Thank you, Mr. President. Thirty years ago, this Body, probably around the same time of the year, declared public schools should be free of corporal punishment. Corporal punishment is an outdated practice. In Illinois, students in grades K-12 deserve equal protection under the law, no matter where they attend school. House Bill 4175 prohibits the use of corporal punishment against students and nonpublic elementary and secondary schools. Corporal punishment does not include permitted uses of physical restraints to prevent a student from harming themselves, others, or property. This is an initiative of Representative Croke on behalf of a constituent and I am happy to answer any questions.

I certainly support the concept of the bill, but I was just wondering if the sponsor knows if there have been any issues of corporal punishment in public or private schools in the last few years, in Illinois?

Thank you for the question, Senator. I don't know of any recent cases, but I should have noted that most nonpublic schools, they have moved towards abolishing this practice. But, you know, unfortunately it still exists as a practice in other nonpublic schools.

Thank you, Mr. President. This bill amends the Child Care Act of 1969. The bill permits a child care facility, non-licensed service provider, day care center, group day care home, or a day care home to use a "third-party vendor" licensed by the Department of Financial and Professional Regulation for the required fingerprinting that is part of the application process for facility licensure and as a condition of employment. If a "third-party vendor" is used for fingerprinting, then the child care facility non-licensed service provider, day care center, group day care home or day care home shall pay the third party for that service directly. And this is a result of a little bit of a backlog that they were having in trying to get new child care providers into licensed day care facilities. And I asked for a Yes vote and I'm open to any questions.

Thank you, Mr. President. House Bill 4500, this bill aims at restoring the truth and accuracy on sentencing titles. As amended, House Bill 4500 amends the Criminal Code to change the offense name from the "use of possession{sic} (a weapon)" to the offense of "unlawful use of a weapon" and several similarly named criminal 14 STATE OF ILLINOIS 103rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 116th Legislative Day 5/22/2024 offenses names. It changes the name of the offense of "armed habitual criminal" to "unlawful possession of firearm by repeat felony offender". The bill does not change the definitions, penalties, or other elements of the offense. We did receive an amendment that was adopted in Committee, and this amendment is from a discussion with the Illinois State's Attorney. Which -- what it does, it -- it changes the office of title of "armed habitual criminal" to "persistent unlawful possession of a weapon". The amendment replaces the "persistent unlawful possession of a weapon" with "unlawful possession of a firearm by a repeat felony offender", throughout the bill. We do have the support from the Illinois State Rifle Association, Restore Justice, GPAC and Cabrini-Green Legal Aid. And neutral right now, we have the Illinois State Attorney and the Illinois Sheriffs Association, and we do not have any opposition. And I ask for an Aye vote.

Thank you. I appreciate the sponsor working with the State's Attorneys and the sheriffs and others. I would separate this from some of the other bills that we've recently debated, because this is more of an attempt to accurately reflect in the statute what the offense is. So, this is very different than what we saw yesterday, for example. So, I appreciate the work that the sponsor has done. This bill, as you said, the State Rifle Association is in support of this, and the State's Attorneys worked with the sponsor on the language for the change of "armed habitual criminals". Thank you, Mr. President. House Bill 4467 amends the licensing provisions of the Mobile Home Park Act. Currently, manufactured home parks require a license to operate and the license expires annually on April 30th. House Bill 4467 provides that operations of a park without a license will result in a fine of $50 for the first month and $100 per day starting in the second month of noncompliance. The bill raises the annual licensing fee from $250 plus seven per site to $300 plus a per site fee, starting at $15 in 2025 and increasing by $2 until 2030, where the per site fee will remain at $25. The license is nontransferable, so if the parks is sold, the new owner must apply for a new license within 10 days of taking ownership of the property. The Department of Public Health is required to conduct annual inspections of parks and if violations are documented and a reinspection is required, the Department may charge a $300 reinspection fee. First of all, Leader Castro and Murphy, thank you for bringing this important topic forward. This is something that happened in my District last year that really opened my eyes to what happens when you -- when the -- when one park is sold and a new owner comes in to take over, what could happen. In this case, an out-of-state landlord came in and what had been a very stable park of senior citizens, mostly, little trouble although there was some issues from time to time, but a very stable park, mainly of seniors, was turned upside down overnight. And, you know, raises -- rents were raised, in some cases without leases even being valid, notices were given of the increases in rent. The water literally stopped. Potable water or drinkable water stopped at one point to portions of the park and people had no water. It was a complete nightmare through spring, summer - last year, we had structure fire, mysterious structure fires. You talked to the Fire Chief the fires occurred under suspicious circumstances. Just not good. Not good at all. There has to be a process by which you can 19 STATE OF ILLINOIS 103rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 116th Legislative Day 5/22/2024 transfer ownerships of a park without disrupting and turning upside down frankly, the residents very lives that live in that park. I again, I've never seen anything like this, don't want to see it again. I hope this goes a long way towards emboldening the Department of Public Health to step in when they need to. I mean, you know, no running water, hundreds of homes without no running water, without running water. That's terrible grammar. I apologize to all of you English majors out there. But -- what the heck? These are seniors. You know, many had nowhere to go. Fixed incomes. You're assessing rent increases on leases that in some cases didn't even exist. This was crazy what happened? And needs to be addressed, so thank you Leader Castro, I would certainly encourage an Aye vote.

