He's currently attending Western Illinois University, where he serves as President of the Western Democrats, and previously served as a two-time Attorney General in student government. Kevin is an active advocate for student voices on campus, and he's got a strong passion for public service, civic engagement, and creating opportunities for underserved communities. He hopes to pursue a 2 STATE OF ILLINOIS 104th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 103rd Legislative Day 5/14/2026 career in government and policy in the future. And I think Kevin exhibits the kind of passion and dedication that we need to foster here in Illinois if we wanna build a State and a future that we can be proud of. And I'm particularly excited to see students from Western Illinois University, a University that puts out a great product. And as many of my colleagues are aware, IARF advocates on behalf of community- based providers serving and supporting children and youth with intellectual developmental disabilities and serious mental illnesses around Illinois. Today, nearly 200 professional and paraprofessional staff from almost 40 IARF member agencies are in the South Hall of the Capitol to highlight the important work they do in communities across Illinois and advocate for investment in IDD and behavioral health services, including higher wages for direct support professionals. I encourage all of you to stop by and visit with the providers from your district. We also have advocates joining us in the gallery today. It primarily makes technical changes to the request of the Department of Insurance and Department of Healthcare and Family Services so that each Department can properly enforce the Act. And the notable -- changes include that changing physician to healthcare professional through the Act and defining healthcare professional accordingly. It shortens the length of time the healthcare professional has to submit a dispute relevant to the Department of 90 days instead of 180 days, ensuring that it has an automated -- automated process is used to identify claims and processing use specific coding guidelines in effect at the time of the service, removing provisions allowing the -- for batching of disputed claims, and adding that down coding does not include the practice of addressing instances where providers submit multiple codes for two or more services that must be included in one group, per federal and State requirements. This bill has been a long time in discussion. I will note something of 40 STATE OF ILLINOIS 104th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 103rd Legislative Day 5/14/2026 kind of interest and importance here, is that there is language in this bill which talks about trying to circumvent the AI processes that are used and so we call for a human person to be involved in trying to resolve these disputes. I mean, I think that's kind of a new threshold for, legislations, that we have to identify a human person to be involved between the AI systems. But this is a process by which, physicians and -- and insurers or MCOs, can use to resolve disputes in terms of -- of -- of issues where downcoding may or may not be in effect. Downcoding, quite -- quite frankly, is -- is just an unfair system. There was some discussion about also trying to limit upcoding, but upcoding is primarily illegal. So, happy to answer any questions, and -- appreciate support.

And this is designed to ensure that the wishes of the person who has died and wished to leave portions of or the entirety of their estate or a gift to a charitable organization, that their wishes are met and it gets there in a timely purpose. Provides that the definition of property includes any overpayment made by a person to a unit of government or government agency, including but not limited to a payment for any tax, license, or fee that was made in excess of the amount required. This bill also provides that these changes are a 49 STATE OF ILLINOIS 104th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 103rd Legislative Day 5/14/2026 restatement and clarification of existing law. Additionally, it exempts asset purchase agreements arising out of bankruptcy proceedings, corporate dissolution, or receivership, as well as an asset purchase agreement for a large business association. And -- oh, the Act requirement for finders, people who find unclaimed property, be licensed and their fees to be capped currently 10 percent of the amount recovered and collected. It requires asset purchasers to register with the Treasurer's Office and that is it. So, these are the annual update to the Revised Unclaimed Property Act. And so I -- I do wanna take a moment to compliment the Treasurer for his dedication and work to constantly improving the administration of unclaimed property. Just to -- to -- since Senator Tracy took a moment, I had a senior citizen walk into a senior fair, and he had been taken advantage of by a caregiver. He had literally had his bank account cleaned out, and he was going to lose his home to 51 STATE OF ILLINOIS 104th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 103rd Legislative Day 5/14/2026 a tax sale. He was, he -- he was destitute, and sat down at the I- CASH table and found $120,000 life insurance policy that his wife had taken out and he was unaware of. And I was given the privilege of handing him that check two weeks later, and again, he was in pretty bad shape. He was advanced in age, but there was this… And I -- and I told a group of students this. They said, "What was your best day in the General Assembly?" And I said, "That was my best day," because I knew that that gentleman, who's a nice guy, he -- he was gonna live in his home, and he was not gonna have to choose between food and medicine. And so this program works, and I -- I appreciate the Body's continued support of reasonable, changes to it to make sure that it continues to function efficiently. Thank you, and ask for an Aye vote.

So, this is a situation where intestate succession, grants ownership to a wide variety of people, and a one of the grantees or the recipients is holding the property, caring for the property, paying the tax on the property, and they have a way of using the courts to establish ownership of the property. The concern here obviously is in an era of -- of increasing costs and affordability issues throughout the State of Illinois, this legislation directly increases the costs of borrowing on folks who, are probably most -- are in most need of credit, folks that are -- are going to acquire consumer goods on credit. And we just think, raising fees on folks in general is not a great thing, but when you're raising fees on people that need credit the most, which is the -- the providers of that -- that are impacted by this legislation, when you're increasing fees on -- on people that need credit the most, especially in an environment of -- of affordability issues throughout the State, that's -- that's not a good thing. So, appreciate the sponsor's sincerity and -- and efforts, but we just think raising fees, like this, on people who can least afford it is a bad thing. And we do also believe in addition to the raising of the fees, that this does also implement a -- a new fee on -- on these folks, as well.
