House Bill 32, sorry -- 5232, it just makes a change to the personal care product industry supplier disparity study that was enacted in 2021, as a part of the Black Caucus pillar, the economic pillar. And it is important to note, this -- this study is really important, because when it comes to hair care category, the black community and other communities that spend considerable amount of money for these products, and there seems to be a disparity. And so, what we're doing too, is we're first doing a couple of things. It makes us -- the -- the study subject to appropriation, and it pushes the study date back from -- originally, we were supposed to have a report in 2022 to -- we pushed it back to 2027. And so, this disparity study will evaluate demographic data at the supplier of -- or distribution level for retailers of beauty supply stores, cosmetics, hair care supplies, and personal care products. And this is the purpose of the Education of Homeless Children and Youth State Grant Program. So, House Bill 5407, subject to appropriation, expands the permitted uses for funds received by school districts from the Education of Homeless Children and Youth State Grant Program. And, I want to add that this is an initiative of the Chicago Coalition for the Homeless (Chicago Coalition to end Homelessness), and I want to thank Representative Mussman for passing it out of the House. Thank you, Mr. President. HB 5431 amends the Counties Code, the Unified Code of Corrections and County Jail Act. Across Illinois, every jail in the State has their own policies and procedures when it comes to pregnant, incarcerated individuals and their protections. A study released in March of 2024, done by the Women's Justice Institute and ACLU of Illinois, found that most Illinois jails and prisons lack consistent, medically necessary policies needed to protect the health, lives, safety, and well- being of incarcerated pregnant, and postpartum individuals and their babies. This bill will ensure that every pregnant, postpartum, and breastfeeding individual in all county jails and prisons has the same rights and protections. The use of restraints during labor has been prohibited statewide since 2000. The use of restraints during pregnancy has been prohibited in Cook County since 2012, but applies to no other county jails in Illinois. HB 5431 prohibits the use of restraints during the entire pregnancy of an incarcerated individual and six-week postpartum recovery period. Additionally, as of this moment, there are no legal 9  STATE OF ILLINOIS 103rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 115th Legislative Day 5/21/2024 requirements that pregnant or postpartum individuals are provided with the necessary supplemental nutrition. To address this issue, HB 5431 requires an additional 300 calories per day to be made available outside of regular meal time to pregnant and lactating individuals. HB 5431 was an initiative brought to me by the Women's Justice Institute, seeking to align protections statewide to address the lack of humane treatment of incarcerated pregnant people. Additionally, the legislation requires annual reporting on pregnancies, births, miscarriages, and the use of restraints in Illinois facilities. This bill came over from the House with the unanimous 105 to 0 vote, and I would ask for an Aye vote. PRESIDING OFFICER (SENATOR KOEHLER) Seeing no discussion. The bill provides that the program shall be implemented based on the New Americans Plan developed by IDFPR in accordance with the Governor's Office of New Americans Act and also provides that the program shall be administered by IDFPR licensing liaison for international applicants. It expands the list of documents eligible for requests by an employee to include personnel documents used in determining the employ -- employee's qualifications for employment, employment-related contracts that are legally binding on the employee -- employee handbooks and any written employer policies or procedures that the employer contends the employer{sic} (employee) was subject to -- to that concern qualifications for employment. This is an initiative by a constituent and the National Employment Lawyers Association. There was an amendment that addressed significant concerns raised by the Illinois Chamber of Commerce, IRMA, Illinois Manufacturers Association. They are all neutral now, would ask for an Aye vote. I would just note, again, that there was significant work done on this legislation to address concerns of the business community. Organizations that we rely on for their expertise, as has been mentioned from the other side. For example, House Bill 3763 now exempts employers trade secrets, client lists, sales projections, and financial data from disclosure to employees. It also establishes a clear timetable for when a civil action can be brought by specifying that employees may not bring a civil action until the Department of Labor has failed to resolve their complaint within 180 calendar days or if the Department certifies in writing that it is unlikely to be able to resolve the complaint within that 180 days. Again, that amendment brought the major business groups to Chamber, IRMA, and Illinois Manufacturers Association to neutral. I would ask for an Aye vote. Thank you. Thank you, Mr. President. There were discussions, on this, regarding a potential opposition from Union. At one point, there was talks of amending the bill to address their concerns. But it's my understanding that the parties met, during the summer. Adult Redeploy is a program that -- helps folks, it's a diversion program, and helps move people out of either anything that could be behavior that can cause them to commit a crime, or if they've been in a -- in a bad position to help them essentially, rehabilitate back to society. I -- I believe it's first time offenders and they have to meet certain criteria. And so, this diversion program and I became familiar with it Senator, because my successor in the House of Representatives -- Representative LaPointe actually, before she became a Representative, used to work for Adult Redeploy. What do you can and I apologize because this is not about the creation of Adult Redeploy. Your bill merely changes the structure of the Board and then some terminology used in it. Right? But this program has been very, very successful at taking first time offenders and not everyone, just specifically eligible for this program, and giving them diversion resources, alternatives to be incarceration. It's a wildly successful program. These are measures designed to make them better. We shouldn't second guess them. This is a program that deserves our support, I would strongly suggest an Aye vote. I rise to bring awareness to the fact that May is Mental Health -- Mental Health Awareness Month. Mental health includes our emotional, psychological, and social well-being and 1 in 5 people struggle with their mental wellness. I'd like to assure Illinoisans that their mental health is as important, if not more important, as their physical health. Our society has been programed to believe a myth that a personality weakness or character flaw causes mental unwellness and that people with mental health struggles can snap out of it if they "just try hard enough". There is a stigma that seeking help for mental wellness is a moral failing or character flaw, and not fixing your own problems is viewed as weak. I rise to challenge this stigma. In fact, mental health issues have nothing to do with being lazy or weak. In fact, many factors contribute to mental health problems including biological factors such as genes, physical illness, injury, brain chemistry, adverse life experiences such as trauma, or a history of abuse including physical, sexual, or emotional. I want to bring attention to the following list of people you might have heard of who have come forward to share their own experiences and the importance of seeking help from a therapist. Football player Tom Brady, Olympic swimmer Michael Phelps, singer Katy Perry, tennis great Serena Williams, actor Jennifer Aniston, gold medalist Simone Biles and lead singer of my favorite band, Imagine Dragons, Dan Reynolds.