If we have bad mobile homeowners, we need to address that. But to simply beat the industry into neutral, this is again, another tax and fee increase on the industry, and we're taxed and feed enough in the State of 20 STATE OF ILLINOIS 103rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 116th Legislative Day 5/22/2024 Illinois. So, you can't have affordable housing and at the same time continue to raise taxes and fees on the same industry that you want affordable housing at. This is, again, an attack on an industry that is trying to provide an affordable product to people, and we need to lower taxes and fees in the State of Illinois. And this is, again, another tax and fee on an industry that we're all supposed to like, which is affordable housing. So, my view, I'm going to be voting No. Thank you.

There's not affordable housing anymore. When you charge and raise your rent to an exorbitant amount. When you don't provide protections for those that live in the community. And Senator Rose is absolutely right. Thank you, Mr. President. House Bill 4768, as amended, offers many basic protections for tenants against retaliation when they have to exercise their protected rights under law. I have the honor of serving parts of Suburban Cook, DuPage, and Kane Counties. I've had many constituents come to my office with many different types of complaints. When my team looks to see what county they're located in - if they live in Cook County we know that they have protections, but if they are located in DuPage or Kane County, they do not have these same protections available to them. This legislation will ensure that these protections are available to all tenants throughout the State of Illinois when they request repairs or code violations. Like many State offices, my staff receives and works with plenty of constituents who have faced some form of housing retaliation. These individuals are looking for quality, safe, and affordable housing and should not be barred from seeking remedies without fear of retaliation. I'd be happy to answer any questions.

You know, today, we've talked about affordable housing. 30 STATE OF ILLINOIS 103rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 116th Legislative Day 5/22/2024 Illinois needs affordable housing and it's been a struggle. We're coming off of COVID and many landlords had a very, very difficult time during COVID because they were not allowed to evict tenants for any reason except extreme reasons. And they had to bear the brunt of not being able to collect rents and the like. I feel -- I certainly understand where we don't want to have retaliation for complaining about a code enforcement or something. Those -- those landlords should not retaliate. But -- but what happens, in reality, is, and let me give you an example - I spoke with a landlord who has like over 200 units in a college town, and college students that you rent to sometimes aren't the most sophisticated caretakers of houses. They don't understand that you can't put a Swiffer down a toilet, or a baby wipe down a toilet, or a lot of grease down drains. And what happens is, is over and over the landlord has to make repairs and -- under this bill, a person just trying to provide affordable housing, as a landlord, could very likely find himself into court. Because someone has taken issue with them raising the rent of their unit because time and time again, they have to come and make the repair and they're in a very low profit business. In many instances of the smaller landlords, and that's the only way they can survive to provide that housing. So, I think this bill gives a -- a bad opportunity in some instances to put the landlords, at risk, of being able to provide that -- provide -- provide the affordable housing that we need and would like to see remain stable in Illinois. I -- I know this is a well- intentioned bill, but it can have major repercussions, and we've had… As I am the minority spokesman, and -- and in Judiciary, we've had numerous bills this Session, last Session, and this previous Session that are very harmful for landlords. I -- this landlord, 31 STATE OF ILLINOIS 103rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 116th Legislative Day 5/22/2024 I mentioned that has 200 units, two-thirds of those are for sale now in the City of Carbondale. This is what's happening, these small landlords cannot stay in business if we keep giving them bills that find them in court defending -- trying to keep their business going. So, with that, I'd urge a No vote. Thank you.

