this bill came to me because we had some constituents who inherited property. Their relative who had owned the property was behind in their property taxes, and this deceased person was still being charged property tax penalties and interest even though they were dead. So, while the -- while the family was waiting to take care of the final wishes of the loved one, they were the -- the -- the -- they were continuing to be charged property taxes. So, what this bill does is that in situations where a person who has back property taxes, if they pass away, this would pause any property tax penalties and interest from accruing until after the probate's been settled or until someone purchases the property. And it's been worked out. So, in other words, what this bill does is this stops taxing dead people over property. So, a few years back I was running a drone bill and IDOT came to me and told me that all drone -- all drone laws are actually controlled by the federal government.

Actually, as I -- as I just said in my remarks, Senator. The federal government, the FAA has the ultimate authority over 400 feet, under 400 feet IDOT which controls the Illinois Aeronautics Act, would have authority under that 400 feet. IDOT has been given the authority by our Body to create rules six or seven years ago, and they have failed to do so. So, when they do get around to doing that, those would supersede any local rules. In the meantime, I think it's important for our local governments to be able to create those as needed.

Senate Bill 2019 {sic} (2918) amends the Illinois Municipal Code to prohibit municipalities from discharging a police officer as a result of their having a physical or mental disability that forms a basis of an application for benefits under portions of the Pension Code relating to officers working in municipalities of fewer than 500,000 people. This is a provision that already exists for firefighters, to prohibit them from being terminated because of a work-related disability. The bill adds the shipping prohibition to the list of petty offenses a person or retailer could face for violating the Act. This was a bill that came to me from a constituent who is the President of Joliet Township High School, and this was another issue of us trying to address kids vaping in schools. Senate Bill 3237 allows school -- school districts waiting on the fiscal year 2004, 2005, and 2006 School Construction Program (Grant) Lists who have already expended funds towards their school construction project to adjust their required local match for their construction project for the first three available application cycles after June 30th, 2024. 47 STATE OF ILLINOIS 103rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 95th Legislative Day 4/9/2024 Madam President, what this bill looks to do, the School Construction Program that the General Assembly voted on in 1997, went into effect in 1998. The 2004, 2005, and 2006 school districts received letters of entitlement. A lot of those school districts went forward with projects and referendums to fund new school buildings, do enhancement on existing school buildings, and there were never any funding reimbursed towards those school districts. And so, what this legislation looks to do is for the 2004, 2005, and 2006 school districts, on that list, is to help them receive funding, for those projects.

Senator Rezin, it will not, unfortunately, in the negotiating process, we in an -- in an effort to get some opposition to move neutral, we kind of backed off the 2004, 2005, 2006. And so, what we're -- what we've always asked for was funding in three rounds. And so, it's our hope that if the bill is successful, that we'll have these 2004, 2005, and 2006 school districts, as well as the other -- other school districts will have three rounds to apply for -- for funding. And so, in a sense, they'll have three different chances.

I do wish that we could have first taken care of the schools that have built the schools 20 years ago, waiting for their money, and have been waiting for their money. But Senate Bill 3265, this bill would aim to improve access to nutritious foods in rural food deserts by creating a program where the Illinois Department of Agriculture establishes and operates projects and strategies focusing on the 51 STATE OF ILLINOIS 103rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 95th Legislative Day 4/9/2024 distribution of fresh and nutritious food, while providing education and food preparation and nutrition in food deserts. This issue is one that hits rural, low income communities the hardest. The bill also defines a food desert to mean an underserved geographic area, where fresh and nutritious foods are difficult to obtain, as determined by the Department. Obviously, no opposition. Thank you, Madam -- Madam President, this bill came to me because I had a constituent right here in Sangamon County who observed the Department of Transportation spraying a pesticide cocktail on a right of way that was going into swimming pools. It 52 STATE OF ILLINOIS 103rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 95th Legislative Day 4/9/2024 actually was like hitting kids in their -- in their yards while they were playing, and it was hitting houses and things. And when this constituent tried to find out what exactly was in this cocktail, IDOT refused to tell him. After our office got involved, we found out that this was a pesticide cocktail that should not have been near anybody. And it should not have been sprayed on -- on humans. And so, what this bill does is it makes it so that any local government or the State, any time they are going to spray pesticides on a right of way within 200 feet of a house, they have to give the people that live in that area notification at least 24 hours in advance, and they have to let the people know exactly what they are spraying, and they have to provide a phone number to call in case there are any incidents to report. And so, I've worked with the park districts and IDPH to make sure the language was something that both of them could accept. And so, I'd be happy to answer any questions. And this is a good bill.