Yeah. So, this kind of goes into a, you know, kind of the same field when we're talking about affordable housing, because now we're talking about affordable renting. And so, in this particular bill, what's going to happen is -- is you have a tenant that complains, and the landlord immediately fixes the issue, and now it opens up this landlord to litigation. And the issue with that is, is who pays for this litigation? Ultimately it is paid for by the tenant. And so, this is why this Body has proposed rent controls. Because due to the hyperinflation that has happened nationally and in the State, the costs are exploding. So, now what we're going to do is we are going to regulate the industries that provide affordable accommodations for the people that we all represent. So, we went after the mobile home industry through taxes and fees that are ultimately going to be paid for by tenants. And now we're going to go after the landlords, the big bad landlords that are doing all these awful things. And again, if they are doing 32 STATE OF ILLINOIS 103rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 116th Legislative Day 5/22/2024 awful things, we want them to be penalized and we want them to be taken care of through the law. But that's not what this bill does. What this bill does is very, very simple. Somebody complains to their landlord, the landlord fixes it, now the landlord is open to litigation. It could be open to litigation because he or she does not renew the lease. It could be open to litigation because they raised their rent. And this is all the bully landlords in -- to not raising rents and just to shut up and sit down and say that they have an asset that they can't protect. And this is a backdoor way for the legislature to put more pressure on the landlords to not raise rents, to not move this bad tenant along if they are bad actors, because we make bad policies in the General Assembly that we're trying to mask. And so, ultimately, who pays for this are all the people that we represent that are of modest means, which is why it only got 62 votes in the House. It isn't because they're strange on progressive policies. It's because they know the people that we all represent are going to end up paying the bill. This is an awful bill for people that are of limited means because they will ultimately pay the price. Vote No. Terrible bill.

So, I -- I know sometimes things are -- are done with good intentions, but people maybe don't fully understand the -- the 33 STATE OF ILLINOIS 103rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 116th Legislative Day 5/22/2024 market reality and the consequences of what happens. I -- I'm not sure about all -- all of that, that was just said, but -- but here -- here's what I do know. I do know that we see significant concerns nationally, and we see significant concerns in the State of Illinois, on single family residences, I'll get to this in a second, on single family residence being bought up by a large private equity firms and by massive national landlords that own 5, 10, 15, 20,000 homes and that takes away opportunity for -- for people to acquire a home, that drives up the cost to buy homes. And what I've seen over the last 2 or 3 years in this Body, is we've ramped up pressure on landlords of -- of multifamily properties, as we've seen consolidation. I don't know if you've talked to the organizations that represent the landlords? I don't know if you've looked at the market studies that show the average number of units owned by landlords? But, what we've seen in Illinois, just recently, is a significant decrease in the number of landlords in the State and we've seen an increase in the number of average units owned by landlords in the State. And the reason why that is Senator, is because policies like this, for small landlords to sell their properties and only the really, really big landlords who aren't connected to the community, who aren't connected to their tenants, who are looking for that profit motive, maybe not some of the good-hearted motives a lot of our smaller landlords have owned more and more units. They drive up the cost of ownership. The connection between landlords and their tenants is -- is disconnected, and you create the problem that you think you're trying to resolve. I assure you, the small-town landlords in the 55th State Senate District do a much better job for their tenants than the big national firms. I assure you, the small town 34 STATE OF ILLINOIS 103rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 116th Legislative Day 5/22/2024 landlords, in your District, do a much better job for their tenants. The service is better, the rent is cheaper, and the relationship is stronger because that relationship has been there for years. Bills like this, break those relationships. Bills like this, hurt tenants. Bills like this, drive up costs for tenants. Bills like this, for small landlords to sell to the big guys who could care less about a lot of the stuff you're talking about. This is a bad bill that's going to hurt some of the most vulnerable families in our districts. It barely got out of the House because people on both sides of the aisle realized how bad this is for the tenants living in our Districts. I urge a No vote.

If an -- if a tenant has a problem, a sink that's backed up and they call the landlord and the landlord comes and fixes that, fixes that item. Does that trigger then based on this, that that tenant then can refuse to pay a -- a rent increase for the next year because that would be considered retaliation. And then the landlord would have to go to court and prove that that rent increase was not retaliation to that maintenance call?

I heard a lot about affordable housing as we were talking. When we were hearing my colleagues from the other side of the aisle. This bill doesn't have to do specifically with affordable housing. And if they have a hole in the ceiling, or if their toilet isn't flushing and they request time and again, time and again from management, actual story where a constituents have come to my office to say that they've been living like this under these conditions, flushing the toilet with water for -- for months on end until they're just desperate and despite the fact that they're fearing retaliation, they do go to the City. They let the City know the City does come in, and the City does tell them that they have to fix this issue, and immediately they are then either evicted or their lease is not renewed. That's what we're seeing the most of, is that leases are not being renewed. There are three, four or five people waiting in line for that same unit. So, this is just basic, common sense. Many of us in this General Assembly, ourselves, or our children have had to rent an apartment. This is a good bill. It's protecting hard working people of Illinois. I believe it should be a unanimous vote. So, I urge an Aye vote. Thank you, Mr. President.
